San Mateo Co. residents demand answers after Indiana Batmobile garage raid

    Unbelievable. Not in their jurisdiction. Not even a criminal matter, but a civil one. Wasting tax payer dollars to intimidate and interrupt a business. These people should be in jail for multiple reasons, but the abuse of authority is ridiculously obvious in this instance. Who signed off on a search warrant? Who signed off to have the business's assets frozen? Prosecute all these people who think they are above the law.

    The search warrant isn't even legal either. You can't approve a warrant for a state you don't have jurisdiction in. You can file an arrest warrant in your home jurisdiction and then request a local LEO make the arrest in the jurisdiction of the named party, but you cannot file a search warrant and sign it in California for a property in Indiana. Youd need a judge in the local jurisdiction to sign it and a LEO in the local jurisdiction to serve it. If they don't have that, they could have found dead bodies and the evidence would be invalid for use in court.

    This is a civil matter and the sheriff had no business spending one cent of tax payer dollars traveling to another state (where they have no jurisdiction), the sheriff needs to fully account for this

    The real issue is that this is a malicious prosecution. The builders story is very clear. The rich friend of the sheriff missed a payment and couldn't be contacted for 8 months. The builder would have been justified to just cancel everything at that point, but only moved the guys to last place. Then the rich guy called his buddy the sheriff and had him abuse his power to intimidate, financially attack, and charge him with bogus felony charges. The sheriff and the DA should immediately be fired and charged with malicious prosecution.

    The problem is you don’t fire a sheriff or District Attorney they are both elected officials. So it would have to be a recall election which should happen in my opinion.

    My only counter to that is you can't just cancel everything and walk away (and expect a refund). The builder has sunk cost, time, employees, etc. to cover. He's already paid money out. Now if the rich guy wanted the shell of a car, sure let him take that. But no refund, in my opinion.

    This isn't just a badge issue. For the left wing this is just the order of they day. They literally deal in corruption every single day. For a law enforcement officer on the right? 99.9% of them wouldn't even accept $1mil to do this.     In this case it involved higher ups. The officers could have felt presser by there bosses demanding they do something they shouldn’t. Either way everyone involved should be punished, the upper management should be imprisoned and the lower officers should at least be sent back to the police academy.

    The local cops were actually functioning under good faith. They are obligated to assist in serving a proper warrant. The Sheriff and DA who obtained the warrant are guilty of false pretenses, the local boys did nothing wrong.

    @@wstavis3135 the local cops still have an obligation to investigate why someone they’re allegedly supposed to protect and serve, is being hunted down by cops half way across the country. Innocent until proven guilty. That case was thrown out already by 2 judges, both criminally and civilly. They should have looked into the matter first instead of just letting this loose cannon agency do what they want to one of their citizens.

    The real question is, how did they get a judge to sign that warrant, to be applied out of state, and who is the judge that thought this could possibly be a valid reason to issue the warrant. Noticed, in all the coverage, no one is asking about that.

    Actually 3 separate California warrants, signed by 3 different California judges, 2 were for banking records, 1 was for electronic records. A separate warrant was issued and signed in Indiana. Unfortunately it can be done legally even though is was morally wrong and a terrible abuse of power.

    A friend's son applied to be a police officer in several cities in my area. He's well qualified and was offered jobs but in all cases, ALL, he was required to sign a loyalty oath to his Chief; not an oath to follow the law but to follow orders. As a law abiding citizen, he declined and was not hired.

    Need to start holding law enforcement just as accountable as any other citizen would be. If you’re supposed to know the law better than me and willingly break it then it should be malicious no matter the case.     @@guskeman but that state can't just cross state lines and arrest you, they have to request the local authorities arrest and extradite you. The out of state department can only show up at the station and transport you. They can't be at the arresting site as they don't have any authority in that state to act as law enforcement officers.

    @@jbonegw No it wasn’t. If you watch the original story on this, it shows the warrant with an Indiana seal on it. The CA cops went to an Indiana judge, who most likely just gave the probable cause declaration a quick once over, and rubber stamped it.

    Should. In a crazy alternate universe where they actually receive charges, they still won’t get convicted for any of it. Just sit back and watch as, yet again, every government official involved here will get away without consequences. At best, the taxpayers will foot the additional bill for the out of court civil settlement, and every crooked official will keep their job, or laterally transfer to another department.     Like the LEO care? They'll claim qualified immunity, which the DA will agree to, since the DA is clearly part of tbis cabal since he brought charges. Then the judgement money comes from the taxpayers who are already being ripped off for over 10 grand. The county should sue the wealthy realtor to recover every cent. He put all this in motion because he didn't get his way. He should shiulder the costs personally.

    District Attorneys have what’s called Absolute Immunity as ruled by the Supreme Court in Imbler v Pachtman, 1976. They can’t be sued for misconduct related to their advocacy in the courtroom.

    Unfortunately, it’s not so “slam dunk.” The people involved are the police. They will absolutely get away with this, with little to no consequences, and, at best, taxpayer money will be used to compensate the victim while the perpetrators admit to no wrongdoing and keep their jobs. This is absolutely the thing that will occur. You can call me out on it if that doesn’t happen (like seriously, please do. I would love to see the police receive real consequences for once). If the officers involved are fired, keep track of what department they end up moving to, and whether they actually received any consequences beyond simply being inconvenienced in their employment.

    If its to be believed, some reports claim that the officers were mislead by their superiors to claim that they were asked by Indiana police to assist in a criminal investigation. I have a hard time swallowing that since it's really not that common not to mention that there would be a public record of it, which I presume they can't find any of. Now to be fair, there were times when officers were mislead by their superiors and then used as scape goats, but I dunno I don't think this is one of them and if it isn't, all those involved need to be fired for abuse of power and violating jurisdiction.

    One of the problems is that they're sworn to uphold the law instead of defending the Constitution of the United States against all enemies, both foreign and domestic. While police are prohibited from using excessive force (which is subject to a lot of interpretation), they are allowed to lie in an interogation (that is, any time they are not testifying in court, which would be perjury). Frazier v. Cupp (1969) also needs to be overturned.

    Respect to ABC7 for pursuing the story and getting those financials. Without the financials, anyone can see that it was a gross abuse of power and negligence of civic duty. Having the financials brought to light provides cold hard evidence of the direct cost to taxpayers and a perspective that, anyone from the area who would not otherwise be invested in the injustice, can look at and start to ask why their hard earned dollars are being spent in this way. This wasn't a buddy helping another buddy power wash their deck. This was blatant abuse of the taxpayer dollar to fund the terrorizing and intimidation of someone over halfway across the country... someone who was in the moral right. This was not someone missing a rent check because they lost their job. This was someone buying a luxury who didn't want to pay a small business owner, skipped out on any communication, then threw a fit and called in a favor from a buddy who used taxpayer money to abuse the power that the local public had entrusted them with. This should not stand and I am pleased to see the media stepping forward to alert the public to the situation. Something that seems long lost in these past few years. It is good to see local news being real journalists again and truly serving their local communities.

    I would put this under illegal use of government resources and personal. This should have been handled in court not by cops. We have a legal system in America and this is not how our system works.     That’s the neat part: it doesn’t. When the people who make the laws, interpret the laws, and enforce the laws want to abuse their power to take from you and give to themselves, who is there to act as a check? That’s right: the people who put them there in the first place. Force them out. Elect better people. If they refuse to get their act together, go further as necessary until corruption like that is no more.     This is unbelievable! I think everyone involved should have their financials gone through as well. There’s no way the DA or Sheriff went to this kind of trouble just because a buddy was butthurt about a delay on a car.     Naive much? The term “lynching” is named that because a Judge Lynch illegally jailed quite a few of his rivals. DAs have been found to have repressed evidence that proved a person was innocent just so they could have a quick trial and make a name for themselves. Unfortunately often found out decades later and after the DA is retired or dead. In the last three years there have been at least two judges convicted of criminal charges. When I was young a judge moved into a renovated barn across the street from us. After he drove in and out of a couple of yards, didn’t make the turn onto our street, and plowed between two houses on that turn, we learned he had a long history of DWIs that had been swept under the carpet. Just because someone is in a position of trust doesn’t mean they are trustworthy.

    It's pretty clear and cut. The sheriff broke the law and overstepped his jurisdiction. He should spend some time in jail himself while getting stripped of his function and pay all costs back with after tax dollars out of his own pocket. Officers, DA and others that made this possible are also corrupt and should be kicked out a well. The officers involved should have stood strong against corruption, despotism and terrorism instead of willing participants. With government like that, you don't need enemies foreign or domestic anymore.

    So, how come all those involved from the Sheriff, the two Deputies, the sergeant, the Lieutenant, DA and Judge are not suspended with out pay, pending an investigation? Also Qualified Immunity should be removed from all of them, no need for the tax payers to foot the bill.

    Real journalism is dead, this story only made it on air because no-one involved had financial control over the news department. You can bet that stories are routinely buried by rich friends of media outlets all over the world. Not one media giant tells the whole truth, all of them are click-bait miners and for a more in depth story, check back at eleven!

    They had no right to freeze bank account, send workers home, or turn away deliveries. They were not only out of their jurisdiction, but they subverted the presumption of innocent until proven guilty and denied legal process. Goes to show you need to have a good lawyer on speed dial if you are in business in the US. I already posted long comments on my experience with local gov and LE in previous story. Suffice to say, even my friends that came to the US from places like Australia have been amazed by how the system revolves around lawyers, insurance/medical realms, and politicians. We need more transparency and accountability, but it only occurs when we demand better. Most people will do what we are doing here - post an outraged comment and nothing more, and the news will eventually move to the next story with likely little real change.

    I’m a cop and I can tell you right now…. That is absolutely unjustified. There is literally no reason for sheriffs deputies from another jurisdiction to spend all that kind of money going to another jurisdiction to question somebody. Anything that has to do with businesses and exchange of contract or money in a contract has nothing to do with the police but it’s all civil court.

    If a crime was even committed it would have been in Indiana not California. Maybe a stretch for wire fraud and a Federal Offense. I'm surprised the DA even signed off on the charges. I don't know what was in the written contract, however seems reasonable if you miss a payment, go to the back of the line. Seems nothing more than civil contract law, which was resolved in a local Indiana Court. Can always appeal to the next higher court.

    At least one of the members of the San Mateo County reached out and was able to obtain a warrant in Indiana which is what was presented at the time. They also took him to the local jail, but never asked him any question or explained what was going on.

    Sherriffs are actually a rather ancient form of authority that enjoys little oversight, legally. Its a carryover from a stuffy British tradition… over there, its an appointed Royal position with lordly rewards, over here its largely a free-for-all once elected. While there are good Sheriffs, there are some truly hideous Sheriffs with all kinds of lose behavior.

    Attorney Steve Lehto has not only done a video on this fiasco, but he's talked to the gentleman builder in Indiana and got numerous issues ironed out. You're County fathers/mothers need to force the Sheriff and his Friend need to receive the ENTIRE bill for Overtime, Flight tickets, Hotels, Rental cars and ANYTHING else that was charged to the county.

    The thing that infuriates me is the fact the Indiana police was apparently complicit in the harassment, sending a detective and allowing the use of the local jail. I want an investigation as to why Indiana police was participating in what is a blatant abuse of power and an answer if this is the kind of conduct we can expect from our police.

    It is called gang mentality. Cops backing cops no mater if it is legal or not. It is so simple to understand. One cop f..ks up and the gang backs him up with lies or if needed false statements to planting evidence. Any one believing otherwise is naive or has not had it happen to them yet. Wait and see when this is all said and done. Wrist slapping with no return of any money earned overtime or not and the public will foot that bill as well and with time will be swept under the carpet as usual. It is how the system is set up, just wait and see but do not expect any real justice. In america justice is blinded by money and is power. Now wear your mask in the hot summer months in fear of catching a winter time cold and having your body fight it and survive like nature intended. Bow your head shut up do not think or ask questions and comply like a good little working tax payer under constant government stress who made the not found in nature sickness in the first place. Remember to wave a flag and believe you are in the land of the free.

    Just to play Devil's advocate for a second....if the San Mateo sheriff will act in this way there is no telling what the Indiana officials were told. Now that this is a national story I'm sure a large portion of the truth will come out. The SM sheriff should hope Mr Real Estate has a job waiting for him because he's most certainly going to lose the one he currently has.

    Different law enforcement organizations cooperate all the time. In this case the SMC Sherrif's office provided a search warrant and felony charges to Cass County Sheriff's office. Cass County would have no reason to question these legal documents, and so would've complied. They did nothing wrong. If it helps with your "fury," consider a child rapist getting away clean because he moved to another county and that county's sheriff refused to assist detectives from the county where the crime originated.     FAILURE TO RENDER GOODS OR SERVICES is absolutely NOT an arrest and detain matter here and nearly every part of the world, it is purely a civil case matter. All the cops know this information going over state lines, and yet still agreed to the matter. All involved need to be immediately fired.

    Straight up abuse of power. This Sheriff himself cut me off on Highway 101 Northbound near San Mateo traveling at a very slower speed than I was jeapordizing the saftey of my child, wife, and myself in the vehicle. I had to move on to the left shoulder (form lane 1) to avoid hitting him and then he moved to the right lane (lane 2) and pulled his badge. I flipped him off as I didn't see his actions acceptable. He then moved over 2 additional lanes to the right and exited the highway. Guess it's all a gang now of who knows who. Thought the mafia era was over.

    They should all be brought up on charges of racketeering and violation of the Interstate Commerce Clause. They clearly used the threat of violence or legal punishment to extort this poor man of his property. Not only did they falsely imprison him, but they also froze his bank account. This is the kind of stuff the mafia would do if they had the legal authority.

Thus impersonating law enforcement, felony theft, felony kidnapping. Not sure what else could be made of it off the top of my head but I hope the business owner hires a good attorney that pursues as many civil and criminal complaints as possible and costs all of those officers their jobs back in Commifornia. Can't be a police officer if you have a pending felony charge/conviction. Hope it happens so we can see it snowball back onto the Sheriff and his buddy in court filings that become a matter of public record.
