Nintendo's Emulation Fight Heats Up! More DMCA's All Around and Now Sega Joins?

This is a follow up video to last months video: Did Nintendo DMCA attack Vimm's Lair? Or were DMCA trolls involved? Lets find out! Because it turns out it WAS Nintendo and their partners that send the metric ton of takedowns to Vimm's Lair and Nintendo's emulation fight continues on...most likely due to iPhone emulation and retro game emulators on iPhone now being a thing! Plus Nintendo sent MORE DMCA takedowns to the Super Smash Bros modding community...and now the ESA and Sega are joining in too? WOW (or the Sega thing is trolling?)
Nintendo Wednesday just issued over eight thousand DMCA takedown requests to GitHub over Nintendo Switch emulation...they just cant be stopped!
Nintendo has killed Yuzu and Citra emulators. Nintendo Switch emulation at least on the Yuzu emulator front is gone and 3DS emulation on Citra went with it! So let's take a look at the Nintendo lawsuit, find out why Yuzu lost and talk about what this means for game emulation moving forward! Because Suzu emulator is here...a new Nintendo Switch emulator that does basically everything DIFFERENT than Yuzu Emulator for Nintendo Switch did. Will it be enough to keep Nintendo's lawyers at bay?
Yes but the Nintendo Switch emulator Suyu threw in the towel anyway due to issues with the Yuzu source code basically leaving Ryujinx as the final standing Nintendo Switch emulation option!
Yesterday news broke that Nintendo is going after the Yuzu Emulator claiming it's illegal and in violation of Nintendo Copyright...which is not suprising because last February I said this was coming and soon! SO let's take a look at Yuzu Emulation, Nintendo Switch emulation and whether or not Nintendo has a legal case to stand on! Because Nintendo is trying to say Yuzu circumvents certain technologies and Nintendo wants Yuzu shut down by the courts! No Surprise...it is Nintendo after all! Nintendo news except NOT positive!
and before this : One year ago I did a video on Nintendo going after Valve and Steam in regards to the Dolphin Emulator and retro gaming emulation in general...and in that video I told you Nintendo was going to end up going hard against video game emulation! Some people didn't believe me...so let's look at the newly updated Nintendo Game Content Guidelines! oh and the competitive Smash Bros Tournament Guidelines are insane too...but that isn't what this is about!

I asked, you answered...and I try to listen :) Of all the requests for new content on the channel one of the most frequently asked for videos is a series on the Steam Deck.
About eight months ago I did a part 1 video on whether video game emulation / emulation setup guides were legal and I mentioned I thought Nintendo would challenge this moving forward...and they did by removing the Dolphin emulator from Steam. Thankfully I have a long background in copyright and intellectual property law, have taught it to college students and have used this knowledge in many aspects of my working life as a filmmaker and professional athlete manager.
And on October 25th Nintendo went even WEIRDER with their new content guidelines rules! So today we will be talking about the concept of why video game emulation is legal in the first place and why Nintendo's new rules are just seriously insane!
But this will be very interesting to follow as if this goes to a court case it COULD be decided in Nintendo's favor and what emulation of retro gaming hardware as we currently know it could be in serious legal jeopardy!

    FYI for all my English speaking friends. Russia does not care about piracy at all. Plenty of Russian language sites and domains have all the roms and game mods and Nintendo can't do diddily squat about it.

    Nintendo isn't going to have much success suppressing ROMs when file sizes are so tiny. They're just forcing the emulation scene underground, but when everything below like PS3/SW is usually less than about 5GB -- they're fighting a battle that they're going to lose against increasing internet speeds and transfer rates on SSDs, NVMe & NAS etc.

    Still for me to get and fully backup VL 12 TB, it's about $1200, $300 to do it poorly. Got to get a VPN, before ESA fingerprints the file of they haven't already and start issuing DMCAs to ISPs. This is the bad thing about me not having a good human network. Finding the underground won't be so easy. But I think it's a good thing if gamers grass root connect. Lots of benefits from a united community, well beyond immunity to corporate greed

    if they want you to buy what are essentially roms on their services, they should make more of an effort. You own the game and not just for a limited time. Include all cheat codes with the roms and scans of the manual and insert. This is way too much effort though for companies these days.

    I remember Nintendo threatening the resellers not to put Sega systems in the front or even not to sell them at all. They were also threatening the game developers not to develop games for other platforms (the same games most of the time to be more exact) during the 8 and 16-bit era. They were extremely arrogant. Still remember the 90s and still can not like nintendo for I still see same shit in them. Sorry nintendo fans. I am quite sure it is the least user friendly gaming company and does not deserve the love it gets from its fans. How are the gamers are going to react? We will see.

    Every gamer who cares about, not just throws around the word while being a collector, preservation, should be declaring Nintendo public enemy number 1. The angry gamers got mad at Sony (shift up say it never happened but gamers won’t believe it) for patching a costume in stellar blade yet the Nintendo loyalists remain quiet when it comes to how backwards Nintendo is at granting access to older gamers. They’ll spend money and lawyer up to make you spend 1000s on one game that came from some neck beards collection of pet free smoke free grass free homes rather than provide a service that can cater and allow cheap easily accessible older games.

    If there's one thing yuzu's shutdown from Nintendo has made me learn, is that you just CANNOT fully get rid of it, once on the internet, ALWAYS on the internet. Also, what makes me laugh about this, it's like big N is trying to crush a scary spider, only for it to multiply over and over again. That's how open-source stuff works.

    @@pketh Can't blame you! I've decided at least for now I have what I have but won't buy any more and cancelled Switch online. Nintendo has certainly made their money off me, going back to when the NES was current and everything since. My main interest was in more ways to run my games and running mods. I even bought in to the Wii U and many games only to rebuy some of them on Switch.

    I think SEGA's DMCA move is about the Steam Releases of Sonic. In Japan they just got Sonic Adventure 1 & 2 on Steam, and the Sonic Origins Plus release would cover the older 16 bit and 8 bit Sonic games in their view.

    SteamDeck can play everything up to Switch easily. Haven't tried PS3/360 emulation but a lot of those games are available on Steam anyway, more modern games are mostly released on Steam day 1 so you can play virtually everything.

    Another great video bro, makes me realize I was how much denial I was in when they announced they wanted to sue Yuzu, I thought nothing would come from it.     Ok then release all those games so we can buy them then. Nintendo is damn tone deaf when it comes to their older catalog. Even Super Mario 3D All Stars being a time limited release is beyond stupid. Nintendo plays a huge hand in how fucked the aftermarket has become for retro games. Availability would surely reduce piracy and ease the price on obviously common games.

    I think Nintendo might be planning to bring their NSO subscription based rental service to mobile in the future and they are cracking down ahead of its launch. As for Sega, I heard that Sega Sammy is taking their game IPs much more seriously again after the recent success of the Sonic movies, Persona 5, the Yakuza series, and Sonic Frontiers; pushing hard for multimedia just like Nintendo seems to be going after the success of the Mario animated movie last year. So they could be getting more protective of their IPs now.

    Don’t think square actually cares about Roms. These have been up for decades and they have never went after rom sites, even Sony and Microsoft which surprises me.     @@snintendog No console has a complete library worth downloading unless you're willing to waste space. Every console has its share of shovelware, that being said, the Wii has a particularly great library. Many multiplats had unique and often better SKUs on Wii as opposed to PS3/2 or the Xbox family.

    Regarding game mods, in the 90's there was a lawsuit between Nintendo of America and Galoob regarding the Game Genie cheat device. Nintendo claimed that the device basically ruined the artistic integrity of the product, while Galoob said that the device allowed the freedom to use the product they purchased in the way they see fit. In the end, the judge decided that the Game Genie did not break any laws and was legal. I feel this decision can be used again to defend the existence of mods, especially in games that have no online component. I love the games Nintendo releases, but their business practices are beginning to look real shitty.

    The thing is all the game genie did was change values in ram to new values. So it didn’t use anything Nintendo could claim ownership of. The mods, while harmless to Nintendo, utilize Nintendo IP so legally they are in the right but “morally” they suck for doing it

    One of these days somebody might stand up and say no, resulting in a court case, where I hope, the fact that Nintendo and others have never taken action for decades, despite obvious and open knowledge of mods etc being present. There is a case to say that standard practice had been established but it has to be formally tested. On the other hand, copyright laws on their own do entitle Nintendo, Sega etc all to protect their IP content. It all comes down to 2 choices for end users. 1. Get together and lobby associated lawmakers in respective companies. 2. Stop purchasing Nintendo and others products. Hit them in the one place that really hurts, the bank balance. Neither of these is likely to happen though because by enlarge, the gaming communities are full of very weak people, putting their own greed ahead of any morals. Harsh but both ironic and hypocritical reality.

    The ESA is also the organization that created the report showing that ~70% of retro titles are not playable on current systems so whenever they go after places like Vimm's Lair I find it kind of disgusting.     I’m gonna get some heat for this but developers of Switch emulators should’ve WAITED until the Switch system discontinued and kept the project underground and not went public until years later. Maybe then they wouldn’t be in so much hot water. The hardware manufacturers don’t go after emulators for systems that have been discontinued for years, I believe because the system is no longer in market. In fact, sometimes they support it! Like Switch Online or PS+ Premium (dying for more PS1 and 2 games). Don’t expect a PS5 emulator until at least 2036. Also don’t expect a Switch 2 (or whatever it will be called) emulator for a long time. I also feel that emulators based of newer systems should have a stigma around them (imagine somebody harassing you into getting the real thing. For example: “Don’t use Yuzu, get the real thing you broke asshole who can’t afford a Switch. There’s 140 million of them, it’s not hard to get. And Nintendo will hunt you down for using a Switch emulator and illegally obtaining its games.” Or “Why the hell are you using Yuzu or Ryujinx? About 95% of its games have been released on Steam, so what’s the damn point of emulating these games? Just buy a Switch to get those games or use Steam to buy those games.” We need to see more Anti-Switch emulator comments like this, they’d be gold) whereas older ones are totally safe to use. Additionally, I don’t pirate newer games, I feel like I’m gonna get in trouble for it but I don’t feel bad for pirating old ones because some of them are very difficult to obtain.

    They've gone after Dolphin and forks of it before (like Slippi). They don't care if the consoles are out of print, they feel that because they made it they get to tell people how they can use it, whether we bought it or not. The reality is that Nintendo doesn't have power to do anything other than sell their products on the market, and people will do what they want regardless. They can throw a tantrum all they want, all they're doing is wasting time and resources while turning people against their brand.

    I have a Switch and emulate many of the games I own, which are first party games. Sometimes I also exclusively emulate to use or create mods because I don't want to mod my Switch, so er...no. Even if I didn't, I would never jump against people developing emus for current systems because that is the key to success. Dolphin is only as good as it is because it began development 20 years ago(including being able to emulate online features before they shut down, making restorations much, much easier), while the GC was still recent. PS4 emulation barely got started, which means it would have been a disaster if they didn't start until the PS5 came out. Same with Cemu. Same with *instert whatever other emulator started early*.

    Nintendo is just fighting fire with fire at this point. They know fans will fight back in their own ways to keep emulation alive. Emulation itself is not legal. Reverse engineering is legal from that Bleem case. Roms are strange though anyone can download if they know what they are doing. 🤷‍♂

    @@VideoGameEsoterica I have an honest question about downloading roms. Legally its pretty bad but if its the only way to obtain said game is it okay then? Like for example. If the studio shuts down or the game is no longer available.

    I guess I also need to turn up my scrutiny on whether I really "need" further Switch games. I've got enough retro games to keep me busy for the rest of my life so that is a legitimate question at this point.

    Yup, like I said in the other topic, SEGA Joined. Either it's that company that uses AI is doing it by themselves (to get them as a client), or SEGA is now also part of it (more likely). Or just false positives by the AI, even though they are not SEGA and LEGO titles.

    @@VideoGameEsoterica I also am not quite ready to dismiss false positives by AI yet. Like you said that Sonic Adventure was on the Gamecube. AI Learning algorithms can make, too us, weird connections sometimes. But it could also very well be that SEGA did get in it. But it would be quite "dumb" of SEGA to go on this warpath, as they got a lot of name recognition from folks like yourself who dumped, preserved and catalogued their arcade/console games. But my thinking probably is very wrong, as I'm biased in this topic.

Against Intellectual Monopoly is the most informative book humanity has on the subject now. Against Intellectual Property is another incredible essay, but it’s written from a right-libertarian perspective so if you’re, like me, not right-libertarian you’ll have to read with an open mind and extract what’s helpful. _Only_ these two texts are the gold standard when it comes to intellectual property.

    DMCA yes but whether they make use of A.I. or partners to send these out, right now they rather fuck up the whole gaming scene. Even if we all agree we mustn't share these games in most countries (Luxembourg and Switzerland for instance handle backups different), there's nothing wrong about modding games.

    I feel bad for all the kids today who aren't going to grow up in a world where they can enjoy a free and open Internet. I wish Nintendo would just embrace emulation. Imagine if they had a first party emulation front end for all of their software and previous systems. You pay a monthly subscription of $19.99, you get access to the entire Nintendo library. Micro transactions for texture packs, the works. They could even push ads through it and get revenue from that, and they would already be way ahead of their competition vis Microsoft and Sony. What's amazing about Nintendo emulation is that entire back catalog becomes modifiable to be 4K, high frame rate, etc. Nintendo capitalized on emulation once with the classic consoles there is absolutely no reason not to turn emulation to something they can use and profit from. they could even hire the devs they've gone after and use the code they've written. But no, easy greedy money

    OMG I’m so upset right now for this!! This year 2024 is gone down hill now. Nintendo is very evil just like trump, They ruin Roms as Nintendo and Sega on vimm lair, I hope not gonna hit Spyro and crash bandicoot fans. But I love emulators when I started 2022 was testing. Just like they did on emuparadise in the past years. And if they hit another Roms, I’m not kidding and excited about this. DMCA has to be gone for good, besides im I love playing emulators while using my computer for fun and I’m supporter of retro video games And emulators. Even worse I’m not getting old games console when it breaks.

    Good. I am 100% on Nintendo's side on this, because they are 100% in the right. Both legally AND morally. Dumps of commercial roms are NOT "preservation", it's theft. It's straight-up, 100%, objectively, by any legally defined means possible, absolutely, undeniably theft. Anyone who disagrees with this is L I T E R A L L Y wrong. When Nintendo went after Yuzu, it's because Yuzu specifically uses Nintendo owned firmware that was created and copyrighted by Nintendo to be placed within the emulator to even make it function or read games. That's why they went after it and they were right to. Even that aside, things like Yuzu and Citra are absolutely 100% means to play stolen video games and that's ALL that they're good for, and everyone knows this. Commerical roms have always been and will always be unethical and legally wrong. Dumps and backups, when traded, given to another person, is legally, morally, ethically 100% theft and piracy. There IS no way around this. It just absolutely is and anyone arguing against that is objectively wrong. Nintendo is in the right with this, always has been, always will be. Nintendo is protecting their intellectual property from thieves. That is their standpoint, their view, and the motivation for ALL their actions..... and they are RIGHT. Whiny kids on the internet pretend to get angry and outraged about this even though they really have NO right to do so. They don't like it and cry about it because they can't steal games anymore, and somehow delude and brainwash themselves and each other into thinking that the mere act of being on the internet makes it ok to steal whatever you want.... somehow. This delusional behavior has gotten so bad after so many years of ignorant people on the internet getting away with what is essentially internet shoplifting and petty theft every day for so long now, that they actually feel ENTITLED to it. Even though it's Nintendo's games. It's Nintendo's characters. It's Nintendo's property. Imagine someone just breaks into your house and steals every valuable thing you own. And that if you go to the police, they just laugh in your face because they tell you "Well everyone agrees that every other random person has a moral right to take all your things and get away with it, so sorry we can't do anything. It's your fault for getting robbed anyway." That is basically the bizarre, backwards insane rhetoric that ignorant internet kids... like 99% of the people in this very comment section I'm sure.... are using to somehow justifying themselves for being thieves, and somehow blaming Nintendo... the victim... for trying to do something to protect themselves. Its lunacy. Sheer, unhinged lunacy to be painting NINTENDO as the bad guy for getting stolen FROM and PIRATES as the good guys for plundering whatever they damn well feel like from Nintendo, whether it's their characters or literally their actual games themselves, just because it was there to steal. It's not just crazy that you all think and believe this, but it's downright sick, too. Well, everytime Nintendo finally sticks up for themselves, does the right thing AND finally manages to recover some justice back for themselves from millions of literal thieves...
