Terrible Tenancy

Ойын-сауық

The plaintiff says her landlord, the defendant who lives above her, had a leaky radiator, and it ruined the plaintiff’s belongings as a result. The plaintiff is suing for the damages and emotional distress. The defendant insists none of the plaintiff’s belongings were damaged. Besides, the plaintiff failed to pay rent, and the defendant even tried to have the plaintiff evicted.

The problem is that the majority of the things the Plaintiff was suing for has no monetary value, just sentimental. Pictures, prison letters, etc. have no monetary value. The only thing she had was the one blanket, which was a year old. She wasn't suing for the dresser and the pants she sued for, she only had one picture of one pair. On top of that, the "damage" to those items are something that could be easily washed, which she hadn't attempted to do. The plaintiff ruined her own case by the lack of evidence, nothing to do with the Judge. 🤷🏽‍♀️

You think THAT landlord would have accepted or tolerated the tenant beneath her calling a plumber AND a dry waller and letting them into the landlord's portion of the house to make repairs? You're flipping nuts. And I highly doubt that the rent for that ROOM amounted to enough money to cover the cost of a plumber (in winter), or a dry wall repair let alone both. The repairs weren't being carried out, it is the slumlord's house and her duty to do the repairs, not the tenants. You’re not. I notice this also. She treats her litigants based on how well they speak, how they’re dressed, and what they do for a living most times. If it doesn’t measure up and check out on her checklist, she goes by the book, throws understanding and compassion out the door and starts over talking them, shaming and bashing them and hops on her high horse with the quickness. Mathis used to also act like this. They both have had their shows cancelled but have new setups on their new shows which don’t have as high ratings because the litigants are clearly actors now.

Judge M was so wrong in this case. Seems like she was being bias towards the plaintiff!! She always says "who am i going to believe you or my lying eyes"!! The proof was in her face on pictures so she should have gotten SOMETHING!! That was terrible as hell.

Sheets from dollar tree or family dollar are $10. Unless she brought sheets 15 times, they are not that expensive. Common sense would be to move the bed or sleep on the couch. Why would you keep buying the sheets over and over knowing it would be damaged again?

The plaintiff was very forthright and honest. She did a fine job considering her circumstances of documents the unconscionable conditions under which she was living. She is on parole and bound to stay in a specific location. She is pregnant. Clearly she lacks the means to move or I am sure being pregnant she would have. As typical, Milian exhibited her bias throughout the case. No one has receipts for sheets. I am sure Milian herself doesn’t either. The plaintiff’s photos clearly document a situation that is not habitable. In many other cases where Milian favors the plaintiff she would have played her game of ‘rough justice’ but not here.

The judge was wrong with the ruling. Although the plaintiff didn't have a $3,000 she definitely should of gotten something. I would have given her $500 for the property in $1,000 for emotional distress. Especially if she had to go to a hospital because of sheet rock falling on her head. Also the amounts the plaintiff was asking for was beyond reasonable. As long as she had proof that damage actually occured to her items she should of been award. Proof does always mean showing receipts for items brought a year ago but also involves proving it's more likely than not that the damage actually occur and it it dictates the amounts she was asking for which the plaintiff did. The house was move in livable condition that's why the landlord was suing for rent because she would of never been awarded it and she knows that.
