    That is absolutely crazy man...I dodged a bullet from a debt collector who bought "alleged" debt and ACTUALLY sued me (breach of contract) for a little over 10k due to an repossessed auto loan. Luckily I have a smart mother and we did our research as far as handling them. The #1 and most important thing I did was avoided a DEFAULT JUDGEMENT....I didn't ignore the lawsuit like so many people do. Then we researched repossession laws and the contract for loop holes. We actually found technicalities with how they repossessed the car with the original creditor to where we could counter sue! We also noticed it was written off by the original creditor..showing this "alleged" debt was bought from a debt collector. When actually speaking to a lawyer vs a collection call representative and pointing out the technicalities, they instantly decided not to pursue the case. When I showed up for the court scheduling, the lawyer wasn't even there and the judge dropped the case. Lesson learned about contracts and debt collectors..I will never put myself in a situation like that again!

    I had a $76 medical debt!!!!! The interest the tried telling me I owe them $1,200. I paid the $76 and then started complaining to the three Credit companies and telling it's a scam.... you can't add interest to a medical bill. I never signed a contract. Got it off my credit score and never heard from him again!!!!!!!

    @@livinglifejaybyjay3063 ......whenever you have something that you know is 100% bogus as this guy had you can contact Experian or one of the other credit bureaus and dispute the debt.......the credit bureau then has to contact the creditor and ask them to verify your debt by producing contracts signed by you for that debt.......if the creditor can not produce the required documents.....you win the dispute......so at some point the credit bureau will remove that particular item from your credit report.

    I just started watching Dave one day as a random recommendation and I have to say I'm so glad I clicked on it. It's really rereshing someone with common sense teaching people the right way to manage money without trying to get some of it. I feel like Dave really cares and wants to help people

    That is some patience there Dave you looked so frustrated at some point. The calls from collectors are annoying. It took months before I got my collections off my report but it was worth the time and money spent.

    Make all debt collectors validate the debt they say you owe. Keep asking them a lot of questions and make sure you tell them you know your rights. They hate to go through the whole process and some just give up. They are counting on you being a very scared little sheeple.

    You are right. However, it is unclear if the caller made payments (even just $1) to the debt collectors during the time they started trying to collect. If you have a debt that has reached statute of limitations in your state, and you make even a $1 payment to the collector, that starts the statute of limitations over again for that debt.

    I had a coworker who cosigned a car note for his best friend. His friend defaulted, and the lienholder's collection agency immediately called my coworker. Judging from the conversation it sounded like the agent was badgering him, and demanding answers and money before he could even call his friend to find out what's going on. A lot of these agents are jerks!

    I would offer them $3000 at the most! Quit making payments because after 3 years (in NC, check your own state laws) they cannot by law sue you for it. They can still try to collect it but they can't take you to court. BTW either way it still goes on your credit bureau for 7 years.

    Why be afraid when a creditor threatens to sue? Suing someone costs money and lots of money. Fewer than 1 in 10,000 collections go to court.

    Dude that's an ignorant thing to say. I was taken to court over an $1,800 debt. Fortunately for me the day of court their lawyer failed to show up and I was able to get the judge to dismiss the judgment against me. I'll admit it was funny calling the debt collectors a couple days later and they definitely sounded embarrassed over the phone lol. Still, debt collectors do have teeth (legal rights) and they aren't afraid to come after you if they think they can get away with it.

    I was ALWAYS told to NEVER pay a Collection Agency because the original Agency wrote off that debt once they sold it to another Agency. I had a $32,000 hospital bill back in 2004 and they sent it to a collection agency and then after 2 years they sold it to another agency. I haven't heard from them since 2006. And it doesn't show up in any of my debt history or credit history.

    Some collections will show up on your credit report until you pay them and tell them you won't pay it unless they agree to delete it from your credit report. I've gotten two deleted off my credit report that way.

    Send a certified request for debt validation, they won’t send it within the 30 day requirement. Also request a court date, when they don’t show up or validate the debt, the judge will toss it all out!!!

    If memory serves, old collections fall off your credit report after 7 years BUT if he makes a recent payment, no matter how long it goes unpaid, it reopens the debt and starts the collection debt reporting as a current collection on his credit report negatively affecting his credit score.

    He gave bad advice on this one. Old debt beyond the statue of limitations for collecting. They can’t even sue him anymore. It’s zombie debt and is uncollectible. They can’t even report it on his credit report. DONT PAY ONE DIME! BAD ADVICE.

    I see this happening in a lot of these videos where he asks a question and they just have to tell their story (or excuse) that goes with it or they interrupt his question altogether. This time you can really see his frustration, but it does make it difficult to listen when they go on and on.

    I worked in a building one floor below one of these collectors. They hired mainly 20 something people to call and harass people over their debts. It was sickening listening to them laugh on the elevator about how they made some old lady cry because of $500 on a credit card she couldn't pay years ago. They make me physically sick.

    Always go to court when sued by creditors, the worst that can happen is the judge gives the credit holder a 100% judgment. If you don’t show up it is an automatic “default judgment” for the credit company.

    -*- Moral of the story is: Don't ever pay debt collectors! 9 out of 10 times the statute of limitations runs out for them to sue! Your credit rating will suffer for a bit for a couple of years. That's all. Negotiate with the Original debtor if possible! -*-

    And the attorney will attach your money in your bank account. Where I live they can do that one time and can clear out your account. It happened to me even though they were getting money regularly from me. They are never satisfied with just payments. I haven’t had a credit card since! And probably won’t even though they send offers constantly.

    If your debt keeps jumping from agency to agency you have no right to pay anything. I had a $1400 debt and never paid on it. Since not paying I got a letter telling me to settle for $600. I will not spend any money on this I have the right to not pay to a collection agency because I never did business with them. They are a 3rd party. And they need to prove that I did business with them.

    When I joined a gym and they sold out to another one, the gym I joined was suddenly replaced by another one and I didn't like it. I couldn't get an explanation so I stopped payment and they sent it to collections. This caused me to read my contract over and over and nowhere on there does it say they could sell my (2 yr, I was ignorant) contract to anyone else at all and nothing about any debt. How do you "sell" a debt or contract, anyway?

    HAL 9000 - so gym #2 and gym #3 stepped into gym#1's place. You should have somewhere in the old contract where they may assign/transfer the business to another company. If not, the new company gym#2 and gym#3 should have sent you an update contract.

    @Cynthia Pope yes. The burden of proof is on the debt collector to prove YOU owe the debt. You can beat them at this if you do your homework. And you might even be able to sue them if they have crossed a FDCPA violation or a FCRA

    I get about 14,000 a year in SS. Not having any more income I have had to use credit cards for medical bills and to put it plain , groceries, rent, car ins. power and internet. I don't have TV as I knew I couldn't afford it. I owe about 20,000$ and this month for the 1st time I have not been able to pay all of them. I have no assets. I don't know whether to consider bankruptcy or just quit paying them. After my husband died things are hard. I live in public housing and have a 2006 Honda. I have always been a big believer in paying your debts but now I can see how people get into these sad situations

    Looks like your first mistake was putting the "$" dollars sign ~after~ the dollar amount instead of before the dollar amount, as it's correctly supposed to be.

    Nah, I would use the fair debt collection practices act and fight this in court. I believe its against the law for them to even add interest on a debt. That collector is probably not party to the original contract to the debt. The statue of limitation was probably 6 years on paying that debt. Did you even verify and validate the debt to prove that the debt even exist? Matter of fact you can probably sue this debt collector for violating the FDCPA which is federal law

    I'm a senior citizen and I m being threatened with jail time, attachment of wages for a leased car and credit crd. I had to return the car because I ran in to financial problems and could not pay the rest of the lease but they have the car back, also I didn't use up near the allotted amount of mileage that they allowed me at the time i leased the car. Can they do that?
