Legal Analysis: Can Amber Heard Win on Appeal?

Virginia trial lawyer Robert Byrne evaluates Amber Heard's case for appeal by taking a look at the arguments Elaine Bredehoft is discussing in interviews.     Of COURSE she is being demonised . She was demonised EVERY SINGLE DAY of this trial , simply by the ridiculous daily circus outside court; .the biased fans inside the court and the TV coverage . She could have been mother Theresa , and STILL would have been mocked, pilloried, relentlessly meme’d , Tik tokked and social media bashed, simply bc she was up against capt Jack Sparrow . Had the judge done one scintilla of research into his social media bias ; vigilante fan popularity , she should NEVER have allowed cameras or fans into the court room . Cant do anything ab the daily zoo and circus outside ( literally , w damn alpacas and Jack Sparrow costumes … abs ludicrous daily circus ) A total travesty of justice and prejudicial from the beginning to allow cameras in . A shambolic trial which was tarnished from the beginning ....unless the jury could be sequestered , given the extraordinary public bias , it should NOT have been a trial by jury . T

    Elaine is so low. I used to empathize with her for having a bad client, but at this point, she is just an extension of Amber Heard. Dishonest, gas lighting, bigoted, manipulative, and just plain incompetant.

    I agree. I felt sorry for her because she was in an impossible situation with Amber as a client. I'm appalled at her behavior now. She's so unprofessional and out of touch with reality, similar to Amber. She knew Amber got caught lying multiple times. I have to wonder if she is just doing this for her own 15 minutes of fame. She's insulting the judge, the jury and basically all of America, like we can't hear and see the evidence for ourselves. The jury saw it like everyone else. They didn't believe her. The one juror said that by the time she was talking the story of her dog stepping on a bee, he knew she was pulling stories out of the air. He also said they did not like how she was staring at the jury throughout the trial. Elaine needs to get a grip.

    The legal system is broken, but that's beside the point ... "harmless error", etc., but 90 percent of cases reversed on appeal and get retried come out with the opposite result -- that's how devastating a judge's rulings are ... but let's look at just a couple rulings/items: 1. Allowing in Settlement Negotiations made by Heard's lawyer in her divorce case. Will lawyers anywhere be able to try to settle cases in the future knowing that all their settlement communications may be used against their clients? 2. Failing to pay charity pledges. Unbelievable. 3. When Depp's able lawyers (superior and better connected than Heard's, obviously. Who pro hoc viced them? And where did they find their experts? and Heard's team their "experts"? Did her lawyers have much trial experience? Didn't appear so. I had a lousy expert once and when you have one you lose.) ... When his able lawyers claimed Heard had recently made up false claims, don't her 2012 statements to therapists have to come in? 4. Lots more, but I don't have time for this and would need to see the records anyway, and jury instructions. What did you think of the judge's jury instructions counsel? And isn't this just all a story of the richer and more powerful winning? Didn't Ruppert Murdock's company/paper win in London? And Depp won here. Is it just a matter of us English speakers having the best justice system money can buy? (Oh, and it's obvious to me that Depp's "PR people" paid trolls to stoke the social media fire (and I am sure there are some "organic" ones too. that's what happens when you have a lot of money creating that and such a popular figure as Depp. I love lots of his work. I didn't know who she was until this trial, but it does appear she's being picked on. Oh, and what is the required analysis in Virginia to allow cameras in the courtroom. That seems a very poor decision by this jurist who appeared unqualified to handle such a case. What do you think?

    @@jrjr9358 The jury instructions were debated and agreed upon by both lawyer teams with the judge ON CAMERA. They had plenty of chances to object, and both sides did voice their objections and make modifications which he judge accepted/noted. Those are the jury instructions which were read out and explained to the jury. There's no issue there, since both legal teams cooked up the instructions together on the final afternoon. This was livestreamed.. so.. Second, the reason the court decided to livestream was, the "thronging crowds" that would show up in support of either plaintiff or defendant, since both are famous and this is a hotbed issue (DV victims/ believe all women/ me-too focus etc). To avoid that, the court *proposed* putting cameras in the proceedings, and Depp's team agreed, and Heard's team initially opposed, but had to accept because they could not give a convincing argument as to why not. Despite the livestreaming, the room was packed daily, with hundreds spending the night on the sidewalk just to get a seat and many more hanging about the premises the entire 6 weeks. This case was more than fair, because everything Heard's doctors reports say, SHE told them. There is however, no record of any doctor visit that shows she was treated for any form of physical assault. So what exactly did Elaine want to reintroduce, when it has already been rejected as hearsay? If Depp had medical records or other chats etc where he is TELLING someone, this happened that happened then amber hit me etc, it would also not be accepted as "evidence". At the very least, the doctor notes should mention the bruises / hernias etc, or the friend has pix or made comments like "omfg what happened to you!!" Or published something to someone somewhere closer to that time, that they had witnessed such injuries or acts. None of that stuff is there. Now, for 6 years or atleast some of that time, everyone believed Amber's version of events. Because we all know "pix or it didn't happen" does not and should not apply to DV situations. So what hurt Amber's case? Quite simply, her own recordings. They are what clued everyone in to what a crazy and aggressive person she is, and that mostly Depp was just trying to gtfo of there, not hitting her over very long and shouting arguments. Not in one of those hours and hours of vitriolic arguments, recorded - sometimes secretly - by HER, is there any evidence of him physically lashing out or there being any threat of that happening. This combined with her strange acting on the stand, wherein she can turn the crying face/voice on and off like a faucet, every time there was an interruption, clued us and the jury in to the fact that she is not really traumatized but pretending that she is. Human beings are not idiots. We and the jury people make atleast 10-15 decisions daily, about the veracity and credibility of what is being said/ done/sold/offered. As adults we are well-practiced on the art of instinctual reading of body language non-verbal and verbal/visual clues. All this factors into our decision making. If she had left well enough done alone, she would have several million in her account with nobody asking questions, a role in a successful movie franchise, a lucrative endorsement contract, and v probably more to come simply on the strength of good old hard work. But she already got a VERY GOOD START. She should have left it alone, but she couldn't. Either her abusive desire to bully and make her victim squirm & suffer even more for her sadistic enjoyment, or her pragmatic wish to promote her Aquaman movie in 2018 was a decisive factor in her choosing to write and publish that defaming op-ed. Neither is a "noble motivation", to speak for DV victims.

    Actually that is true. There are articles online stating that Robert Palmer son of Andrew Nichols worked for TalkRadio, Rupert Muduck (Murdoch) owner of TalkRadio sister company of the Sun. Robert was involved with the person who wrote the article about Johnny being a WB. It is stated a lot of evidence for JD was not allowed by judge nincompoop, even I witness testimonies that would have won the case for JD. The judge for the UK trial was corrupt. Elaine needs to do some investigating herself.

Secondly, the jury awarded $2 million to AH… does that sound like AH was “demonized?" Elaine can't see Amber’s lies and malice “demonized” all hope of winning this trial.

    Absolutely correct, there were at least half a MILLION jurors in this trial (people that watched ALL of the testimonies and saw ALL of the evidence presented). We ALL concluded that Johnny was telling the truth and that Amber was lying !!! Definitely a FAIR trial !!

Awful professional, she did not even know how to ask the witnesses without being objected again and again by Camille Vásquez.     I don’t think she’s gonna want to appeal this to a higher circuit. They will slap her with perjury if she keeps her lies up. The higher the court , the more serious they take your claims and expect you to tell the truth.

    @@MsCaryopteris That is the best question yet! The only reason I can see is AH and team keep dangling this appeal over the court's head. I believe that the judge wants give them enough rope to hang themselves. These lies and insinuations will come back to bite them on the behind. AH and Elaine are digging a really big deep hole and they may end up getting adjoining cell! Elaine needs to be more careful or she could lose her license.

    Correction Elaine, AMBER did not win in the UK case….“The Sun” did. The difference in this case vs. UK, is that Johnny actually got a fair trial here, AND the public got to see it all first hand, unfiltered.

    Defamation cases against press are almost never won … as you cannot prove malice or them knowing that it was false. They can hide behind “it was a developing story” or “these were the facts we understood at the time” What was interesting - the UK trial did force testimony under oath, which allowed Depps team to prepare effectively, and use each witnesses deposition/story to impeach each witness. Clever legal strategy - make amber reveal all her evidence ahead of time.

    Social media may have, in fact, affected the jury’s judgment; however, not because the jury checked out social media on their own time, as against the judge’s instructions. Remember: it was Elaine’s expert who first presented the hash tags that were trending ( remember the proverbial 4 hashtags) in the Twitterverse. This gave the jury a glimpse or idea of social media’s inclination. But note: it was Elaine’s fantastic lawyering that allowed and first introduced this data to enter the courtroom. Any lawyer worth his salt would have fought not to get any such data on public opinion in the courtroom. Depp’s legal team merely reacted on it from there. Elaine, you laid the red carpet for social media to have a voice inside the court.

    This "He had his chance in the UK" argument makes me angry because it's so incredibly disingenuous. The UK case was between different parties, under different laws, making different claims, held to different standards, looking at different facts, and in a different legal system. It could barely be less relevant if it tried. And Elaine knows this very well, yet continues to lie about it.

    Elaine makes it a thing because Heard is her big movie star client and her first big bank roll. Truth is the UK trail wasn't even against Heard. She just wants to make it about her to reinforce the failing evidence and to corroborate her story in the Fairfax VA case. Heard and Elaine are both waahouts trying to make it big, and flopping.

    Amber also lied in the UK case (in more than just her abuse evidence) about the money she "donated" to charity. She said she donated all of it by the UK trial, and the judge accepted her word on it without further evidence.

Blaming the jury, saying they saw and or participated in social media is reprehensible to me. She picked that jury along w JD’s attorneys. Also, in Va, isn’t it true that for AH to appeal she has to post a bond in the amount of the defamation with malice judgement, 10.35 million?

    Just curious about the alleged 'medical records' that Elaine claims was 'suppressed' in the US trial: these are supposedly reports by AH to her psychologist/psychiatrist about having been physically and/or sexually abused by JD. My questions are....If her doctor believed her, then wouldn't the doctor be ethically required to report it to the proper authorities? And if her doctor had reported the abuse, then wouldn't there be actual hospital/ER records of injuries to back up AH's claim? No judge would've suppressed hospital records like that, since it would've been critically important to the defamation trial. Just the fact that AH's 'mountain of evidence' seemed to contain a lot of other useless evidence--as opposed to what would've been pretty much unassailable evidence like a hospital report--leads me to believe Elaine is again making a mountain out of a molehill (pun intended).

    The more evidence that Heard presents, the more evidence there is against her. All she has is more stuff that proves Johnny's case, such as telling her psychiatrist that she was abused on such-and-such day, when we have now already seen the photographic and audio evidence that she was fine on those days and the following days.     She was way better off when she was just sitting in the court looking like a robot. Her testifying literally ended all her chances and made her look like a complete joke. Johnny was smart when he requested to put cameras and stream the trial for the public. He succeeded in exposing her to the world without even arguing with her directly.

    Pardon but I have to say Cacamber Heard had made so much disturbance, such a trouble maker and all those things are all made up lies. The worst part was lying about donating to charities. Unfortunate, sick children and people are depending on donation to help them. If Cacamber doesn’t want to make a contribution to charities is completely fine, totally legal.     So let's get this straight, the reason Amber lost according to her attorney is the judge didn't do the right thing, the jury didn't follow their oath, Johnny's attorney's were not ethical, Amber made mistakes on the stand, the media played a part, the fans interfered because they wanted to be in the courtroom and Johnny was a celebrity (even though Amber was also). Let us not forget that more than one witness she accused of wanting their 15 minutes of fame when their testimony didn't support Amber's claims. Hmmm I didn't hear anything about the quality of her doing her job. In addition to that she's a bold-faced liar for simple things like a suggesting Johnny is trying to retry his case with Amber. He didn't even Sue Amber in the UK. She knows damn well that's a separate case. I have to give a credit. She found someone to represent her who is just as delusional, narcissistic and blames everyone else for a failing just like she does.

When cocaine is snorted through the nose, it causes the blood vessels in the nasal lining to constrict. Chronic cocaine usage can result in prolonged constriction of the nasal lining blood vessels with the resultant death of these tissues. This results in sores in the nasal lining and septum that can lead to perforations of the septum, infection, loss of supporting cartilage, scarring, and eventual collapse of the nose. The resultant constellation of deformities is commonly known as “cocaine nose”. Unique to the cocaine nose is the relative sparing of the external skin cover, but underneath lie many, many problems.

    She wasnt on trial on the UK case, johnny was, and johnnys supporting rebuttals were severely limited, she chose this venue for that reason specifically. Having now seen the full scope of his rebuttals, despite still being limited and tearing apart her case almost entirely, she has no grounds to actually appeal this unless she has someone get on the stand with a GOOD random unrelated heresaying testimony this time around to make her lies more believable and disprove some of johnnies factually based claims. - Not that she can because she's millions in the negatives Side-note, i think the judge was exceedingly fair with Amber and if anything she gave her way more leeway than was deserved, although she was a defending party. Was a very fair trial, they gave Amber all the chances she needed and they failed to produce feasible evidence and arguments to disprove that she didn't create a defamatory situation. - If the Jury felt they had reason to suspect even one of her rebuttals were falsely claimed or fabricated, they have the right by law to consider amongst themselves that the rest of the speculated rebuttals 'without proper supporting evidence or not' could also be considered False testimonies and False, or disregardable evidence. - as this is a defamation case - and the full scope of a personality as well as preceding events pertaining to the individuals surrounding said defamation will also be considered. The defamation case could likely still have been won even if he had physically abused her, because the op-ed in question stating that she spoke out about SEXUAL VIOLENCE 'Can' be construed as false, since she had no evidence to support any sexual violence - And since she linked the article she "Claimed" to have had written by someone else and then signed off on in that op-ed, relating to her alleged abuse, it's basically a straight admission of guilt swayed in defamation unless she could of proven he assaulted her with a bottle, which she never did even in the UK Trial. She signed off on it, it's not true, it's defamation. Hope that clears this up for people, because even if you want to still hate on Johnny Depp or Amber, you have to now consider the full scope of the situation, and that is, there is no way to tell if he hit her, there's certainly no way to tell if he "raped" her, but there is reasonable enough doubt to prove that even if he did hit her, he most likely did not "rape" her and thus the op-ed was intended with malice and exaggerated. It's unfortunate she didn't keep the original photos she took of her "injuries", and instead basically wiped and regenerated the meta data, put the photos through editing programs and submitting non originals masquerading them as original photos.. The meta data expert Johnny produced absolutely shut down mostly all of her recovery chance for proving any kind of factualism for those photographs.

    JD wasn't "on trial" in the UK case. That was a civil case in defamation, brought by Depp, against the Sun newspaper. The newspaper was the defender. The law in England is different from American. Under English law, the party accused of defamation must prove that what they printed, was substantially true. (The judge held that that it was).

    The uk case wasn’t against Amber, it was against the Sun Newspaper (with a powerful/influential owner). So Amber wasn’t the defendant in the case she was called as a witness. It’s likely jurors would have been aware of the uk case but to imply jurors went home and broke the rules is disgusting! Amber was poisoned by herself when she consistently lied and lied again when she got caught out in the lies.

    AH's lawyer is a disgrace. Self reporting to a Therapist is NOT Medical Records. - and Social Media did NOT make the case for JD. AH LOST the case bc she lied her way thru the trial, from beginning to end. Everyone could see right through her ridiculous and horrific lies. she even lied when she didn't have to, like the TMZ video, she could have said yep I sent it bc I was mad, but no she lied & said I wouldn't even know how to do that, then later said with rage I could have released it in a much more sophisticated way. Also, the UK trial was against the Sun, not AH, so isn't relevant.

    Sure, she can say it. The general term for what Elaine is accusing the judge and jury of is "jury misconduct". The term also applies to instances where, for example, one of the jurors is somehow linked to one of the parties, but purposely hid this fact from the court. There have been cases that have been thrown out and retried because of jury misconduct. But Elaine would have to prove that this actually happened, PLUS she would have to prove that it actually made a difference in the outcome. Just complaining that "social media was everywhere!" is not enough.

    Personally, it appears to me that Elaine is trying to rehabilitate her legal reputation. Her client is a pathological liar which made her job as a lawyer difficult but she made the choice to defend her, so the onus is on her.     Mind blowing to see how Elaine cannot see that she is making it far worse for herself and I, and am not surprise a lot of us were kind of feeling sorry for her because it would not have been easy having Amber as a client and Elaine was doing the best she can BUT NOW with her going on a 15 minute of fame circuit, I feel that she and Amber actually are truly enmeshed in it all.

She said, "he (Johnny) has never accepted responsibility for anything in his life, he hasn't admitted to anything, he's blaming everybody in the world, his agent, his manager, his lawyer, Amber, his friends, everybody but we ask you to hold him legally responsible for his actions. We don't want anything, we want him to leave Amber alone". Look what happened now. Look who's not taking the responsibility for their actions even though the Jury gave their verdict and legally hold her responsible for her hoax. Now Elaine and Amber's team blaming everyone including Judge, the Jury, social media, people, Johnny & his lawyers. People around the world heard & saw everything.     The appeal will be difficult simply because Amber's team was trying to argue a DV case or a SV case which was a wrong attack, and they know it now. So now they want another bite of the apple. The bottom line is that this was a defamation case, and so argued improperly by the defense. If Amber wanted to argue a DV case, she should have pressed charges for DV a long time ago. If she won that case, things would look a whole lot different now. Same with a SV case. For whatever reason, she believes that her testimony is evidence. Not so. The UK trial was not against her, and truth be known, it was not proven in that trial that JD was into DV or SV. It was proven by the UK way of law, that the Sun et al, did not slander or commit libel against him. Two major differences there. That the allegations against JD over there are very similar... again, the case was against the publications, not Amber, and as such there was no way of disproving the allegations, which until they were dis-proven The publications had every right to say, "Amber said.......". Now, if Amber alleged... it is always in a newspaper that the police alleged this or that against so-n-so. But, now JD has gotten to face his accuser, and his accuser is not happy. Now, as Amber would say, "I wish he would just go away and leave me alone... but first I am going to attack one more time through the appeal process".

    This is probably the most used line I've seen surrounding this case. And it usually is from people who never watched the trial in full and their only form of context were small clips they saw online. Amber's own lawyers said multiple times through the trial that Amber was indeed talking about JD when she wrote "2 years ago I became a victim..." They even mentioned it AGAIN in their closing arguments saying this: "“We’re not running from the fact that when she discussed becoming a public victim representing domestic abuse, Amber was speaking of her experience reporting domestic abuse against Johnny Depp" I'm not pro-Amber or Pro- JD. I believe both should have lost and both were abusive to each other but people are taking this 1 thing and running with it assuming that's the only element required for defamation. It simply isn't.

    The judge in the UK trial also DIDN’T look at lots of the evidence that was submitted to him and was allowed in this trial. As for the social media influence, AH’s team brought it in through one of their witness and through questions about social media that they asked AH herself while on the stand. And she’ll only be able to appeal if she can afford it, and her lawyer went on record in at least one interview saying AH can’t afford the settlement she owes.

    If there is an appeal by THIS team it’ll be because her homeowners insurer who hired them does so under her defense under her policy. My gut is her insurer pays the policy limit and exits the stage. I may be wrong but it would not surprise me.

    If anything I think the judge gave the Heard team a lot of rope to hang themselves with. She over- ruled the Depp team several times that I thought was iffy if not outright unfair. Elaine has crossed a line imo and I hope she’s brought up before the bar for her bad faith and malicious public interviews.

    Gimme a break ...it should never have been a jury trial in the first place , esp in this day and age of social media . Impossible to find jurors who had not been exposed to the notorious insane popularity of JD Jack Sparrow fame . It was prejudicial right from the get go & a ridiculous expectation that they could avoid press , media exposure ( ALL BIASED in favour of J ) for 7 long weeks . And to then allow TV & the daily circus of fans inside and outside the court .....PREJUDICIAL on those grounds, straight off the bat . Judge should have done due diligence on these aspects alone before allowing the daily circus to unfold . AH didn’t have a level playing field of impartiality from day one . Am glad E Laine is on record for this . She was right ....it was a colosseum with the same victim being thrown to the lions day after day after day

    Elaine is making an egregious claim that the jury's decision was influenced by social media without any evidence to support her allegation. Secondly when she is talking about evidence she omits to address the fact that team Amber ignored a court order to hand over evidence to team Johnny so that it could be forensically examining before the trial by withholding the material and playing games with their experts. Whilst DA claims should not IMO be subject to public exposure it was a brave decision in this case to let everyone see just how false Amber's accusations were. Even if the public were excluded I am confident that the jury would have returned the same verdict however the media would have tried to control the narrative more and that would have been a circus. At least everyone got to see the sham that Ambers case was really built on.

    Something you left out that has a major implications on her being able to file an appeal is that, as in VA jurisdiction she would need to post a bond for the judgement against her as well as attorneys fees. And the fact that her attorney has publicly stated that she cannot afford to pay the judgement she most likely would not be able to post that bond. Additionally since the jury’s judgment dealt with actual malice, the judgment is non-dischargeable under US Bankruptcy statutes. So I HIGHLY doubt that there will actually be an appeal because shy of getting a loan from Elon Musk, she will not be able to post the necessary bond do move forward.

    She's an idiot unqualified to do this case. The legal system is broken, but that's beside the point ... "harmless error", etc., but 90 percent of cases reversed on appeal and get retried come out with the opposite result -- that's how devastating a judge's rulings are ... but let's look at just a couple rulings/items: 1. Allowing in Settlement Negotiations made by Heard's lawyer in her divorce case. Will lawyers anywhere be able to try to settle cases in the future knowing that all their settlement communications may be used against their clients? 2. Failing to pay charity pledges. Unbelievable. 3. When Depp's able lawyers (superior and better connected than Heard's, obviously. Who pro hoc viced them? And where did they find their experts? and Heard's team their "experts"? Did her lawyers have much trial experience? Didn't appear so. I had a lousy expert once and when you have one you lose.) ... When his able lawyers claimed Heard had recently made up false claims, don't her 2012 statements to therapists have to come in? 4. Lots more, but I don't have time for this and would need to see the records anyway, and jury instructions. What did you think of the judge's jury instructions counsel? And isn't this just all a story of the richer and more powerful winning? Didn't Ruppert Murdock's company/paper win in London? And Depp won here. Is it just a matter of us English speakers having the best justice system money can buy? (Oh, and it's obvious to me that Depp's "PR people" paid trolls to stoke the social media fire (and I am sure there are some "organic" ones too. that's what happens when you have a lot of money creating that and such a popular figure as Depp. I love lots of his work. I didn't know who she was until this trial, but it does appear she's being picked on. Oh, and what is the required analysis in Virginia to allow cameras in the courtroom. That seems a very poor decision by this jurist who appeared unqualified to handle such a case. What do you think?

    You did an excellent job of explaining all of this "law" stuff. I watched the entire trial with lawyers online so I think I can say that I seriously think Elaine should shut up and go home. She is not doing herself or Amber any good by bashing Johnny and his legal team. I think Amber should be prosecuted for lying on the stand under oath...several times.

    She has no chance of winning an appeal. The fact that proving the judgment of the Judge and jury was incorrect would be near impossible since overall the whole trial was fairly conducted, the reality is she lied, under oath, several times so if she wants to claim that the judgment was unfair, the courts can claim she shouldn't have provided false information that clearly would have been taken into consideration in any judgments the jury made. She really has no justification for an appeal, in fact she'll be lucky if she doesn't get charged for perjury.

    I thought Amber was broke, where’s all the money coming from to go back to court? Elaine looks like she hasn’t miss any meals! I’m sure she and her team want Good old American dollars $$ or pledges? She just brought a house while owning JD . Etc. charities. Can’t believe AH.

    As a former law student (ended up running s successful business in another field that changed my professional carrier) I have to say that this is the first channel that walks people through this legally in a way that gives the content real credibility and also gives us some useful information. Something I as a novice of the Virginia legal system (living in Sweden) really appreciate. Cant (or haven't had time) to fact-check the source yet but taking the content as-is is right now I do believe this and find it really interesting. Hope people take notice of the difference between this and other "Lawyer"-KZreadr content and appreciate this breakdown of the case from a local legal standpoint. I sure do. Thanks!

    Sure it is. Civil testimony under oath is just as subject to perjury laws as testimony in a criminal case.

    Elaine going on these talk shows isn’t doing herself any service. She’s making excuses for the loss, although AH was awarded some damages. She’s blaming judge, social media, jury, JD. Elaine was out lawyered and didn’t have a credible witness. The jury saw through the bs and really fake crying. I don’t think she’ll get the appeal

    I'm surprised at Elaine speaking to the media & also criticising and blaming everyone else - with unsubstantiated accusations and wild remarks. I thought as a lawyer she would be sensible and logical once all this was over and be quiet. She's proving she isn't in fact a good lawyer and she seems to be similar to Ms Heard - attention seeking, untruthful and nasty.

    Elaine literally blamed everyone but herself. She blamed the social media, the jury, Johnny and the judge for giving a one week pause and not letting evidence 🙄 be presented. Good that we watched everything.

    Elaine speaks about giving him his shot in the UK case, but they literally gave him no shot in the UK case, they had all of his potential witnesses and evidence redacted so he couldnt submit any counter evidence relevant to her claims. That's why amber makes the reference of people coming out of the woodworks after all these years, because it's the only time they've been able to be called on in all those years.

    The audio recordings combined with blatant lying by Amber were devastating to her case. This has nothing to do with social media or suppressed evidence. Amber herself was all the jury needed to see and hear.

    Exactly. So many people have said they went in neutral or even pro Amber, but then she destroyed herself. The pledge vs donate nonsense. Denying the trailer park manager existed. Referring to JD’s witnesses as ‘coming out of the woodwork’. Employing ‘expert witnesses’ that were basically a joke. The audio of her saying see who believes you. And on, and on. And I think the final straw was when she said she wrote the op-ed because Johnny was powerful and she ‘knew this would happen’. Which doesn’t tally with the audio of ‘see who believes you’. I also think the judge isn’t someone you want to be poking accusations at unless you have very very good grounds, to say the least…

    One of the problems with complaining about social media is that Amber Herd's team introduced it into evidence with a survey of online comments. Therefore it caused Johnny Depp's team to debunk it. Also Amber talked about it during her testimony. How would Elaine Bredehoft be able to blame the jury for considering social media under these circumstances?

    The legal system is broken, but that's beside the point ... "harmless error", etc., but 90 percent of cases reversed on appeal and get retried come out with the opposite result -- that's how devastating a judge's rulings are ... but let's look at just a couple rulings/items: 1. Allowing in Settlement Negotiations made by Heard's lawyer in her divorce case. Will lawyers anywhere be able to try to settle cases in the future knowing that all their settlement communications may be used against their clients? 2. Failing to pay charity pledges. Unbelievable. 3. When Depp's able lawyers (superior and better connected than Heard's, obviously. Who pro hoc viced them? And where did they find their experts? and Heard's team their "experts"? Did her lawyers have much trial experience? Didn't appear so. I had a lousy expert once and when you have one you lose.) ... When his able lawyers claimed Heard had recently made up false claims, don't her 2012 statements to therapists have to come in? 4. Lots more, but I don't have time for this and would need to see the records anyway, and jury instructions. What did you think of the judge's jury instructions counsel? And isn't this just all a story of the richer and more powerful winning? Didn't Ruppert Murdock's company/paper win in London? And Depp won here. Is it just a matter of us English speakers having the best justice system money can buy? (Oh, and it's obvious to me that Depp's "PR people" paid trolls to stoke the social media fire (and I am sure there are some "organic" ones too. that's what happens when you have a lot of money creating that and such a popular figure as Depp. I love lots of his work. I didn't know who she was until this trial, but it does appear she's being picked on. Oh, and what is the required analysis in Virginia to allow cameras in the courtroom.     She never submitted medical records of the actual assaults telling a psychologist would be completely different then medical treatment from my view as a survivor of vicious assaults... The cameras showed Amber's arrogance to questioning & her acting skills

    Based on the information to hand, I think the jury was very fair. Heard was awarded $2m. Heard has been proven to be a liar who subjected JD to DV. How is Elaine etc going to prove the elements required to bring an appeal? I doubt very much that she will succeed. Time to go home!

    I've been honestly shocked at how CNN and nowthisnews have basically ignored the jury, and the obvious evidence of mrs. Heard lying under oath, and posted that Amber Heard was in the right. It's almost as bad as Fox News with regard to ignoring reality.

    From what others have said, there seems to be a law or statute in Virginia that if she wants to appeal, she has to put up a bond equal to the award in the trial - in this case, $10,350,000. If this is the case, it's impossible for her to appeal, as she has no way of producing that much money.

    The only person to let the Jury know what was going on in the outside world was Amber herself by saying what the major public opinion was including death threats. It did not sway the jury one bit and the first trial in England was against the newspaper not Amber.

    I'm no expert, but it seems to me that Elaine is walking a thin line that might verge of some kind of violation or reprimand, in that she's going on national TV and essentially implying that the jury--and perhaps the judge--were incompetent. The ABA may be interested in a closer look. Second, another law channel online pointed out the BOTH parties WON. Amber didn't get the $$ that she had wanted, but there was still one count with which the jury agreed. Amber blurted out on the stand that she wrote the op-ed "because of Johnny"...so, there's that... Plus, doesn't she have to post a bond for the appeal? IMHO, the Depp team had a short, gracious statement after the trial, and isn't making the circuit, which I think is extremely professional. Amber's team is coming across as sore losers, and they should just chalk up the losses and move on. But, it certainly looks like SOMEBODY wants their "15 minutes of fame"! LOL

    Rosetta Stone. In my opinion, if she was going to appeal then she should have done it instead of making a public announcement. What I'm thinking is far out there BUT maybe she is saying that they have proof of 12 counts of DV so Johnny will pay them what they want to stop Elaine from doing the appeal because she knows he doesn't want to go through another exhausting trial.

    A lot of "evidence" from her devices was not allowed because they couldn't authenticate the stuff because of how Amber's legal team was trying to do it. They wanted to allow in doctored photos and varying other shopped and invented "evidence".

    It also works both ways - the defence team got stuff suppressed - such as direct evidence that Amber Heard gave that video to TMZ... did you see the way they nearly had a heart attack, jumping up to object when it looked for a moment that the witness was going to describe the link for the video? And it was so obvious that Kate Moss's testimony was very tightly limited to answering questions solely about the alleged stairs incident. In fact both sides would have made many stipulations, and that's on them.

    I was shocked the judge allowed photoshopped images of injuries to be shown. Without these ambiguous images Ambers team would have had an even bigger task to prove her accusations were true. As team Jonny showed only too clearly, these images don't stand up to scrutiny, especially when one image was submitted twice for different events..
