Josh Hawley To Biden Nominee: "Do You Think The US Criminal Justice Is Systemically Racist?"

During Wednesday's Senate Judiciary Hearing, Sen. Josh Hawley (R-MO) asked Candace Jackson-Akiwumi, nominee to be United States Circuit Judge for the Seventh Circuit, if she thought the US criminal justice system is systemically racist.

    She was saying that burglary is not considered armed robbery, which is true in most cases. If you have 10 armed robbery arrests but 1 was a home burglary (without a weapon), then technically you have only 9 that are “armed robbery”. That PART has nothing to do with race - it has to do with adding up the violent crimes properly.

    The comment about race seemed to be in regards to extra time being added to mandatory sentencing. The REAL question is “Are the amount of years a criminal gets for a SPECIFIC crime averaging to be the same regardless of race?” If Black people are averaging 30 years while others get 15 years on average for the same crime, then that is a Fair Sentencing issue. Bringing up race “just because” is irresponsible. These Congressional hearings where they have limited time to ask complete questions and give full answers is part of the problem.

    @Thomas Robinson no, did you miss the part where I said "armed robbery is armed robbery?" It means, it doesn't matter what skin color or gender a person is, all should receive the same punishment. In this case, Jackson is attempting to claim that its somehow racial, ignoring other factors that could've lead to the sentencing and instead, pulls a race card. Its that mindset as to why things will never get better in a timely fashion and why there's so much racial divide when we really need peace and understanding the most in these trying times

    I marveled at the fact that they BOTH answered the questions posed to them. We are not used to seeing Dem-nominated candidates coherently answer the questions posed. I would have had serious problems not voting for the first woman questioned in this clip.

    She had a fairly candid style. A lot of Hawley's other victims try to dodge the question or give canned answers that speak to being coached. I thought it was a fairly respectful exchange. If Hawley had only wanted to grandstand and she was fodder, he would have glossed over her answers being sound. He liked her responses.

Simply because the man is black he should have a reduced sentence to try to make statistics change...this is not the letter of the law. Emotions should not be involved in the judicial system.

    Watching these confirmation hearings over the years for many federal judges nominees and SCOTUS picks, any time I take “thank you for the question” as they’re thinking “this is a stupid question” or “how can I skirt around this question?”

    @@AnniceMichelle I'd say the same or similar whatever her race but I am very happy to hear from you how you would prefer I say the same thing in the future - IMO she is unflappable & poised in her smart responses, & a great candidate. But I admit to being hesitant sometimes in knowing how to favorably comment on speaking & presentation. I hammer the same messages of comportment into my kids b/c IMO how we present is as important as who we are or what we, and it's especially important for judges or neutrals - compare her demeanor/presentation to Kavanaugh's, for instance. He got visibly belligerant. But I also know comments on presentation & bearing can be perceived as racialized by some if about a Black person. So constructive feedback is welcome! 🙂

    Your right, burglary is burglary, traffic infraction stops are traffic infraction stops, all men are created equal (in our US birthing documents) etc etc but as majority vs minorities equal applications of the law are not treated or sentenced equally to these two fractions. All of the great statements and proclamations documented in the (OUR) constitution written by independence freeing themselves from ENGLAND though written as a blanket statement were only to be applicable to those self and same persons. Self evident by how the indigenous peoples and slaves were treated at those very same moments in history. So, minorities receives more judge time more jail time for the same infractions even though our presence is less in many cities and states across America.

But your forgetting each judge when setting the sentence will be different to another judge from another city or state for the equivalent charge. Each judge is different when comes to sentencing and they also include the person's criminal background and behavior when setting the sentence. Don't try to include racism because it's not there on a national level. Maybe local level but not national.

    @@SJ-ny4it As per usual the evasive use of the word "should" says it all in your reply. IF all that was needed was a mechanical application of law in black and white with no grey areas then neither the Republicans nor the Democrats would try to load the justice system with appropriate leaning judges, nor would either of them have any grounds to complain about such actions as under your "perfect people" pretend situation the judges' personal leanings would have no effect. So what was all the fuss about when Amy Cohen Barret was proposed? Taken to a logical conclusion it makes no difference therefore if all judges are white, male and even solid conservatives, they will always rule only on the basis of law. Bring it on. It was already pointed out that she advocated in one case for a position that was not actual law at that time. Her excuse being it was under consideration by other circuits. Not relevant in a mechanical application of the law as it stood. And the law does contain huge grey areas in which judges have to exercise their judgement as to meaning and then personal traits most certainly do come into play.

    I would certainly hope that the transcripts of the responses of the nominees are recorded and that their recording applies to ALL committee members in future use in the case that consequence is required for judicial failures. Quite frankly, there are too many claims of what rules that each current Team Biden nominee will work by “once they are confirmed” that just don’t hold water against their previous actions.

    Was Hawley one of those shouting and supporting the insurrection with a fist pump? Yes, because we all know justice is not blind. Imagine a crowd of black folks on the Capitol grounds like that, their civil disobedience turn into an all out riot, beating cops, just crazy. Black people or other minorities would not made it to the to breakup the place, there would have been black bodies and blood all over the grounds and Capitol steps, never would have made it inside.

Has nothing to do with race although you have to know that most extreme sentencing is given to people of color ( mainly black) for crimes that otherwise would not get those sentences if they were caucasian. the racism that is embedded through laws within American society is shameful. I wouldn't go as far as to say this is a racist country because I love it, but being in this country is a challenge, because of its racist history.

    I think her comment about race in the particular case COULD have been relevant IF she provided a clear reason- - in the section he read, she did not. If “equal and fair sentencing” data shows that Black people receive disproportionately higher sentences for the SAME crime, then that needs to be studied and addressed. However, the criminal can’t claim being Black as justification for leniency. But we also can’t assume, without reading the entire document, that she did not break down those specifics in later paragraphs. It’s challenging or premature to draw a conclusion without reading the entire document. We’re all making snap judgements these days based on a video clip or part of a statement which can be dangerously inaccurate.

    The problem is politicians only set the fines, punishment and the crimes are. Representatives push for funds to help their cities. The ones who have the most impact are law enforcement and courts. With low funding, law enforcement can't do their jobs. Representatives/mayors use their influence on the public to help combat crime in their cities.
