Junk fee law bans restaurant surcharges
Some big changes may be coming to a menu near you. A decision by the state attorney general means there can be no surcharges added to your restaurant tab - everything must be included in the price you see on that menu. As Terry McSweeney reports, it’s leaving a bad taste in the mouth of some restaurant owners.

Worst part She doesn’t even admit to the fact that.,, If the customer finds out about the junk fees after dining, they’re less likely to return cuz NO ONE LIKES TO BE RIPPED OFF.

I wish Niagara Falls did this. They literally alllow hotels restaurants to put ridiculous fees 10% “tourist fee” which the owners just pocket. Ridiculous

She wasn’t necessarily a restaurant owner, but rather an executive of the Golden Gate Association for Restaurants. Bottom line, few of these people in those positions of influence tend to lack economic and financial backgrounds, that ultimately leads to them talking out of their derrières… 🤔

I don't get why people are so against this. All I hear is people saying that it will hurt these businesses, it will hurt our economy, the companies will just increase the prices... Honestly, if restaurant can just call my order I'd be happy to get it myself rather than leaving it to someone else to bring it to my table. One less person to possibly spit in my food.

@@thevoid1337 Tips are generally non-existent in many countries. It's an accustom, not a factual concept that is necessary. You work well, and you get a good tip. If they don't want to pay their servers, then you are able to decide their pay essentially and that's why the system works. Your logic isn't making sense to me, may I ask more?
ok customers who dont care what the real price is aka "no need to tell me up front" are crazy af. like tf if you dont really care about price, there should still be no problem being told THE REAL PRICE. For people who actually budget and plan their finances, this is a big deal. Not being upfront in the beginning is scammy.

That lady in the video who said she does not want to see the price up front, she is insane. You don't go to a doctor's office or a car dealership not knowing the final price you have to pay... oh wait 😡. Price transparency should not be limited to hotels and restaurants, it should be everywhere!

Sometimes when people have too much money they spend money on frivolous and superfluous things and tend to disregard such things. That's a habit that I've both seen, heard, and experienced with people that come upon higher-ends of wealthiness is that they tend to not care, and as a result they assume everyone else is the same in regards to disregarding pricing, etc. It's the unfortunate truth, glad to see that they're working on enforcing full disclosure of pricing in-advance, always frustrates me personally.
If a business has to screw/trick customers. Then it shouldn't be in business....

If you have to deceive customers to get business, you need to get out of business! I don't like being lied to!
The reason why some restaurant owners are opposing the new law is because many of them, not all, but many, use the upcharge fee money as their personal cash machine. They take the money as an upcharge for "mandated health care" and then use it for whatever they like. Unfortunately, this money doesn't always end up in the employee's pocket or go to the group health plan.
There is no good reason to play games with the bill. Between low wages & high prices for food, tip & taxes; any extra charges can make it unaffordable for many people to enjoy a meal out. Be up front.

I wish they would place the tax in the menu as well that way you know if you can afford to there as soon as you see a menu in the window. The Junk law should apply to that too. I understand why tipping is done, but considering how it is being used now it too should be removed. Tips should never have been counted as part of a wage, and it is a slap in the face to any who works a job that has no tips.

Oh great idea Laurie, so to get people to dine out more, let's lie to them about the actual price. That's a great way to get customers to come back. Glad to see this law finally happening.
We need to ban this practice nationwide. Just include it into the price and stop trying to be deceptive.
SF Mandate is a illegal charge restaurants add to your bill for extra profit. Wages, healthcare is all supposed to be taken care of by your BOSS, don't pass that bs onto the consumer when it's the owner's responsibility.
This is a welcome change and about time. The only fee should be the sales tax plus menu prices.

It’s kinda weird that you’re not okay with junk fees, but you are okay with sales tax. Sales tax is just a fee to use the money you own (and have already been taxed on).
Any place that did this … I stopped going. So I applaud this change. Transparency is important and expected.
Can a customer refuse to pay the hidden fee ? What I do is I reduce the tip accordingly. If any fee appears on the cheque as a surprise, I will also do what ever it takes to not get ripped off by the restaurant.
Those owners are talking as if charging hidden fees would bring out more customers. Nah.. people avoid dining out because of those hidden fees. Many say "never again", "fooled once is enough" and avoid restaurants and hotels that charge hidden fees. The best is to enact laws to require the inclusion of service charges in the price, like many European countries do.
Ban tips as well

We used to go out to eat maybe once a week. Now we rarely go out to eat, and if we do it's at places we know what to expect. Problem is now the food isn't so great, prices are high, and service is bad. I'd rather have good food that's better for me and costs less, so cooking at home is the much better option. Plus I have leftovers for lunch!
I’m fed up with the whole restaurant scene anyway. I can afford it, but choose to say no. Doing a whole lot more cooking at home, eating healthy.
interestingly, food delivery apps like Doordash are exempt from this ban 🙄

This is why in many places you pay first before you receive your goods, if you dont agree with the price then you can always walk away or change your order.
Good. There should be no fees on restaurant bills. Also, IMHO there shouldn't be tips. They just need to raise their prices and pay their employees a fair wage.

Without Taxes you may have never learned to read. Only the rich could afford school. Without Taxes only the rich could call the fire department for help. Without Taxes the gas stations could sell you a "gallon" but there would be no oversight by the county. Without Taxes, only the rich would travel on (very few) private roads. Tax wealth. Stop taxing Labor.

It’s already sticker shock when I get a bill and see 15% added for this 20% added for that just tell me upfront. That logic of sticker shock doesn’t make any sense. If they do tell you, what is for is tiny all the way at the bottom of the menu often at the back

Unfortunately servers pay taxes on what they sell. The government assumes they'll receive minimum 10% and tax them on that. When you don't tip they have to pay to serve you. Can't tip don't eat out. It's simple

went to trader vic's 16 mos. ago and noticed an "admin. fee' on the check. we questioned/challenged this extra charge and they agreed to remove it. not fair to be expected to tip on a total that includes fees that have nothing to do with quality of service, you need to subtract it before calculating tip.

We also need to get rid of tipping and taxes. Include those in the menu price as well. What you see is what you pay exactly like Europe and Asia.
They will just bake it into the menu prices. On a slightly different note, I went from eating out at least a couple times a week, to maybe once a month at a higher end restaurant. No more chain places. They want you to tip 25% to a machine on my table after I see my disinterested server smoking darts by the dumpster and taking 10 minutes to refill my Diet Pepsi.
If you have never worked in the food industry then you should know a lot of restaurants have insane amounts of food waste. The money that could be spent on labor is spent elsewhere.
There should never be hidden fees on ANYTHING. Tell me exactly what I'm paying g for.

In a nutshell… Restaurants added surcharges to convey to customer that hiking up minimum wage has a ripple effect and consequences beyond the benefits for employees. California Government officials didn’t like being shamed. This law is the result.
Wait people will know the total cost before they order? Outrageous, next they will compare prices between restaurants.

How about auditing all Restaurants for immigration and health violations?
There’s a restaurant that hires employees from troubled backgrounds. On the bill, a % surcharge is added for staff training and mental health or something like that. If you don’t want to pay, you ask to have it removed. How awkward is that? I heard their food is good but I’m not interested in dealing with that.
They are getting upset because they can't rip consumers off.
They need to do this everywhere, corporations at resorts really get you, rental car companies too...

Like that one restaurant owner says he'll work longer and cut back on staff to not add surcharges. I didn't realize surcharges included paying the owners to take the day off. And that lady who says she doesn't mind any extra charges that she doesn't even look at on her bill anyway, definitely must be single with no dependents because who else would say that? Paying for ambiance should be part of the deal, not extra (plus that music in restaurants is too loud as it is!) What next? Ice, or no ice?, for the second it took to scoop it. Seriously, if it was found how to tax just thinking nobody would leave their house.
If you’re not gonna purchase something over the price, then you were never going to buy it in the first place. That lady that said she doesn’t care about the price and you can add on later probably has credit card debt or spends money and doesn’t care about saving. What’s crazier as restaurant owners are saying they’re not good enough at running a business to truthfully tell how much the meal actually cost. These owners have to realize that they’re not staples to the community and that it it’s not your right to have a restaurant. These restaurant owners sound like entitled rich kids who shouldn’t have to work hard to make a business successful

My friend, food prices have risen for everyone. Have you forgotten that California is the hardest hit by this inflation? National numbers does not reflect actual state inflationary numbers. The small businesses are fighting for their lives while folks are allowed to break in, steal, vandalize...many lost their insurance or have had too much crime that their policies have skyrocketed. You sound like a misinformed person. Please research everything I am saying. There's legitimacy for the small business owners. Even profitable In-N-Out left Oakland because of the ongoing crime and affects it had on staff/property including customers being robbed.

I also one thousand percent agree that these people who think price is nothing either has money or are in debt as you have mentioned. These people are transplants forcing these bad policies that is pushing everyone further into poverty. They are trying to charge to use any lane on the highways now. It is ridiculous.

Restaurateurs that charge hidden fees are deceiving their customers into thinking that their establishment is the same price as other restaurants that don't charge hidden fees. Shame on them. If they can't survive without deceiving diners then they should go out of business and let another restaurants takeover their space that will charge up front pricing.
If you go into a store to buy a "widget", and the price charged has hidden add-ons, you can refuse you buy it. If a restaurant has hidden charges when you get the bill it's too late because you have eaten the meal. The sticker shock argument is a way to defraud customers. As an aside, the US should follow Europe where all prices include sales tax (VAT).
Cooking at home is an option.
Before covid my family ate out 3 times a week . Now not even 3 times in the last 4 years . Home dining is wonderful .

I remember this restaurant charging me a Covid fee, another one charged me 15% surcharge which was separate from the tip I found out-I just gave that as the tip bc I didn't know, so they are charging me essentia;lly 30% more and it was an expensive place to begin with!

Does this new law still allow restaurants to charge a "Cost of Doing Business in California" fee? I've seen it attempting to order from the pizzahut website and selecting a pizzahut store in Los Angeles. At checkout such a fee is listed so I chose not to go through with the order.
Hidden fees should never be allowed. At least mark in on the menu. Like when they say additional gratuity added for larger groups. I get that but put it in the menu

Sticker shock is way better than a bill shock. At least you know upfront and don’t feel cheated. The lady there is admitting to wanting to trick and bait customers with a lower menu price. Not sure if she understands her customers will leave with a bitter aftertaste.
