    In Indiana, u do not own the water, but the land under it, if it's navigable, public may float through, no foot traffic though, also, it must be listed as navigable on some non-existent website or library book the dnr don't even know where is!!! If it's a smaller creek/river, they just tell u it's non navigable, even though in my mind, it's clearly navigable because that's how u ended up there!!!!! Ignorant

    House Bill 1397 which would have defined or redefined navigable waterways in Georgia died in committee on 3/28/2024. The only way to get this to change is to go to the DNR board and legislatures and stay on them. At this time they are not representing their constituents.

    There’s a whole section on navigable waterways that covers flooding You can’t cross boundaries that goes beyond the natural flow and consider that navigable

    You can definitely fish as long as you’re floating through. And by law, you can wade and fish as long as you stay on the opposite side of the halfway point of the riverbed. If they own the land on both sides, then you can only float and fish

    Thought the only water you can own is a pond. If you have a huge property where a creek starts you can technically own that. But can't impede someone from floating up steam if that's possible.

    Georgia has always had some of the most idiotic laws when it comes to waterways. What it has always boiled down to is the legal definition of the word "navigable". The original definition essentially said if it could float a log it was navigable. It was later changed to essentially say being capable of barge traffic, which few GA rivers are. I've been fishing the upper Flint for over 40 years, and my family has for generations. There was never any issue anywhere on the river until some jackasses bought the land adjacent to Yellowjacket Shoals and sought to exploit the river for profit. Unfortunately, even though the DNR refuses to write tickets, the law is on the landowner's side and GA courts will side with them every time. PS - Those post-spawn fish love to chase and/or short strike, which can make for a frustrating day. The last time I fished it, I had around 40 topwater blowups and only caught 12.

    @@jamessmith-hq5mr Have you reviewed the new law that the governor signed? It still doesn't clear up what is "navigable" but it does clearly state that navigable rivers are to be used by the public as highways. The flint has centuries of history of using it for navigation.

    @@therivergiveth I've only skimmed through it. What you posted illustrates my point though, it says "navigable rivers" and the upper Flint is not legally considered navigable. It should be but at this point it isn't. The lawyer for Four Chimneys LLC, who owns the land in question, has already argued that point in court and won. As a lifelong river rat, I want full public access to all of our rivers, but the current law is not on our side.

    @jamessmith-hq5mr yea but that case was before the new law. I guess we will have to see but the public needs to come together to fight these ridiculous access laws. Even the upper flint has been used for hundreds of years for navigation. Taken from the state website: 24 "further finds that, by the common law, the citizens of this state have an inherent right to use for passage and for hunting and fishing all navigable streams from low-water mark to low-water mark." Again, it's all about what's considered navigable. We need to make a stand. Flowing rivers affect everyone - shouldn't be privatized.

    In Ohio you can fish the river if someone owns the land…..BUT… you have to be floating. The moment your feet touch the riverbed, you are trespassing.

    I live and fish lakes/rivers in Arkansas. My understanding of the law here, if you can navigate on the water to where you are you can fish or hunt. That includes flooded land. I have seen other videos of people fishing on lakes and the property owners telling them they cannot fish around their docks. Some property owners are just snotheaded ignorant karens. 👍😁

    What about the public trust doctrine? All wildlife in the US is held in trust by the state governments for public use. Seems strange that they can claim ownership of the fish in that section. I suppose it is akin to alloing people to traverse your property but not allowing them to hunt.

    In GA, the landowner owns the riverbed to the center. If the same person owns the land on both sides, they own the entire riverbed and can legally "post" it as long as the river is not considered to be a "navigable" waterway. The recently changed law being discussed in this video will almost certainly be overturned in court, because the Upper Flint is not considered to be "navigable" by GA or federal law. Federal law considers the Flint navigable as far north as the city of Montezuma in Macon County. The area shown in this video is well upstream from there.

    What does Georgia law actually say? Some states say the land owner owns the river bed in some cases. If you can navigate the river without touching the bottom, you're good. Georgia, not sure?

    My lake is surrounded by private property, there is zero public access points. The land under the lake is also privatly owned. But rivers & creeks in a kayak are fair game i.m.o. while we dont own the water, we own 100% of the land surrounding/under it therefore you had to tresspass to fish it in anyway....

    No offense but he'd have a fight on his hands to come out on me and grab my boat, and I intend to go home and not the morgue. I'm not afraid to let someone drown in the river. I had a DNR officer to get me to load up and float with him to arrest a security for a gated community and he told me if I felt that my life was in danger to use what force was needed to stop the threat. I just had to be really well aware of the consequences of screwing up.

    Welcome to the north east where the NIMBY attitude of everyone comes to the forefront. If you don't know what nimby stands for It means not in my backyard. I live in NJ and EVERY INCH of river or lake access that exists is owned by private parties or corporate entities. It's nigh impossible to find places to fish our rivers and lakes without being ridiculed or outright called police on us for daring to fish some water. While we do have some places available to us an outdoors mindset is not what NJ is about. We are more of a Karen state. I hope lawmakers realize we are losing so many places to just enjoy but I don't have high hopes.

    It’s absolutely gross when people can take natural resources as their own. I get ponds on private property but a river with water that flows continuously should belong to we the people. It doesn’t give anyone the right to litter or abuse it. If people or corporations can own rivers, our system is more broken than I realize. Sorry for the rant but fishing and outdoors are my life.

    Why would anyone care if you fishes the river in their backyard as long as you’re in a kayak and not standing on their land? Can someone please give me a reason they can think of that could be considered a legitimate concern? Not being a smart ass I genuinely can’t imagine why anyone would care

    Recreational fishing is a God given right that "people who call themselves the state" have converted into a privilege and charge fee/license/permission slips. This is wrong and more of us need to see it, also they are guilty of destrimination just look at prices of resident v nonresident ! These are the things i have learned since I started recreational fishing as a kid.

    They got to run a fence across the river well in my state but just changed and it was not for you guys. But every state the public vote for 90%of this started to vote how you want to live life. Don't really on others to run your life and family...
