    Yep, that is a total ambulance chaser attorney letter. If anything that lawyer should man up and become a class action lawyer and go after Nissan for their horrible CVT's. When I did customer care for a brand that the General owns if its not in writing its on you.

    I agree. that this letter is an intimidation tactic. The lawyer for the angry customer is assuming that you cannot or will not hire your own attorney. The customer wants you to fold under pressure and give the money back merely because the situation is confusing and mysterious to you. Send that long response letter from your attorney to the customer's attorney. The customer is not expecting a prompt, detailed response from your attorney.

    I sold a $700 car one time to someone who begged me to buy it, it broke 6 months later and they tried to get me to take it back. People really expect a used car, driven many miles, to never break or it’s your fault ,

    Similar experience here. Sold this Honda civic that was had on time maintenance done and was solid car drove it around for few weeks . Dude calls me says it has a all kinds of issues and wants his money back

    Lesson learned, don't buy or resell Nissan vehicles with a CVT. Also, don't rush a car and skip the reconditioning.

    Any Nissan with a cvt from 2012 - 2018 will have this problem. My maxima 2014 got 156,000 before it died and I was told I got extremely lucky.

    Remember, there's only two separate companies that actually develop CVTs, they're Subaru who does their own in-house R&D and has done a really good job making CVTs and then there's those other ones that all the other car companies use. Don't use the other guys. If the CVT is not in a Subaru, you do not want it.

    Had this person done a little research they would have never bought a Nissan Rogoo. Those jatco CVTs are known to be ticking time bombs after 60k miles😂

    You couldn’t give me a Nissan Rogue. My 2009 Rogue CVT transmission went out at 90k miles and was replaced under warranty. It went out again at 180K and I sold it as is.

    If you don't do any maintenance, they will certainly fail. We have one with 95k miles, and it had the CVT serviced at 68k. It will be serviced every 30k miles or so and we will see how long it lasts.

    @@trbstang There were design flaws in the 2009 and 2010 Rogue CVTs so Nissan provided an extended warranty for those model years. Regular servicing and maintenance cannot over design flaws.

    From a thirty year plus paramedic (Who worked two jobs for 28 of those years-F/T +P/T) there is a wide range of behaviours, as you well know, to expect when dealing with the general public. You can do your best all day long, but you can't nail down everyone to appropriate behaviour no matter how many written contracts and conversations are thrown at them. You have my sympathy and I'd say you're doing well to cite this as a unique example.

    Having worked in the auto repair biz, none of this surprises me, especially when you're dealing with old cars. I remember a customer who brought in an ancient mini-van that needed some oil lines replaced. When the customer picked up the car, he got in, shut the door and window regulator broke causing the door glass to fall to the bottom of the track. Needless to say this was our fault. Then there was guy who came in for a headlight bulb replacement. Two weeks later he accused us of breaking his car because it had a cat efficiency code pop up. It goes on and on. You have to expect these things when you're in the car biz.

    Ya I just got my x3 back last night. Took for oil change Monday and during the oil change the plastic part on the radiator that the hose plugs into going to the overflow tank broke so that had to be replaced. Felt bad for the dealership as they felt it was their fault and replaced at their cost. But same time gave me another part to upgrade to aftermarket much higher quality to help protect against issues like this. It's only a 2015 but nearly 150k miles. Nor to mention a bmw. So what do you expect.

    A lot of lawyers these days charge only if they win the case. However if they go to a trial then if they lose they have to pay all legal fees including the attorney fees of the winning side.

    ​@sct913 that's why a lot of people are saying he should countersue since this is a frivolous suit and can then get it paid for. You are definitely right that if he doesn't do that they wouldn't have to pay his legal fees. Amazing how easy it is to just arbitrarily sue people and cost folks money.

    Definitely good to see that you have yourself covered and it is sad at points in time when people feel they need to resort to this way of handling things.     I've bought a couple of used cars from used car dealer lots, all cars are sold as-is, no warranty. Documentation and signature is key in this business. Now as far as that Nissan Rogue and the transmission issue, there is a class action on that if that car's vin number comes up, and she should take that up with Nissan. I am hoping this gets thrown out. Keep doing what your doing Mike, your a Godsend.

    Thanks for helping a single DAD. I was there doing that several years ago- So awesome. Crazy games people will play on that car purchase. You have your ducks in order. Yup free money is all they want. If it came down to take it back - costs - less miles driven - damage - wear and tear. Yup They would not get much back due to all that. They are looking for an easy way to get money to buy another car. Keed smiling

    Steve Lehto has covered this on his channel more than once. The only warranty that cannot be disclaimed is "warranty of title" that the seller has good title to the vehicle. Will be interesting to hear what the other attorney responds with once all your documentation is sent to them.....

    Sadly when u are in business and esecially one like yours selling used cars, some customers just cannot be satisfied and want to take advantage of you. Glad to see you protected yourself from the start. The sad part of this is the attorney fees, etc. that u will still have to bear. Keep up the good transparent work and honesty and of course u will prevail.

    All you have to do to fight the claim on the transmission is demonstrate that the Rogue has a known issue with the CVT and that you couldn't possibly predict when it's going to fail.

    Exactly. They had the option of *not* buying a late model used Rogue! Its well known what those trannies do! Nissan calls it 'customer satisfaction issue'🤣. As for the P0420 on a low mileage vehicle is probably poor quality fuel of the regular unlead variety. That stuff burns cats out like nobodys business when combined with a lead footed driver.

    I actually just bought a 21 outback from a used dealership, 140k miles(May). Put gas in it not half an hour later and got the same code they did. I went back to the dealership and they ended up fixing it because it was supposed to be fixed in april. Long story short, it cost them 5300 dollars because it was catalytic converter inefficiency, and it needed a whole new system put in

    Been in the car business a long time with multiple dealerships … in Florida if you fix or do repairs to a customer’s vehicle after they sign as is contract the as is warranty or contact is null and void. Found out the hard way! Good luck with your battle 🤑

    The used car market is tough, as you already know. You could do a 350 point inspection and have a problem a couple month's later, most car lots do the best they can to hide issue's, even repair collision damge off the record to make a car appear better than it is. When I'm in the market to replace a car I hope to find a company in my area that at least tries half as hard as you portray in your video's so i can have a favorable buying experience.

    I had an input speed sensor go out on a jeep grand Cherokee 6 months after I bought it from a dealer. I didn't call the dealer to make them pay for it. I didn't even put 3000 miles on it that year. A dealer doesn't even pay a factory warranty. I've heard many people try to get dealers to pay for repairs, but they all sign as is, no warranty. Even laws that say that. Most people today want free hand outs and everything paid for.

    i have a po420 code story too long for this. a garage changed mine. used an aftermarket cat then a day later i get the po420 code. my car had NO codes prior to this. but had this hesitation issue.

    The 420 code is from the gas they use it happens all the time at our dealership when it car goes from 93 to 87

    I remember reading recently that there is a big increase in repos. Because people can't afford what they are buying. A side-effect of this is that there is an uptick in these same types of people claiming extreme number of mechanical issues with the cars. All these issue are within the 1.5 yr mark, which coincidently aligns with most states Lemon laws. Some states have Lemon laws that also cover User Cars. These people are using the Lemon laws to basically buy and use a car for about a year, claim "Lemon", and force the dealers to buy back the cars - giving the customer back all or most of their money back. That basically translates to the customer getting a car to use for free, for that period of time. Then they repeat. Scams. The amount and creativity of scammers is mind blowing. Now we are going to start seeing an uptick of cars being sold with Lemon branded titles, in the same way titles are branded Salvaged/Restored for totalled cars. The difference is that a lot of states allow the title to be cleaned on salvaged cars, once full state inspections are done and passed satisfactory (this does not clean the history, just the salvage branding from the title). But for Lemon branded titles, there is no way of cleaning it from the title in most states. So be aware of this out there. People are sneaky clever and just as scrupulous. Especially if its to stick it back to the dealer "man" (who I admit might have earned that "sticking")..., or just sticking it to the "man" in general (because the system, the government, the politicians are all about Greed).

    FYI as is means as is people it's a used car. I tell people they can bring there own mechanic and if they buy it I put in the bill of sale that there own mechanic looked over the car.

    Mike, I can't wait for you to become a Chevrolet dealership because my 1946 pickup is having clutch issues, and I will be suing you at that time. BTW, my father purchased this truck on May 13th, 1946. I think it is still under warranty.

    I live in Indiana. Shame I don't need a car right now. Got a 2007 GL450 in 2015. Still in great shape. Same with 2007 Lexus 470. :)

    This threat is either from an inexperienced Attorney or an ambulance chaser. In no state is there an implied warranty, UNLESS it is in writing signed by both the buyer and seller. I'm sure your Attorney will basically tell them they have no claim and that if they file suit it will be counterclaimed for defamation and filing of a frivolous claim.

    Too Bad that you have to experience this type of situation, I truly understand the frustration that it causes, but apparently this family is trying to pull something to get the Money back, get a newer car, or they have a kid who doesn't know one thing about car maintenance or up keep, the individual drove the car and if anything was wrong you would have received a phone call, but apparently whomever signed that contract, didn't bother to read it before signing on the bottom line, WOW what a ordeal

    Their probably using legal shield an online legal subscription service, the typed that letter themselves and just had an attorney slap their name on. It's very possible.

    I work at a Nissan dealership, this is what seems to be a customer who got the loan, either couldn't afford it, or didn't want to pay it anymore.

    Yeah, this is easy in court. Going in to court the burden will be on you, because of the perceived imbalance of power between a customer and a business. That said, virtually any judge will go to the paperwork first. It will be over in your favor in minutes unless there are credible allegations of forged or fake paperwork. Your customer's attorney is the reason why so many people dislike lawyers; instead of advising his clients that they don't have a case, because he is starving he will file anything and see what sticks. You may run your business any way you like, but here is my advice from a 30 year career in the car business (now retired): never sell a car that hasn't cleared the shop yet for any safety (brakes) or maintenance (belt).

    Glad to hear you are not just rolling over for this very obvious scam. I think any judge, once they see the paperwork, will rule in your favour. The only issue is, how much is your attorney charging you? And since you are in the business, and have a lot of experience selling cars, its a little presumptuous of me to give you advice, but I will anyway. I would be more selective in terms of what cars you choose to buy and resell. I would avoid all Nissans except perhaps 350Z or 370Z (or GTR), forget about anything made by Audi or BMW, and be very selective with Hyundai or Kia products. That Rogue was junk the day it left the factory.

    Helping people and doing good is one thing, getting walked on with golf shoes is another. Glad you're pushing back. If they wanted (near) perfect they should have bought new. I could see them being cranky if the transmission went out within a week or two, but after thousands of miles (and not to mention a CVT) those are the breaks.

    Those Nissan Rogues are notorious for everything breaking down... the customer was just mad that they chose the wrong vehicle
