Oscar Pistorius Trial: Wednesday 12 March 2014, Session 2

A forensic investigator, Lt-Col Johannes Vermeulen on Wednesday used Oscar Pistorius's cricket bat to demonstrate how he would have struck the toilet door through which he had shot Reeva Steenkamp.

    Why I believe Oscar Pistorius is lying: 1)If there's a burglar in a house the first thing anyone would instinctively do is to check what damage has been done. . .did he break the window, did he open the ceiling, are the children there, is the wife there... that is the first thing a person does. So his lame duck excuse that he forgot to check whether Reeva was in bed, but willing to shoot a burglar is absolute nonsense. What if the burglar was with Reeva... using her for a human shield? There is NOBODY on the face of the planet who would start dealing with a burglar until they know what lives are at stake. Secondly, why did he NOT call for her? Again, any normal human being would, irrespective of the amount of fear, call out to ascertain the identity of the person before shooting. What if it was a prank? What if they were planning a surprise dinner, and the bathroom was filled with his friends and family? (It was Valentines day, after all) Oscar is lying... Oscar is lying... Oscar is lying.

    I reckon he struck the door before the shooting. My guess is that she had locked herself in the bathroom after a domestic which left her in fear of him. He wanted her to come out, so he started beating on the door with the bat. She screamed. He shot her through the door.

    How unbelievable, bordering on surreal, it is that the witness himself is making what amount to legal argument/objections to questions that the prosecutor himself should be making?! Vermeulen is asked about whether a man on stumps would lose balance etc., which he clearly is not competent to provide any opinion on. But rather than the prosecutor objecting to the line of questioning, the witness himself has to!! And the objection is accepted by Roux, so evidently it was a valid one. Thank god some of these witnesses are brighter than the lawyers.

    ok here is my take on this, Reeva took his legs and phones into the bathroom because she was pissed off at him, he in turn raged when she did this and being adept at moving on his stumps all his life just grabbed the cricket bat & tried to get in the bathroom & failed so he got his gun and fired killer her, then got his legs, put them back on and called security, hung up & tried to figure out what he was going to do! just ma amateur sleuth thoughts

    The difference between SA and US courtrooms is that most witnesses are not asked to tell a story. They are asked to answer with 'Yes' or 'No' responses for the most part.

    If Oscar was a bed-ridden patient who had been attacked many times and was living in constant fear; his statement would still be questionable. But now Oscar is a world-class athlete, he has agility and speed, he has power and strength, and despite his disabilities, he has built enough confidence to compete on the world stage. How then does he suddenly assume the role of a highly-pregnant mother of 10 babies to crawl over to the bathroom floor and start shooting out of "child-like fear"? And four bullets? I don't buy any of this. I can see the judge kinda likes Roux. . . I pray it has nothing to do with the verdict!

    I think not having his legs on suggests that he was chasing Reeva, not going to confront a burglar. If I feared for my life, I would minimize my disadvantage before exposing myself to the danger. But OP wouldn't have feared Reeva and could probably move much faster on his stumps that we imagine, having been that way since he was 11 months old.

    Why bother checking for fingerprints? Why focus on the bat at all? Unless they can prove the shots were fired AFTER the door was hit with the bat or the bat was used to hit the victim it's pointless.

    TheExplosionist Because OP wasn't on his stumps. The bastard probably still had his legs on during the hours of fighting before she finally grew fed up (or terrified) and went off to the toilet room with her cell phone and locked the door. He then chased her down and shot at her in a blinding rage. After he realised he had killed her, he got the bat to break into the room to get to her. OP's fabrication is that he and Reeva were both sleeping in the bed until he "heard a noise" coming from the bathroom so he grabbed his gun and immediately ran to the toilet on his stumps (without putting on his legs wasting time) so he could catch a "burglar."

  • @GooglSucksDisk

    @GooglSucksDisk

    10 жыл бұрын

    I don't care what OP, Roux or the forensic investigator claim. The door will prove that he chased her down in haste and shot and killed her with his legs on, because he was NOT sleeping when this mysterious "noise" came from an intruder in the bathroom. OP claimed a year ago that they went to bed around 10 and he was awoken by a noise from a burglar in the bathroom so he quickly bolted to the bathroom on his stumps to catch the intruder. They were not sleeping - they were arguing, as all the neighbours heard. But even if the two were in bed, awake, arguing, OP could have put his legs on to go after her once she ran off to the bathroom. But that's not what OP said had happened a year ago.

    flowerblossom To me, whether he had his legs on or not can only prove truthfulness,and maybe support timelines, but won't prove whether it was premeditated or not. The man has lived with stumps since he was 11 months old, and I bet that, while it's obviously a huge disability, he can move faster on them than we can even imagine. And it seems to me that if you feared an intruder in your bathroom, you would put your legs on before you investigated to minimize your disadvantage if you encounter that intruder. What would make you more likely to run around on stumps is if you were in a fit of rage and not afraid of the other person..

    It's too bad for Pistorius that this didn't happen in Florida. Under Florida's Stand Your Ground law there wouldn't be a trial. Since he said he feared for his life, he wouldn't be charged, let alone reach trial. He wouldn't even have to provide serious reasons why he was afraid or that it was reasonable to be afraid. If citizens of all the US states with Stand Your Ground laws don't pressure your legislatures to repeal them, we will continue to have many, many more of our own Reevas, Trayvon Martins, James Davises, and countless more. Our trigger-happy people need to know there will be serious consequences when they are not really justified by self-defense.

    What's happening NOW...... 3/13/14 (7:55 am) Regardless of whether or NOT Oscar was on his stumps did NOT give Oscar the RIGHT to go BLASTING away withOUT checking to see if Reeva was in bed or in the restroom and IF Oscar called Reeva's name out and Reeva WAS in the restroom, then WHY would Reeva NOT answer? Was Reeva indeed HIDING from Oscar? If she was, you can rest for SURE that Oscar KNEW IT! Also, the arguing PRIOR to the GUN SHOTS is a MAJOR factor as well as the MASSIVE screams that were heard by neighbors BEFORE the shots were fired and IF witnesses have testified to hearing screams in the middle of the night at a GREAT distance PRIOR to Oscar shooting Reeva, then Oscar had NO CHOICE *but* to hear Reeva screaming and KNOW that it was HER because Oscar was RIGHT UPON Reeva *SHOOTING* here. Nevertheless, with Oscar HEARING Reeva, he CHOOSE to FIRE AWAY and SHOOT Reeva and CONTINUE to shoot Reeva DEAD! Inasmuch, the *PROSECUTOR* (never) stated that HE claimed as of that Oscar was NOT on his stumps. So, that is NOT part of the PROSECUTOR'S argument now. Oscar being on his stumps is STATE testimony as it was JUST proven. According to the DEFENSE attorney, in Oscar's statement, Oscar said that AFTER he shot and killed Reeva, he went and put on his legs and THEN beat the door down but EVIDENCE has proved that Oscar beat the door down withOUT wearing his legs. Again, Oscar was COMPLETELY on his STUMPS when he beat the door down. So, Oscar LIED. I don't know WHY Oscar felt that LYING about wearing his legs to break down the door, would help his case. Answer back with your speculative thoughts......

  • @HaveYouHeardMe
    @HaveYouHeardMe10 жыл бұрын

    SEEMS LIKE..... written 3/13/14 (9:32 am) Oscar had ON his legs BUT knelt down while SHOOTING and while HITTING the door to make it appear that he was at a disadvantage OR is Oscar just THAT STRONG to where he has GREAT BALANCE which ALLOWS him to SHOOT a weapon that's SO POWERFUL and BEAT DOWN a door with a cricked bat, WHILE on his STUMPS? It IS possible to have stumps ON and therefore USE THEM as LEVERAGE while committing such acts. Without getting TOTALLY conclusive at this point, let's just examine the evidence to broaden speculative thoughts....

    What the Adv. Roux is asking of Col. Vermeulen at around the 40-odd minute mark is extraordinarily strange. If you are striking the door with so much force that it does - as Roux said in earlier cross examinations - sound like a gunshot, your body would be in *the* most forceful and natural position possible. Bending at the waist is not a forceful or natural position. It prevents the recruitment of all the necessary musculature to strike the door with that much force. Just like you can throw a punch from the shoulder... you can indeed do this to demonstrate a fixed pattern of movement, but it will never be as powerful as a more natural punching movement where you plant your feet and rotate through the hips as you throw the punch. The Col. clearly knows what he's talking about, and Roux is undermining his own defence - in my opinion - by suggesting Pistorius would have been wasting energy when striking the door.

    according to the laws biomechanichs there is no way that Pestorious could have been without his prosthetic legs - you simply can't deliver a 80 kg punch by just using using lumber muscles and deltoids. A strong swing appears when the actual strain initially generates hamstrings and then is amplified by gluteals then lumber muscles and then by deltoids and then reaches maximum force through energy transfer to triceps.

    Yes, but the adrenaline rush of having killed a person could result in anything. If he could shoot the gun without his prosthetics, then he could have delivered the much disputed whack on the door. His behaviour, all round, is scary. I'm convinced that Oscar could have done many things that night that would never be answered using any law. My heart is only broken that he violated the law of common sense so badly. Before you shoot, give a warning shot, and (very importantly) seek to identify the target!

  • @ARIES9327

    @ARIES9327

    adrenaline rush would weaken the whack in this particular situation - the muscles because of adrenaline are contracted and do not allow large amplitude motions - and there is a big difference to pull a 1.1 kg trigger and deliver a 80 kg whack. If you think that there is a bugler in your washroom which is kind of odd because normally there is nothing to steal in the bathroom and no burglar would lock himself in the bathroom he would rather jump back to the window which is next to the bathroom door, anyways if you think there is a n intruder and for some reason he locked himself in the bathroom then you might wanna be in good shape to run at least you take the gun then you put on your "shoes". I mean his logic does not make any sense. I am absolutely sure it was a premeditated murder unless this guy is a schizophrenic or something ...

And again under normal circumstances (and I believe my stats would be right) More than 98% of people on the planet would rather scare a burglar off, than have to shoot him, since you do not know what weapons burglar has and what his intentions are. This case should not have gone on so long, as this only adds to the pain for the bereaved. Oscar intentionally shot and killed Reeva. Intelligent people don't stick with a preliminary theory that they themselves subsequently prove wrong. The state has not argued during the trial that he was wearing his "legs." That was their belief up through the bail hearing at least, but dropped when the forensics showed otherwise. You don't make your final case before you begin the in-depth testing and evaluation by forensic experts. But you do have to have reason to arrest and charge the person to begin with.

    He has the advantage of a 9mm parabellum. That's a great deal more than an equalizer. And testimony by him, as well as his former girlfriend, were that is was always within his reach when in bed. According to other testimony, it appear that he was uncomfortable if he didn't always have one on his person or within reach. But he didn't have to get out of bed to kill her. It could have started in bed and she had the jump on him in running away from him. But why would she run to the bathroom? Maybe because there was no door or wall to put between them on the doorway or below, based on home photos, and he would have a clear, unobstructed shot? Maybe she watched a lot of TV and therefore believed a door and wall would protect her? But you bring up an interesting point I hadn't considered. You may be right.

    JULIANA anddrade Pistorius is highly mobile on his stumps. This has been stated many times before. In his testimony he has also stated he "ran to the balcony", "ran to the passage" etc. all on his stumps. The fact that he resembles a short person (125cm, or thereabouts) on his stumps doesn't matter. He's still a physically strong male *and* constantly making people aware he's in possession of a firearm. He's also stated the bedroom door is locked at night, so that wouldn't be easy to escape through (if that is indeed the case, that Reeva was trying to run away from him) and there's no door on the bathroom but there is a lockable door to the toilet. Logically - taking this into account, if he prevented her from getting to the balcony to call for help, the toilet is the only other option.

    But if the bedroom door is locked - as it was, and it would take you time to unlock it and get out of it, and you would have more time to get yourself to a safe place if you ran over a greater distance (as you say, she would have an advantage - even though he's highly mobile on his stumps)... then it's logical you would do that in a time of panic. That's even assuming that she was able to get to the bedroom door... perhaps he confronted her in the passage, and the only place she *could* retreat to would be the bathroom/toilet? I'm sure she never thought, if she did indeed run away from him, that he would shoot her. She would maybe fear that he'd hit her, but I doubt she'd entertain the idea the man she loves would shoot her.
