Physician's assistant committed an illegal/unauthorized digital rectal assault behind closed curtain inside hospital ER; pending MRI study/dx to confirm CES. This was reported promptly as an unwitnessed assault, without my consent; that is somehow omitted from my medical records. Zip, zero, zilch!! Fighting for accountability.

My surgeon left bone fragments, had to have a second surgery a week later. No accountability.

I took an action against my doctor who failed to diagnose that I may have a disk problem. After 18 months of seeing him and my symptoms increasing, I ended up in hospital with Cauda Equina Syndrome. I came home from hospital in a bad way. I decided to consult a solicitor and a negligence case began. Shortly before proceedings I was warned by my solicitor that my beloved 10 year old son's death, 7 years prior, would be used against me in court. I was horrified that these tactics would be used to make me look emotionally unstable. I withdrew. No-one was going to use my innocent beautiful little child against his mother in a court of law. I have carried the anger around with me for 25 years.

I'm so sorry to read that. I don't know why they would attack you for your emotional state as that obviously would not affect your physical disabilities nor would it affect whether or not the medical professionals were competent or not. Its disgraceful what they will attack in order to discourage a case :(

I'm of the opinion that it was lawyers tactics to promote an 'out of court' settlement. The Medical Profession experiences litigations regularly, The lawyers for the prosecution and the defence want a quick and easy outcome for the Doc/ Hospital. With my case there was a bit of fear-mongering going on, saying that the defence also has a strong argument and if it is battled in court it could either see me with a much-diminished sum or none at all. and there was the constannt reminder that..... "you know, most people settle out of court anyway" I didn't care, I knew I had a lock solid argument to say if my operation wasn't delayed by an incorrect diagnosis when I first presented, I would have undergone emergency surgery to comply with the suggested 24-hour time frame since onset. Therefore I would have been more likely, than not to fully recover. If my mediation didn't produce the amount of settlement my lawyers and I calculated there is no question I would have seen the pricks in court. I am carrying this pain and symptoms with me now for the rest of my life. My lifestyle has been turned upside down. I lost a relationship because of it. Psychologically I am no longer the positive, happy and enthusiastic person I was. CES has affected me physically, emotionally and mentally all because of a lazy interned Neurosurgeon and a Radiologist that couldnt be bothered.

I’m so sorry. Let go of the anger, it attacks every cell in your body. I too have Cauda Equina and am looking for a lawyer in the US. I’m confident that I had the initial injury 10 yrs prior to my diagnosis but they kept taking X-rays over the years instead of an MRI
