Great presentation. She is absolutely right about lack of oversight. I just got commissioned in Michigan. It was so easy to become a notary. MI does have a law that covers notorial acts but it is very basic. I've been reading everything I can find and watching videos. We are not even required to have a stamp or a journa in MI. But the lady in the video convinced me to keep one anyway!

That awkward conversation with my global employer is absolutely what I have had to do after I learned more and sought training on my own as a notary who is employed by a company that uses my notarial services. It ruffles feathers and creates a little panic sometimes when you learn to do better, but I am more confident and professionally supported and can serve the company so much more efficiently when I am more knowledgeable about what I can and cannot do for the company. It can save the company millions of dollars too when you as a notary know your notarial laws and best practices. It protects us both!

Same thing here where I work. I got my notary stamp thru here but never anymore said oh this is what you do and what you can’t do. Also having me stamp on a letter that has no certificate for me to sign or place my stamp. They were like here is just so it looks more ok. 😒? But the letter does not require it. Yea but just in case. Now I am like I don’t want to sign that letter in particular. 🙄

@16:21 ~ I love the videos, but I would love also to ask these two guests how they would advise a notary to act if the principal sign or refuse to sign a journal for a notarization, and maybe even refused to give their address for the Journal? But to be clear, I’m talking about a notary who lives in a state that does not require a journal to be kept at all. I’ve seen best practices say that the notary should go through with a notarization as long as all the state legal elements have been met and not force A principal signer to take extra steps like leaving a thumbprint in the journal or showing a second form of identification. The best practices didn’t mention the example of a principal sign are refusing to actually sign the journal, but the same thing what stand to reason. So what would any notary who sees this comment do in that situation?

  • @NationalNotary

Hello. Unless state laws specifically requires it for your journal entry, you cannot compel a signer to provide their personal address or a thumbprint for your journal. Article VIII-B-1 of The Notary Public Code of Professional Responsibility provides the following guidelines: “The Notary shall not record a full identification serial or Social Security number, date of birth, or other non-public, personal information in the journal of notarial acts, unless required by law in the state where the Notary is commissioned.”

Hello Mari. A Notary Public is an official of integrity appointed by state government -typically by the secretary of state - to serve the public as an impartial witness in performing a variety of official fraud-deterrent acts related to the signing of important documents. These official acts are called notarizations, or notarial acts.
