The school punishing her just made it 100% worse, this probably means they would lose money due to students leaving or not joining. So if they "knew" it was going to court, they wouldn't have punished her

I had this one terrible teacher in 4th grade. I tried telling my parents about her but they thought I was overreacting. Then one day I broke and cried for 2 hours straight, keep in mind I was 9 or 10 at the time. Only after that did they actually believe me. Turns out what she was doing violated school policy so she got demoted to teacher's assistant the next year.

I’m a retired teacher and a classroom should NOT be a place where privacy is promoted. Classrooms should have cameras rolling at all times. If you’re doing your job you shouldn’t be afraid to have camera rolling. Children need to be protected and parents should have the right to know what is going on Plus it is also very helpful for teacher’s protection too. False allegations have hurt many a teacher’s reputation. So cameras in classrooms should be a must!

@ dona' little fawn Camera footage isn’t the only reason why phones are normally banned during school hours. It’s also b/c it can be used for other inappropriate stuff. Like adult videos, cyber bullying, distraction from their academics, and cheating on tests. If she’s told not to record, she needs to follow school policy! Period!!

Depends on the situation. So all we know, the kid was probably being defiant and the teacher must’ve rightfully scolded her and gave her a fair consequence. We don’t know the full story.

In the teacher's judgement, the teacher was motivating the student. Different kids need different kinds of motivation. That kid recording probably didn't have the same temperament as the kid she thought was being bullied. She may have ruined an opportunity for the teacher to reach the kid in a way that would only work for that kid.

Think about it, whose judgement is more likely to fit the situation, a teacher who chose that profession to help kids or a kid who whose goal is to "get the teacher in trouble." I'd bet two bits that the kid didn't record out of altruism but instead did it because the teacher has been correcting her bad behavior and she got mad about it.

Students can be using phones for other reasons like cheating on tests, watching adult content videos, cyber bullying their classmates, and recoding other students, and being distracted away from their academics. We just came from a pandemic that caused learning loss, now more than ever, kids need to focus less on making tik tok videos in class and more time on learning reading, writing, and math skills that they fell behind.

You do realize that students bullying other kids and staff members all the time right. Now a days, a bratty kid can literally call an admin the “F-word”, and very little is done about it. Kids and their parents need to be held accountable too! Babying them is setting them up for failure.
As someone who was mercilessly bullied throughout my grade school career, I can atest to what a teacher bullying you feels like. I've had a good few and it's makes you feel a different kind of hopelessness verses being bullied by your peers. Like there's no where to turn at that point... since these are the people who should be protecting you.

I guess the lesson here is, the teacher who bullied was employed by the school: ergo, take the recording to the police. Even if the school is against a teacher acting this way, it's an embarrassment that they hired someone like this...this young lady absolutely did the right thing. And the recording is NOT against the law: the expectation is clearly stated in the name PUBLIC SCHOOL!!!

The student who was “bullied” by the teacher was clearly a trouble maker who was defiant and probably bullied other kids. No teacher in their right mind would yell at or intimidate a well-behaved and respectful student. If a student was called out by the teacher, they were clearly asking for it.

The bottom line is.. The school got butthurt for being exposed to its recklessness, so they decided to suspend the student that exposed the school for endangering not only the lives of the students but of their loved ones that they come home to, their Mother, Father, Siblings, especially their elders who are more susceptible like Grandma or Grandpa. Also anyone with a weakened immune system. Shame on the school for being reckless and Shame on the school for thinking it was okay for suspending her!!! Furthermore, because she got suspended by the school, it only makes people see the school for what it really is by trying to coverup its recklessness and trying to get into the student's head as well as other students by suspending someone the school thought they could scare others but failed!!! THE TRUTH CAN NEVER BE SILENCED!!! SAFETY FIRST!! THE SUSPENSION WAS NOTHING BUT PSYCHOLOGICAL WARFARE!!! FOR THE STUDENT!! The Student did everything right!!! and Nothing Wrong!!! Nothing!!! Her actions only saved/prevented future potential others who could have gotten sick by the spread of the virus. Also, there should be no school in these troubled times.

Its just a way for them to circumvent the law. Which should be illegal. And what would have happened if the teacher did drop that student and this girl videos it and had proof? Then what? Was her act still illegal? When you catch the system doing wrong with intent, then the system will tell you your wrong for catching them. Snowden is a patriot of the people and our constitution. He knew what would happen. I agree he should have stayed here and fought even if he lost. I had a 4th grade teacher I just hated going to her classroom. Math was my least favorite subject & I didn't understand a lot of it. This teacher didn't hide who her favorites were. They were the smart kids that never asked questions and always raised their hands. She made it obvious she had NO patience for me. It was my most miserable year of school, by far. The following year I had the sweetest, kindest, most patient teacher I had ever had. Best school year ever & I actually enjoyed learning math. Won second place in the class spelling bee that year with my best friend, who won first place. Those 2 years of grade school were like night and day, different. Many people have no idea how much a teacher can influence how you learn or don't learn. How miserable they can make learning for you. Many teachers may have good intentions but, truly should not be allowed to teach children anything because they should not be teachers!

Cause if so, that could be why she was frustrated, stressed, and favored the kids who were well-behaved. No teacher likes to deal with difficult kids just like how no customer service worker likes dealing with a Karen.

@@amylee8969 That's not true. No teacher goes into a classroom believing that all kids are going to be college bound sweethearts. I've heard of teachers who like the challenge of turning around a kid who is difficult. Teachers have different teaching styles and kids don't understand that - they only know if they like how the teacher acts or not, and not every kid will like a particular teacher.
"Doing the Right Thing" does come with consequences. The school district was WRONG. Any recording that reveals a crime is not WRONG. People who try to cover up the bad things that they do and say think this is wrong. GOOD people KNOW that revealing a crime is a good thing. How about this, Don't sue the school district...sue the individual teacher responsible for the CRIME AGAINST A CHILD. Far more effective when bad deeds cannot hide behind 'big money' for protection.

Everything in every classroom should be recorded. Man would that change the world of education, good teachers could teach and bad students would be gone.
When I was in 8th grade my teacher pushed me into the door as she was sending me to the office. I was a problem child and pissed her off daily on purpose. I told the principal EXACTLY what happened and I was called a liar. She’s hurt several more students since and as far as I know still works there.

Robert Teachers are PUBLIC employees and must follow laws and rules designed for the protection and rights of the PUBLIC. Students, in a PUBLIC school, are the PUBLIC, not paid employees, and are there as required by law. If the PUBLIC school is not protecting the PUBLIC then the PUBLIC must protect themselves.

It's technically NEVER illegal for a child to exercise his or her rights. They have rights too and schools go WAY too far when restricting kids from them.

No. She literally didn’t. You legally can’t record a conversation that you aren’t involved in, as well, any conversations between a teacher and another student are protected under FERPA. She was violating the 4th Amendment Rights of everyone in that room. Doesn’t matter if tHe TaXPaYeRs PaY FoR iT. You can’t legally record a conversation without the consent of one of the people directly involved in the conversation regardless of whether you are in public or not.

There is no acknowledgement that the teacher should not have been talking to her student like that. How is there an expectation of privacy in the classroom? I do not think that is right. If a child said anything they would be held accountable. I think accountability should extend to everyone.
The school should be more upset that a teacher is bullying a child, than the recording. This says mountains about the school and the staff... Home school your children if you can... Find a way...

The only possible defense here was the one the school made--that there was an expectation of privacy. Unless there is relevant case law specific to classrooms in the state, I think that is a dubious argument.

Follow Up: The teacher was fired. After this story aired, the superintendent for the district intervened and the suspension was lifted.

The teacher is talking to a class full of kids. She does not have the right to be private. Choose me to go to court as a juror and I would find her guilty.
