    I really enjoy your channel, but I think I have to call you out on this one for two points: Mr. Bays outright hostile tone in the initial interaction with the police (which forcefully escalates the situation considering they are there because they think he may be tampering with police vehicles.) He immediately attempts to flee when confronted, ignores lawful commands, and refuses to let the police explain the situation until they finally have to cuff him. You ignore it in the beginning, but you yourself even call this out during grading. I believe that should bring his score down to a B- or even a straight B. The second point is when you bring up that the PD doesn't have to "verbally Identify." You say that it's true they don't have to, but spend 2 and a half minutes going into why they should (especially the section on entering homes? that isn't even relevant for this video!) If you are going to be "auditing", then you can't punish the PD for not doing something they legally don't have to. I don't know if it would raise the score personally, but as much as you criticized the PD for distorting facts I could say you were doing the same this time.

    Much more, it supports *the detention was extended out of retaliation because he was invoking his constitutional rights.* Officer actions that are otherwise legal can become illegal if done for retaliation, harassment, and intimidation.

    This is the very specific reason I watch ATA. I do miss the other guy, sometimes, however. They are still great, however. Lackluster gives the same thing but with personal opinion, which is why I prefer ATA.

    Too much credibility is given to an anonymous 911 call. The officers should have said they got a call about a suspicious person matching his description. An open conversation beats a nasty accusation before facts are known. As a retired 911 supervisor I’ve seen too many errors due to simple misunderstanding. 911 needs to report facts only, their personality has no bearing.

    Agree. This seems to be a problem with humanity and id imagine (hope) officers are trained to be suspicious of the call as well as the situation they walk into. Seems stressful for all involved. Thank you for sharing your experience.

    I work dispatch as well. We can’t report fact only. We can only report what someone says. That may be fact but it may also be opinion or lies. It’s up to the officers in the field to make those determinations.

    You are so right, CJ. It's a common problem seen on practically every auditors channels, where the caller gets God's honest truth credibility, even if the auditor is cooperative and tells the officer exactly what was going on. Example,in a recent video I watched, that took place at a post office, the guy went outside to wait for police, when the officer arrived, the auditor explained in detail poster 7 rules of conduct on postal property, and the postal employees camera phobia, being the only reason for demanding he leave, and be trespassed. The officer never even attempted to go inside, and read poster 7, and took the postal employees word, even after verbally stating he was unsure of his jurisdictional authority, and he didn't have jurisdiction, since postal property is federal, and postal inspector jurisdiction. I was shocked by his behavior,as well as that of his backup, and supervisors ignorance, and their failures to just go inside and read poster 7. As a retired postal carrier, I'm amazed at how many postal employees are totally ignorant about poster 7, it's been the policy for decades virtually unchanged, although periodically updated. Which highlights the lack of personal professionalism to be the best you can be at what you do. that's obviously missing these days, and it spans across the entire public service employee's spectrum. Your statement here, shows me, you had proper upbringing, that instilled being the best you can be, at what you do. And I thank you for that ,and your service to the public.

    @@cooloutac a simple sign works just fine. My local pd has it on their personnel parking lot and it's 100% legit. So they have 3 parking lots. 1. For police vehicles (gated) 2. Personnel parking (posted no trespass sign) 3. Publicly accessible parking (no signs or restrictions)

    @@juandoe2994 True, but alot of these auditors will then say they didn't see it. They have to put it in a better place. Or in the case of your signs, none of them state pedestrian. Does the no trespassing sign literally say that? Or does it say Personnel parking which is what they say at most precincts which is not good enough. They will then say well I don't have a car it doesn't apply to me, I'm not parking. They need your 1st example. gated. I'm from NYC, I don't know of any precincts that have a non gated parking lot for any cars at all. You have to literally park on the street. And thats all BAT is accomplishing costing taxpayers money.

    @@ESPLTD322 okay that’s just bull, if the cars on private property it’s no one’s business how often it’s driven. that statement is way too broad. i too hate people leaving cars on the side of the street or in public parking lots but you didn’t even specify. so my question to you is did you just not bother to be specific in your comment or do you truly think people should have to sell their vehicles if they’re not driven once a week, regardless of where the vehicle is stored?

    I don't get how the disability laws haven't required verbal identification from officers. Someone who is impaired may not have the ability to read, hear, or see. Thank you for the videos 👍

    It's not really hearsay outside of court, but I know what you mean, based on a 3rd party. And The 911 operator should have asked the person if they actually WITNESSED him touching the car, or if that was an assumption. ESPECIALLY if you're going to arrest somebody based on it. Because people say there are assumptions when speaking to police all the time.

    it has to lead to far more than a brief detainment for charges of false report to occur. The thing about police work is public perception is huge, and if police started arresting most of the people that call.... people will learn to just not call when they see stuff they legitimately think is suspicious. So the dumb people that report obviously not suspicious activity would cause the people seeing actual suspicious activity to decide not to call.

    This video is now a couple years old and the police statement says that they've brought in experts to evaluate police interactions with the public and make improvements as to professional conduct and being within the law in their policing. We all know that if anything in the last couple years their conduct and professionalism has totally gone out the window and they are purposely totally out of control from the top down.

    I was less concerned with the video, it was almost entirely factual, right up to the point about the complaint form interaction. This seems to be a recurring issue with police departments intimidating citizens who want to file a complaint. We shouldn’t even have to ask for it, it should be a pdf available online and copies in a folder in the entrance to the police station.

The announce requirement is to say "Police" before entering, not to knock and say it's Officer Joe Friendly Badge # 007 please open the door." ATA is getting wacked.     I sincerely hope that if a concerned citizen calls police because a suspicious character seems to be messing with the cars of the haters on here the cops just blow it off and let the guy walk away (with your car stereo under his jacket). Wouldn't want to violate his rights by asking what he was doing after a 911 caller implicated him.

    The ACLU has resources for people with cases that local attorneys don't want to file. But, if you can't find an attorney to file a case, then it's possible there's no case to file. Not every violation of your rights leads to a civil trial, it generally has to be egregious. If, for instance, the police prolonged your detainment to wait for a drug dog, that would be a violation of your 4th amendment rights that can lead to dismissal of charges but doesn't rise to the level of what you need for a civil trial. I mean, it's America so you can sue for whatever you want, but lawyers don't like to file suit against the government when they know it's a losing case.

    The problem is many of these cases take years to litigate in courts. So it’s not always that there even is anything to report for several years

    Audit the Audit analyzes incidents that are uploaded to youtube, and he provides the legal ground in a sound and responsible manner, which I'm sure is a lot of work. To now research the outcome of these cases would be a whole different endeavor, and I don't think we can expect such an endeavor to even be actionable or realizable.

    Do a video on the use of handcuffs.. it seems that alot of encounters that start off as consensual suddenly become detained in handcuffs simply because the subject refuses to cooperate by answering questions. It's odd that they aren't in fear of their safety until they refuse to answer questions.

    Absolutely. Handcuffs should be considered an extreme rights violation to be used in only extreme scenarios where there is RAS to detain someone.

    For most Departments, handcuffs fall under the use of force policy. A lot of Departments can detain you using handcuffs for "officer safety". That's the only reason they need unfortunately. For example: You can literally walk up to someone and detain them using handcuffs to question them. That's really all there is to it and that's a damn shame.

    @@Sadows12 yep. And so we need more clarification from the courts as to when "officer safety" can be used to put someone in handcuffs. It is being abused by police as an intimidation tactic which should be considered a civil rights violation.

    Laws are written by attorneys, mostly, and ruled on by attorneys as judges. Convoluted laws are just good ol' job security.

    It would fix so many of these issues if cops would stop digging for any excuse to arrest. These interactions constantly come down to the cop using the absolute maximum amount of force. Or the maximum charges possible. Making it clear that the laws restricting the tyrannical nature of the police are not only vital but also need to be expanded.     That is one law that I would support. It should be illegal for police and LEOs to create stings and bait cars and all that. There is plenty of crime that goes unsolved, but police are creating more possibilities for crimes instead of investigating the unsolved ones.

Not only that but they use those situations to learn more about how the crimes are being committed and the techniques/tools they should look out for

    The problem with videos like these is that the people put themselves in situations where any reasonable person would conclude that person is acting suspicious. Just because you are not technically doing anything wrong does not mean that the police are wrong for investigating and asking questions to determine the actions of someone.

    Exactly ! After watching multiple vidios its clear most of these auditor's purposesly taunt the police it seems just to argue their rights or collect money by provoking the police into violating their rights ..im all about the constitution but totally against purposely provoking or taunting the police to prove a point or in most cases an opinion of rights often with limited knowledge of the law to begin with.

    @@wilclif lol, arguing fuzzy areas with people that often have a superiority (like god) complex and gun is foolish ..from watching these vidios it seems most of these auditor's are lacking knowledge of the law and . Using time and resources to prove ,in most cases an opinion. Tuanting the police or testing them is no different than making a false 911 call and if these auditor's continue pressing the issue the courts will find away to minimize more of our rights ..this is just a common sense opinion of course but im sure my opinion will soon become a fact if this kind of thing continues..

    I am absolutely astonished by the court ruling. Training is the Only way to ensure people perform their jobs correctly. If you allow police to use their feelings as a guide, you end up with all of the problems we see so many times. That court ruling literally reinforces the idea of guilty until proven innocent.

    @@balmorrablue3130 I honestly don't know what that jumbled mess of a sentence is trying to convey, but Thomas is flying around with rich people that have an interest in his legal decisions and Scalia had many gems, such as: "If we cannot have moral feelings against homosexuality, can we have it against murder?" "There are those who contend that it does not benefit African Americans to get them into the University of Texas where they do not do well, as opposed to having them go to a less-advanced school, a slower-track school where they do well" "Certainly the Constitution does not require discrimination on the basis of sex. The only issue is whether it prohibits it. It doesn't." For what its worth, I don't think highly of any member of the court.

    Bay Area Transparency is one of the best out there. His occasional use of "vulgarity" is not only protected speech, but never, in my experience, used without a legitimate cause. There are other auditors who purposefully, taunt, harass and antagonize public servants. Even they have the protection of the First Amendment. The majority of audits that I have seen reveal that public servants are the ones who need more consistent, in-depth training on public photography, de-escalation, and basic knowledge of our Constitution.

    I want to second that compliment. I think this video is important because it shows the three parts of many police/suspect encounters that in many cases that end in tragedy. Since this case did not end badly, there are no strong emotions that might make people immediately take sides before a rational evaluation. First, the 911 caller speculated that the guy was tampering with the cars. In this case, the speculation was minor. I have heard people make such amazing jumps in fact that the officers tend to be on very high alert. Second, the police officer enters the scene a little confrontational. However, it could have been much worse. Third, the auditor appears to be unreasonable. Although his actions may have been within his rights, given where he was found, he should have at least have stopped. This video shows how bad the relationship between all parties that frequently contribute to tragedy. As in this case, all three parties acted reasonably well if you only look at one point of view. But taken on the whole, they all need to think about what they are doing. And, learn to treat each other with a little more compassion.

By never, I mean that I can’t think of a situation in which I think the overall outcome would be better for having police involved. At best it’s a waste of time and in most situations having the cops involved will just lead to more problems for you.

    @@trippmoore I really wish that I could disagree with your comment. But, in most cases it just isn't worth the risk. A few months ago I called 911, that was probably the last time I will. There was a guy who looked passed out or unconscious. I called to report a car break in. When the police came, they started questioning me like I was a suspect. I repeatedly told them that I was the one who called. They tried to tell me that they were just following procedure. When I challenged that, they pulled the old "you match the description of" garbage. By this time a supervisor showed up who knew me. When he saw me, he motioned the cops away. They had a quick chat and the original cops left. The officer I knew did that apology non apology thing. He said that they had got a call that a black guy was breaking into cars. I told that was not true. He hemmed and hawed for a while. I just looked at him and said "okay, I'm done."

    RAS Was not established at any point, no officer saw him doing anything suspicious at all. All they had was heresay and the complaintant never decribed an actual crime in progress. Reguardless of "how close the stop was to a school".

    This where i feel audit the audit drops the ball. If going to offer FULLY unbiased review of situations, then need to point out where the cops alleged reasoning for detention at least APPEARS to be a lie, and , therefore, it APPEARS that they are even more in the wrong. In a number of cases there is ample evidence to back up that assertion (one being here as they never checked said brake lines, and many others where they claim break ins at the police departments yet never offer a report number to verify that when asked/requested), and said assertion gives a much much clearer picture to issue a final grade of. They can lie to citizens but they cannot lie on reports or to the court, so the basis of their reasonable suspicion that they claim cannot be a lie.

    @@Ivang017 On top of that, a cursory inspection of the area would reveal no tools, no weapons in the immediate area, nothing with which he could have used to sabotage a vehicle. Unless we're assuming he's got REALLY sharp nails...there's no reason for them to suspect he's been tampering with the cars.

    It's ridiculous when cops are asked for name/badge# and reply with "It's right here on my uniform" as if someone wants to get that close to be able to read them... most likely resulting in being slammed to the ground because the cop felt threatened by someone being that close to them.

    Ask them to identify right away. If they try the "right here" then tell them they are a random nobody that youre not engaging until they ID.     BAT does quite a few audits. And he does push the limits of what an acceptable audit should look like. But, importantly, he limits his emotional outbursts to words. Calling cops 'trash' and berating them for being dumb cops is still protected speech. A cop's ability to put his ego in check and let a citizen vent at them without repercussion is an important element of their job, and auditing police for their reaction to protected speech, I'd argue, is a chaotic good.

    You all missed the point period of this audit. Does looking like a homeless draw a different treatment from the police than looking like a working person. But because the auditor is crass and brash with the officers his audit suddenly is the jerk. This society today is way too sensitive. Everything he said was protected, just because it hurts the feelings of the officers or other people doesn’t make it a crime. He was showing that their response to emotion being displayed is not proportionate to the displayed emotion(s).

    Do you understand what an auditor is? Its all a test to see how the cops react him saying he wants to be left alone is technically what the cop is supposed to do since he hasnt done anything illegal. "Mr bay" is meant to poke and see if the officers are going to react the way they are supposed to. (Cop didnt really have to waste as much time as they did. They chose to make the interaction longer than needed.)

    @@madcamdisease The problem with his tactics is that he was operating in bad faith, the very problem he’s ostensibly addressing. So the message becomes “Cops operate in bad faith, therefore one should operate in bad faith to instigate a reaction.” That doesn’t solve anything. It just reinforces in the minds of the cops that they’re justified in their bad attitude towards the public.

    As per quoted "mere presence within an area to be determined such is not probable cause in and of itself" If this were the case it would completely undermine the whole point behind reasonable articulatible suspicion. Quite often an officers idea of RAS will drastically differ, especially compared to that of the suspect. It's not exactly BS, it is however often a reach in determining wrong doing. The real BS is their entire reason for the investigating appeared to drop by the wayside once they determined themselves having enough for a detainment.

    Oh, I don't know, when was it the duty of citizens to defy a lawful order, or violently resist a lawful order, or arrest? Hint......never. Works both ways sport, probably need to think a little about that. Don't like the laws, there are legal ways to change those. Trying to change them on the street through stupid behavior, yeah, thats never going to end well.

Because yeah, those "citizens" in Kenosha, Portland, and Seattle were so controlled, polite, and non-violent. Go work as cop if you think you can do better, they're hiring.     Any cop that hurts a civilian should have a psychiatric evaluation done every 6 mo. After the second or third time should not be able to hold down a job in law enforcement. He hurt him so he should have to spend a month in jail. We need more excellent auditors. Someone that knows law well.

    Bay Area Transparency is one of the best auditors out there. He never pushes beyond the line and by the end of his audit, he almost always has the cops standing quietly listening and getting educated. Good work.

    Oh, his mission isn’t to keep people from being recorded. He’s a cop. His mission is to enforce the law. His goal might’ve been his personal agenda. Might’ve been to protect them their privacy, but that’s not his mission. That’s not his job that’s not in his job description, and it doesn’t matter whether they’re private citizens or employees. They have no reasonable expectation of privacy in a public place regardless of where someone might be filming them from that doesn’t generate privacy expectations.😊

    I really appreciate your breakdowns. I personally think being completely rude and baiting the officers is not the best way to audit. It’s also hard to separate the bad behavior by officers when the auditor is being a complete jerk.

    @Seano Mac I totally agree, one of their main jobs is DEescalation and many don’t seem to do it well. But they are human too and if the person, especially an auditor is rude and belligerent just to CAUSE a reaction, it’s not the best way, IMO to deal with them. I am all for the huge ego’s to go, but you can still treat them as a human being and they obviously need to do the same.. I have seen some really good cops totally de-escalate a bad situation. I do agree with you.

    It's like having a bully pushing your limits while being "free of consiquence" Be it civilian, worker, cop, politician. Just cause you have the right to do it.. doesn't mean you should. If people like this guy is constantly being rude and testing the police's patience.. someone is gonna snap and that's human. If the auditor is a jerk ment to do this on purpose... you lose me thinking you are a just cause. Because you might be testing good people constantly... taking away people that might be needed at an emergency or actual crime just to test them and wasting time. Wich is infact a crime to do.. but.. these people walk the thin line of remaining in their rights on purpose all the time.

    @@boxerspause even though is not normally equal, in this instance I would bring up the parallel to any service worker. Cashier, gas, or waiter if someone came in with the exclusive intent to harass. A point for the audit is the subject of burden to investigate first for the police beyond a private business, but the empathy is more understood by bringing up a type of job a majority of the population has engaged in. AtA brings that up, but I would have given him a C+ at most for this individual interaction because he escalated it in a way that was counter productive to the cause. 👍

    Being a bit of a jerk should be no problem at all, so long as the auditor follows all lawful commands. This tests the officer's professionalism in such situations. If an officer will only remain within their lawful authority if people treat them politely, then the officer is incompetent and unfit for the job, and potentially dangerous. When I waited tables years ago, the employer would occasionally send in secret diners to test servers. The secret diners would be difficult customers on purpose in order to test our patience, because if you can't handle a difficult customer then you can't handle the job- period

    On 3/13/2023 @ 4 a.m., Pico Rivera swat raided a house, my husband, & I were helping the owner remove squatters and clean up the property. The warrant was nameless but had 3 boxes checked for probable cause search for items used in a crime, could be used, or was being hidden. My husband was asleep in the next room where these items were found 3 hours later, then accused of being the owner and arrested, I was forced to sit on the curb and directed into the sprinklers. I have bailed him out and asked the PD for his strategy since he hasn't filed motions or even discussed the case with us. The trial comes up in 2 weeks and it's been 6 months since he did not waive his right to a speedy trial. What can we do?

    Open your ears. The auditor was a total ass the way he talked to the cops. And he fully admitted that he lost his cool and professionalism to ATA, as said near the end of this (during the grading part), solely because he was cuffed.

    @@anti-ethniccleansing465 yep your completely right, I saw blatant hostility at the end....my point since your oblivious is the cops said he was hostile from the beginning. What you and people like you need to realize is, it's not our duty to give police any assistance, speak to, help, volunteer information etc. Police should get called out for abusing their power, violating rights and in the worst situations, killing civilians. It is auditors like B.A.T. that go about in a way that allows the police to trip themselves up unlock other auditors that are provoking from the beginning or antagonistic from the initial contacts. He did nothing wrong and just because 1 citizen called and in and said he looked like he was doing something does not give police the right to show up demand he answer questions and provide his ID. They should show up and investigate yes but investigation doesn't rely on handcuffing someone for no crime. We are not animals until proven innocent, no one has the right to "chain" someone who hasn't committed a crime period.

    Yeah, if it is true that he only got angry for being handcuffed, then there was no insult. I was surprised AtA didn't comment on that point. Not answering questions is not "continued hostile behavior". ... Well, OK, maybe his refusal to stop, if we consider the detainment legitimate.

    @@Dowlphin If there was no actual phone call. and they couldn't corroborate it then i would consider it an illegal detainment. Cops use the "someone called" alot and its a lie. in this case it was not since we heard the phone call and BAT didn't present any facts to dispel their suspicion. And they didn't detain him longer then 45 mins.

    In thease situations Officers often say "right here" and point to their name tags in an attempt to get an aggravated person to approach them so they can respond to being approached by a subject by escalating the situation and going hands on arguing that they were "being approached by an angry subject" just another underhanded dirty tactic employed by power hungry tyrants who are high on their own egos and their presumed authority
