SCOTUS Hearings "Sad and Disappointing:" Harvard's Tomiko Brown-Nagin | Amanpour and Company

In the course of this week's Supreme Court confirmation hearing for Ketanji Brown Jackson, the candidate kept her composure in the face of what even some conservative critics called “meritless” questioning. Tomiko Brown-Nagin is an award-winning legal historian and dean of the Harvard Radcliffe Institute. Her latest book "Civil Rights Queen" recognizes the path paved by Constance Baker Motley. She joins Michel Martin.

    It seems the questions say a lot more about the people asking the questions than Judge Jackson and unfortunately, demonstrates, in my opinion, that citizens need to really think more about who they are voting for, for Congress. If our senators cannot even focus questions on the law, instead of a children’s book with very strange text, instead of the job judge Jackson will be doing, it is maddening.

    Voters thinking more about who they are voting for? Not exactly a solution. If you want American legislators to do their jobs, how about limiting the money and time they spend campaigning? Election reform. It is THAT simple.

    Forgive this non-US, 70+, medical professional my probably naïve constitutional observation, but why is it acceptable in the 21st century that a rôle in the judiciary is dependent on a nomination by the Executive and consent by the Legislature. Other representative democracies are far more stringent in maintaining the seperation of the three pillars of government.

    KBJ is totally qualified for SUPREME COURT. However, she told a little fib about Morrison and Foerster. She was hired by Morrison specifically to work with their Gitmo Appeals Team. She used her PD Gitmo experience as her ticket to land a Big Law associate position. Can't blame her. Big $$$. But she didn't get asked to be partner because she didnt have the type of experience a firm like Morrison wanted. There huge in international business law and when the Gitmo dept minimized she was quietly let go. Nothing personal, just the cruel world of big law. Actually they demanded a definition of "woman". It is not applicable to her future role nor is it her role to drone out a dictionary definition. If the senator needs to know the definition perhaps they can look it up. They did not say what they meant. Did they want the biological definition? The Oxford English definition? A specific church's definition? If those posing the question were students they would have to be more precise. In reality they were simply grandstanding. Unprofessional. Silly. Immature grandstanding looking for tweets.

    She’s clearly qualified but the problem was the process. How is limiting candidates to only black women not racist, if limiting only to white male is racist? I hope Biden sees how this divides America rather than unite.

  • @judiemeierfranz4329

    @judiemeierfranz4329

    Thats a really good question. Maybe in the future that'll be true. Unfortunately, it is a given in the States right now that a white male of certain "class" already is at the top of any list. Even if not the most qualified. Biden found and chose a highly qualified candidate who is also a "nonwhite" woman. He gave his reasoning that black women make up a significant portion of our society yet are grossly underrepresented. He probably had a field to choose from, he chose not to limit his selection process to upper class white males. By the ridiculous questions she's had to face, it reveals what a woman has to put up with for the same job. It reveals why it's important. A highly qualified black woman has had to endure absurd remarks - think what the same woman in a "low level" job must endure. So it's right, we desperately need better, more diverse representation. We can hope this is a step towards a time when women and men and all ethnic backgrounds are considered equally for any job.

    @@judiemeierfranz4329 what's more important, assume you have cancer, the best doctor in that field or the color of the skin of that doctor? If you agree with the former, then what is more important then is equality of opportunity than equality of outcome, and we should strive to ensure that there is equality of opportunity regardless of economic class, skin pigment, or anything else. I hope we are more than merely are color and that such pigment criteria is not used for something as important for medicine or legal field. Otherwise, you are basically rationalizing racism.
