    I’ve been hired a one wage and got a lower wage. The person hiring me said oh no it was the amount your receiving that was negotiated. Which it’s was not cause I was already going to be getting less that I wanted but after probation it would be the wage I was looking for to cover my cost of living. I had turn down other jobs because they didn’t want to reach that wage.

    @@guppygb6078 mine was verbal. I had experience I was there for the interview got hired during the interview. We negotiated I said $15/h. Which I had turned other places down for not being able to pay that. That was my cost of living. He replied $14/h for your six months probation then a $1/h raise after six months. Because of when I started between their pay days. I had to work three weeks before I got my first check. It was $13/h.

    exactly!! unless you can quantify the work ie. # of sales per month, % improved capacity of a machine.. ect...its very difficult to push back when management claims your work performance is not good. What I have learned is that the more you are seen the better others preserve you.And regardless of what metrics show management will likely give you a better review. I learned this the hard way.

    Got played by the company. They needed someone to keep things running while they outsource their stuff. They dangled the 20K in front of him to keep him there. There was no way he could have ‘improved’ to their expectations.

    I was working at macys and was brought in by loss prevention, I was so confused, they have this like backwards way of like explaining what you did wrong acting and assuming you just know what happened or what you did and then questioning you and making you out to be the bad guy. I made my quota every month, had tons of postive reviews, mostly made my sales goals. Oh no one tiny stupid rule and your done

    I worked for a fortune 500 company and they hired me for a job and then tried to fire me for a mistake I made that was not part of what I was hired to do. When I met with HR I told them I had never been trained to do what I was asked to do and I was doing my best to help our project get completed. They did not fire me and I got the training I needed and ended up working there eight more years. Its important to stand up for yourself when other peoples mistakes try to come back on you.

    Instead of calling the Ramsey show, call an employment law attorney. It looks the employer is firing the caller to avoid paying the bonus out.

    Don't admit to, or apologise for, any shortcomings in your work performance. Don't feel obligated to thank someone who's firing you. If they refuse the $20k, go speak to an employment attorney to see if you have any legal recourse. Promises made can end up legally binding.

    Dave is out of touch, thinking a large corporation will negotiate. They have a prepared script and process, no negotiation outside external legal action. If they promised the 20k and you can prove it was offered and the conditions were satisfied, then the money is owed.

    Dave has sound financial advice that is 90% common sense. However, he is from an era where people stayed at a job for 40 years and then retired with benefits/ full pension. That's not the case today. What happened here is the company knew they were going to lay him off but they needed him around a bit longer than his coworkers. To avoid him quitting when they started layoffs they pulled him aside, offered a promotion and 20k bonus if he stayed. Once they knew that his usefulness was done they put him on a PIP, and are now firing him for cause. He'll likely get no severance nor will he be entitled to unemployment benefits. You are right his termination was plotted in detail from the minute they decided to keep him.

    Don't mix a $20K bonus w/"severance" or you're heading down the road to ineligible for unemployment payments. This whole thing sounds screwy - if he was going to stay for $20K, he should've gotten when he agreed to stay.

    It was done to keep him there while they were reorganizing the company, otherwise he would’ve been looking for a new job as soon as he saw his coworkers getting laid off.

    Retention bonuses are typically not paid out until the completion of the retention. He would have had to agree to it in writing. If he didn't, he won't see a dime.

    They were going to lay him off anyways, and wanted to wait. He said he was going to quit (so he saw the writing on the wall). And they dangled the $20k in front of him and got him to stay, that money clouded his judgement. The performance reviews are them creating the paperwork they need to fire him. Slimy tactics by the employer

    Fantastic Analysis and advice.Daves experience and wisdom is really shining through on this one.For those of us who have been in similar situations giving our everything and being told to run faster without having the right training,tools or leadership we can definitely relate, except having 20k to look forward too 😭💰😏

    Sounds like the company planned on going back to outsourcing but they couldnt contractually do it immediately so they fired everyone and kept one guy in the department to do all of the work with a 20k carrot over his head. After they got what they wanted for the timeframe they needed they canned him and said it was a performance issue so they didnt have to uphold their end of the deal contractually

    Honestly, even when you work your hardest, struggle to make ends meet and try your absolute best, bad employers will always find ways to beat you down. Always best to leave an environment like that, and if you don't get the 20k then at least you get a fresh start to find a better employer who values you and recognises your strengths

    Here is what you really should do: have your doctor write a note you have some disability (literally anything qualifies, depression, anxiety etc). Tell your employer you have the disability. Then when they try to fire you, you can spin it legally to say you fired me because of a disability

    Has your progress or lack of been documented? Have you signed any paperwork regarding this? First thing at your meeting take the initiative, ask about the bonus and when can you expect it.

    Stupid argument considering they hand picked him to stay aboard and keep things afloat until they were ready to move to a different company for his role (job=outsourced). If he sucked, why would they offer it to him? 90% likelihood is they never intended on giving him the bonus, it was just a carrot/stick to clean up loose ends before they hire the new company. Regardless of how you feel about HIS work, THEY held 10000% of the authority, and SHOULD bear the responsibility of making a poor choice, and promising you things they didn't want to pay out.@@reese85

    I would've gotten that bonus in writing some way, shape or form. If he brings this to court, that's the first thing the judge will ask. I know you aren't entitled to a severance, but he definitely should get something for staying throughout

    I made a mistake at work. In what I call my first “big boy job”. I missed something due not being detailed enough in one area. Which caused hassle for everyone. And despite doing well in every other area. They were not happy and haven't forgotten. It's my first time in 12 years of working that I've felt disappointed in myself to this extent. So now I'm preparing myself. Mistakes happen though.

    When management wants to get rid of you no matter what you do will save your job. In this case the guy stayed to fill a role that just didn't work. He should have got the money upfront!

    I was suddenly laid off last November after coming back from having Covid. Went back on a Wednesday & that Friday morning, I was pulled into the VP’s office. There was talk starting in the summer, about moving me up to a different position because that department needed help. I had a lot of health issues that year which unfortunately needed time off for / working at home, when allowed. I think in the end, they just wanted me out and didn’t want to give me any sort of boost in pay, which was a question I had with switching roles. The morning I was let go, I immediately came home and downloaded Indeed on my phone and started applying. A couple of weeks later, I got a new job.

    I bet they were lying about that 20k just to keep you working until they lay off everyone as soon as they can. I would have wanted that 20k TO stay on. Not if I stay on and they can fire me for any reason and not pay what they promised. Very sketchy and dishonest employer. Wouldn't trust them one bit.

    I was asked to pay back a signing bonus because I was not there the required time. They fired me and I would have stayed. I did not pay it back.

    It sounds like they put him in a position to fail knowing they were going to eliminate his job. His first recourse when he was initially told his performance was unacceptable would be to ask for coaching help or training to meet their expectations. If they don’t want help, the writing is on the wall, you’re toast. Don’t burn your bridges, by trash mouthing the company. Try to get a letter of recommendation to put in your resume. The company won’t give a bad recommendation since that may come back to haunt them. Take notes of all conversations, if it becomes a legal matter, those with the best backup will normally prevail.

    If the option was being laid off or getting some weird promotion, I think I would have just taken the lay-off. They are already having some serious problems apparently and if they're this inconsistent, I think it's time to leave.

    Some management at branches of a big company will sometimes manipulate a situation in a way of basically setting people up to fail, so that instead of giving them a raise they will give themselves a raise and replace you with a new worker for the same wage.

    If you were involuntarily terminated for performance, then UI should be paid. If you resign, then you get nothing unless you can prove discrimination.

    It could be worse, I was told today the insurance rates went up 400 bucks a month and deductables doubled, with the hsa plan I expect to pay close to 23k a year

    Unless there is a contractual or legal obligation to pay him a severance, or a portion of the completion bonus, if they are terminating his with cause he gets zilch. It's not a negotiation like Dave says unless they want to continue an employment relationship with him.

    Always have other options in your back pocket. I get job offers every month. I have turned them all down because I am going to retire early so no need for changing jobs right now. But over the years, it's great to know I had many options for maintaining income if I needed to. Good luck to this gentleman.

    Had a job that they talked to me about my performance in early parts of the summer. For months I thought I was doing well. No meetings by my manager or anyone else then December came and they told me switch postions or we'll let you go. They wanted to switch my position completely. I left the company.

    If he "thinks" he's getting fired why not beat them to the punch! Walk in to bosses office and just say I feel like this will be the day you plan to fire me. Instead I'm quiting as of right now, gives you the upper hand albeit not having a job doesn't make for warm and fuzzy feelings. It is not something you are able to change in an instant just collect your belongings and walk out.

    Yup where I worked bonuses,profit sharing,awards,gifts,etc. were all agreed upon in contract every seven or so years.. Set mine up to be auto deposited in 401k each year.

    Learn about quiet quitting and constantly being ready to change jobs by watching Joshua Fluke. And you have no control over the time it takes for the outsourcing company to be ready. Learn from this. Never train your replacement. Don’t be a rat on a sinking ship.

    Obviously, they are firing him to not pay the 20k. Companies have no interest in spending a single extra dime for a lost contract or outsourced department. Whenever a company makes these kinds of offers, make sure to get it in writing with the details explicitly defined prior to agreeing.

    I’m hoping somebody sees this before Monday : I’ve been at a transportation job for 7 months with in that time I’ve gotten two recommendations from passengers. Everytime this happens it gets worse for me . 1. The dispatch talks to me mean and in an intimidating way . 2. In person he acts like he’s innocent 3. Union rep pull me to the side and told me …they don’t know how to receive me bcus of my up bringing …I don’t act like I’m in the streets it’s been 20 years ago … 4. Now I’m having back to back meetings where the manager is lying …yesterday I asked a question in a meeting and he lied to me in my face . 5. I was told if I can take how the dispatcher is acting towards me …until he retires …I’ll be ok …but I trying but I can’t 6. At this point I don’t know rather to quit or put in a two week notice 7. I feel like the manager and dispatch is trying to get me to resign or they gonna find some way to get me in trouble with the law by lying….idk …this just my situation…

    I’ve been trying to get fired for the last three years and my dad and family will not do it! All their jobs are night jobs and I really dislike working nights? I could walk away and get another job, but then I’ll feel bad because they are having a hard time finding good employees to work their jobs. If they are firing me then it’s out of my hands and I won’t feel as bad?

    There’s your story, their story, and the truth. A neighbor in my hometown had a deceased father that was an Engineer. One day a supervisor approached him in a hallway, asked him a project question - he didn’t know the answer right then and there and so he got fired on the spot. Another time a co-worker told me he used to work as a supervisor at a large retail company. Upper management would order him to fire 3-4 people a week because they were downsizing their budget.

    Any time an employer owes you something they look at it a leverage to fire you to avoid paying it out. I've seen several people be fired to avoid paying pensions. 401k are better than pensions because firing you doesn't get the company the money.

    If you are terminated to avoid paying a pension, then you have a case. A EEOC filing is a no cost option. Case law indicates that the courts do not look kindly on this issue.

    @@deepthinker999Like when Sears fired the guy for "stealing" a candy bar so they didn't have to pay his 30 year pension. You might have the case law on your side but the company has lawyers on their side. The proper cure for the guy fired for stealing would be his 30 year pension -$1.50. But they just took his 30 year retirement.

    I think it was the company plan to give 2 or 3 bad reviews regardless of performance in order to terminate employment before bonus is due.
