    We went thru the same thing years ago on property we owned, had a easement shared driveway with a neighbor who was a total nut job. Blocking access to the driveway blocking a 3 car garage we owned at the end of the driveway. Cops called numerous times. Finally 9 years later we had enough sold the property and bought another. Never will I ever buy property with any type of easement. Karma got her in the end she lost her house to foreclose... justice served

    I agree. NEVER buy property with an easement or a shared driveway/access. I had that situation once and the agent that we bought thd property through failed to disclose it and never got us to sign anything. The other property owners lost there minds and threatened to sue me. They never did but they made my life a living hell so I sold the land.

    If they block you off and don't let you leave call the cops and have them charged with unlawful detainees and kidnapping. If your client paid for an easement he has to have access to his property

    If you really want to play hardball, sue them for your time, your equipment, and the money your losing having to put other jobs off because of them. You'll win the case. If they dont pay, then you go back to court and the judge will make them sell a portion of the property satisfy the judgement.

    lol it don't work like that trust me and it sure not that easy . a case like that could take years and longer the case is higher lawyers bill will be . i see this happen before and it never work out cuz the cost of the lawyer

    @@funtyes1970 i never implied it would be cheap or easy. Ive done collections, I know exactly how a lawsuit works in a case like this. It would probably take atleast 3 years to jump throuth all the hoops and in the end you could end up with nothing but a piece of paper that says person A owes you X amount of dollars. The only good part is person A wont be able to engage in a majority of transactions they would normally until the judgement is satisfied. This includes selling any of their property and or death. Yes I said that correctly, if someone has a judgement against them, when they die that amount is taken from any insurance they may have. Having a judgement against someone is a last ditch effort to obtain monies that are owed. You win some and you lose some.

    ​@david ellsworth never .. judges never give you the money from time you lost Just watch judge Judy and you'll see that... let alone money you could have made or for equipment rental...or the time lost of work for having to go to court... You know absolutely nothing about how these laws actually work in America... Best thing guy could have done was call the customer on the first day and quit and gone on to the next job. Let the property owner fight it out with the nieghbor. Never worth it to drive 3 hrs back and fourth for a job in the first place.

    You didn't call the cops to give you permission to be there, they are there to "warn" the neighbor to not block the road. And if they do, they will be charged.

    Most states all the law enforcement can do is keep the peace. This is a civil matter that would be solved in civil court.

    This is all on the owner. You should bill the owner for a full 8 hour day each time you show up. The owner should be the one to lawyer up and get an injunction against the neighbors. It's the owner that should sue. None of this is your issue. You should just bill for the time to, on and away from the site.

    Absolutely. I don't understand why you think a nickel should come out of your pocket. If it were me, I wouldn't go back to the site until the owner guaranteed me that the neighbor issue was taken care of.

    I know that is stupid of people to not know where their property lines are. When my family moved out to the country the first thing we did was clearly mark the property lines and then we put four corner posts in and a string line so that the fence would be straight. We have lived here for 40 years and a few years ago someone started to move in to the lot beside us. They came out and mowed the grass a couple of times in a year and then they came out on a holiday weekend and demolished a 3 bay garage and pushed it into a pile under the 3 biggest pine trees and set it on fire and they had no water on the property. Then later on they were digging test holes for the septic with a small excavator and they went across the property line and were digging holes on another lot right in someone's septic system I don't know what they were thinking they were right behind someone's house I mean 15 to 20 feet away from that house when they moved in they had a bunch of stuff sitting across the property line.

    You need to tell your client to accept an invoice from you for the days you lost by these neighbors, and then he can sue them for damages for lost time and money he has lost on his project. You don't need to go to court for a simple land dispute that doesn't harm the neighbors for their bully tactics. Right now they think their winning and its time for your client to go on offense and stick it to them.

    I was a draftsman for a county assessors office. The original plot plans are made from deeds VERY ACCURATE. A survey is usually done when the property is purchased. TWO more surveys are not necessary at all. Their lawyer needs to go back to school he is just a scare tactic. YOU have a law suit for your time, equipment, labor, the delivery, gas and any further business that was delayed because of this. It can be totally seperate from the owner's issues I would have dumped the dirt because the cops can't do shit in a civil matter.

    gloria welch, a point of fact, yes he is correct. It is a process that all real estate law does require that a survey be performed before any land sales can be completed. Cities usually have the survey on record for sales of houses and property. I am not a lawyer but even I know that. Anyone who has purchased a house or vacant land learns that law.

    Is it a private or public access easement? The easement may not have been granted for access to the person trying to build. Which would then require the builder to gain access to their property

    I lost part of my road to a property dispute. When I studied I found out it was because of a drainage issue. Since it would cost more to fight in court vs building a new road. I built a new road and cut off the drainage to the previous road I lost. So now my smug neighbor can watch her property legally sink

    When I first bought my home in WI , neighbors were very friendly but kept telling me that they owned up into my yard areas. The maps I have said differently,,but my realtor was not right about how much I owned eight. So I finally had to pay to have it surveyed. They weren't happy but at least no one could tell me what they owned.

    When I got my first place in Mississippi I didn’t know how far my property line went and the county gave me and the two neighbors mixed wrong info so we all paid for a survey and got the facts but never had issues with my neighbors we’d hunt on the land and had weekly bbq’s,I just feel bad for people having bad neighbors and drama like this.

    Yes, actually termed "false imprisonment". Such a touchy letter of law that there's attorneys that specialize in it. Most common cases are domestic disputes and/or drinking involved w/the threat of a drunk driving or just being dangerous to themselves.

    You do not have the right to defend yourself unless someone is physically keeping you from leaving which is assault and false imprisonment. If they’re blocking you in with a vehicle it’s just false imprisonment and they can and will be arrested however, if you go hands on on the latter you will find yourself in the deputy’s spare cuffs.

    I've been shot at I actually had a sheriff shoot at me when I was clearing my own land and I had to shoot the sheriff state police had to come stand guard for a month until we got a solid block wall 674 feet because the sheriff had tried to steal the 13 acres when my grandpa passed away

    lol it never work . what you think contractors never sued neighbors before , it could be drag out in courts for years , it wouldn't be worth it after lawyers fees . best thing to do is work away before get worst . if i was that client i would sell that land . if he think he having problems with that neighbor now wait after he finished building that house and dealing with that neighbor years to come . i would get that hell out of there

    LOL A nightmare FR. I bought a piece of property once in a small village. I had a recent survey the old survey from the seller and the registered survey from the village. There was no house on the property but a shed and a driveway put in by the village years ago. My neighbours driveway was mere feet from mine, all these years with no one living there they had started parking extra cars, company and such in my driveway. Plus they mowed in between the drives and some 4 + ft. on my side. it looked nice and looked like they owned it. When I came to cleanout the shed ( full of junk) and tare it down they had a chain across the drive. I asked nice to have it removed and they said they had squatters right since they had been looking after it all this time. Cost me a lot of money to have them move there gate, Cops do not want to get into this. The lawyers love it and charge thousands to fix what they know is right.

    People get completely crazy over property line disputes. Even with a survey one time, we had a guy sue us claiming “ open notorious possession”. We won in court, but before that he cut our fence multiple times.

    People just assume land all the time. I live in an innner suburb of a fairly large city. When I bought the property there was an area that I questioned whether it was part of the property. I required a land surbey before I bought the property and it confirmed what the seller said. As soon as I bought it I started clearing it out and the neighbor went nuts. I showd him the survey, we argued about it for a few days and then it sopped but he hated me for years over it because he thought it was his. Its sad/ridiculous but people are people.

    I find this amazing because when I bought my house, in the stack of documents, I received an architectural drawing of the lot locating the survey markers, all easements, and setbacks. Both parties should have their documents.

    This seems to be a perfect example of why these people should have bought the landlocked property themselves. Then they wouldn’t have been forced to allow an easement across their property to other property without access to a road.

    FL Statute: 704.01(1) (2021). Once created, the location of the easement cannot be changed without agreement. When an easement is blocked, the easement owner may pass over the adjoining land as far as is necessary to avoid the blockade.

    I had to get my property surveyed three times and now I have to go to court and get a court order to get the police to enforce it, or they won't.

    I used to have a neighbor who would argue every weekend that I didn't have any water rights from the canal. I had paperwork from the canal company, I kept it in my pocket.

    Even if they bought the land containing the easement, it still exists. You cannot land-lock a landowner.

    My question, being a Native Floridian, and owning land locked property, is How in the Green Eyed Naked hell did the Buyer even get an "Easement" to begin with. Florida is a Land Locked State - and it is news to me that some one could be compelled to provide an Easement. Now, I am on the side of the Buyer and the Earth Mover and Land Clearer Business, but I would still like to know how the "Buyer" received an Easement to get to the two acres.

    Definitely take them to civil court with the land owner. At the very least you get paid for lost time and resources, at most those neighbors have to pay AND they get charges for false imprisonment.

    Let them block you in, report to the authorities that you’re being held captive and hope the shitty neighbors get attempted kidnapping charges. You may also be able to hold those neighbors accountable for any lost time and revenue on the job if it amounts to a large enough sum.

    This is all happening in Lake County Florida and you seemed to have good relations with the Deputies. This lady and he male friend think they have the power to deny access to one’s property using an easement. I live in Clermont and these asses need to be taught a lesson legally.

    The officers should tell neighbor anymore trouble ,and she will be arrested on site if she interferes, by one word . Send a deputy to sit on site and arrest any one who causes trouble.

    My brother had a neighbor dig a trench 6 feet deep across the right of way my brother sued and drove him into bankruptcy and then took his house in bankruptcy court it was great

    I've seen very often where old surveys don't hold up to the modern surveying equipment. Good to get the cops there to protect you. New to your channel. Will be watching.

    Deputies don't want to be involved in surveyed land dispute, just tell excavator to be careful with the people who are blocking. Sorry for your losses involved in this fracas, these blockers know they are wrong.

    The guys with the dirt made the decision to not dump the dirt because there was controversy and they did not want to get themselves in trouble. The PROPERTY OWNER is responsible to be sure the way is clear, legal and civil.

    Take all the info to the DA of your county and have him take it to a county judge and the judge can Wright an order for anybody interfering to be arrested and taken to the jail booked and brought before him and fine them for obstruction of personal property and open them to a law suit for funds and stress to the contractor business and property owner. If the owner is delayed on building house onschedule he can suite for entire cost of house.

    I had a neighbor when I lived in California that acted like he had rigjts on my property that i didnt have. Every time I did anything he would call the county and his lawyer. He was president of the home owners that he was in and i wasn't. Everybody called him Fiveskin because he was much to big a prick to be a fourskin.

    You should put hardware wire around the coop, and foot out and a foot in underneath the cage sides for digging animals. Chicken wire is weak and any animal can bite through it. I would put it up all the side and top, as any animal can climb as well. The cage edges has a huge gap for animals to squeeze through. You may have chicken murders if you don’t.

    21:12, it's also a great idea to have a larger flexible pipe "sleeve" pushed onto the cable BEFORE you rejoin anything, such that afterwards, after doing a simple wrap, position the additional sleeve completely over the joint itself, extending from one side's main insulation to the other, and just wind another single direction of insulation tape, such that the additional outer sleeve, will take a lot more rubbing/damage, before the inner cores are exposed, or broken.

    I agree. These people are worse than the Oddities in Odder Creek. Lawsuit will settle the whole mess and you should be paid for all your lost time. If they own the land you may become a new owner. Thanks for sharing. Do you do work in middle TN? I have 44 acres of land that is overgrown and needs to be cleared. LOL.

    Our friends in Merritt Island FL have had their nieghbors put boulders across their driveway blocking them from accessing the shared road to and from their property. Then the Sheriff arrested them for tresspass when they moved the stones...

    My father filled in a rock quarry got it all flattened out all smooth out had a road that ran probably another 200 ft from smoothing it out and the city came in and said well now that's ours you can't have it and they didn't pay him a nickel

    Learned that lesson well! Wire your trailer toa female plug mount on trailer frame somewhere, then make a male to male plug and some extra so if that happens again simply replace right quick fix male to male later!

    Sir you seem so nice. I am sorry they are doing this to you. I sure wouldn't want them for neighbors. I had a home built across the road from me. They had a huge dumpster didnt pick up trash comes on my property so I would pick it up and throw it in the dumpster. It happened a few times so I did say something about it nice if rhey could please pick up the light trash because my back is bad. Just saying something made it worse. I just picked it up and threw it out again. Then one day this young guy needed gas for his chain saw asked another neighbor he told him no. He looked at me and I said sure do filled it half way divided my bottle with his. It made me feel good to share But still no respect. I wish it would of been a person like you sir you seem so nice

    The Client should have an "Injunction " from the Court to tell these people to "not interfere" with your Job. If the people do. Then the Court will intervene and you should sue them for recovery of your lost wages.

    In times gone by you could "hire" some people affilated with motorcycle gentlemen that can assist in the persuasion of those pesky neighbors. Today some of those getlemen are police (look at tattoes) and public officials and set the price of persuasion very high. Beware cops can do the deed, and get his buddy to charge you. Always get references for subcontract 1099 work.

    Police are 'not surveyors' and do not regulate land disputes but continue to ask questions regarding wet lands and property survey. Trying really hard to regulate against the contractor, unfortunately for them and the disgruntled land owners he is very much prepared.

    sounds like they had a chance to buy the property next to theirs themselves, they didn't buy it but wanted to have total control of it for free..... to bad so sad. although, after the first time it happened, the client should be there on site at the next time with all the documentation, it's his/hers responsibility.

    In most situations he county , sets in place easements to properties, that would otherwise be land locked,,,, wene a property is bought and land improvement as well as a dwelling structure,, the easements and right of way is inacted,, some land owner don't know how that works,,,,,, and this type of thing happens
