Just a week and change ago we talked about Nintendo issuing MORE DMCA take down requests in regards to video game emulation...and now they filed two new lawsuits against the Mig Switch flash carts and are asking for information about the buyers! So let's see what Nintendo is up to this week!
It's Nintendo Direct Day! Metroid Prime 4 is coming, a new Mario and Luigi is coming (Mario & Luigi: Brothership) along with Super Mario Party Jamboree and The Legend of Zelda: Echoes of Wisdom...but let's talk about the Nintendo news which is Nintendo Direct..ly going after emulation of their older games! and now Rhythm Heaven modding tools and even Nintendo Sheet Music have come under attack...along with more Switch emulation bits! Heaven Studio is gone!
This is a follow up video to last months video: Did Nintendo DMCA attack Vimm's Lair? Or were DMCA trolls involved? Lets find out! Because it turns out it WAS Nintendo and their partners that send the metric ton of takedowns to Vimm's Lair and Nintendo's emulation fight continues on...most likely due to iPhone emulation and retro game emulators on iPhone now being a thing! Plus Nintendo sent MORE DMCA takedowns to the Super Smash Bros modding community...and now the ESA and Sega are joining in too? WOW (or the Sega thing is trolling?)
Nintendo Wednesday just issued over eight thousand DMCA takedown requests to GitHub over Nintendo Switch emulation...they just cant be stopped!
Nintendo has killed Yuzu and Citra emulators. Nintendo Switch emulation at least on the Yuzu emulator front is gone and 3DS emulation on Citra went with it! So let's take a look at the Nintendo lawsuit, find out why Yuzu lost and talk about what this means for game emulation moving forward! Because Suzu emulator is here...a new Nintendo Switch emulator that does basically everything DIFFERENT than Yuzu Emulator for Nintendo Switch did. Will it be enough to keep Nintendo's lawyers at bay?
Yes but the Nintendo Switch emulator Suyu threw in the towel anyway due to issues with the Yuzu source code basically leaving Ryujinx as the final standing Nintendo Switch emulation option!
Yesterday news broke that Nintendo is going after the Yuzu Emulator claiming it's illegal and in violation of Nintendo Copyright...which is not suprising because last February I said this was coming and soon! SO let's take a look at Yuzu Emulation, Nintendo Switch emulation and whether or not Nintendo has a legal case to stand on! Because Nintendo is trying to say Yuzu circumvents certain technologies and Nintendo wants Yuzu shut down by the courts! No Surprise...it is Nintendo after all! Nintendo news except NOT positive!
and before this : One year ago I did a video on Nintendo going after Valve and Steam in regards to the Dolphin Emulator and retro gaming emulation in general...and in that video I told you Nintendo was going to end up going hard against video game emulation! Some people didn't believe me...so let's look at the newly updated Nintendo Game Content Guidelines! oh and the competitive Smash Bros Tournament Guidelines are insane too...but that isn't what this is about!
Pivot time! Normally you would be watching a random fun Friday video this morning...but we have bigger fish to fry. Because we are going to be talking about video game emulation, its legal status and how Nintendo is currently threatening basically everyone who ever made a video on a Nintendo game ever with their new Nintendo Game Content Guidelines!
I asked, you answered...and I try to listen :) Of all the requests for new content on the channel one of the most frequently asked for videos is a series on the Steam Deck.
About eight months ago I did a part 1 video on whether video game emulation / emulation setup guides were legal and I mentioned I thought Nintendo would challenge this moving forward...and they did by removing the Dolphin emulator from Steam. Thankfully I have a long background in copyright and intellectual property law, have taught it to college students and have used this knowledge in many aspects of my working life as a filmmaker and professional athlete manager.

    Be sure to watch the video guys. This isn't Nintendo going after people playing Everdrives on NES/SNES/N64. This is pirates profiting by selling Switch flash carts pre-loaded with games.

    Oooh , for a second there , was worried about the 8bit ,16bit , 32bit ,64bit era .. it's understandable that Nintendo would sue , the Switch is way to recent of a console to be pirate games 🎮

    It’s legal. It’s been done before. Direct TV was a huge “buyers acquired non permissible item” and they were gone after for it

    @Mingodough it’s not but they pass laws where they can get around this stuff like a terms of service and a disclaimer, it’s always how companies try to avoid being sued but they still try to break laws anyways to maximize profits.

    As someone that's downloaded Nintendo sheet music, so I can play some Zelda tunes on the piano/synths. this is just the sort of thing that makes me want to stop buying their products. I've spent countless monetary units on them for decades. Now I hate them. Nice job N. They aren't just losing my interest. I won't buy things from them for my kids, friends, family (as I often did). I'll just play the old games I already have, and call it good. I was planning to buy 6 Switch 2s (for my family), but I'm thinking maybe they'll all get Steam Decks instead. I don't even pirate new games. (sure I have old ROMs) but I buy all new games (then re-buy) them on new consoles for the convenience. I don't have a Switch backup device, and this doesn't even impact me directly. However, it just makes me hate them as an entity, and I'm at the point in my life where I have too much choice for the things that consume my time. It's easy to cull one that I find distasteful now.

    @@DrJ3RK8 I only pirate games so that I can try them out and if I like them I generally buy them or wait for a sale and buy them. Anything that is 15 or more years old I think it's fair game as that is far more than enough time to be monetarily compensated for your work/software. While I don't agree with a lot of what Nintendo has done lately this I do agree with in some ways since it's their current platform and publishers/developers are still making money on it.

    @@Jokerwolf666 Agreed! I don't even do that with new games as it just takes more effort than I'd like. I typically know if I'm going to like something with pretty decent accuracy these days. :D So I just buy it. I haven't accidentally bought a game that I ended up hating in decades. :D Agreed though. If it's older, I wouldn't necessarily call it fair game, but I would suggest that it's pretty close. I'll still buy things again though say to have all of my favorite Mario games on my Switch or something like that. (just an example) For another example though, I would re-buy Wind Waker HD and Twilight Princess HD in a heartbeat for my Switch if they were available. I gave my Wii-U to my daughter, and these are the versions that I want to play if I'm going to play these two games (which are among my favortie Zelda games of all time). However, Nintendo stupidly won't release them on there for whatever reason, so I play them on CEMU. Problem solved for me. But, I would have happily bought them again. They just make REALLY stupid decisions. Holding things back that should just be available like this is one of my biggest complaints about them. It's like the Disney Vault, which is also asinine. Make your content available, and people will buy it. Make it easy for people to play it how they want, and that's a HUGE gesture. Going after people with questionable (at least some of the recent litigation is) lawsuits, and you just look bad. I get protecting IP. I really do. But there's a point where you need to decide which IP is most important, and make the rest easily available, or people are going to go elsewhere. It's pretty simple (at least in my mind).

    Here in Italy, the argument of a big corporation trying to slam you down in court playing the cost card is fortunately not a case. It is full of cases for instance where a single lawyer won against big pharmaceutical companies that could count on hundreds of lawyer; if you don't have a valid argument you won't win, even if you have all the money in the world 😂. It is very sad that in the US it doesn't work this way...

    This is very different from Naspster or other cases. Nintendo are fighting a losing battle. Like many Japanese companies today, they are stuck in the past. Their policies and mentality are still of the 80s-90s. The majority of these Flash cards and cloned emulator systems cards are made by Chinese companies in China, where Nintendo (or Western companies) have zero jurisdiction and no power to enforce their policies. It’s just not going to work, only making people more eager and angry.

    Nintendo had better not harass people who simply bought those flash carts. That tactic didn't work so well for DirecTV back in the day when they tried going after people for having smart card programmers.

    @@Pawnband I have to imagine that part of the Wii's astronomical sales numbers had to do with the ease of loading homebrew on it. I hope that it isn't cracked wide open day 1, because developers might lose confidence on the new hardware, but I do love homebrew.

    Anybody have a feeling the Switch 2 is so similar tech wise that Nintendo worries people will have decently working emulators of it running within a few months? Like, why now? With new hardware on the way no less? I'm sure it's just a coincidence, but eh.

    I’ve been saying this for years now. There’s no way Nintendo can make the switch 2 a significant improvement over the 1st. They are a handheld console company now, and have to compete with the steam deck and a hundred other handheld PCs. The only thing they have to keep them afloat now, is their IP

    Could they even go after the SNES/N64 EverDrive? There must be something we can do about this. For decades, this stuff has been perfectly legal. If suddenly they go after that, we have to make a stand. None of our governments will lift a finger. At most, we may be able to get the EU to do something, but I live in the US... And right now, it's a mess over here.

    Downloading roms has never been legal. So if you bought any type of flash cart that came with roms of any kind, they absolutely could. An empty flash cart on the other hand, there's nothing they can do.

    The irony is, the more Nintendo do this the more I pirate their games. Genuinely, I supported the Switch so hard for years but lately, why would I support them? Why should I give them money that they are just putting towards unethical practices? And don't even try and debate me on this. Any action that makes older software that is no longer supported less accessible, is unethical. You will never change my mind on this. No one ever will.

    @@VideoGameEsoterica Honestly I'm not even talking about their games. If they want to take their games down and not offer them, that sucks and I think it's wrong. But by shutting down ROM sites, they make it so difficult for younger, less tech savvy people to find software. Im from the UK and there were so many games that I never got to play because they weren't released in PAL territories. My only option was the download the ROMS and play them on ZSNES. Tales of Phantasia, Earthbound, Seiken Dentetsu 3. It was so easy for me to appreciate these games and get into the series. But with Nintendo doing what they are doing, they are killing these communities and making finding older software difficult for people Do you know how important CDROMANCE is to me? How important it is to someone who just won't have the patience or knowledge to patch a game that was never released? I know I'm preaching to the choir but this shit stings. Because Nintendo themselves benefit from this. The eShop on the Nintendo Switch is absolutely stacked with incredible games. And most of those games are inspired by the games of yesteryear. The games they want to make extinct.

    Seems like they are preparing for Switch 2. The idea is to sow and spread fear of their wrath, so that when Switch 2 comes out people would think twice and thrice before doing something that Nintendo might disapprove. Might work on some, but I think it's a futile effort generally, people will just be more cautious and clever about "preservation".

    I'm all for modding consoles and using flash carts, and I'm even for piracy as a means of preservation (it's usually more effective than the companies' own archives), but I'm always baffled when people sell pirated software for profit, whether that's by selling the software itself directly or including it with a hardware purchase. If someone else wants to break the law and download something they don't own, that's already easy enough to do. It's idiotic to put a target on your back by including pirated software with your flash cart.

    Step 1: Develop recompilation tools for other Nintendo consoles, similar to the N64 recompilation tools. Step 2: Develop WYSIWYG game makers derived from recompile Nintendo games, so that everyone can make (and share) their vision for Nintendo games.

    Thats terrible of Nintendo. They made no effort to preserve their software or hardware, all the money they ever made off of old cartridges were made decades ago at the original point-of-sale when they stopped printing the last one. Meanwhile, Ive got 1,000 NES games on a cd rom from the year 2000 off ebay and nobody cared.

    Knowing the state of most of the District judicial courts in the states, the fact that these cases are expensive to even go into, Nintendo is going to get this settled extremely quick. Nintendo isn't going to win based on merit of the law, they are going to win because they are a massive company fighting enthusiasts and fans that could never outlast corporate lawyers. But we also have to be patient and wait for the right case to fight back on. Because there are those little breadcrumbs in community efforts that give Nintendo carte blanche to take them down. The one thing that keeps me going is the reverse engineering and decompilation efforts. Nintendo can't do anything there except try to get rid of the roms so people can't compile the games.

    Going after purchasers or even requesting their info is the only thing I dont agree with here. The piracy that most people end up doing doesn't amount to anything and nintendo knows it. You cannot equate piracy to actual lost sales in most cases except maybe when are paying in situations like the cart being loaded with games. Even then I don't feel it's 100% absolute. Lesson right now is don't attract the ire of with stupid piracy shenanigans.

    @@VideoGameEsoterica Thing is, flashcarts have been proven in America at least, to not be illegal. So I really don't see them doing anything about the current supply that exists. Probably mostly trying to stop the flow. If what in the lawsuit is true as well, him sending out SD cards with games on them, he's totally screwed. That is a sure fire way to get yourself in trouble cut and dry. The MigSwitch is functionally no different than any other flashcart in the terms of, you still need the exact files that are on the regular cartridge. VS a modded switch where you can just have the one merged xci.

    What is very interesting about he actions against somebody like James Williams is that this kind of general practice of promoting piracy, even if not quite as directly blatant as him, KZreadr reviewers that peddle directly in showing piracy online and showing that they either purchase or receive products from the likes of Anbernic, who openly sell devices with pirate material, might want to think very carefully about their own exposure to civil lawsuits and worse. People openly demonstrating vast catalogues of games to the world do rather leave themselves open to questions about whether a normal individual could really own so many of the games bearing in mind the outlay that would have to come with having such collections. Discovery processes in court would potentially put people in a position to have to actually show that they legally owned these collections, which no reasonable person would likely believe. Many will also show that they purchase collections from huge sellers such as Amazon. Which does beg the question of why we are not hearing of lawsuits against Amazon and others, whose scope of selling across the globe is absolutely huge. Nintendo cannot afford to stand back and only go after the small guy because it will set a precedent that the small guy could use in court as a defence of being unfairly targeted, even if they are still legally guilty. If Nintendo is going after the Migswitch owners, what is it potentially going to do about those that review them on KZread and elsewhere? Some of them they should be able to track without the originating company revealing any internal information. They don't have to take on KZread directly because they are protected but users who post are not. The closing comments of the video is not necessarily accurate, that the foolish actions of a few somehow means that everybody else has to dal with the consequences. If you don't pirate then there are no consequences to even think about. Anybody thinking that these hardware backup solutions were not going to be subject to challenge must be deluded. Whilst it doesn't mean that they are illegal in terms of how some laws will see them, defending in court is a whole other matter, costing a lot for the small guy, whilst being chump change for Nintendo.

    @@VideoGameEsoterica It's a good idea, though. With actual piracy, pirates come onto your ship and take things that belong to you, and leave with them... potentially including the whole ship. These are physical items that cannot be copied with a few mouse clicks. When the pirates take them, the victims are deprived of them, and that's what makes it criminal. With software piracy, people don't enter your physical space, but instead use software to copy things that you have, and leave the original behind. These are nonphysical items that can be copied with a few mouse clicks. When the software pirates take them, the 'victims' are not deprived of them, and that's why it should not be a crime.

    at this point, i won't be purchasing anything switch 2 related. the switch will be my last console from them. they've become far too anti-consumer for me to reasonably support any more. high prices with almost no sales. subscriptions for a limited library of retro games on poor emulation. morally speaking. on top of everything else. this is a step too far and deserves to meet with sincere lack of financial support. guess more of my money is going to competitors, indie games and spiritual successors. including ones that welcome mods. nintendo and it's ninja lawyers it pays for wants to argue legal right. it's my legal right to refuse to purchase anything from them.

    Someone needs to do a proper video about the Bleemcast lawsuit. People believe it legalized emulation but in reality it never concluded due to bankruptcy, the rulings were about things like box art and none of it became precedent. Due to very poor coverage in the tech press from sites like The Register a lot of people believe emulation was ruled legal and precedent was set which simply is not true. Dark times are potentially ahead for the emu scene depending on how far Nintendo goes and how many others decide to follow suit.

    @@VideoGameEsoterica Maybe this will help: Before the internet have become a fast and affordable service to almost every industrial countries, I bought and/or rented physical copies of video games. Although I liked building collections, renting was a way better option as I could try out games before deciding to buy or not. But, over time, I realized, at least on my part, that... 1. I spent more on renting then I could afford on buying. 2. When I actually bought a (physical) game, I spent as much time with it as if was a rental! So what happened was the following: As price (especially price), data and speed of ISP was going up, the incentive for me to buy games (even digital) was going down. I still wanted to play, but with so many (digital) games on the internet and not always time on my hands, for me, "freely" non-restricted download buttons on rom/iso websites and torrents became the norm. Therefore, for quite some time now, I enjoy, for a few hours or less, testing out games to see if I still care for those (mostly retro) that I haven't (or never) played a long time ago. As for the newer games (if the hardware specs can handle), I just check them out for a moment. I hope I cleared my somehow ambiguous "back half" comment. Have a good day!🙂

    My opinion is not going to be too popular but while I do hate Nintendo for taking down Vimms and other ROM sites, I do absolutely believe they are in the right for taking down Yuzu and MIG Switch. There's no absolutely valid use case for emulating a currently sold system, it's just pirates I think a lot of what Nintendo does is kind of sketchy legally but I'm all for this

    @VideoGameEsoterica I work for data entry companies, these tactics are nothing new, but it sure is scary how much power they truly have no matter what the laws are they can definitely go after whoever and we can’t expose them for what they do.

    I was actually kinda on Nintendo’s side in some ways during the emulator shutdown fiasco, between Steam Deck users bragging about the ability to play their games and someone making a TotK rom while the game was new. But this… nah. Going after customers’ info is disgusting.

    I’m fine with all Switch emulation because emulation offers what Switch can’t…modern performance. I’ll buy a switch game then emulate it. I own three diff Switch consoles. Nintendo loses nothing and I can play games at 4K60 like I want to. And I’m fine feeling ok with that :)
