Bribes and assassinations and coups are NOT within the scope of ANY president's duties (official acts) so there's NO WAY that a president can expect to avail himself of presidential immunity after undertaking said conduct. In facts these examples are activities which would not only see the president indicted but any other official who would prove to be a necessary accomplice in the commission of such acts such that they would refuse any presidential order to so act, an order that would be illegal on the face of it anyways. Chief Justice Roberts stated in his ruling that the president is NOT above the law. In fact the president takes an oath to preserve, protect and defend the constitution and within the constitution is the ability of governments to make law. That said ANY law breaking by a president will be a violation of his oath and hence NOT an official act by said definition. IOWs the concerns expressed in Justice Sotomayor's are fantastically moot in that they'd never happen outside of a John Grisham novel.

Wait.. So for the sake of national security, Trump and all MAGA's are jailed by Biden. Meanwhile Trump and the MAGA's have to sit in jail while motions for pretrial release or to dismiss are filed which could take 90-120 days until the court agrees to hear the case. Maybe. It covers them for "official acts" in performance of their duties. That doesn't include everything. I don't believe you could prosecute a sitting President though. Then it's up to Congress to Impeach & remove him first.

Judicial immunity does not grant them criminal immunity. It just basically means that they can't be sued for their rulings. Any criminal action, including judicial misconduct, is not included in the immunity. The president already had that immunity. The president also can't be sued for his official acts. Now he also can't be prosecuted if he did something illegal. That makes him above the law.

I thought the argument by Chief Justice Roberts was accurate and well said regarding how this issue ended up before the Court. I particularly liked Justice Thomas' opinion when he put Jack Smith on notice. Have Obama, Clinton, and Bush called President Trump yet to thank him for taking one for the team?

The SCOTUS cited in closing arguments of the presidential immunities case that Jack Smith was illegally appointed for prosecution of a political opponent. According to the constitution the General Attorney must use the "offices of law" to create a special council. Merrick Garland didn't do exactly that, he did NOT go through the legislature to create that special council. Instead he appointed a private citizen himself, which is illegal under the constitution according to article 2 section 2 clause 2. This just keeps getting better by the minute.

Why is this being seen as some new thing? Back when I was in high school you had to take American Civics to graduate and we were taught that Presidents can not be tried for official actions.

The Seal Team 6 hypothetical was from Judge Pan. Trump's lawyer Sauer essentially said, "maybe." It wasn't Sotomayor's invention. Did Gutfeld forget? Will anyone correct him? No? Okay.

This decision is pretty much what I was taught in school was assumed to be presidential immunity but had never been tested in trial. Now it’s been tested and found to be along that line.

Certainly questionable, but reasonable to allow the government to function. What Trump v. United States introduces is the idea that the immunity for “official acts” is unconditionally absolute.

Sotomayor is pathetic. Her ruling on this case, on the Chevron case too was just awful. She is the furthest thing from a "wise latina". She is classic DEI hire, in over dead, picked for the Court so Democrats could claim we're the party of diversity. There were thousands more lawyers more qualified to serve on the court than Sotomayor. She was also was put on the court to rubber stamp Democratic policy positions on all legal issues, some of which violate the US Constitution (DEI hiring violates civil rights laws, so does affirmative action in govt. hiring, and so does race based admission to colleges. Sotomayor is FOR all these things. She does not even believe in civil rights!

Because using the military would invoke the military justice system, and the military which is recognized as, by necessity, having the ability to circumvent constitutional liberties when deemed necessary. so, civil law holds the president as immune, military law might not hold the commander in chief immune, should one be foolish enough to attempt using military personnel to wage a private war on political or personal adversaries. Also, military personnel are not required to follow and illegal order, I think most of the fellas in the SEALs know assassinating the presidents political opponents would be illegal.
