Man Jailed After Hertz Reported Rental Car He Paid for Stolen

Rental car company Hertz has a slogan that says “rent the car, own the memory,” but some folks who live in the Atlanta area say their memories of renting from the company are ones they would rather forget. They all say they were charged with theft after Hertz incorrectly reported their rental cars as being stolen. Inside Edition’s Investigative team found people who say they were arrested, and even spent time in jail, after being accused of stealing rentals cars they properly paid for.

Like the video states the 'confusion' occasionally occurs when someone either extends the rental period or swaps vehicles & the paperwork wasn't properly filed so in the Hertz database it shows that the vehicle is missing &then they report it stolen.

    6 months in jail ? That’s beyond illegal , you have a right to a speedy trial , if he wasn’t tried or sentenced, wth is he doing just sitting in purgatory for? That’s not how the law is supposed to work. But I suspect there is a lot more to the story.

    I would actually try to rent more but keep my receipt And when they acuse me of something like that I would gladly stay in jail for a couple days then take out my receipt and boom sue them for a fat settlement

    To hell with their apology. I could give a rats ass about needing to hear sorry, as that word means nothing to me. It's one thing about mfs that don't possess, know or experience what being cared for feels like. They will *always do the worst without a care, only to revert to using kind and "caring" words with the intent to wiggle their way out of experiencing whatever rank repercussions. It's disgraceful!

    I hope they sue and get millions, this is unbelievable and terrifying. I could see maybe a mix-up and you go it to jail for a few days but 6 months? Unbelievable. Not to mention the fact that these people could have been killed over this mistake. Stuff like this should not happen, and when it does the price to pay needs to be extraordinary.

    @@krane15 there have been at least two cases where people have spent years in jail because they had the same name as a known criminal. There’s one case where a 25 year old black man was jailed in Las Vegas for weeks because he shared a similar name with a middle aged white career criminal who was also several inches shorter. Another case I heard of was a homeless man who spent two years in prison in Hawaii because he shared a name with a man who’d been in prison for nearly a year before he was arrested in Washington state.

Benjamin Franklin What is worse, is that over 50% of those innocent that were convicted, was due to police or prosecutor misconduct.     Well think about it. They report to the insurance, they get a new car. For all we know it was done on purpose. I hope they get sued big time for this. They have the receipts to prove it. Also during Covid lock down thousands of convicted criminals were released into society and they put these good people into jail? How does this make any sense. Our community was upset because 11 sex offenders were released into our community. Many of them re offenders.

    There's this and there's the case where a man spent almost 5 years in prison for a murder he didn't commit. Hertz had the evidence that proved he was innocent but refused to turn it over despite several subpoenas for that evidence. They owe him booku bucks.

    It's the cost of defending your innocence that's offensive. You may not get your job back, your friends may not believe you, you may have trouble paying your rent after losing your job, or your car payment, or your utility payment and you still have to hire an attorney to defend yourself starting about $2,000 up front. Even if you win, doesn't mean that Hertz will pay up or in full. Nor will the court or Hertz help you clean up the mess they made of your personal life. That's a permanent loss.

    This isn’t the first time hertz did this. A few years back a guy was charged for murder he didn’t commit. He had an alibi that he was in another city and rented a car from hertz. Hertz claimed they didn’t have the receipt and for years the guy sat in jail. Until they revisited the case and a judge demanded hertz provide the receipt. And what do ya know they have it.

    It happened to me about 10 years ago in DC. The police officer was extremely kind and new it was an error by the rental car company. I was renting at that time from thrifty rental car.

    Hertz did the same thing to me. A Georgia State Trooper pulled us over after signing on our new home after moving to Atlanta from Los Angeles. Hertz reported the vehicle stolen. Even the trooper believed me and verified I was telling the truth with Hertz. I was still charged with theft by conversion, sexually assaulted by a Dekalb officer at the jail, humiliated, deprived necessary medical care and food. This was after the trooper notified the judge that Hertz acknowledged their mistake to him. The judge demanded I be immediately brought over to the court. I was not. The judge sent the trooper to get me. The judge ordered me released immediately and said he would not be surprised if I sued Hertz. The jail still kept me anyway. Hertz never apologized and never even gave me my money back. I still have PTSD. And this happened in 2004 or 2005!!!!!

    By the sound of it, HERTZ isn’t giving an apology to anyone just justifying their unbelievably wrong actions. That says a lot to me. If I ever have to rent a car I won’t be going with HERTZ. I hope many stand in solidarity with those wrongfully accused & arrested for nothing. Company should change its name to HURTZ so customers know what there getting into when renting a car from them! 👍

    Those cars were all grossly overdue. Those cars were stolen but the renter’s and they found a lawyer to try and say it was all a misunderstanding. If you rent a car for 3 days and don’t return it for months ya in a stolen car.

    That man who spent half a year locked up, every cop who ever pulls him over will see that he was locked up for a felony, but they won't see that the charges were dismissed. He also has a mugshot forever. His life absolutely was ruined, let alone the mental trauma. Absolutely disgusting, and the fact that man has to fight for compensation after they had him locked up wrongfuly for half a year is mind blowing. though, this brings up yet another huge issue in our legal system.     Hertz has a PR disaster on it's hands. I would never, ever rent from them based on everything I am seeing about in these videos. They need to apologize right away rather than being arrogantly dismissive of people's claims. It just goes to show how horrible and terrible their booking and tracking technology is.     You cant give hertz all the blame for the arrests. That actually falls on law enforcement. If they just did their job instead of blindly go along with what a corporation says, they would have done a proper investigation. Any time a citizen has to prove himself innocent, that's a problem and goes against the bill of rights. Whatever happened to innocent until proven guilty? This is what happens when you train cops to believe everyone is always guilty.

    I have problems with policing too but cops don't determine innocence or guilt...that's determined in the courtroom. Judges issued arrest warrants for these people (based on Hertz's claims) so the officers did their job and went out and collected them. That poor man sat in jail for 6 months because he was waiting to have his case heard. The system is broken.

    6 months in jail for a crime he never even committed. This is not the first time that I’ve seen stories about this. How is Hertz still in business?

    I worked there. It's literally impossible to make this mistake. When hertz rents a car the system automatically updates.

    Well, they won’t ever get a penny of my money! This is wrong on SO many levels! I can’t imagine how all these people felt having guns pointed at them, placed in handcuffs, all because you rented a car. Shame on you Hertz! You owe these people more than apologies, I hope they sue you for everything you have! 😡😡😡

    Yup we were going to take a road trip once...but after hearing and reading so many horror stories about car rental companies, we drove our own car. Possibly saving us many troubles.

    Do you rent cars often? Most the people commenting aren’t their target demo. Companies don’t care as it’s whoever is cheapest or gives them a break. Not attacking you, just saying it doesn’t really matter.

    Obviously it doesn’t. In those four cases it doesn’t seem like they did anything before reporting the vehicle stolen. Thank you for this report so I know not to ever rent from Hertz again.

    Hertz has been doing this for years...there is a massively long history of this and other strange incidents happening to people.

    I was planning to rent from them, good thing they told me I have to use a credit card, because I was a young driver, I left there and went to enterprise, never had a problem with enterprise.

    What I don't understand is why can't you show the officers your contract for the rental car and specified dates. That clearly gets you off of the theft of car.

    Not necessarily. I saw a police vehicle cam on KZread where a lady did pull the Hertz rental car agreement from her glove box and the officer still arrested her for car theft anyway. All the officer cared about is what was showing in their system, not on the paperwork she had. I could not believe many of the commenters were defending the officer's actions after being shown the signed rental agreement.

    people think they can get away with anything these days. making a payment , signing a contract does not release you from the terms of that contract. politicians have encouraged this behavior and don't hold people responsible for their actions anymore.

    How humiliating and embarrassing for these poor people. Wow Hertz should have to pay them some big money for this! That is insane. I would be so flipping angry it would be crazy and I would sue the hell out of them too!
