All of this! I’ve seen Tayab Ali be interviewed elsewhere on KZread recently and have been very impressed with him; as well as heartened that there are people here in the UK taking proper and decisive action to stop and prevent the atrocities being committed by Israel, in the total absence of any substantial or even rhetorical action by our so-called political leaders. Sure, I guess we have the power to vote for different people to represent us in either 6 or nearly 12 months… but how many tens of thousands of Palestinians will be killed before then? And what even real alternative do we have, when the “opposition” is exactly as gung-ho about Israel’s actions as the government? In light of that absolute shambles, I’m even more grateful for the work of people like Tayab Ali.

The endless suffering of the Palestinians, the atrocities they have been subjected to by Israel ,over and over again ,with the impunity and complicity of the western leaders ,has changed my perception of the world we live in ,of our democracies .I 'm utterly disgusted and horrified .

I don't think Thinking Muslim realise how much relief this podcast has given me in terms of allowing me to be hopeful that justice and accountability is under way for Israel. Thank you so much for The Thinking Muslim for this critical and outstanding discussion and helping me to have hope in the international court of Justice. The only other thing I am worried about is the bombing, may Allah grant the Palestinians an immediate ceasefire.

You are right, thank you. Please don't forget that under the Ottoman Empire, the whole region was just one. Current borders between Syria, Lebanon, Israeli/Palestinian territory (occupation and land theft not taken into account!) were drawn by the Western powers who dominated the world before, and at the end of WW1. Who is "Palestinian" and who is not may be considered taking into account the history of the 20th century, or so I believe.

I largely agree with the analyzes of Dr. Tayab Ali but I would like to remind him that for more than seven decades international institutions have not been able to prevent the state of Israel from continuing its illegal occupation of the territories. and regularly continued to kill civilian Palestinians with total impunity. Not to mention, for example, the crimes committed by the USA during its various illegal actions. The only hope for a re-establishment of international laws and institutions can only come with the emergence of a country or a group of countries capable of putting an end to the impunity with which the USA and the EU have behaved since several decades. And I think we are now closer to achieving this goal. The existence of a hegemonic power is by nature incompatible with effective and impartial international law, because if impartiality is lacking it is only a mask for the exercise of dominant power, which we been observing for a long time now. law. Is a subject i have been trying to find information on for years. For a long time i have been pushing for British and Irish duel citizens who are serving in the IDF or have settled in occupied Palestine... To be CRIMINALLY prosecuted for crimes committed abroad. These people should have their British citizenship revoked or they should be made to stand trial on return to the UK.

Interesting topic. Also, this is the prime time for a legal case of this stature.

Great news, it is about time someone takes this right through, Israel, US, and UK are complicit in the plight of the Palestinian's tragedy for too long.

Mr. Ali, thank you! Two questions. First - I realize your organization (ICPJ) has sent official individual letters of intent to prosecute for complicity in the genocide in Gaza to political leaders in the Uk, US, Canada and I think, Germany. These official notices were sent in mid Nov, 2023. Thank you ❤. Could you please update - where are you at with these intentions now? When would you proceed with actual prosecution?. Second - SA has officially via ICJ accused Israel of Genocide in Gaza. ❤. However, we hear the head prosecutor of ICJ is warning and working with US/Israeli to warn and feed them information to protect/prevent them from prosecution. Obviously, tantamount to crime of complicity in and of itself! What can be done to prevent this from happening? Is there an international legal mechanism or group - such as ICJP - that could investigate the risk PRIOR to ICJ hearing? Or be ready to immediately respond if this?

There's a huge population of the world who are traumatized by what they're seeing in real time. There are masses of people who have gone from rallies in support of the palestinians in Israel, to protests against Israel and even the US president. I do hope that the officials who run the ICJ take into account that if they fail to use their powers to protect the palestinians in Israel, the possibility of a world wide revolution, like the american civil war -only on a global level, is very real.

Not that I believe an international lawyer is sufficient to be able enforce international law on its own founders. But I believe we need people from all walks of life with high ethical (especially Islamic) moral values to put up a front against oppression perpetrated by any entity to make them account for it. Or at the very least become influential voices to that effect. If I was younger, I would have studied international law, law fascinated me always and lawyers repulsed me because they can be extremely unethical and bend the law to their profit. But I think a highly ethically moral lawyer can be a force to be dealt with.

It is refreshing to know that there are groups as steadfast in the pursuit of Justice as there are groups in the undermining of truth and Justice. Surely, the believers will win through.

More states signatory to the Genocide convention need to activate the genocide convention and file proceedings to the International Court Of Justice. All states signatory to the convention have an obligation to prevent genocide and need to file proceedings to the icj in a timely fashion, as genocide is crime which the civilized world condemns

Outstanding discussion. The legal process of determining whether a genocide is truly committed seems extremely difficult and will certainly take a long time to argue. The events surrounding the Christmas Eve attack and the subsequent “apology” were particularly disgusting IMO. “Sorry we used more force than necessary?” This Israeli government has to be held accountable for the totally disproportionate response otherwise we are all living under a complete lie.

As a Muslim who knows the history of the Palestinian cause and the suffering throughout decades from colonialism to settler colonialism and the formation of the Zionist state simply to be the land of the Jews who were protected under the Islamic states through out history, I am for the prosecution of Israel and what they have done to the Palestinians along with every one who helped them. Otherwise, this will never ends Thank you for this enlightening program

Hamas prepared for an extensive period on how to attack Israel but, importantly Hamas also prepared well on how to expose Israel for they really are and especially the crimes they committed with impunity for over the last 75 years. Hamas knew when they attacked Israel, how Israel would respond that will trap them into committing step by step war crime mistakes including genocide. At least by now, you know South Africa lodged a genocide case with the ICJ.

So you are saying that Hamas set up a genocide for the purpose of framing and blaming Israel, using Palestinian women and children’s lives as material. The higher the death toll, the better, right? It was planned carefully for several years, being careful not to build shelter against bombing, lest the protection of children jeopardize the high death tolls. Invading, committing atrocities, and retreating with hostages into terrain densely packed with human shields would warrant a military response, as does the firing of rockets daily from that terrain - ensuring Israel’s participation in the scheme. The cooperation of the surrounding Arab world by refusing to shelter Palestinian civilians from Israeli efforts to track down Hamas has also a helpful factor, as has the cultivation of Gazan willingness to sacrifice themselves or their children to martyrdom has had a tremendous return on investment. Hamas and its leadership are to be commended for exposing how uncivilized the Israeli people are in contrast to the moral and civilized parties that made the whole plan a success.
