One thing that went to my mind is, is this how open he is with declassified documents? Would he just share them with anyone who was in the office? Also, would he use them to throw one of his cabinet members under the bus about going to war with Iraq? It went through my mind that if YOU are someone who thought these questions, then you are stupid and suffer from confirmation bias because these tapes don't prove a thing. Trump didn't break the law or even do anything wrong. It's simply a witch hunt.

SCOTUS hasn't ruled on presidential self-pardons but if 45 tried it, it's certain he'd lose 9-0. I am someone who has held Top Secret clearance and have had to sit in a SCIF many times to read through the classified file at the embassy. Mr. Moss is exactly correct. There is no laughing matter. Sure, some highly classified information may to seem some like no big deal. But, information related to our national defense is in a category all to itself, and should be treated without the utmost, controlled care possible. That an ex-President, who has no right to retain such information/documents, would brandish it in front of anyone, especially those who have no clearance at all, is beyond belief. If anyone in the embassies where I have worked were caught doing anything remotely similiar they'd still be rotting in prison.

Not yet. We haven’t even gotten to the point where the trial judge is appointed. Neither Cannon nor Reinhart are trial judges; they can’t preside over anyone’s jury trial, regardless of who’s it is. A jury trial judge is one level above Cannon.

The charge under the espionage act is not dissemination of information, but "withholding material related to national security after request of restitution from the national archives", which asked Trump to no avail (and, per his own words, he didn't want to return the documents to the national archives). Since Pence, Biden, and all the others returned the documents, the charge of withholding doesn't apply to them. If Trump had returned them when asked for a year and a half, he would have been exactly in the same situation as the others you named. Sorry that your cult doesn't let you grasp simple English words, such as "withholding documents when asked to return them". I'm not even a native English speaker, but that's really not too hard. I mean, unless your brain is so blocked by lies that you can't see the difference between those situations. Should they find proof that Biden, Pence, Obama, and whoever else wilfully withheld documents of national security when asked to return them, I'm with you and they should be charged. But until now, the facts are that they returned the documents. Sorry, the law doesn't bend to your wishes, the phrasing in the charges is crystal clear

We just experienced something similar in the UK with Boris Johnson and "partygate", when a xmas party full of drinking and laughter was held at no 10 Downing Street during the lockdown. Maybe not as serious an offence but the main difference is that Boris Johnson was ejected as Prime Minister by his own party and has recently resigned as an MP. I held a TS security clearance when I was in the military. I was warned upon my discharge that I was still subject to prosecution if I wrote down or repeated any classified information I had access to while serving. I am totally disgusted by Trump's complete disregard for national security and sharing of classified documents with people who were not entitled to see them. Just my guess here: In order to search a property you need probable cause and for a former President (or a member of Congress, or a Supreme Court Justice, etc.) a judge would be extremely skeptical of DOJ's claims. They met their burden at MAGA-LAGA but not at the other properties.

I just find incredible, and incredibly scary, that even in America one man alone can put an entire democratic system in jeopardy like this. His own voice is on tape. An ordinary citizen would have been in jail, but for Trump we waste hours of debates. 🤯🤯🤯

I don't understand why people think he can run. The 14 Amendment, Section 3 disproves that. Here is Section 3: "No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. I think Trump will be held to account. I do believe we're going to see convictions in Georgia and DC when those charges are brought, this one is almost sure to end in another conviction, and NY has a good shot too. Sorry but I'm a contrarian on this recording. Dump is a conman, and he pulls con-man moves. He _may_ have been waving papers around, they _may_ have been enclosed in an actual classified-marked folder. But I'm at least half-way suspicious that none of those people could read the print, and that that the "highly sensitive", Milley-originated docs were just smoke and mirrors to make a grand impression. "Folks, I have an ace up my sleeve..." "Let's _see_ the ace."

​@@-danRI don't think Smith is relying on this recording as a major source of evidence. He probably interviewed everyone that was in the room at the time of the recording and he's gonna use their statements as the main evidence. The tape just adds authenticy to that.
