But even then Roy should ask this question: "conspiracy to do what" and "the value of what was 2700 USD"? Answer to first one: violate New York law? In what universe state law pertains to federal elections, and even if, the violation was what? Answer: "NDA" and concealing it. So this immediately should be followed by: under FECA this payment cannot be campaign expense and even if, it had to be disclosed on documents that were due well after election, so no concealment and, more importantly, elections are over and there's nothing to influence. Answer to second one: Cohen made illegal campaign donation exceeding limit. But did he? at best, it could be (and AFAIK Bragg classified it as such) a loan, but now the question is: what was the value of that loan? Bragg didn't even try to calculate that - thus yet another violation. Last thing: Dreeben explicitly argued before SCOTUS in Immunity case, that this kind of prosecution is expressly forbidden under US and State laws, that prosecutors can be trusted not to bring frivolous lawsuits and EISEN HIMSELF opined on that case in a way that contradicted his stance in this hearing.
