Refusing an offer is not a contract, anywhere otherwise shops could literally sue everyone who doesn't buy from them. But I'd offer to give my details to her lawyer, just for entertainment value. There was a follow up to this post. The babysitter contacted the CB's husband at work and he agreed to pay her, saying something like "I wish she would stop doing this." Her sister reported that he had planned to come over the next day with the cash. If I had been the babysitter, I would have spread the word in the neighborhood so she couldn't find anyone to babysit unless she paid in advance. Then I still would have demanded her engagement ring as collateral in case she stayed out later.

Fun fact: Threatening to sue someone without grounds to sue, especially to get somebody to do something you want, can result in Coercion charges, and repeatedly calling someone the R word is Slander. The followup messages could count as Harassment and emotional distress. The choosing beggar is lucky it didn't go to court, because the guitar seller has a real case against them.

I swear if I hear the words "Verbal Contract" one more time from these idiots, I'm going to flip my shit. A verbal contract would be where both parties agree to a set of terms. Neither party did. She said that her *interest* in buying it automatically meant it was legally hers. The man said no several times when she asked to have it for 400~. Even if a verbal contract is legally binding, there was no agreement here. For reference, here are the elements of a Legally Binding Verbal Contract: Offer and Acceptance: an offer is made by one party which is accepted by another, e.g. the aunt offers to loan $200 to her nephew to get a new tire, he accepts the money with the promise to pay her back in full at a later date. Lawful Purpose: the purpose of the contract must be lawful, e.g. the aunt can create a verbal loan agreement with her nephew so he can get a new tire, but she can’t give him money to do something illegal like steal her neighbor’s TV and have it considered an enforceable contract. Lawful Consideration: there must be an exchange of value (monetary or otherwise) between the parties, and the thing exchanged must be legal, e.g. the exchange of the aunt’s money for the tire and the nephew’s return of the money to pay back the loan, which is all legal. The nephew could not, for instance, substitute his repayment of money with illegal drugs. That's exactly what I thought! Here in Finland that is enough ground for a lawsuit, it's a contract agreed on by both parties and these texts are enough proof to solidify the case. What exactly do you need in America to justify the lawsuit? Because I think that should be enough no matter what, the parent even suggested the price herself! There's been a massive increase in people trying to buy American made Fenders for well below retail price on r/CB. If you're buying a first guitar for a kid get a Yamaha Pacifica or a Squier Affinity, if you want something a bit more then spend up a little bit for a Vintage Modified or Classic Vibe; no kid needs an American Standard for their first guitar, and it'll definitely be a huge waste of money if they decide to give up on it.

That one about the $300 coffee is hilarious. I had an experience like that once. I’m a tax law specialist and one lady told me that if I did her tax return (for free) and got her at least a $10,000 refund she would ‘allow me’ to buy her dinner. I said that this seemed more than a bit one sided, and shouldn’t she pay for dinner if that’s the case. Her response was that ‘my payment was being seen in public with her’.

The pool table guy reminds me of the "friends" I used to have in elementary school who would come over and just want to play on my playstation, would always want to play some one player game then wouldn't take turns with the excuse that they don't get to play at their house and I get to play whenever I want (not true anyway) so I should let them play the whole time they were there.

That first one, just what on earth. Reminds me of a baby sitter story involving a game boy on a private bus system.

I honestly would have given her my contact info so she could sue me. I don't know if American law accepts "verbal contract" as a ground for legal binding, but it's also clear that not even a verbal contract was made. She said she would buy the guitar, which initiated the contract, but was denied based on the grounds of inadequate price, so the contract was not formed. If this went to court, the judge would possibly piss himself/herself laughing at the stupidity of the woman, and she would be left with paying all charges since she obviously would not be able to win a case like this.

Aadem only a few states accept verbal contracts and they aren’t enforceable in court. Anyway it wasn’t even a verbal contract since he said NO several times.

How in any Universe is that an emergency?!? If you called the police for such an idiotic reason you are likely to get charged for wasting their time. All of these examples are civil cases, not criminal cases, for which you would need to hire a lawyer and go to court. Considering the tiny amount of money involved it is v unlikely to be worth your time though. Instead The babysitter should take it as a learning experience and ask for the money (or at least half of it) up front.

Ashley Smith no lmao police don’t only deal with emergencies. If they called 911 that would be a different story. The babysitter doesn’t need a “learning lesson” for doing labor at a set price, the choosing beggar broke the law and can easily get in trouble for it.

@@ashleysmith1276 The babystitter was agree to work for a set payment every hour. The mother refusing to pay is basically committing theft. The amount of money isn't huge but it's still a crime no less. And honestly, people have even been arrested for less.

I looked up the story of the babysitter that wasn't paid because "you got ice cream and a day of fun". They called the choosing beggar's husband and told him what happened, and also threatened to take it to small claims if necessary. Luckily, it wasn't necessary as the choosing beggar unblocked OP and paid up.
