He's saying all of that but convictions are not overturned over simple mistakes, and Baez knows that. It has to rise to the level of one that clearly and prejudicially harmed a person at trial. Not just they allowed something that we didn't like. Plus they had the neighbor testify as a witness for the defense that said Daystar was popping shots. Plus if you actually listen to Baez, he said he hasn't even made an appearance yet. Which means he's not had time to even look at the case in full. He's really just giving lip service at this point.

Exactly. What would you expect an attorney to say about his client's case? He'll take the money and make his arguments, but his client is going to prison.

That same witness said Kelsey grabbed the gun and shot first. There is clearly holes all in this trial and the investigation leading up to Tory being charged. This was not the best case for the State to take on. It was really a drunk night full of bullshit from all parties involved.

@@brandonmontgomery4592 And yet the state took on the case presented evidence and convinced a jury that he was guilty. Despite the "holes" in the case and Kelsey pulling a Reagan with that "I don't recall" bs. All of that aside, none of that would lead the appeals court to grant an appeal.

I've said this before in these comments on other TMZ videos covering Daystar with people who wanted to argue for some damn reason, you can spend the time going to find them if you wish.

You Leprechaun daddy more than got a fair trial. It's nobody's fault but his own that neither he note his driver testified. He had a chance to tell his side of the story and passed. Too bad, so sad. He's guilty anyway. But now, he will most definitely need a Hail Mary. Maybe in 3 years or so when he actually gets a date for somebody to hear his appeal, something will have changed.

That so called case was based off Instagram and emotion which was very disturbing they couldn’t even prove he actually owned the gun since it was unregistered plus it was four other people in the car or that he actually fired it at her. The witness switched up at the trial and so did Kelsey this was all a game and they actually put him in jail with no evidence besides Megan saying he did it basically. The Sean Kelly witness is suspicious to me since he changed at the trial but I digress.

If gets appeal, Tory has to take stand. Unless the driver has a compelling account. If he doesn’t have a driver testimony in his favor, he has to take stand where it shows that he was drunk and didn’t mean to shoot Meg. Whatever happened,he didn’t intentionally shoot Meg. Negligent discharge of a firearm.

Tory needs a new lawyer like the best of the best to fix this shit ass case! Hoping for an appeal!! I think they were all wasted an nobody knows exactly what happened. If Tory did shoot her i firmly believe he didn’t mean to an he wouldn’t have ever done that sober!
