    She wants a third but doesn’t do any type of management in terms of placing tenants, collecting rents, handling repairs, vacancies, etc.

    But the brothers are also living in a couple of the properties rent free (properties in which she has partial ownership) so that should also be considered.

    That should not deter them from giving her the fair share. If they really felt she wasn’t contributing they would give her what Is rightfully hers and let her manage her share of the property. This is very greedy on her brothers part whether she manages or not. They needed an excuse period.

    What sucks is that there should've been a formal agreement drawn up. Sounds like she was living in the US, and the brothers were physically managing the properties. Technically, I'd say they deserve a larger portion of the profit. However, it also sounds like she was just accepting whatever money they were giving her, without asking questions. Weird situation. The moment she became an adult, she should've starting looking I this, but it just sounds like she didn't really care that much in her youth and now wants her fair share in old age.

    Can she manage the properties from where she is? Does she want to? There will be a price for her choices. If they are doing the work and bearing the responsibility to manage the properties, they should get more.

    They should get compensated for their work, and it should be agreed upon, not done unilaterally. Compensate and then divide the profits according to the will.

    her brothers are acting as " management company taking their fees for managing the properties" while she gets her cut doing absolutely nothing. Honestly this sounds like shes very greedy and entitle .

    It's hard to say without more details but in general I agree. She is in another country doing nothing and getting a passive income from it, while they are there managing repairs, evictions, getting new tenants, etc. It's not reasonable for her to expect a 1/3 share because she is doing 0% of the work.

    I wonder if there is much more to this story. We are only hearing one side and do not know what the laws are in Argentina or exactly how the properties were to be split amongst the family members. One thing that caught my attention was that the caller left her family and moved to another country, the remaining family continued to work the properties. Now the caller is upset that they don't send her enough money.

    She already explained how the properties were distributed 50% to her mother and The other 50% was split three ways between the two brothers and herself so she owns 33% of 50% of the properties.

    @@harsh1225p I don't think so, in my opinion. I think they are going to act like that no matter what happens and it's just best to rinse your hands of it. But like I said that's just my opinion and that's what I would personally do if I was in her situation. I don't see anything wrong with taking either route, I would just do what Dave said here personally.

    Unfortunately it's probably very difficult to litigate from afar, especially in a country like Argentina. Who knows how fair, transparent, and expedient things will be in court.

    This situation shows why it's a terrible idea to own real estate with anybody who isn't your spouse. If you jointly inherit some real estate with a sibling(s), sell it ASAP and divide the money, or buy out their share from them and take full ownership, or have them buy out your share.

    If she gets her property, who will upkeep and manage it at the other south pole, and for what cost? The brothers would get all these years a property management cut, and she should’ve talked about this ealier, not after 30 yrs

    Sounds like a take it or leave it scenario, Out of the total amount of property it sounds like she should own only 16-17%, and if you are getting less than that good luck. I'd imagine trying to sue for property in a country you don't even live in would be very difficult.

    Exactly 💯💯💯 Unless we are 100% brutally honest with ourself and is 100% fully self aware, then we can be honest if we are the villain or the hero in our own story. If one is the type of person who always plays the victim, refuse self responsibility, then everyone else will always be the villain. Not too many people can be brutally honest with themselves because most people lack self awareness and most preferred to deceive themselves because admitting the truth to themselves hurts, taking accountability in our own story is hard and most people will avoid this pain by playing the victim and self deception, thus other people are always the villain and we are always the hero in our own story.

    I have a feeling she is confusing GROSS and NET income on rental properties… rent may be 1000 but only 100 of that is profit.

    Dave really needs to giving his opinion as though it were legal advice. He should just tell the lady you may want to speak to an attorney and leave it at that. Her case has all kinds of problems with no written contract, statute of limitations, foreign jurisdiction issues, etc.

    No my dude you misinterpreted the call, probably because of her English, she said she's getting 20%-30% of what she should be getting, so there's a 70%+ income that she feels entitle to that she hasn't gotten for decades.

    The brothers are the greedy ones, she said she gets 15% of what would be her fair share (1/3 if evenly split). For managing the brothers should be compensated or they hire someone to do it and split the costs. But her brothers already live there rent free, so that’s compensation too.

    Yep. Just because Argentinian law says she inherits the property equally with her brothers, doesn't automatically mean that she should receive 33% of rental proceeds, does it? Dave never made that distinction.

    @@MichaelAnderson-wk1no Addressing OP’s uninformed claim that she “ran away” is exactly relevant. And we know nothing about the properties, so don’t know what is involved in managing them. Are the brothers working at it full-time from a fancy office in a high-rise with a battery of lawyers and accountants? Or do they occasionally make repairs to small condos and little offices and change locks, and ought to be working their own full-time jobs instead of milking the portfolio? Is one a cattle ranch they work on all day every day? WE DON’T KNOW. sounds like she is entitled to a third of the profits. Profits means after the brothers are fairly compensated. Idk if that means executive-level salaries or reimbursement for paint and supplies.

    I'm guessing she is better off here in the states which is why she doesn't go back. If I were her I would simply just wash my hands of everything if they want you to sign everything over to them come up with a reasonable number that is maybe 10% of what everything would sell for and be done with it

    I had to move away from my hometown for my and my husband's work, but my siblings still live near my parents. When my grandparents passed, my siblings divided all their possessions among themselves and left nothing for me, even though I was the closest to my grandparents of all the grandchildren. I would have liked to have even one momento to to keep as an heirloom. I know that when my parents die the same thing will probably happen, so I have prepared myself to not have any attachments to any possessions in my childhood home, and instead just make the most of every moment I have left with my parents. I think I can then avoid having any sense of loss or resentment toward my siblings if they leave me out again. I do understand that those who live closer to aging parents, have a greater responsibility. My husband and I are caring for his aging parents, but we would never even consider not splitting everything 50-50 with his other sibling.

    I'll say this, my father is an original investor in my company and his percentage is 25%, the investment did not need to be paid back. So when he was doing his will he said he would leave those shares to us kids split in 3s. Sounds fine right? Except that I would be working the rest of my life and sending my brother and sister checks. I'm single and not wealthy, they are married and have serious wealth. I talked to my father about this issue and he agreed that it was a messed up deal, so instead dad gets paid back and checks for the rest of his life, but it ends there. He's happy to get 1k a month as a retired guy and all his investment has been paid back as if he never took the risk, win-win. He and my mother are wealthy just like my sister and brother and I will get 1/3rd of their wealth when they pass. This is the way it should be.

    Maybe she should offer to sell the brothers her share of whichever properties have her name on them and be done with it. Her father died intestate and I understand that she is entitled to her portion of the inheritance, regardless of who is managing the properties, but she waited 37 years before she bothered to look into what they were giving her. Sell your share to the brothers and get out.

    Property disputes among family in South America is extremely common. Her brothers know that she is living in one of the most expensive cities in America while they are living in a country whose currency is worth almost nothing. I think it’s understandable that they are being about the properties and the money. They know they need it more than her.

    honestly it just sounds better to deed on the property over to them and forget about it. Even if the properties were making a decent amount of money in USD she’s in America and she has opportunities, in Argentina where they’re very limited. I don’t like this word victim, because she’s not the one who’s managing the properties. I’m in a similar situation except for in the US, but I don’t even count on that property anymore. One way or another I feel like my family will messed it up so I just don’t even count on any money from that place.

    She can just decline to deed it over and remain a thorn in their sides without incurring legal bills. At some point the brothers or their descendants will want to sell and need to clear title. Let them pay her fair value when they have the need to clear it. The down side of retaining in title is liability in lawsuits that can arise, and taxes.

    She could do that, be a thorn in their sides but to me, it's just not worth it. Life is too short to be bitter like that. I'd rather just take whatever portion I was given and just call it a day and go on living my life. She doesn't sound like she's hurting for money. Also, from the sound of the story, it does seemed like her brothers are doing all the work managing and up keeping the properties because they are physically there while she's not. And it sounds like the brothers were taking care of their mom too while she's in America. So I'm going to assume the brothers did most of the work so I don't think she's entitled to half when she didn't put in equal shares of the work. But I guess we won't really know the full story unless all her brothers call into the show. We're only hearing her side of the story.

    Had a 50/50 business partnership, this guy was lazy, didn’t do his fair share. Only collecting 50% of the profits. She didn’t contribute to management, repairs and time. Sorry but you don’t deserve 1/3 the cut.

    Don't understand why he suggests just handing it over to her brothers. Get it appraised and offer to sell them her portion based on the appraisal. How much does her mother still own after all these years? Obviously, she needs to talk to an attorney..

    It seems like it might be fun to legally sign the properties over to just one of the brothers and sit back and watch the whole greedy bunch of them be at each others throat.

    People dont want to read the will while they are alive because some are not sure who will take care of them when they get old. I have seen some messed up things with people and their passed away relatives.

    Instead of walking away she could bring up the potential of suing with them and then say she would be happy more than she is currently getting in exchange for not pursuing it any further. At least then she may still be getting something without paying lawyers. Why deed it over them when it is essentially passive income. Se would need to drop the issue in discussions with family after an agreement was reached in order to prevent it dragging on her life going forward.

    She is actually getting the correct amount. Her mother owns 50% and the three siblings split the remaining 50% which works out to 16.6%. I think maybe the issue is that her family isn't being upfront with the documentation and that makes her nervous and mistrustful. It is better to address that but she is getting the correct amount.

    Ask the brothers to buy out the sist6er's portion. She can sign over her percentage in exchange for a n amount of money. Then she can walk away and the brothers don't share ownership any more with her. And if the brothers refuse, to sell, then just keep accepting the money that they give her

    yes, her brothers are doing all the work, but they still have the same amount of equity. they should be paid more for their effort, but it needs to be agreed upon, and written in a contract

    Something’s wrong with this lady. Legally yes she’s entitled to her 1/3 but being in America means she’s absentee and hasn’t taken care of the properties at all. It’s a lot of work. When you hire someone to do it, it’s a full time job when there are issues. When it’s just collecting rent, it can be a part time gig. But no one can do this overseas. Being that she’s doing okay here, personally I would let 1/3 go. But for her, if the brothers can let her cash out, I think that’s already more than fair.

    Why would you deed it over to them when you are getting money? So, if I can’t have all the money I think I’m entitled, I’ll just not take any?? Also, are the brothers managing these properties? It doesn’t sound like she is. If they are actually doing the work, then it her payment % might not be that unfair

    Some cultures just plain aren’t fair to women. My mom went w a bilingual OG life insurance broker bc she doesn’t know English. However when my sister reviewed the contract, she saw he automatically gave the boys 10% more than the girls. She said heck nah and made the broker split it evenly (a move all of us kids agreed on).
