Hip Hop samples are derivative works, and so are collage pictures that use hundreds of smaller photos of the subject to make a mosaic image of the subject. So, it is his derivative work. That said, he didn't suffer any damages, so he can't make a claim. Unless a perspective client of JTs somehow saw that image in a Keem video, and decided 'Oh, I can see JTs thumbnails on Keems channel for free, Im not gonna pay JT for them now', theres no damage. Just try and imagine any type of legitimate situation where Keem's use of that thumbnail cost this JT kid money, or ruined business prospects. He's got nothing but a hurt-butt....its a fair use of his copyrighted 'IP' all day long. IP that again, is a derivative work...he better lay off the strike button before Keem hits him with the Romeo Lacoste treatment....

I slap a few words on meme template, make one, meme gets to hot to 9gag and somebody see it and uses it for some meme compilation on youtube as thumbnail. Do I got to take down a video and sue them for using my meme? For using an image from the movie I don't own rights and slaping few words over it? Its highly ridiculous concept. I would understand is somebody was using your art aka something you did drawn without paying you or credited you. Because that is trully your intelectual property. @@Cinder__ He technically has rights to the picture, the nuke and font are both Public Domain, and the Picture would likely be seen the same as a famous person's picture, and be the person who took its property, which could be anyone since its on a public video Leafy Aired similar to tweets. JT was being Petty, but the only argument would be fair use, and the transformation of definitively his property, and that is a court issue, as Fair use has been debated for as long as reactions have been a thing

I know nothing of him but I don't believe its a bad strike. He is correct that under most interpretations his work is copyrighted. I honestly think keem would lose in court. Keem didn't criticize the work and left it up the whole time. Its not really a fair use. Keem really fails to understand what the fair use laws are for this. Its shitty to take down the video but I think Keem loses in a court of law very if the kid sues him. If he drops the lawsuit though its going to be hard to defend himself if keem sues him back.

@@FatedGamer but he doesnt own any of the three pictures and lets be honest its not very creative, ive seen the same design used with other youtubers thumbnails on other channels many times before. Not saying he copied just saying anyone with a slight knowledge in photoshop can make it in 2 seconds which is why many youtubers make the same looking images.

@@FatedGamer Umm you clearly don't understand copyright laws lol, the case would most likely be thrown out because the person in question does not own the intellectual property rights to leafy's image and thumbnail which he used without permission. No judge is going to say this is transformative enough to be protected.

That Leafy thumbnail looks like he wants your soul and credit card information before he’ll blow you up with a nuke

I would understand if it's a thumbnail that would take hrs to make.... that really only takes 20 minutes.... 2 minutes if the background is already removed
