Second Survey - Surveyors are concreting the front of the house pin in and Chad does NOT like that at all.
He is pretty unhappy with the results. That entire side of his fence is going to have to be moved.

    I went through a similar situation years ago. My neighbor had a wood privacy fence installed, but it was 2 ft over onto my property. I showed him a copy of my survey when I bought the property before he moved in. I told him the fence had to be moved or taken down. He said he wasn't moving anything that's his property blah blah blah. Well, he went on vacation back up to New York in the summer. While he was gone, we took the fence down, piled everything up, and put it on his property. I talked to the local municipality they said it was legal to remove it as it was on my property, everything was documented by film. When he came back he was pissed he called the county sheriff, the County Commissioners. They were on my side. He had the fence put back up on his property line. We haven't spoken in 10 years and that's fine by me.

    As a surveyor for 30 yrs , this was all to common. I've seen fist fights, guns pulled the works. I loved that job!!

    Registered professional land surveyor here. I have also seen many angry citizens far angrier over far less than that much land/fence encroachment. I find this one mildly interesting.

    @@o9rgeronimo979 Nope. Not at all. In some states it might be minor destruction of private property but since it’s a common property corner: it’s half his too. So, maybe criminal mischief could be there.

    Lots of home improvements means lots of estimates. If Buddy doesn't like someone they don't get hired. He can pick the sketchy person out of a crowd in a heartbeat. The few new folks and kids in the neighborhood he hasn't liked all proved out to be creeps or major problems. He's a smart boy and a charmer so if someone ignores him that tells me a lot, too, even if Bud isn't suspicious. He's very protective of his friends and me. But if you need to battle the monster cat next door you're on your own. Only cat I've ever been scared to go near. Loafing on MY porch bench and as I walked past to leave she reached out and laid the side of my hand open and on down the length of my little finger.Blood everywhere. I pet cats others are afraid of. Not this beast. She showed up one day and decided she was home. The woman was the only one the cat wanted anything to do with. Hubby and daughter avoided her like the plague. Massive cat. Buddy was terrified of her while the other cat was rubbing all over him. Bud is a longhaired dachshund and the love of my life. I adore my dog!

    It’s hard for me to believe that your neighbor does not concede to his mistake and correct it. You seem like the type of guy that’s pretty easy-going and understand mistakes and would not have held it against him. Sometimes we all make mistakes because we’re human. But your neighbor chose to double down on stupid. It’s going to cost him and he has no one to blame but himself.

    I think the problem is the wife immediately, from the get-go, Karen'd up and got entitled, rude and nasty. Since that was the pace the wife set, the husband was locked into this course. Since shame and common sense doesn't seem to exist anymore, stupid gets the double down more than not these days.

    This happens more than you think. When I was young my parents had to do the same when a neighbor "took" 20ft over the line on a 2 acre property. Land you pay for and someone steals it.

    Same here sold up and moved to Spain in the mountains bought all the land around so no one near. But all the neighbors are really good people and we'll all help each other out. Typical got to move to the middle of nowhere to find good neighbors!

    @@Melanated4ever Also, any court that sees the overwhelming evidence. Will know exactly what to do and who to judge in favor of. But bless Your heart for being on the side of an abusive human. I would film to. Did you see the early videos when they had a constant alarm blasting at their neighbor? Pretty sure it had to be turned off because of sound ordances. They shout obscenities and are constantly rude. Even if Jack attempted to sue back, all they surmountable evidence shows exactly why filming was a good idea. And in legal terms, When you leave the privacy of your home, the first amendment give people every right to film you(as long as you are NOT on their property) recording from the street or your own property is completely legal and protected. Jack could try to find a lawyer but lawyers don't like to take cases they know they will lose. In this case Jack doesn't have a leg to stand on. Defamation is a catchall for the two civil torts of slander, or saying untrue things to harm ones reputation, and libel, or writing untrue things to harm ones reputation. The keywords in both being UNTRUE THINGS! I swear it never ceases to amaze me how the people who talk the most shit are the ones who know the least. So, we've established that A- its absolutely legal for him to film and publish the video and B- there has been no slander, or libel thusly no defamation of character and C- lastly the absolute genius you are for some reason defending knowingly and wilfully committed a crime on film.     Any decent civil attorney, or one who has expertise in zoning and land laws could easily handle this case. Yes, it will cost money as it would be billed by the hour and a retainer would likely be required. However, you can go after them for attorney fees in your civil complaint due to their vexatious behavior. Until these two are formally served with a complaint and forced to provide proof of the legality of their actions in a Court of law, they will continue to walk all over you. If that is your land and you have all the documentation to back it up, then you need to move on this. Consider also that any decent attorney is going to tell them they don't have a leg to stand on. Thus, I believe the odds of this going to trial are slim. Being nice and civil towards them has served you well, but enough is enough, get your land back! Finally, I sure as hell hope you put that marker back in and camped there until the cement was set! 🙂

    @@regdor8187 did u not watch the 3 part bodycam vids that was posted ,which actually was just this past January. In those vids the fence was not complete. So, it was not erected 7 yrs ago, thus he's in the right to have it removed.

    ​@@regdor8187It depends on the state. My neighbor complained that my fence was on his property, (it was not) but it didn't matter since the fence had been there for at least seven years before he built his house. That's how it works here, but some states don't have those provisions.

    @@tubedude54 I don't know the laws in that state, but in Arizona you have to pay the property tax on the land for five consecutive years before you can claim adverse possession. I'm sure the taxes are being paid by the rightful owner.

    After a certain time frame, unless addressed, they can claim that extra bit of land as their own. They were trying to be slick about it and failed. If this doesn't get resolved, the next homeowners will have a right royal mess to deal with.

    Digging out that pin may be the answer to the problem. It can be physically stressful on the heart at his age to go digging concrete out of the ground.

    Great video, really brings back memories of surveying when there was a property line dispute. People are so funny and simple-minded when it comes to land, and often much more threatening.

    TIP: Use fast setting concrete like you did there but use HOT water with it. It will set in five minutes or less. But you need to mix it, not just dump water on it. And bend the end of the pin up so it makes it almost impossible to remove by hand.

    It still takes hours to reach full strength in the middle and they used a smooth piece of metal bar, a jack would have removed it anyway.

    The tiny bit of concrete they added will make it look hard to remove, but it won’t prevent a bad neighbor from removing it. The best way to do it, (as a surveyor, not a homeowner) is to dig a three foot deep hole with a post hole digger, mix the concrete in the hole and set the rebar with a cap.

    @Chad Gurley or maybe he is just ignorant enough to think that the flag is the marker. Anyway the jack and Karen show clearly illustrates that Karen is mentally ill and off her meds. Might be time for a 2 week commitment to level her out again. That is a temporary solution because she will quit again.

    @@Melanated4ever Sure they can sue, but they won't win. As soon as they step outside of their home, into an area that is visible from public areas, recording them is 100% fair game, and that includes publishing the videos for profit. The case law is summed up fairly well as "There is no expectation of privacy in public." So if Karen and Chad sued, they'd be doubly in the wrong. Similarly if you were in public or any area plainly visible from public areas and I were to video and audio record you, there is nothing you can legally do to stop me. That activity is protected by the First Amendment. Your consent to being recorded or photographed is automatic by you being in public. If you don't want to be recorded in public you must create a shield of privacy. Some people do that using white sheets, though they like to have patches sewn onto those sheets. The thing is, in the US you can sue anyone for anything you want, whether the law is on your side or not. It's a popular Karen tactic, but many states have enacted anti-Karen legislation that makes the suing party legally responsible for damages in frivolous lawsuits. Knowledge is power, thinking you have knowledge and operating from that false perspective is dangerous.

    I think that instead of paying for more surveys, or paying for lawyers, I would just be putting up a fence. Chain link, barbed wire curled around the top, 8' tall if the law allows it. All around the property. If they want to put their fence back on their land, it will be inside your fence, safe and sound, until they pay you to take it out and toss it back over the fence. Good fences make good neighbors. Bad neighbors need tall fences.

    the funny thing is that they could have enjoyed the use of that property up until they decided to illegally fence it in. Their propery Looked bigger then it was without the fence and it will look even smaller when they have to move it . Heck, if they choose not to reinstall the fence I would go ahead and install one just because it makes their property look very small . Hell even if they do move their fence I would drop a solid 10' privacy fence right next to it ( after they finish their move)

    The area between the set iron pin and the same across the street is the right of way owned by the local municipality. In a neighborhood like this usally 50 ft wide, give or take. That is owned by said city, county, or other so that they can maintain the roadway and possibly utilities, if the utility easement is in front of the houses. If your prop cors are in asphalt that means the ROW is very narrow or that your property extends to the centerline of road, more common in smaller developed tracts.

    In my state, the property corner is usually about 12ft back from the curb to give space for utilities to run. Pointless to put a pin in the road.

    Time to have fencing companies come out to give you estimates at the real property line. And film the fun for court. At this point they have to know they have lost they just haven't gotten to acceptance. You, Sir, are a better human than I could be. I'm so glad I live in the middle of nowhere with my nearest neighbor being almost 2miles away. Part of why I left the city was bs like this. God speed!

    That bag of fast-setting concrete weighs exactly 50 pounds. It looked like only about 5 pounds of it was dumped into the very shallow hole surrounding the pin. Jack or Chad or whatever his name is will have no trouble pulling it out again, even after the concrete has hardened. The entire plug of concrete will lift right out, unless the pin is long enough and was driven deep enough to prevent that from happening. The security camera should be focused on that spot right away.

    Hey here's an idea. If you can have concrete fences, one can have those concrete crash barriers installed in a day when they go out of town or house for the day. Like to see them move it... Nothing stopping you. Just keep sending them the bill to pay for the surveyors, if the fail to pay you can take possession of their house. One can only do this so many times.

    Nice to see you taking a methodical approach to this but this requires a systematic approach to bring full closure 1) Updated survey with non-tamper pins - DONE- 2) Civil court filing (papers served) for violation of property lines 3) Seek to have the speaker noise stopped when you are on the land you own (per the survey) 4) Seek and obtain judgement to have fence removed by the guilty party by a specific date/time (part #1 of the setup) 5) When guilty party refuses to act, get the best quote to remove the fence + your time and effort 6). Schedule a bonded company to remove the illegal fence - notifying local law enforcement of a potential violent disturbance in advance (part #2 of the setup) 7) Place a lien against the violators home for the TOTAL cost of the fence removal (include your time) 8) Garnish wages/income and do as much as possible to wreck their credit rating. (part #3 of the setup) 9) Enjoy your preferred beverage of choice knowing you took care of matters permanently

Having the backing of a court judgement and possible LEO involved may keep people from losing it. This has been a protracted argument and things can go sideways .     My parents had a fence right on the property line for 25 years but when new neighbors moved in, they had it surveyed and the fence was 18" over the line. Instead of picking a fight, they offered them an extra 6" if they would take all the rotten fire wood piled up along the fence and everyone walked away happy. Some things aren't worth the trouble, especially if you're in the wrong.

    @@JeffDeWitt Well the fence is cemented in and I speculate that Redzot will make the neighbors pay to have the holes filled in to repair his property back to it's original condition when they have to pay to pull up the fence and move it. IDK how it is where he is at but in my State, all fences have to be at least a foot off the property line.

    The fence belongs to Z. The cost of removing it is less than the scrap price of the metal. Z might have a slight profit to offset other more expensive impacts.

    @@bamaman6297 I think they said the fence itself is property ("asset") of the neighbor's that put it on the wrong side. Technically it can't be removed now or damaged, until the neighbor does it themselves. Otherwise you're liable for damaging their "asset". Its crazy, but similar to if a thief trespasses onto your property and injures themselves, say on a broken post in the grass or loose shingles cause them to fall off your roof ... They can sue yOu for wrongful injury. Especially important regarding swimming pools. You must have your pool behind a locked unclimbable fence, otherwise you're responsible if someone trespasses and drowns in your pool.

    It doesn’t matter what it is. It has to be done or he is going to have another problem when either his house or their house sales. He pays now. He receives a judgment for them to pay him his cost Mandy maybe more. If they pay him great if they don’t he files a lean on their home and when they die or sale he gets his money he can file foreclosure on them and force them to sale or takes their home.

    @AJ XOXO no he could not have done this cheaper. 1. he has to hire a surveyor to establish his property and that could cost anywhere from 700 to 2500 (depending on area and how much work they have to put in to determine your boundary) 2. then he has to hire a lawyer to take dumb and dumber to court. property cases are not cheap nor are they quick. 3. the upside for the property owner is having the dummy on video removing survey markers etc....which is breaking the law and the penalties depending on his area can be a very expensive lesson for his neighbors to learn along with any juudgment he wins from dumb and dumber

    I ran across this video and had to watch it . We actually just went through a property dispute. Our Neighbors here in NW Iowa tried taking over our Driveway because their house doesn't have one . Long Story but we bought our house off a realtor site from another State we moved in to the home this coming September 2 years ago . We had our property serveyed the Neighbors next to our Driveway got permission to use our driveway by previous owner only until the House sold so we the lucky ones bought the House . Kept telling the neighbors to stat off our driveway he kept saying he owns half .As it goes ok we need the proof the sale of the property something says you own half our Driveway . They had nothing . They would park up to 5 vehicles illegally on our driveway. We fought with them called the police they said it was a civil matter posted no trespassing sign Everything . They get drunk and be out on our driveway sometimes till 3 am leaving long nasty messages on our security camera about the driveway and us of course. Went on forever. They finally hired an Attorney local this town we moved to has like 900 people . Because we went and got a privacy fence permit to put up on our own property to keep them off . It was all legal had survey only had to be put up 6 inches from property line . Them hiring the attorney halted the fence . But we ended up getting the last laugh. We went and met with their attorney and made an agreement to an easement so they could pull up to the side door of their house but they could have made a driveway through their backyard and were refusing to do it . The measurements they put down for use to sign were way off and wrong . They actually BLOCKED THEMSELVES off our Driveway their attorney Didn't catch it until it was all sign ect. Called us yesterday to ask if we resign a parking agreement and my Husband told the Lawyer Hell No we signed what they wanted lol So they spent $3,000 on this attorney to block themselves off our property was an easy fix for us lol and cost us nothing in the long run complete idiots

    A 3 or 4 foot piece of rebar driven flush with the soil would solve that problem pretty much permanently. Maybe the latest pin is long enough to prevent easy removal?

    My feelings also. Only I envision one inch bridge rebar four foot long driven in. I would like to see Jack or his fencers pull that out.

    Only the pin the surveyor set and noted in his field book is a legal property corner. Yes, I have over 30 years experience as a land surveyor.

    You can tell that bush towards the bottom of the yard was probably planted to show the actual property line. It matches up perfectly with the survey stakes.

    yup.. up where i am in a rural area, if you look at the Tan oaks, they mark the plot lines everywhere around here... the Tan oaks and Douglas Firs...... they planted them in a redwood forest... makes it easy to spot em

    You definitely are going to have to stop being passive with them. Letting them get away with what they're doing because once those markers are in you can take that fence either down or put up a new one.

    @@AyaBlue22 No he can legally remove that fence. He thinks a lawyer that no one can afford is going to fix the issue. He already got screwed by previous lawyer. So yes he's being passive and that just leads to spending more on a lawyer.

    Something like this happened in Delaware in the early 2000’s. The only difference was it was an 8 foot privacy fence, but it was about the same distance off the property line. And the guy representing you painted jack’s side of the fence multiple hi-vis colors like orange, green, pink and yellow. It got caught up in the courts for years until the guy playing jack finally moved.

    what's the set time for rapid dry concrete? he may be back to pull the actual stake and not just the flag. they should have pounded 4ft of rebar in then concrete it. although pulling on it may have given him a stroke

    That fence is YOURS. Paint it bright red, or lime green, or even sky-blue pink. Your neighbor can't do Jack about it, since it's not on his property, and it has the proper amount of setback from the property line. ;)

    I had a feeling that shrub in Chad & Joann's back yard had been planted on the property line, years ago by the size of it, either by them or the previous owners. I see that it lines right up.

    Too many “neighbors” do just that. I know from experience … they want to “lose” other use of their land as little as possible, so they plant on or very near to the very edges of the property lines.

    I worked as a surveyor in the Province of Ontario and we have a Survey Act that makes it punishable to remove a property marker you could be fined up to $ 15000 and or go to jail for 5 years. That usually deters people from removing the property bars.

    Does Jack understand that, that is a legal boundary and can be enforced by the law? IE, he can be served papers and everyday the fence stays in place, a fine will start to acrew? And if he waits for to long, they will come after his house and other assets?

    Are these legalky recignized surveyors from the city or county replacing the property mark spikes? If so, this is legally recognized property line. So how can he pull out stake marker flag on camera & not get in trouble for interfering with their job?

    It was just a disposable flag that he pulled out. The iron rod is in the ground encased in concrete . He cannot pull it out with his hand like he can the flag.

    old trick I learned surveying was to put in a pin and paint it, flag it and make it stand out like a sore thumb. Then drive the real pin in flush to the ground or lower and cover it up. Vandals go for the bait but the actual point goes unnoticed.

    I went through basically the same thing with my next door neighbors and their fence . She hired some fly by night unlicensed guy to build her fence. I came home to find them digging holes in my driveway, I just told them they were on my property, went in my house called a surveyor and an attorney. In the end they had to pay to move the fence, dig up the concrete, regrade the area, and repair my driveway! The cost of the survey was about $350, I don’t know what it cost them to redo everything, but I’ll guarantee it wasn’t $350. Before you put in a fence have the area surveyed, it’s worth it!

    I drove in a piece of half inch debar 50" down with a similar situation. Later I had to dig 16" down parallel to shorten it at grade. That was 29 years ago, and it's still there!

    My father thought he made the surveyor’s stake permanent by using a metal pipe held in place with a coffee can’s worth of concrete. With the aid of her flashlight the Karen next door dug it out that night. My father next used a 6 ft metal pipe held with a wheel barrow of concrete. He said “let her try to dig that out.”

    I hope they drove that pin in 2 or 3 feet into the ground before they concreted it! Did you put that flag marker back in? Lets see if they dig that one out.

    I wanted to put up a fence to keep my dogs in. I called a surveyor, paid $475 back in 1985, and my neighbors had a fit. They thought I should just listen to them about where the boundary lines were. Why? Get the experts. The corner pins had all been removed so we had those put back. The neighbor came out every night and yanked them up. Cops were no help. Small town = cops were their drinking buddys. We bought a fence and had it installed with the installers wearing side arms. The house had sat empty for years several times and I think the street thought it was their property. They used he big double drive to park their cars in and had dug a bonfire pit in the back yard. I hated living there.
