Unfortunately, Ruben did not win, Roblox has won on the outside because they have banned him from playing from their platform, legally, which is a big W for Roblox, not considering the fact that Ruben has to cooperate with the corporation (deleting some videos, not being able to release content of Roblox gameplay, etc.)

This. This is why i think roblox got the last laugh. They might have been tarnished but this might go away after some time while ruben was a constant and persistent threat to their image, at least in their own community. The only way i will be able to see this as a win is if something actually happens to roblox like better protection for their users. Otherwise this would have been an expensive loss for no cause, which i really hope won't be the case.

Hey Retro, may i ask what's the movement behind Rubens exclusion from roblox means? I've never played roblox and have no idea how they operate as a platform. The action of removing one of your content creators of your own platform seems never to be a positiv move, so by whom lies the problem? (also, is this a unique case or will this be repeated?)

Sorry to be a downer. This is a terrible ending for this situation. Ruben was forced to settle with Roblox. Ignoring the fact he had to pay 150k, he can’t play roblox anymore. I’d say Ruben was the biggest whistleblower for roblox and now that he cannot be an active part of the community he can’t continue to expose and criticize the corporation to the same effect he had when he could play it. Worst of all it set a TERRIBLE and terrifying precedent. Massive corporations now have seen in practice that they can sue individuals criticizing the way their games are managed. There is no way an individual KZreadr can go to court and fend off a massive corporation’s legal team due to how much lawsuits cost. Imagine if ACTIVISION sued any KZreadr covering the ongoing “misconduct” scandals. They are holding Ruben by his balls. If he decides to continue making videos criticizing Roblox such as his ongoing series about the lawsuit itself they can call it slander, refer to the settlement where it states he can’t make false statements about roblox and claim he is violating the court order. Even if those statements he is making about Roblox are true Ruben can’t fight the lawsuit due to the cost. This whole situation and how it ended is truly disturbing.

Actually he forced them to settle. Roblox even with thier crazy legal teams realized that Ruben had a counter argument and ways to prove defamation of his person. If it had gone to trial and they settled after Roblox would've been out money, or they even could have lost. What Ruben did is force a corrupt company to back down. It might have been a net loss for him but it's a win to the community, and for the wronged. Because trust me if a court found that Roblox was essentially harboring child predators and even employing them, it would be a disaster on a monumental scale for them.

There is no way a single individual like Ruben would be able to even fight against a corporation with literally millions if not billions at their disposal even if that person has evidence of the allegations being false. You can't present evidence without covering the cost of fighting. Ruben was forced to take the cheaper option because he didn't have enough money. The majority of people would have to do the same. Before this whole situation Ruben was able to play roblox, make news on it and criticize roblox. Now after the settlement he lost 150k, he isn't able to play roblox and he has to cooperate with them (like deleting some vids and stuff). They have accomplished their goal of getting him off the platform and possibly even silencing him (we'll have to wait for the future in that respect). I'd even allege that roblox probably never planned to go for 1.6m but just wanted him off their platform as a whistleblower exposing them for all these terrible things and a regular critic made the company look bad. Roblox now has their biggest whistleblower gone and they can move on without even a scratch. People have to know about this or else other companies can get away with the same thing and so we could try even in the slightest to hold roblox accountable.

The fact that big companies can single out someone who exposes their "not so great business practices" and force them to lose over 150 thousand dollars is so disgusting to me.

Doesn’t really feel like a complete win, but more like a Draw, or even a safer option for Roblox. The court case had the opportunity to let Rubin rehash all his channel content and criticisms in a publicized trial, bringing scrutiny to Roblox as a company. Settling reduces all of this into one person’s conspiracy or opinion online, and easier to downplay and deny.

Unfortunately, Roblox was likely never trying to win. This is an intimidation tactic known as a slapp suit. It's used to dissuade others from attempting what Ruben did.

The lawsuit had no legs to stand-on whatsoever, it was an absolute joke. The fact that it got this far is baffling to me. I hate how these big companies think they can bully the little guy.

This isn't a victory. This isn't a victory in the slightest. A large company just made someone critical of them pay 150k in order to defend themselves from a SLAPP suit. That's a horrifying precedent that has just been set by Roblox. Sure, there case was flimsy as wet paper. They knew that well enough to settle. But the fact that they settled and didn't 'win' the case doesn't mean they walked away from this MUCH better off than they were when they sent the suit. Ruben has been effectively silenced, he in a state that would leave other KZreadrs financially ruined, and Roblox walks away with a small dent in their reputation, a large thorn out of their side, and a very clear message sent; "See that person on the other side of the courtroom? He just lost 150k because he spoke out against our company's ethics. And all we had to do was write up a shitty case file against him. "Who else wants to try to say something?" This isn't a victory. This isn't even bittersweet. It's a travesty; this is horrible outcome for this case, and for critical review of large companies.

This really shows how the judicial system is completely unfair to people with less money. Roblox literally tried to defame Ruben Sim and Ruben can't even sue them back because it would possibly cost him hundreds of thousands of dollars. Roblox didn't even need to win, it seems like they just wanted Ruben to drown in debt from the legal fees since the very start of the lawsuit.

Even though he “Won”, this is still really sad. Maybe, this case will be more popular until parents start to hear (tho my faith in majority of parents are decreasing as i hear news like these) and not let their kids play or something, hopefully.

I love how when Reuben released the first part of his defense video, he not only defended himself, but then proceeded to show dozens of examples of Roblox turning a blind eye toward people who actually really screwed up stuff to people, and then further humiliated them by showing how many times they contradicted their own ToS in the report. Bunch of corrupt scumbags, Reuben should be able to keep playing. Although after all the crap that was handed to him from that, I wouldn't be surprised if he didn't want to play there again.

I have been watching Ruben for 2 years now, knowing he won the case makes me happy but also knowing he had to pay 150k its fucking disgusting. I read some of the accusations and its just full of bs. Roblox as a game its alright but as a corporation its just disgusting, I’m so disappointed in them.

When your victory costs you more than most people's yearly pay, it's time to really rethink the system.

I think the straw that broke the camel's back for Roblox, was when Ruben started posting videos criticizing Chinese internet censors and letting people who live under the censors know about the heinous actions of their government through roblox that they wouldn't have known otherwise.

as emotionally and financially draining a lawsuit with roblox would be i kind of wish someone with the funds and will to not drop dead from having to deal with the company for however long it takes would go for it, just to have it become a massive lawsuit/story and have parents take a closer look at shit like this

@Poe Soul I mean, yeah, but if he could somehow win the actual case itself, it could've cause Roblox to just be outright shut down, or forced to have a complete overhaul of the staff, or whatever else. Winning in court would have been the far better victory, it just wasn't really likely that he would.

I was stoked when I heard the news a couple days ago, but now that I've thought about it a bit, the end of this case is a little bittersweet. Ruben lost 150k, and all the dirt of Roblox's name right now will probably be forgotten in a year

Hearing all that I do about Roblox and thinking back to all the other kid-based platforms for online games. Like Club penguin, Bin weevils and Toon Town, all those. I think I'm starting to see why they all closed down and shut up shop. They were dying as a hero in our memories rather than resorting to the stuff we see Roblox now doing in order to stay afloat, alive and thriving. If being buried and having your platform go under is the alternative to all the abuse, gambling and danger the kids are being put in. I think... It's worth saying goodbye to Roblox.

I honestly don't see how Roblox "lost" in this situation, if I'm being honest. The lawsuit did exactly what it was supposed to do -- remove a muckraker from the platform and put him in a large amount of debt at the same time. The only thing they lost was their reputation -- and lets be honest, no corpo cares about that nowadays.

Honestly they got everything they wanted and minimized their losses. Ruben's been fined 150k for messing with big business, he's banned from their platform so he's out of their hair, and after his video they probably figured out that the reputation damage wasnt worth it. If roblox wanted to they could've just dragged the case on and on and make ruben pay for more and more legal fees but he got off easy instead. - People are now aware of the shit roblox is doing on their platform. it's the wins in other ways. it is unfortunate that ruben has to pay for legal fees and get removed permanently from roblox, but in result of this case - roblox essentially omitted that they were in the wrong and had to fold out of the case. so having a relatively small creator versing a mega billionaire corporation and making them dip out this early before the trials got messy is pretty huge.

This is exactly what I think. I think their goal was to get rid of one of their biggest criticizers... And they got their way. Sure- He got away from the legal bills; but the money wasn't actually what they were after.

This story actually got me playing Roblox again. Probably haven't played since like 2014 but I had fun before in the late 2000s

No corporation of such size should be able to sue an average person for that amount. Unless it is something seriously damaging and wrong. Why should a single man pay $1.6M to a multi billion dollar company? It's so great that he won, but that's like a rich man making a homeless give up their clothes for getting too close to their fancy car.

They got him off their platform and set him back 150k. Roblox won. Ruben was just one of the many people talking about the grooming and stock market, but Roblox denied any of it, despite the stock market thing being publicly visible to all. as for shady deals or happenings, Roblox has already stated that, if its not happening directly on their platform then it isn't their problem. where does the pedophilic behavior take place? Not on Roblox. therefore "not Roblox's problem" despite the offenders being very public about what they do. Roblox does not care as long as the cash keeps flowing.

When you go and read the settlement, it actually gives you the image that Ruben lost. Also about the 150k, the settlement reads "IT IS FURTHER ORDERED that a judgment in the amount of $150,000 is entered in favor of Plaintiff Roblox and against Defendant."

as someone whos played roblox for years and being a fan of ruben, im so happy all these vile things roblox has done over the years are being exposed, I'm hoping that they step down and just get some new moderation for their devs and staff team.

For me this would be a half lose half win Roblox gets him off the platform which is a loss but roblox's reputation gets demolished which is a win.

This is kind of a good thing, that roblox lost, but uh. It's almost as if large corporations with shitloads of money have greater legal power than actual individual people. And that… should not be a thing. 150K is outrageous. Paying that amount of money could put someone into poverty.

And worse, it wasn't because of anything actually big. They overblew a false situation, made up false accusations, and made a person with almost a MILLION SUBSCRIBERS of a fanbase waste 150k USD because some grown men at a game platform headquarters had a temper tantrum. Ruben will survive this, but how about the average person? What is stopping Roblox from going after us next? Most of us here won't survive losing 150k in attorney fees, and god forbid 1.6 million.

This is so bittersweet. I mean I'm glad someone was actually able to make genuine impact on Roblox, a platform literally known for barely holding any accountability, but it's still fucked that this guy has to cough up 150k, regardless if it isn't lining Roblox's pocket. I just hope that he can find support online to help lift the financial burden.

There was no real impact on roblox, and idk how people can keep saying this was a win. This was almost the best outcome for ROBLOX, not Ruben. Ruben stopped short of full blown exposing Roblox, holding their nuts to the fire, probably because they threatened to make his 150k legal bill WAYY worse. So, roblox just had to pay their own legal fees, which they were already doing anyway, Ruben agreed to leave the platform which is what they wanted and (haven't read the terms of the settlement myself) I'm guessing he has some kind of gag order, non-disclosure or cease and desist or something of the like preventing him from ever discussing Roblox as a company again after this case, with the stipulation of leaving up his videos he already has. Don't get me wrong, raising awareness is great, but it only works to a certain extent, especially when it comes to a multi-billion dollar company that will likely not change its ways or fire anyone at all. And will likely attract more employees like that in the future and protect them in court. Lets also not forget, Roblox's case against Ruben was NOT dismissed. Roblox and Ruben agreed to settle outside of court, as it literally says multiple times in this video, so no, the legal system did not "take care of" roblox. I get that people want a reason to celebrate some big evil company falling, but this was not that. The company is as strong and greedy as ever

@@PsychoticWolfie I never stated that it was a complete or absolute victory, but I do believe there was an impact. Like Charlie said in the video, at least now parents are more aware of how shitty Roblox is as a company. So no, I don't think Roblox will change literally, what i meant when i said holding Roblox accountable is that now there is more of an awareness which will hopefully result in more people leaving the platform. And that is not to say that the cost of bringing this to public was greater than anyone should've had to pay, and I am obviously still sympathetic towards Ruben's situation. I guess the point that I'm trying to get across is I understand this wasn't an absolute win, far from it, but considering how it could've gone a million ways worse, to pull any sort of victory out of this is more than anyone could've asked for considering the true extent of what Roblox could've done if they truly wanted to.

This brings me much joy.

I played roblox most of my childhood and I can say without a doubt that these problems have been prominent since back in 2008

I hate that my siblings enjoy playing roblox and that there is no good game to replace it with in their opinion... Scariest part is that they have online friends there, whom could easily be really disgusting adults pretending to be kids. Luckily my siblings only talk to them thru roblox. jeez

I'm really surprised for how good ruben managed to handle this case, massive L for roblox

This is called a SLAPP suit. It’s a way to affect a person monetarily as well as emotionally when wrongdoing by a big company is brought to light. It’s an intimidation technique in the legal world. So if Charlie and other big KZreadrs hadn’t brought attention to this, Roblox would have been the winner in this situation. The real winner in this situation now is neither Ruben nor Roblox; it is the people who now know to avoid Roblox.

It seems like a form of censorship. It is easy to see how easy winning a case is if you got the money. Look at the how easy celebrities get off from felonies. It’s just a shame it’s like court is a pay to win game. But isn’t doing this slander. I’m sure that’s illegal.

Charlie wasn't the only person talking about this. Lots of big KZreadrs and media outlets were making comments about this. And tbfh, if anyone was paying attention to the things people like Ruben were saying for YEARS then everyone would have seen this coming.

I think it’s called SLAPP, certain US states have anti slapp laws but some don’t, and I’m sure roblox could choose to sue the roblox KZreadr in any state they want to get the state laws they want. John Oliver and Legal Eagle both have great videos on SLAPP stuff.

@@OddMeterMusic yup, it is called SLAPP suits 😅 John Oliver is how I know about them even though my dad is an attorney who specializes in protecting whistleblowers like people who are discriminated against for a disability that’s protected under federal law by an employer, so kind of like the attorney that represented Ruben.

Its fucked how there aren't any law's about these David v. Goliath type lawsuits. $150k is an absurd amount of money for JUST the attorney's fee's, granted Ruben probably makes more than your average Joe but what if he was a much smaller creator? These companies know what their doing and in the case's where David wins, I think Goliath should at least pay with a finger instead of David being forced to hobble away claiming victory because he "only" lost a leg.

Wtf no, roblox did NOT lose this, they totally won. They cost Ruben 150k out of his pocket whether it was paid to them or not, and forced him off their platform. This is exactly what roblox wanted. They successfully scared off whistle blowers just by writing some words on a doc. They will no doubt do this to anyone else that tries to speak out as well. And while I agree the bad publicity that roblox is getting rn is pretty bad for their image, it really won't be the end of them. How many companies do you know that do stupid shit and still carry on. Remember when nestle was being shat on for stealing water from african locals? Yeah they're still doing fine. The parents that let their children run free on this website, credit card in hand, will likely not do anything after this boils down. RIP Mr. Ruben, yet another victim.

What about reputation? I think this is why everyone is looking at roblox right now because of fucked up shit involving kids. Its the whole player base. Just wait until celebrities add to this when a random journalist asks them the roblox question. People will dive in for the stories and better yet remind everyone what fucked up shit they do. Why? Because kids. There are kids everywhere in the entire globe. African water is not everywhere.

America: We have freedom of speech. Also America: Criticizing a company can cost you 150.000 dollars in legal fees. I'm sorry. But, seeing this as a win is a little too optimistic in my book.

It’s seen as a win because of how rich they are and how long they could just keep bleeding money out of him because of the money they have. It’s pretty obvious looking at the accusations of him that they couldn’t have ever won the case.

It's a win overall While Ruben did lose a lot. Roblox's reputation had been badly tarnished, with many people now learning of Roblox's missdeads and incompetence. I think this case will give others the push they need to speak up against Roblox.

Omg I am glad I found yours videos… I am French and my kid is 9yo. He plays Roblox and I have parental control since day 1 on his account also disabled chat after a while because people would add my son and try to engage conversation with him. But at first I wasn’t too worried until I saw that my son’s favorite KZreadr was a grown adult playing on Roblox and had his whole channel revolving around it.

I was more surprised because as an adult I have never been attracted by this platform. As a parent I check everything my kid does and he only have Roblox and KZread Kids that requires internet. So yeah my surprise was more on « wow » adults are playing on Roblox 🤣

As someone who's been playing roblox since about 2013 (if I remember correctly), its sad to see roblox slowly go down the drain. Roblox used to be a fun site, but as I've gotten older I've seen more and more problems and issues that I don't remember seeing before. And instead of actually fixing their platform, roblox instead decides to sue one of the few people who publicly speak out against their horrible practices that isn't just "haha roblox moderation bad cuz I got banned for saying a normal word". Roblox could be so much better if they actually put money into improving their game (I know they have the money to do it), but instead they waste it on stuff like this. Side note: I wonder what the other 2 videos Ruben Sim was going to upload were going to be. Sad we'll never see them.

I agree, Roblox is just going down the drain as we know it. I've been playing since 2015, and have NEVER remembered Roblox helping 24 year old adults that simp and say stuff like "i wanna suck that #####" and other stuff. I agree with you 100%.
