"Why did Chief Justice Chandrachud take a public position on the new criminal laws?" - Indira Jaising, one of India's best known lawyers, speaks on the new criminal laws that have replaced the Indian penal code effective from the 1st of July. Ms Jaising says the laws, passed without enough debate or discussion will be the harbinger of a "police raj" calling the emphasis on electronic evidence without safeguards as the most dangerous aspet of the new laws.     The 90-day cooling period is to counter the idea of criminals getting quick BAIL, after committing heinous crimes. Even NBO do mot apply to women and minors. So Bail should the granted only in deserving cases, Barkhajee, and you cannot tout bail over the counter(OTC).Syndicated crime networks in urban and rural settings get bail at the drop of a feather thusaking a mockery of the rule of law NOW, BAIL HAS TO BE EARNED, NOT DEMANDED

    With due respect to Indirajree, most of your arguments are subjective and legal theories,and may not rear up in criminal practices. But i believe that the 90-days cooling period is to ensure that EARLY BAIL PETITIONS should be dealt with, on CASE-to-CASE basis, and nobody could DEMAND BAIL

    With the induction of the sobriquent POLICE RAJ in police parlance, Barkajee, the duties and responsibilities of the police force have increased, ThREEFOLD . Wirh increased POWER and territorial JURISDiCTiON, comes GREATER ACCOUNTABILITY and LARGER RESPONSIBILITiES to the current crop of the indian Police Force.     @Barkha keeps bringing these old skeletons from the cupboards, the relevance of which is only among these lackeys of the erstwhile Khan Market Gang. If you have issues with the law challenged in court, bring/suggest amendments to parliament. Now the Opposition is stronger, so use it for good rather than keep shouting and doing nautanki.

    It can’t be that everything in the new law is bad or done with malafide intentions. That there was no debate prior to passing it is a justified criticism. I listened up to 6 mins and found that the guest is only finding everything wrong and nothing good. That can’t be true . Maybe a waste of time to listen to the rest. We need impartial analysis. I felt Shekhar Gupta did a somewhat decent job but he is not an expert in law. So experts clarifying things and pointing out both strengths and weaknesses and areas needing improvement would be very helpful.

    That's the problem, u created a bias already, u listened upto 6 mins and didn't know what she said in 19th min on the merits such as on women, children, seniors not required to come to police station, the e-FIRs, etc..

    These NEW Laws were needed a long time ago. The Rights of Hindus have been violated with impunity in several States and they continue to suffer religious abuses. There is also the continuation of violence against Hindu Pilgrims, especially in Kashmir. The naked violence of murder against the two Hindu Sadhus and their driver after being driven out from a police Station, is another example of my point.
