i think salem should not still be banned, based upon the fact that what he did was less bad than what others in smash community have done, yet they're still fine but yet salem cant do anything anymore. Seems like community bias/unfairness. The punishment should fit the severity of the crime, but that's not how things are atm in many situations for many people.

Not that i think nairo is innocent or anything but he has a very good legal reason to not release his information. It's a situation sometimes called the paradox of statutory rape where acknowledgement of one crime implies the other. Therefore both parties can be guilty of a different crime from the same event. Proving his rape case will incriminate himself for a statutory case. Both parties are quite literally better off not pursuing this any further.

Samsora's ban was completely reasonable - he knew Zack and Nairo were dating, and he let it happen. Knowing about any form of child abuse and not reporting it is a serious offence which both Salem and Samsora were guilty of.

I vividly remember how the Zach guy was bragging about seducing him and getting to do things to Nairo. Honestly, I don’t feel sorry for him.

Even though I enjoy Tech's personality and gimmicks the most on doing these expose pieces, I personally liked this video better! You hit the nail alot harder on how heinous this all is. You covered every single angle, counter argument, possibility and variables alot harder and resonated alot more morally and emotionally. You really made sure you pointed out the MORALITY in all this nonsense from all angles to see it and how it without a doubt warrants an official ban even in the most charitable interpretation of the situation. Nairo was a 20 year old who plays a nintendo game for a living at the time, not even old enough to drink. One could argue that Nairo was not a fully functional/developed adult at that time since brains don't fully mature until the mid to late 20s. Zack was a manipulative predator who took complete advantage of his age, it's not as black and white as you may think it to be.

The basis for your argument is really wrong. Many times what people want in situations like these ones is closure, acceptance, and to continue on trying - trying! - to carry on a normal life as much as possible. If the arrangement was reached between the parties involved, and there are no criminal charges being levied by authorities, then it is very believable that those involved have agreed to settle the matter and move on with their lives. This much should be respected by outside parties regardless of the context or circumstances that surround the event. Now, whether that 'exonerates' anyone in the court of public opinion, that is a different matter altogether. But honestly this peanut gallery nonsense that is a mainstay of gossipers and drama chasers is pretty ridiculous and frankly gross.

I am speaking about this specific document in particular - in a case where it looked like a grown ass man flirted with a 15-year-old boy and fucked him. Said adult who receives support from a community of people who are just NOW beginning to find the context of what he was doing a little suspicious at the very least, after years. A case involving many big names and figureheads in this particular community. I don't care if you call it naïve, but I would like to be apart of this community and if they are going to ban someone for telling a bad joke or ban someone for creepy texts with a minor, but then Nairo comes along, I think a precedent should be set. And the only thing that would go against that, logically would be document that would, "Ultimately exonerate" him. I don't need to see the damn document, I don't care about Nairo. I can only assume it is because you're trying to view this in a broader scope and remain general rather than zooming into what is going on in the situation itself, which causes you to conflate banning Nairo from Smash events to the Salem witch trials. So allow me put this into perspective for you. This is not in any context similar to the Salem witch trials. Yeah, when false accusations are made, they can be viewed in that light. This is not one of those cases. If the accused party were stated to be a witch, if memory serves me right, they would be killed. Nairo will face no consequences from being banned, he isn't being jailed, he will still stream his content and have friends on his stream, he isn't losing any money. People in the Salem witch trials were fucking dying. And I get the point you are making isn't that they are 1:1, rather it is akin to that. But no. I still disagree. I just fucking told you the motive behind wanting to see the legal documentation that would exonerate him, and you view that as me saying he's guilty baselessly. People have been banned for less, people have even been arrested and jailed for less. Cinnpie is banned and rightfully so, however there is LESS evidence than her doing anything with Puppeh than there is with Nairo doing stuff with Zack. We literally took his word and banned her ass. ZeRo was banned, rightfully so, but yet again for doing LESS than Nairo, and he was accused of more than Nairo, but had been cleared on all of his accusations except the one, which despite there being a gap between the dates in the screenshots and when the actual conversations took place, there was STILL no incriminating evidence. And yet his ass got banned. Anti, literally wasn't his fault. But he should be banned for displaying he was unfit to be in a circumstance by enabling underage drinking and some other actions. Nairo, from the accounts of 4 different people had been feeding into the immature dynamic of Zack flirting with him. Even if jokingly? As a 20-year-old man at the time, I'm 19, that isn't something that's normal. I wouldn't flirt or cuddle with a middle schooler, that is the last thing I would joke about and it's genuinely disgusting. The only reason Nairo wouldn't be guilty of escalation, is if you somehow manage to believe that he has been getting blackmailed into feeding into that dynamic, the dynamic which has evidence of it being fed into - even unprompted in an instance by Nairo, from the start. And I'm not buying it. I get you saying if the Vic Mignogna situation or the Lui Caliber situation were akin to Salem witch trials, because the parties making the accusations had literally no evidence to substantiate their claims. They cried wolf, and people acted accordingly even when there was no evidence. Even with the Johnny Depp situation, same thing happened. Nairo, if absolved from accountability regarding sexual misconduct with a minor by the document ultimately changes little to nothing because he is still guilty of escalation. If TKBreezy and Dabuz can easily say no or express discontent for how those actions look, I don't see why Nairo couldn't. So then, you have his lawyer come out and explain how he has a document conjured by the 7 magic dragon balls stating how it could exonerate Nairo even with evidence to the contrary, and when so many people are pushing to get you banned and defaming you, you're not going to show it? Maybe he can't but again, it changes nothing. He should still be held accountable for finding it okay to cuddle with and flirt with a minor. By doing those things he expressed that, similar to Anti and MVD, that they shouldn't have been allowed in those situations because they don't have the capacity to do the right thing; they were unable to be held to the standards of a regular adult who wouldn't flirt with a child.

@@tomb5511 And the part about it being handled incorrectly. The dude was already banned for this, but then everyone campaigned to get him unbanned because he had reached a legal agreement with Zack. We took word of mouth from who has displayed he lacks the brain capacity to be held to the same standards as an adult, that he was the victim. When he was feeding into a relationship with a minor. Cagt stated he couldn't remove people from the GBD unless they provided them with evidence contradicting their ban. I am telling you this because they literally operated on a guilty until proven innocent system WAAAY before Technicals campaigned to dispute Nairo's unban. And he almost used the momentum for the ZeRo situation to make a bigger move while he had the most eyes on his channel he could, but it was halted and staggered by the commentary community, there was literally nothing he could do about that.

ZeRo gets banned off of an allegation and a bunch of lies from distrustful and jealous people who plotted his downfall while Nairo has admitted to what he did and everyone was well aware of what was going on with Nairo and Zach along with the fact that Zach was known to do exactly what he was accused of. Nairo's story makes little sense and regardless of you thinking it's true or not he still allowed it to happen and if ZeRo and others deserve to be banned then Nairo more than deserves to be banned.

I used to support the movement back when the unbanning happened, because without the screenshots it was tough to debunk since there was a settlement and people who previously condemned him switched stances. Tech finding the incriminating tweets was enough conclusive evidence to realize it was not as one sided as Nairo made it seem. I do think some of the people who still support him haven't seen the screenshots just from the fact Tech is the one spreading them and a lot of people just dislike Tech so they don't engage. I engaged without some outside of tech threads and after seeing the screenshots they did start doubting Nairo, so it seems to be, as you said, a problem of mob mentality and following and trusting your favorite top players.

Nairo was my favorite Smash content creator and initially the mythical document gave me hope for his exoneration. Though as time passed, and you really look into it everything looks HORRIBLE. It appears horrible, it sounds horrible, it feels horrible. Yet somehow people rally behind him and others before him get banned for seemingly less horrid claims or deeds than what Nairo has "allegedly" done. He truly is Smashes golden boy, and they'll do everything they can to uphold his reputation.

It might be like the Leffen situation, literally everyone dislikes him now. I'm sure if enough top figures or people express disapproval or disdain for Nairo, could easily destroy his following and view count. You will always have a few stragglers who will support him for some reason or another but it could happen. And I'm hoping that's what this may cause.

I had no plans today but I do know that 20 minutes of it was immediately allocated to watching this video. Also Nairo's case broke me. He was easily my favorite to player, but I just can't give him an audience anymore. I don't care about any supposed pressure, blackmail, or what. Nairo changed his story 3 times. 1. Denied it 2. Admitted it 3. Claimed he was raped and has a 30 page document that exonerates him that almost no one has seen. Why would someone change their story 3 times I wonder?

I’m usually 50/50 on your videos. There’s a part of me that would like you and tech to cover different topics. Good point. But, in my opinion, ZeRo needs to be banned for the sake of PR. More people probably heard all the allegations than Technicals' debunking them, with the exception of the Katie stuff. And more people would probably not have heard how he's not a pedo from Tech, rather that they would think he is. I think Tech knows this, he said that the Katie thing is good grounds to keep him banned. (This is not important to my argument, but let's not forget that ZeRo's 1000% retired from tournaments, so he wouldn't go to any of them in the first place.)

Like you said, Nairo had to agree to keep the info confidential otherwise he breaches the legal contract and can get sued by Zack. He had no reason to settle, unless he was also in the wrong. Usually people settle due to that reason.

I can't even believe that we have to humor that discussion to begin with. The case should start and end with "Nairo had sex with a minor, making him guilty of statutory rape." End of sentence. There should not even be any discussion about this settlement. I would not even be remotely surprised if part of that settlement involves him paying Zack a portion of whatever he makes from streaming, and the people who supposedly saw it are vouching for him just so that he actually can stream and not go bankrupt.

The innocence project is there to help those whose been wrongly convicted by exonerating those who have already been incarcerated. Nairo never went to prison cause he never went to trial. The innocence project wouldn't even work because there is actual proof of Nairo flirting and cuddling with a 15 year old kid. He let a 15 year old kid blackmail him into having sex with him. If he had to come to a point where that's the only logical choice to get him out of a bad situation, he has already screwed up in life for him to come to that conclusion. People settle all the time. It is common to see that in a settlement both parties are not to release any legal documents outside of those approved by both parties in the settlement. Heck with plea deals (which is a form of settlement just on the criminal side), we find that not guilty people take them all the time often decades later. So i disagree with your statement that settlement = liable or guilty. Sometimes even if you are correct it is smarter to go for a settlement since 1. Evidence is usually not disclosed to the public and 2. Less headaches, emotionally and financially.

It’s so puzzling how the creators whom are hyper focused at going after Nairo (rightfully so) fail to acknowledge Zero deserves the same focus, even if his crimes are (at least apparently) less severe. It just seems like the “this person is my friend” factor is the only factor on any of these cases. Both parties being absolutely merciless against the other guy and completely forgiving with their friend. And all these mountains of evidence and morality grounds while completely ignoring the victims feelings and damage, which it’s literally the most important thing.

Hi, I'm a nario fan, and I have to say, I 100% agree. I do not think Nario is to be unban either as the smash community has plenty of cases of double standards. I do believe in second chances, but being banned should be a reminder to never let a similar situation happen again. And although I usually have 100% faith in cosmos, void, and internet funny man, I just don't believe that they know that this 30 page evidence is enough to 100% confirm inoccent, and like you said, it wouldn't make him inoccent either. What I think should happen is what's Nario kinda doing, just moving on and making regular smash content without being involved in the smash scene in any way, but considering how much cosmos yuzu sessions happen, that's not gonna happen. My God, I just wrote a SAT short response over a video. Anyways, great video, loved it!

The different ways Nairo and Zero are treated by the community for their accusations are baffling. Nairo, we know for a fact he did sexual acts with a minor, but somehow gets exonerated, while Zero supposedly shared hentai with someone who lied about their age online, and we don't even know if it's true, yet Zero takes all the hate. The difference seems to be in their connections.

Well and their attitudes. I remember that went it all went down, Nairo admitted it and ducked out and we never heard from him until he released his legal statement after going to therapy. In contrast, ZeRo then made not one, not two, but three documents explaining himself each time. The problem was that there was language with classic words and phrases that is attributed to classic deflection, gaslighting, and outright negated statments (ZeRo lied). So essentially, he dug his own grave even more when he was in a bad spot in the court of public opinion. Essentially Nairo played it smarter than ZeRo did. ZeRo burned a lot of goodwill before leaving and seeking legal counsel. While Nairo said he did it, ducked out of town, got therapy (paid by NRG, likely a contractual term), and found a good lawyer. What I also think helped Nairo was that Zack was immensely hated in community for his taunting, actions at EVO, his morally ambiguous relationship with Ally (and blackmailing Ally), and match-fixing (big nono in any competitive game or sport). Heck it was bad enough that Zack's friends testified against Zack's original testimony which meant that Zack's credibility went down the drain even more. I am not victim blaming here, but the fact is that the alleged victim here is no saint which likely contributed to the better public perception of Nairo than ZeRo.

Hmmm, I wonder if this is at all related to why Nintendo won’t endorse the competitive scene? Everyone seems to be mad at Nintendo for not wanting to give a license to events. But if events are ok with having predators attend… it’s almost like a family-friendly company wants officially recognized events to be safe for minors. Because people will realize what it actually is. How you phrase things will come out totally different depending how you say it. Hes not grooming, he's being a passionate hands-on instructor. "He's got potential man"

Before a lot of the stuff came out, most people didn't imagine that there could be quite a relationship underneath. In fact most people who saw these things, even at locals testified that they thought the two were just really close friends. Same with the Puppeh and Cinnpie thing because people knew she wsaa mentoring him, so they thought it was teasing. The vast majority of people are not going to assume the worst (you know statutory rape or illict relationship) without adidtional information or context. This is a classic hindsight is 20/20. Now afterwards, well we have more context now.

I still watch Nairo. I’m no saint, neither is anyone else in this world. Zack has a history of being a predator and manipulating ppl. Nairo has a history of being a good person and tending to his self. Enough for me honestly

I hate to say it dude but despite it not actually being the truth, blaming a 20yo for being assaulted by a 15yo because he flirted with the 15yo is still victim blaming. 15yos are fully capable of assaulting people (or did we all forget about brock turner?) and while flirting with a minor is fucked up, nairo still wouldnt have been "asking for it". thats a fucked up thing to claim.
