    @@JDjee5 yes but she was still charged fees and those can add up very quickly. Also if it states in the contract there are no refunds then there are no refunds. It would be a slippery slope if she bent that rule for him. Then everyone would want it or should could be sued for treating someone differently.

    Exactly speaking as someone whose mother worked in retail for over 30 years one of the first things I learned is to treat the customer right and make sure they leave happy so they will come back.

    He should've been entitled to a full refund! Months in advance, didn't hurt her one bit, but she still wanted his money. I hope there's motorcycle enthusiasts out there that see this and know not to ever give this bag any money. This guy was even a regular customer, how's she treating non regulars?

    Not sure where you get this "months", it was like 10 days in advance. The point is that if they had a contract that stated no refunds, and he agreed to it, then that's it. This crazy lady wanted extra and the fact that she has no refund in the first place would be a red flag for me.

    The question in the beginning was really well strategized by Judy. She suffered absolutely no losses because of his cancellation, that was timely, orderly and way ahead of the event. Enforcing a no cancellation policy like that loses her more business that she’ll ever get. Nasty piece of work

    She got to keep the money, she lost a customer, and she wanted to have him cover her NSF funds on the account. How bad of a business person runs the margin so close that a refund of $390 would overdraft her accounts? If I was JJ I would have awarded him $500 for pain and suffering for having to put up with his loss and her aggravation. Also held her in contempt of court for not shutting up.

    I agree. Some just have no respect for others, or themselves. I watched one video of the atrocities people do in court. One guy pulled down his pants and mooned the judge.. on another, a man pulled out a joint and lit it while on the stand. Just awful, but entertaining.

    What terrible business practice. Could you imagine alienating a regular customer like that? Especially when you only have a handful of motorcycles in the first place? It isn’t like it’s hard to rent one of those bikes again, MORE THAN 2 MONTHS IN ADVANCE. Glad Judy understood.

    @@jetstream6389 Same thing applies in real civil courts. While she was a Judge, in this instance she is not acting in that capacity. She's acting as a mediator. Thus, no contempt of court. A civil court judge has the same inherent authority to hold people in contempt as a criminal court judge. In point of fact, those are most often the same exact judges.

    That's why Jude Judy called her a bad businesswoman. She was so hung up on what her contract says that she will be the one losing out in the long run. Also, a person always has a right to dispute a charge regardless of what's in a contract. The dispute may not go in their favor, but they still have a right to dispute a transaction regardless of the outcome. The Plaintiff was being unreasonable and rude.

    It's a shame Judge Judy could not find for the defendant on a counter claim. That defendant acted like he had more honesty and decency than the plaintiff has ever given to anyone.

    Agreed. Since JJ didn't mention a counterclaim, he must not have filed one. He probably would have won, regardless of the plaintiff's policy, based on the fact that the plaintiff suffered no monetary damages when he canceled. If she really wanted to, JJ could have applied the Unconscionable Contract rule, though that might have been a bit of a stretch in this case. So many people file nonsense countersuits, but he actually had a good set of facts. Too bad he didn't try.

    JJ had already stated she was not going to give her a cent so she had nothing to lose by mouthing off; the reason JJ then didn’t kick her out immediately was because she wanted to try to demean the woman’s claim and business practices before dismissing the case. When she grew tired of the interruptions and it became clear she wasn’t going to be heard she gave up and kicked her out.

    Judge Judy was right calling her a bad business person. I work for a small online company and anytime someone asks for something outside of usual policy we ALWAYS check to see if they are a repeat customer. Better to make an exception and take the hit once than to alienate them and risk bad reviews.

    Sounds reasonable, but I'd think there's a fine line you have to judge, between bending the rules for good customers and giving the public impression that policy is only a suggestion. Another skill that business people become good at in order to become _good_ business people

    I booked 2 nights at a major hotel chain, first time customer of theirs, with a no cancellation policy for a discount. Unexpected stuff happened and I had to cancel. I called, politely explained the situation, and within 15 minutes reservation was cancelled and I wasn't charged. This was 4 days before the reservation but the hotel manager allowed it. She received a glowing commendation, along with the person I spoke to over the phone, that made it to the eyes of a few higher ups as well. Legally they would have been in the clear, like this lady unfortunately was if a contract was signed, but they didn't die on that hill and instead decided to do the right thing. Since then I've traveled more and guess what the first hotel I look for is? And this was for a first timer.

    The poor man, so she got $390 for nothing? Most places let you cancel within 24 hours, and then wanted another $790 because he dared to challenge her no refunds policy. What a way to treat a regular customer! She had 2 and a half months left to rent that bike out and I bet she did manage to rent it out and so got paid twice.

    He did not pay a penny, insurance policy that comes with most credit cards do that. That’s why he dropped a lawsuit. That’s why the judge said the credit card company sided with the defendant.

    What a no refund policy means is that once they get your money, they don't want to give it back under any conditions. They can call it a policy all they want, I call it just plain greedy

    Yeah it’s something I never fully understood why it exists. I mean obviously you can’t refund a purchase if the service was used. But I’m this case the service was canceled and not used therefore there should be a full refund.

    @@grizzly_manbanimation8436 in certain conditions it makes sense. Cancelling the day of, you may be unable to replace the service with new business in such a limited time frame. Of course if you manage to, they aren’t out anything other than inconvenience (perhaps some last minute advertising costs). But she had plenty of notice, so she’s silly to spit on a repeat customer when she’s out nothing. And the audacity to sue for more money when she got his money for nothing.

    She thinks she's entitled to $400 of his money even though he won't be using her services? That's a lunatic. I understand a nonrefundable booking fee, maybe $20 or something, but to keep $130 like that is outrageous. I'm glad she got thrown out, she's nuts.

    Umm I'm sorry but your are incorrect about the this case. She has no obligations to return his money. She clearly has a "NO REFUND POLICY" prior to him placing the rentals date. Given that he's a repeat client of 3 years he should know about her rental policies. She did practice good business ethics, when she offered to reschedule him for future rental dates. He should have just taken the rescheduling offer now he has "NO 3-day bike rental" and he had to "repay the original reversed payments". The only thing the the business lady is wrong for is she recovered her rightful payments owed but she's not entitled to a dime more she was just greedy trying to claim bank fees because more than likely the bank reversed the fees for her without any additional fees and claim for money for stress comes under that's the cost of running a business. Once you place a order and the policy is no return that's a you problem. Just like when you put a money deposit down to reserve a place and it says you forfeit your deposit money for any cancellations. Than that a your problem not the business persons problem.

She literally says that there WAS other bikes available for other customers. Therefore she lost no money when he reserved the bike for 3 scheduled days for less than 24 hours. No customers were driven away. She is a horrible business woman. There is no reason for her to keep the money and lose a REPEAT customer. She lost no money!!! She actually gained money without any miles being put on the bike. The only reason for that is because he dropped the dispute. He didn’t want to deal with the crazy lady anymore. She is just a bitch for going after him for the bank transfer fees. All that does it tell you what kind of person she really is. She got his money and her motor cycles didn’t get used !!! That’s not enough?
