Funny how utility companies and railways never have the problem of their easements getting sold out from under them.

These government officials are going to roll over and let these landowners do what they want.

The government officials are the ones who own the most private property next to public lands.

The landowner is violating ORS 166.025 (Disorderly Conduct in the 2nd degree) for blocking a public road. Someone should go exercise their right to cut the gate down.

How can there be a land owner and public property

It's called an easement. I.E., in most cities the strip of grass between the sidewalk and the street is private property but also public easement. You can get cited for blocking the sidewalk even though it is technically your property.

@@terrapinrocks So I guess people can drive all over my side walk just because they have public access. My gate that leads into my home should be removed then because it stops people from pulling into my property without my knowledge. The gov can't pick and chose what is public or not without investing their own money into it. The dude owns all the surrounding land for a decade but he's not allowed to expand or build because others keep driving through his land? Fuck that the local gov should've built a new road if they lost the property rights to the land. We're talking about a stretch of land and road not some stupid side walk that you need to pay a $200 fine because some ass-hat dropped a wrapper in front of your house. If I'm parked in my driveway I block the sidewalk. Is the city going to charge me for keeping my car parked in one spot? OR are they going to help invest money in order to make the house they sold me up to " code ". It's just more shit to get more money outta our wallets. Every person that ignores his gate and drives on his property ignores his property rights because of convivence

@@godzilla42698 Hey Moron! The USFS legally acquired an easement from the land owner. That became a legally binding agreement by both parties. The land owner unilaterally put the gates up without permission of the USFS, who now has legal property rights thanks to the easement agreement. Essentially, the owner changed his mind about the easement which is not allowed - that's why there are things like legal agreements. Also, moron, when a home is built an application for a permit is needed. That permit, along with city codes, define the public's right of way on sidewalks. That is part of the agreement made when a property is purchased. That also means you are NOT allowed, under most city codes, to park your car to block the public's right to walk on the sidewak (across your driveway). It also may mean that you have to keep the sidewalk in good operating order at your expense. Again, if you don't like that idea, don't buy the property; otherwise, shut up, and deal with it like the rest of us. If you don't like city codes, move an unincorporated area. Of course there too, there are restrictions, but they are fewer. Some counties in Nevada have almost no restrictions at all - good luck with employment in Goldfield, NV, however. The thing is here, moron, is we live in a society. Societies have rules and laws that are designed to help people get along as much as possible. For example, it is illegal to punch somebody for walking on a sidewalk in front of your home. Yes, you are welcome to do that, but there are consequences for that action. @O_O_ZOMBIES it must be refreshing and freeing to not be encumbered by the thought process.

Here's how you work with the private land owner in this case. "Remove the gates or lose your property. End of discussion."
