Quarantining the Constitution: The Fight for Free Speech on a California Campus

Nearly a quarter of a million people have watched the viral video of Modesto Junior College student Robert Van Tuinen being told he couldn't pass out the Constitution on Constitution Day 2013. (Watch it at • Students Banned from P... ) But did you know that there's even more to the story? In this video, two Modesto Junior College professors speak out about their treatment at the hands of the college when they refused to take censorship lying down, while Robert Van Tuinen himself speaks about the climate for student speech at Modesto after his successful lawsuit.

    "Students are afraid to speak on campus." Well, that's the whole point, isn't it? And successful it is. Like Orwell pointed out, tolerance is really intolerance. Newspeak is real, and it's here now.

    Yeah, the first time I ever heard of "free speech zones", was when GWB was President and at his re-election convention, there were free speech zones.

    Drew Kelley Sounds like something a self-serving war-monger would write to justify his complicity in America's criminal and never-ending Wars of Empire. Actually, IT IS the reporter, the poet, and the campus organizer that are vital to keeping our Democracy strong! While the young man in this video made the (IMO) immoral decision to align with a criminal and bloated military "so that he would have some money for college," I still defend his right to practice free speech once he comes to his senses and returns home.

    I'm glad neither campus I've ever attended had a free-speech zone. We did have to reserve rooms and such for club events, but there were many options for us.

    A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. 2nd Amendment. If someone tries to suppress your right to free speech as expressed in the 1st Amendment, isn't the 2nd Amendment the means to protect the rights of the people in order to keep it a free State?

    According to the USA's founding documents, it already is one big FreeSpeech Zone, and only tyrants are ILLEGALLY restricting freespeech in certain areas are violating this & other "natural rights," and thus it is your right -- and duty -- to fight them for denying your "natural rights" as you see proper, including violently.

    why are these lawsuits happening there should never be a climate politically or socially where FREE speech is restricted to a specific zone, in fact the U.S constitution designates that any and all U.S claimed territory to include our states and of shore outposts as free speech zones. In other words any U.S territory is a giant continuous free speech zone.

    The best way to have Free speech is merely to speak Freely.... and if the authorities have a problem with it, then it is their problem to deal with, not the free speakers problem at all. In the end the best speech will "Win" if it is truly the best speech; of course, you prolly already know this.

    Rob, if you read this: I'm curious to know what you think what have been an appropriate restriction on your speech, on the administration's part. Obviously you thought they made you jump through too many hoops to express your message but, does a public school possess any right to spell out how and when people speak and distribute items? I'm feeling that the answer is somewhere in the middle and that the real substance of your claim was that MJC created an unnecessary burden.

    they wouldn't let him hand out the constitution of the united states on a u.s. tax payer funded campus and you think there is a middle ground for that? this protects all free speech on that campus regardless of the politics involved. college should be a place where your values and politics are meant to be challenged. not to change your mind but to allow you to learn how to openly support and defend your convictions in a proper manner. being shielded from dissenting voices does not do you any good as a student or a citizen. being shielded from the dissenting view is why you see videos of 23 year old ivy league juniors crying instead of debating when they are challenged. maybe it is just me but it seems as though people in this country are openly welcoming totalitarianism. if they are not welcoming it they are at least complacent about it creeping into our lives.

    I am all about free speech, but aren't we talking about a Jr College?? (the13th grade) in MODESTO?? I think you might be going too far, next you will think all junior college kids should have full rights - and that is just crazy talk;)

    you are so f'ing right. certain groups of americans do not deserve the same rights as other groups of americans do. we need watchdog groups in america to make sure that the proper people are given their proper rights and that the others don't try to get the rights they are undeserving of. we should probably even segregate those people we don't want getting their share of undeserved freedoms. separate schools, separate water fountains, ect. at the very least we should make them wear a symbol on their clothes so those people can be easily identified and dealt with accordingly.
