Rights of Arrested Person | Code of Criminal Procedure | Indian Constitution
“Innocent until proven guilty”, in context to this phrase, it’s very obvious that in India the burden of proof to prove any allegation lies upon the prosecution. Until and unless, an accused is proved guilty, he or she cannot be considered a criminal.
An accused person is an entity who has been alleged to have committed an offense. Our Indian Constitution and CrPC provide certain rights to an arrested person that cannot be taken away.
In this video, we have discussed the most important rights provided to the arrested persons and the duties of a police officer that has to be kept in mind while making an arrest.

On today's world and due to increased police brutality day by day, this rights must known to each civilian and it should not be limited to law students. It must be included to school books as a mandatory subject.

Reality is far different from theory.
doubt!! Babulal was arrested and detained by police under preventive detention law MACOCA. he was produced before magistrate after 2 days. he was not allowed to consult his lawyer during the period of detention. babulal applied for writ under article 226 on the ground that his fundamental right under article 22 has been violated. QUES- ARE the police authorities justified in their action? give reason.

On the last part of the video, I would like to adduce that :- Generally, when a person is arrested by the Police, he is produced before the Ld. Chief Judicial Magistrate (CJM) or Ld. Additional CJM, within 24 hrs from the time of arrest excluding the time of journey. Then before the Court, the Prosecution ( Public Prosecutor) intends to get the Bail rejected, this is commonly known as Remand Filing. Now, It cannot be anticipated that when the Police will arrest a person. In a circumstance Police may arrest a person on Saturday night, but he has to produce the accused before the Ld. CJM by Sunday, for that purpose though Sunday being a holiday, CJM Courts are kept open. It would be inappropriate to say "Police generally conducts arrest on Fridays" !

It's a Latin term meaning "On its own motion". Generally, When a person files a Complaint / Petition before a Court, upon the basis of such Complaint / Petition Court takes Congnizance (getting Known, taking notice of a Fact). If, on a Circumstance, Court takes Congnizance on its own motion i.e. by itself & not upon a Private Complaint / Petition, such would be regarded as Court has taken "Suo Moto" Cognizance.

Great work but dear finology team there is always one magistrate present in the court even there is holiday for the purpose who are arrested on Friday so that police can present the person before the court with in 24hrs of detention . Thankyou

I don't completely agree with ending part about arresting on Friday. Court has to sit not only on public holidays but even on Sundays to hear matters regarding remands and bails

For Friday arrest accused can be taken to executive magistrate. Or any magistrate on duty in nearby.
At 1:59 where you are saying that the right of the arrested person to consult his advocate, isn't it mentioned in Sec 41D instead of Sec 50(3) . Sec 50(3) isn't even a section i think. You can google this. Please confirm

Agr kisi female ki ya ill person ya below 18 year old ki arrest Friday ki jati h and court close h Saturday and Sunday ko to special trial before magistrate at his or her house can be conducted and in non bailable offence bail can be granted basis on the discretion of court.

Right to free legal aid is given under section 304 of crpc 41D right of arrested person to meet an advocate of his choice during interrogation 303 right of person against whom proceedings are instituted to be defended

Sec 50 of crpc has two clauses ,1 &2 how come clause 3 develops there? Instead sec 303 provides with the right to engage a pleader of the accused's choice and again to correct you right to free legal aid is mentioned in sec 304 instead of sec 303

Correction: duty magistrates are entrusted to deal with such matters on holidays. That's why Fridays can't be misused by POs.
