? why didn't Dave inform her that; if she records or documents the Collector threatening to "come get her", she can easily get a summary judgment in court against them for around $1,500 because, it's forbidden, by law, for Collectors to use such tactics and the Fines for such Forbidden Tactics is already laid out for such behavior. Incessant phone calls are on the lower end of the Fine Schedule at around $500 but, you MUST record each instance of these violations in order to spank them in court.

I had a debt collector once try and threaten me. It was a small amount of money from an old medical bill, barely $100. I didn't have the money to pay that at the time. She then threatened in a very vague way, along the lines of, "We will have to take further action against you..." I calmly replied, "How? What action are you going to take?" She was absolutely rattled and I haven't heard from them since, haha.

@@Armouredb really lady? A lien on your property for a measly $100? No they can't do that number one, they have to have a judgement for ANY action they use against you. That's money out of their pocket just to sue you. Then they have to go through the courts, and the JUDGE will give out the judgement, but that's only if they have a case to make. A lot of time and money over $100. Not gonna happen.

Most people are not trying to get out of paying because they are just jerks who won't pay their bills. People fall on rough times and then they are not able to pay. Settling is a way they can at least pay something, when otherwise if they waited to pay off the full amount they might never be able to pay the company at all. At least with settling they are paying something. If they filed a bankruptcy the companies would potentially get nothing at all. I have always paid my bills on time, but I recently have fallen behind due to a very rough year . It is very stressful not being able to pay bills due to financial hardship[

sharlylpn ok. What is your argument here? You said "most" thus leaving some which means my comment is still accurate. However, whether or not someone falls on hard times doesn't have to be someone else's concern. It can be, that's what makes someone decent but it should not be expected. I just think people suddenly forget their obligation later. Everyone losing their job while someone has a major illness is not what I'm referencing though.

I had received mail in my home mailbox addressed to the former home owner. So many letters threatening to: "Get our money, our $220." This one particular note was hand written and looked like an invitation to a party. It was an ERGENT message to call a number about someone in the family being at deaths door. I knew it was from a collection agency. I had no idea who the person was, or where they were living at the time. Not till I remodeled my living room, tore up the carpet did I see the former owners name on the carpet. Eventually the letters stopped. I never did get a phone call. They couldn't get that number.

I can understand if your 20 but most of the people are married with kids, how can u put your family at risk? If you don’t have enough money make more and spend less. I work with a girl who gets calls from time to time all day to work from an off shore payday loan co. It had been a few months since the last time and it's starting up again. I don't know if she can even get the address to send a letter to not call. We have all spoken to this man and tell him she doesn't work here anymore. She has had the police at the workplace and our boss had told these people not to call and we were even instructed to tell him she no longer works here. It went from that to...just hang up on him. He has even called and sexually harassed a few of the women we work with. I know this all sounds bizarre but...some of those online payday loan companies have nothing to lose because they aren't dealing with US regulations and don't care. So every few months we get calls from this weirdo. We just hang up on them as we are all familiar with the accent of this man and he always asks for her. She hasn't lost her job and I don't think she will due to this. While stupid for taking a loan like this, she didnt ask for this harrassment and nobody deserves to he treated like this. But it's so disruptive!

On edge, because I was studying for finals, I harshly asked the lady what US Code she was basing her arguments on. She started stumbling over words, I just told her to leave me alone because I was trying to study for a law school exam. I hung up. This had taken place on the landline. I had a nasty person call and tell me that my husband has debt and they want it NOW..I told them we don't have that much money. I can give them $100.00 at that moment, but we don't have anything else. They said they won't take less than what is the full amount of the loan or they will take us to court over this matter. So I told them, give me till 5PM that night to see if I can't find a way to get the money. So I went to an attorney and told him about this. He said we needed to file bankruptcy. So I told him, I only have $100.00, but he needed a retainer fee of $350. They called back to find out I went to a lawyer and it bought me another week till they found out I didn't get a retainer for him. I got him to notify them to cease and desist. Yes, I know, they bullied, I fought back. I don't like being abused by others. I fight back with their own tactics. It works for me. They threatened to take me to court, and I called them on it. They called me names over the phone, and I told my attorney to deal with that cause its illegal. Needless to say, they found out I don't play fair, and I am NOT that nice when it comes to being constantly abused by others. My husband learned a valuable lesson in that. Our bankruptcy forced us out of our home, but he learned don't mess with a woman who took over finances when he could not balance the checkbook. This took 10 years to get removed from our credit history. So now my husband again went back into debt. This is the last time I bail him out.

What about the bottom feeders that don't pay money they owe. You are out of bounds on this one Dave.

Bark partially true, but debt collectors need to follow specific rules or face huge fines and such for each case of abuse, sometimes much higher than what the due debt is worth. there's seeking debt owed and then there's harassing people because of debt owed and ruining their lives over it instead of trying to work with the people and still make a little profit from the deal to pay off what they had to pay to buy the debt and your operating expenses. when debt collectors push to make too much profit from these sorts of deals, that's when they go too far, they leave themselves in a situation where they try to take too much and the client can't handle that sort of burden, so the interactions become abusive instead of constructive. it's not good to incur debt and not pay it back, but it's worse to use abuse to attempt to make someone pay the debt.

Rick Believes it's not so much the debt, but the obscene fees and interest charged. That's the main problem. They have no problem charging people like crazy or whatever "feels right", according to them.

These days, hardly anyone reads the contracts to my knowledge since they pretty cookie cut across the consumer lending industry. If we were to pay attention, the wording is such that you would require the services of a lawyer to decipher. That’s how vague and confusing the wording can be that you cannot make sense out of it. As for the fees bit, if you look closely, some lenders will have a clause in their contracts that talks about ‘universal default’. This is where when a lender says to you that they have the right to raise fees if they suspect that you might not pay them back in full. Crazy, but true.

You should payback. Yes. However with 600% interest you end up paying thousands for hundreds of dollars of debt too
