So if I select all the countries I have to pay extra for each country I'm trademarked in? I don't understand why someone just wouldn't select them all otherwise

Yes, you can add as many countries as you want but keep in mind that: 1) there will be additional government fees for each country 2) If any of the countries issues an office action against your application, you'd have to deal with it separately (which is where most of the potential expenses add up).

Cool....you answered my question on securing my International plans!! Ok...Question!! A health longevity consulting company has a Trademark for its basic service. Of getting paid, to work with cities. To develop systems, so their citizens, can live healthier lifes...and live longer. AND....they are doing that. Namely they preach, and put in syztems so that people will...walk...be with friends more...go to social activities to get rid of stress....eat healthier foods...eat more plant based foods and less meat...drink a little, but not a lot...etc!! Nothing earth shaking, or proprietary!! OK... So...this company got this idea, and their name...from a medical researcher. Who years ago, researched, geographical places around the world, where people just live longer, and healthier lives!! Its this researcher that coined the name for these 5 little communities, that people are healthy!! And is what this company, preaches the things these people do, that live longer. Ok....my question!! Sooo....this company trademarked their name, for EVERYTHING, under the sun!! Beyond merely being a service of information and consulting!! They trademarked their name for...restaurants...cookbooks....foods...grocery stores...supplements...drycleaners..etc.!! Claiming their name for EVERYTHING!! BUT... Tjey use tjeir one company name...and in their trademark discription....they make the claims, that it extens over ....EVERYTHING. That they could think of!! Ok...BUT.... They aren't actually using their various trademarks, except for city consulting!! I want to trademark that that name...BUT!! Adding the word ..."NUTRITIONALS"...to it. To explicitly denote that its trademarked explicitly for, and trademarked only for, my product line of, supplements!! In their trademark for supplements. They put their label on a spice bottle of Tumeric!! And took a picture of it, againstba whiteboard. With no indication, that the item is in commerce. And I cant find that bottle for sale, anyplace!! Nor are there amy advertisements, on the intetnet, that its for sale. Not even Amazon!! How do I go about, contesting that Trademark....that its basically a fraud!! The company is like 7 years old, maybe. They probably thought one day they might sell supplements. BUT...their supplement trademark claims, were filed, going on 5 years ago!! Amd I cant find one sign of the product in the actual market place...for any type supplement....except that one bottle of Turmeric!! I'd be very interested in your thoughts!! Thank You!! Love to know ur thoughts, on how to disrupt that trademark...as it appears its not actually in commerce!! Jeffery Like Ok... Tje company wo

You may be able to cancel the other trademark using the procedure I describe in this video: kzread.info/dash/bejne/equVs9tmgNyuZdI.html . First you would want to be pretty certain the other trademark is not in use for your products and services, then you would file the petition for cancellation, and assuming that the other trademark is cancelled, you will be able to have yours registered. We can help you with this process if you are interested.

Ok....!!! Good info!! Im going thru your other videos!! Will check this one out too!! I am an attorney. Sooo....I'm connecting with you, in the terms of legal thinking!!! BUT...so you know!! Unlike most all other lawyers....you do....Do a very good job explaining things in common layman's terms. And that's my problem with most attorneys, as well as most all Doctors....they can't just talk with you!! As they're so lost in their details!! YOUR VERY GOOD!! Im a new startup...!! Making sure I lay it all out, in the right way...tje first time!! Jeffery

Thanks for the Video. I am Canadian looking to file a trademark in the UK and US. I have already filed one in Canada. Is there any UK requirements for internationals to know while going through this process? According to research, in the US, it is mandatory for internationals to have a local counsel because I am not American. Do I need one for the UK or can I do this by my self? Does it make more sense to go through the Madrid protocol or register through the UK & US Intellectual Property Organization since it is only 2 countries I was to secure my name in?

Don't do Madrid for just 2 countries. It's too much risk-and you're not going to save any money. Madrid only starts making sense after 5-7+ countries.

Hi I live in the UK and I have looked on the WIPO for my desired company name and another company has registered the same name on the WIPO in the US and Australia, does this cause any issue for me registering it in the UK being a Madrid protocol country? Thanks.

Great question. Madrid simply facilitates the filing of trademark application in different countries. Just because the UK is a Madrid country does not mean that registration in any other Madrid countries confers their owner any protection in the UK. If they haven't actually claimed protection in the UK, with some exceptions relating to well-known and famous marks, you should be safe in the UK.

If I start a brand named ABC in USA with T-Mark registration in US only and another person start with the same name (ABC) in China with T-mark registration in china only. At any moment if I want to extend my ABC brand in china what will happen ? Who can use the ABC brand name ?

In your scenario, you will not be able to sell your products in China because the owner of the Chinese trademark will have the legal right to stop you.

Hi Andrei, can you please answer my question. I have a clothing company in the Philippines and I named it Dime Clothing Co. And not having to know that there is a clothing brand in Canada with the name of Dime MTL. I search in Ph TM database and I can only see my own trademark and theirs is only registered in Canada. Am I in sort of trouble? Need guidance. Thanks!

Assuming that (1) you are correct and there are no DIME trademarks registered in class 25 in the PH and that (2) you are only planning to sell your apparel in the PH, then you should not be in trouble.
