Practical advice, thanks!! Many feel it is a status symbol to claim a practice directly in High court but I feel without understanding how lower courts function there will hardly be any prospect of getting appellate work in HC as the person will be unable to pick holes in issue/charge framing, evidence recording and appreciation or trial proceedings as per cpc crpc or mlrc etc. Lower courts' experience make an advocate a complete package. A high court advocate may actually struggle at each step in lower courts unless he knows his cpc crpc properly on the other hand a lower court advocate just has to get used to highcourt rules of filing and he will be able to plead himself. So far as original side work is concerned, it is mostly taken up by big law firms with established roots since 50-80 plus years.. there an individual stands no chance unless he joins as employee/associate of such firms

Thank you for sharing your insightful thoughts on the importance of gaining experience in lower courts before practicing in higher courts. You make a great point about how having a solid understanding of how lower courts function can help an advocate pick holes in issue/charge framing, evidence recording, and trial proceedings, which can be crucial in succeeding in appellate work in higher courts. It's refreshing to see someone recognize the value of gaining experience in lower courts, as it's often overlooked in the pursuit of practicing in higher courts. You're absolutely right that lower court experience can help make an advocate a complete package. Additionally, your perspective on original side work being mostly taken up by big law firms with established roots is spot on. It's important for aspiring advocates to understand that there may be limited opportunities for individuals to take on such work on their own, and that joining an established firm can be a viable option. Thank you again for sharing your practical advice and insights. It's clear that you have a deep understanding of the legal profession and the importance of gaining experience in various areas to become a successful advocate.

I'm sorry to hear about the situation you are facing with regards to your original certificate from Guwahati University. I can understand how frustrating it can be to not receive such an important document, especially when it is preventing you from applying for a practicing license and taking the AIBE exam. Regarding your question about suing Guwahati University, it may be possible to take legal action against the university if they have failed to provide you with your original certificate in a reasonable amount of time. However, before taking any legal action, it may be helpful to exhaust all other options to try and obtain your certificate. You could try contacting the university's administration and student services department to follow up on the status of your certificate and see if there are any steps you can take to expedite the process. You could also consider reaching out to the Bar Council of your state for guidance on how to proceed. If you do decide to pursue legal action, it would be best to consult with a lawyer who specializes in education law or civil litigation to discuss your options and assess the strength of your case. They would be able to guide you through the legal process and help you prepare the necessary documents and evidence to support your claim. I hope this information is helpful to you, and I wish you the best of luck in resolving this issue and obtaining your certificate.

I think that's perfectly okay. Keep up doing the good work. But always remember that you learn something out of whatever work you are doing. Let every case be a learning experience of legal principles, human psychology, honing your skills of speaking, thinking and writing. That's how one can grow bit by bit everyday. If you are steadly working in the profession a day will come you will start earning handsomely. I would say unfortunately the very nature of this profession is such that a new entrant doesn't earn much. But if the new entrance is committed steadfastly to his success, by working working and working in the right direction nothing can stop him from succeeding ultimately. My best regards to you.

I was appointed as assistant floriculture officer on contractual basis in department of floriculture kashmir. After 2 years of joining I was verbally forced by concerned director to replace or tamper service records of one of the employees working in my office,That person had already filed writ petition regarding his service.so it was not ok for me to act on verbal instructions as after doing that only i would have been made answerable because on changed documents there would have been only my signatures. In nutshell i refused to do so unless and until i have any written instructions regarding the matter. After this the concerned director issued me termination. From that day my service case is in high court.now it has been a period of 14 years my case is still in court now it is in final hearing stage. I am so frustrated I don't know what to do. My career is destroyed I can't understand why my case is still pending for decision. Plz guide me sir. What should I do at this stage. I am in depression from last 14 years. Regards 🙏🏽

It is understandable that you are feeling frustrated and helpless after all these years of waiting for a decision. As a practicing lawyer, I appreciate that you are seeking guidance, but unfortunately, I am not in a position to provide you with specific advice on your case or the reason for the delay. It is essential to take care of yourself during this challenging time and get the support you need. I hope that your case reaches its final decision soon, and justice prevails.
