    He's probably been on this case since last year already. Look at the Logan Paul scam with the eggs. He was already investigating over a year prior to exposing Logan. It's just a matter of time now. Legal eagle and so many other KZread lawyers will probably get in on this too

    I got a copyright claim on a snippet of royalty-free music that I had purchased. I disputed it, stating that is was fair-use due to being royalty-free, and the copyright claim was removed. I think these phony companies get away with this mostly because creators are nervous about disputing them, but if the creator is definitely and unequivocajly in the right, they should always dispute the claim.

    It's risky. If the lawsuits goes ass up, a random judge could set a legal precedent that ends the current understanding of fair use. If it's appealed to the supreme court it could end fair use until congress changes the laws. A lot of younger people don't understand how modern our understanding of fair use is. 15 years ago if you said I should be able to make money from uploading a video of me reacting to somebody else's content most people would think you were high.

    I got a copyright claim years ago. Weird part was I created the song. I disputed it. I don't remember the name but I did some research and they seemed to make money off bogus copyright claims. So they are banking on people being too afraid to dispute it.

    I think what scares a lot of people is that they have to give out their REAL address when defending against bogus copyright claims... pretty much doxxing themselves. Not on this account, but on a new account I plan on uploading my own music by the end of this year. I'm looking into P.O Boxes so I don't have to give out my real address (I've heard about virtual P.O Boxes that directs your mail to a physical address in another state or country and they then redirect the mail to your real address. However, I have no clue if that is allowed when defending against bogus copyright claims. Currently looking into that).

    To shed some light on the relationship of copyright claims vs strikes discussed at 6:00 -- A copyright claim where the creator takes no action indeed does not equal a strike. On the screenshot shown, however, you can see "Dispute rejected" meaning the creator attempted to dispute the claim and was shut down. At this point, the creator's next option is to Appeal the rejection, and if that appeal is also rejected, at that point, they receive a strike. So copyright claims can become strikes if the creator attempts to dispute it, is rejected, appeals the rejection, and the appeal fails. I recently went through this when a band sampled the PS1 startup sound in a song, and then suddenly all my PS1 let's plays were getting copyright claimed and my disputes were rejected. I decided to Appeal, writing an essay about how that sound was created before this band existed, and even if anyone is going to claim their copyright on it, it should be Sony. Thankfully, the appeal was successful and I haven't had an issue since.

    @@TheDaniel746 As Kira said multiple times in this video, it's not a problem of KZread or a problem KZread can fix. It's how the legal system is setup as easily abusable and not transparent is what the problem is. KZread is under no obligation to deal with that for anyone. Theoretically someone who's making honest fair use of copyrighted material should have no problem getting their shit reinstated, but to get to that fair assessment they'd have to go beyond KZread to the courts. And that costs money, time and energy almost no one has. So companies/people bank on that and just file all the claims they can.

    @@mushyroom9569 It's a of a mix of both. In order to retain legal immunity under safe harbor provisions, youtube has to do certain things regarding copyright claims. That they make these claims all but impossible to fight, don't have humans reviewing things and require such a lopsided amount of doxing is on youtube. But the legal system is very much part of the problem. They have to show that they are taking action to remove what appear to be bad actors from the system, else they open themselves up to a shittone of legal liability.

    I know right? They are sending their money to someone. Why not require them to register with YT with a business license number. After the Panama Papers most countries require the full list of anyone who receives money from a LLC so this could be easily identified as a legit copyright holder.

    Who is "we"? I don't watch his stuff. I never did, and I will continue not doing it. I imagine you don't watch him either. Hell, I reckon most people in Kira's community doesn't watch him. There is basically no intersection of communities here. KaiCenai, IShowSpeed, Adin Ross, BruceDropEmOff... These people have a very separate community from the rest of streamers. It is very insular, and they are going to continue to watch their stuff regardless of all this, they don't care.

    @@naosou921 I suspect that the streamers/KZreadrs that the OP was referring to are ones that overlap communities... there were big gamers like xQc & that crowd that played with iShowSpeed at the time of the crypto BS and were giving him the 'free pass'. It would matter to _their_ viewers to hear those big streamers calling him out for this crap instead of waving it away with a "oh he's only young" excuse... and there are plenty of fans who have a foot in both communities.

    The biggest gripe with this whole copyright thing is that anyone and their grandmom can file a copyright claim. How is it that unverified nobodys can just do that? It's insane. Also at some point mentioning speeds age is getting old, don't you think? He's been a content creator for years and should be much smarter about this stuff by now. He has no excuse if he keeps continuing doing the same mistake over and over again. Plus he has a whole crew behind him now that's supposed to educate and prevent him from going completely apeshit.

    My original YT channel was copyright claimed by a company that existed solely to claim-attack videos. I had lost access to it due to a glitch when Google took over YT, and it took years to get back into my account. Imagine my surprise to find that my video had not only been claimed by a company that didn't own the music used, but they had MONETISED my video and been making money off of it the whole time I was gone. When reading the terms of disputing the claim, I discovered that all they had to do was reply with "Nuh uh, it's mine." to get my whole channel shut down. Lie or not. I walked away from making anything on YT. What was the point? Anyone could just take what I made, so why bother?

    Perhaps one step closer to the solution would be that the entity that have their video claimed gets more information on the claimant, so it will at least be a level playing field. If I get to get for example Kira's full personal info, it would only be fair if he got mine. Why should I get to claim his videos virtually anynomous, but he can't counterclaim anynomously?

    In terms of the counter claim being anonymous that can't legally be the case. But I agree you should get the initial claimaints info. You technically do, since the company is the claimant and if its registered you can look it up... the issue is abusers can make a fake company name.

    Instead of KZread letting them claim the entire video and them getting the entire revenue for that video. What KZread should do is tell them they are getting the percentage of said video where their stuff was supposedly used, especially if KZread can tell what percentage of the “copyrighted” content was used. That itself would probably deter most people from going nuts with copyright claims because they won’t get the entire ad revenue for that video itself.

    we had something similar happening in internet Germany less than a year ago. A streamer copyright striked "exposed" type videos and their reactions where he got critizied, immediately sending ripples through the whole community as he effectively opened pandoras box, something the reaction scene has considered an unwritten rule never to do. This system gives people power to silence critizism about them because nobody wants to lose their channel. 3 strikes and you're out

    YT is not supposed to interfere. If they interfere with a DMCA claim, they can get sued. It's how the DMCA law works. When you filed a counter claim, you're basically asking the person who claimed your video to give up. It's their choice to ignore it. If you want to contest, you have to take them to court. Yes, it is ridiculous, but it's not really YT's fault, it's the broken copyright laws.

    Kira: the watermark they add when they steal your video is most likely one of many tactics to confuse the automated content ID system. Adding watermarks, background music, and zooming in randomly (see "cops" on KZread) is just a way to confuse the automated copy id system.

    This stuff has to be poorly enforced because I've seen at least a dozen channels that upload Joe Rogan podcast clips unedited and get millions of views. Spotify exclusive stuff. The only sanctioned youtube clips are on his official channel. How does a huge company like Spotify not crush them like bugs?

    The aspect I don't understand is why are the copyright claimers given so much power when it's two entities that both are claiming the content, so why does one entity get an unfair advantage? One entity says "that's my content" and KZread is required to assume credibility of the claim. Why then can't the other entity also say "that's my content" and be given equal credibility by KZread?

    The one video i have ever made for YT got claimed as soon as i uploaded it for using copyright free music. As i had nothing to loose i decided to fight it and responded. This gave the claimant 30 days to respond to which of course they didnt and it was dropped. I truely believe it was a fake company just claiming to make the 30 days of revenue and as it didnt make any money it wasnt worth their time. Put me off creating any more videos after that.

    Something that bugs me about KZread's copyright system. I once got a strike and the strike mentioned exactly which videos need to be taken down but what was left out was what aspect of the videos were the cause of needing to strike. I had to watch videos of KZreadrs who had the same situation as me to get an idea of why this was happening. I took the videos down but I will still never understand why the company could have claimed/blocked the videos and sent me a message to take them down for whatever reason.

    I get being in KZread’s shoes, and the liability parameters they must work with, but this is downright insane. I’m a Mangaka and the thought of someone getting my royalties for original work… nope. That’s not just immoral, but a precedent that will eventually result in someone or people going down in flames.     8:35 there's a huge issue with corporate copyright trolls whose large chunk of income is false claims, and since most people don't bother to verify if it is indeed the company which owns said content they run rampant. There's also another scummy practice but it's at least not illegal so I aint gonna talk about it

    I posted of a video of a small indie game on youtube that was copyright claimed for music. The music they were claiming was a classical piece, which by it's age might be public domain, but by performance may not be. Luckily the game provided credits for who the piece was performed by, I could verify it was a public domain performance, so I went all in on "fight me bro". The initial appeal for a copyright claim is sent directly to the people that placed the copyright claim against you - not sure how many people know this. The company rejected my appeal since they felt they confidently owned the piece. This is where it gets spicy. You do have the option to escalate the claim, however, in doing so you have to agree to terms that you understand you will be open to legal action for the validity of your appeal. You need to provide your actual real information (name, address, etc). This information is given to the company that copyright claimed me, though I never received any information about the company besides their name. It is a very scary thing to click through that process. Everything about the process is framed to dissuade you from escalating your appeal. I rode the "fuck it" train all the way to the last station, and the other side backed out (at the last minute of course cuz fuck me and the horse I rode in on). So I prevailed. But I mean goddam. It's not easy. It's not fun.

    QUESTIONS: 1) Are you allowed to supply them with a P.O Box and NOT your home address? 2) Are you allowed to supply them with an address from a mail forwarding system (they are kind of / sort of like a P.O Box, but it's a normal physical address and they receive your mail and they then redirect your mail to your real address. I used one company like that years ago when ordering stuff online which was based in Germany and they redirected my stuff to North America).

    I had a copyright claim on a video due to some music. The one I used and their claim were both based on a song from Zelda but were completely different songs. I disputed the claim and got no reply for 28 days until the claim was removed by default. Thankfully I'm not monetized but that video wouldn't have made a penny because this company decided to go with the false claim.

    So if a fake company decides to claim a video and it's disputed and after 28 - 30 days they decide to not reply (which removes the claim) even if the video hit (for example) 10 million views and the creator is monetized, they do NOT make any money off the video's first 30 days because of the fake copyright claim which I guess eliminated all potential revenue for that period?

    The thing that sucks is at this point there's really nothing that can be done that would matter specifically to ISS. He's rich, and even if he managed to get himself cancelled, he's set for life. But hopefully something can be done with YT so that in the future people are protected from someone like this.

    They legally can't. Blame the DMCA, it says content that is claimed must be taken down immediately to prevent any further harm to the owner (it assumes anyone claiming is in the right). If they demanded proof they would be liable for any lost revenue in the time between the claim and takedown. Also there is legal precedent that says once you own something you are under no obligation to prove ownership unless challenged by legal authorities, or else you would constantly have to defend your ownership. If you buy something at Walmart you legally don't have to show your receipt to the door person on the way out. It's out of their hands unless they want to be liable for damages on every stolen video. If you want it changed, you have to change how DMCA works.

    @@Toastybees At the very least, KZread should get three forms of good contact information from a would-be claimant before the claimant can actually make a claim. It's not about proof, it's about ensuring KZread doesn't get sued for allowing false claims on their platform- y'know like BUNGIE DID! Because KZread is currently a safe harbor for criminal activity. The very least they could do that doesn't step on the toes of copyright owners is require three forms of contact for distribution when a claim is disputed. When a dispute comes through, KZread should hand all contact info from BOTH sides to each other and dust their hands of it. Only requiring contact info from one party is biased and has resulted in the dumpster fire we've been seeing for the past ten or so years.

    I had a live stream on my channel one time it got copyright claimed. It was a song in the background of one of the people in the call. You had to turn it all the way up to hear anything at all. I figured no one is going to watch a 8 hour live stream from a 100 ish sub channel so I just deleted it. On my crafting channel I was doing a audiobook/crafting stream and only used public domain audio books and someone was claming them so I responded something like “i wish there was a way to report people to KZread for constantly falsely claiming videos and them loose the right to make claims after 3 false claims.” like magic they dropped the claim. Each and every time. So incredibly annoying.

    I saw this last night. The sad part, according to law, "Fair Use" is not a guarantee that you can use anyone else's content. It is a defense/justification. There are the "Fair Use Test" or tenets that courts consider but arguments have been made that by making money (ad revenue) the content is no longer considered Fair Use because you are making a profit. So then Transformative has to be considered. The law is so patched together that even copyright attornies have difficulty and it can all rely on the judge you get. You can also be overly aggressive in enforcing your copyright, but you have to decide if is it worth the backlash. I keep bringing up an "artist" who takes photos offline, deletes the comments, and prints on canvas to sell for 100K. He has won almost every copyright case from professional models, photographers, and unfortunately, the everyday person cannot bring it to court due to costs.

    there are factors that do have to be made clear such as was its Transformative? IE does it do enough to be considered a new work? with photography a lot has to be taken into consideration such as the framing of the photo, the level of exposure, and so on. its really a mess.

In my example above, the "artist" just downloads the image, deletes comments, and puts a phrase or comment as if he was the original poster, then proceeds to print it on canvas. Sometimes this has actually damaged the original person, such as a woman who posted the picture, he put in a smexy comment and it caused issues because she is not that "outgoing." He even took from a professional modeling agency. It typically boils down to who can spend more in court, and Speed here can definitely outspend all the people he claims.

    ESO recently made a video talking about this. Apparently there's a bunch of companies with 1-3 employees sending these fake DMCA claims and stealing ad revenue and no one is doing anything to stop them. It is insane.

    I honestly don't understand why people defend this behavior. These clip channels aren't "making original content," and what they do make does NOT fall under fair use. They literally clip streams from Twitch, *maybe* put an intro or outro banner in there, and post it wholesale. That's theft. It's just theft, there's no way around it. And the fact that Charlie and whoever don't care enough to go after them doesn't mean that it's okay to do, that's an absolute braindead argument. Kira literally just showed everyone here how much of a systemic problem clip channels are, and there are still people defending them in the comments... I can't even 🤦🏼‍♂️

    the easiest way to stop these claims is to put a $100 fee to do it, the winner of the claim takes the $100 so if a company is sending out thousands of claims hoping just to grab the money from the easy fruit, then they would have to put the money up to start each claim and if your claim is genuine then you would be willing to pay the $100

    They need to use the Jim Sterling solution. The way KZread's copyright system works is that when two or more competing claims are on a video, no claiment gets any of that ad revenue. So, you do what Jim Sterling did. You intentionally plant content from letigious companies in your videos (Nintendo and Konami for example), when talking about people or topics you know will get claimed and no one will get the revenue. If you can manage a sponsor on the video even better, but at a minimum you'll deny the trolls. I still think KZreadrs should set up separate companies they own, then claim thier own videos as soon as they post them - which you would of course never contest. Because it's you. The ad revenue would also go to you - via the company you own. And on the off chance it is claimed elsewhere, the claims would compete and block others from taking it.

    The solution is, take them to court. If legal costs are too high (which might very well be the case) don't do it as a single youtuber, but as a group, I'm not a lawyer neither from the US, but if enough people were afffected a Class Action might be a way to keep the costs lower. Waiting (and hoping) for KZread to do something is just... waiting for Godot, it would take too much work for little to no gain.

    People seem to forget that copyright law is basically written by the film (disney) and music industry. Even if KZread wanted to lean more into defending the accused, armies of corporate lawyers would suit up and start doing so much paperwork it'll damage the Amazon rainforest

    Regarding copyright claims 6:30 : It would be interesting if somebody made a monetized video which is a compilation of clips of various other content creators. Now what would happen if each of those, let's say 50 or 100 shown content creators, would file a copyright claim. Who would get the revenue. Is it split, first come - first served, nobody? Always interesting to look at fringe cases in half-assed rulesets.

    Hoo boy, this brings back memories. A decade or so ago, around 2013-2014, I remember a similar situation with all of the "Mystery Science Theater 3000" videos being copyright claimed by a 3rd party company. The weird part was that in the end it turned out the original owners weren't involved at all. MST3k was a 90's show that was on Comedy Central and the SyFy channel. Basically, you would have three guys watching bad movies and making fun of them. It wasn't uncommon for some of the episodes to regularly be taken down due to copyright strikes due to some of the weird legal issues (some of the movies they watched that were regularly removed were classic rubber suit "Godzilla versus a monster" like Godzilla versus Megalon). But the weird part was that it wasn't just those specific episodes being removed, it was nearly all of them. The company that owned the rights to MST3k (Best Brains, Inc.) wasn't behind the removals either. After a little digging it turned out that the company responsible for the copyright strikes wasn't connected to Best Brains, Inc. at all. This company's entire business model basically boiled down to them going around and copyright striking videos for content they thought violated the copyright rules, and then going to the original owner of that content to show them how much of their stuff was being "stolen" by other channels. This 3rd party company would then try to get a deal with the original creator where the content creator would pay the company every month to have them go around and remove videos so the content creator wouldn't have to worry about it. So channels were having videos claimed by a company that didn't even have a copyright claim to the very content they were claiming.

    I remember something like this happened to a youtube musician called The Fat Rat. Someone claimed his song, "The Calling" was theirs and his video, that was getting millions of views, was loosing a lot of money to some company that had taken his song, made their remix and then claimed his original work as their own.

    for the keeping the video up, i would recommend, that the claimant has to say a price to YT, and put it to YT. that can be disputed by the video produce, who than has to put the amount to YT if he still wants to have it up for that price (he/she can say no, even if they think they win, to get the money the other party say it is worth). and the money goes to the winning party in the court battle.

    It's very simple. If there are hundreds of thousands of dollars, or even millions, at stake here, the aggrieved content creators need to find a class action attorney and sue the company and ishowspeed. They should be able to get an injunction to stop this from happening and get most of the stolen funds returned (with the attorney's of course getting a sizeable chunk of it). That's it. They are violating US law, and can be held accountable in court. If they don't bother suing, nothing will happen. ishowspeed should also be concerned with this, because if they actually sue and win, that could lead to YT banning him for violating their policies, which would end his current career.

    I am glad that you defended KZread to some extent. The law as it stands - where someone publishing user submitted content isn't liable for copyright claims - is basically the only reason that KZread or platforms like it can exist at all. Without that law, no one would ever run a streaming site, because it would be far too much of a liability to ever be worth it. Can recommend Legal Eagle's "KZreadr Extortion? MxR Plays v. Jukin" video which goes into the DMCA a bit more.

    But KZread is acting like an enforcer. They're just getting away with it because they're only enforcing for one side. It just so happens that the one side is clearly able to then use the one-sided enforcement to commit crimes en mass. KZread has gotten sued for it by Bungie, but once is not enough. We need smaller creators to band together and start a class action.
