I fly drones in a Tokoroa park - am I in trouble?

The South Waikato District Council has told the media that there is no rule preventing us from flying our drones in the small New Zealand town of Tokoroa -- so I thought I would put that to the test and headed down to the park with a couple of quadcopters -- then the police turned up.
Fortunately, the cops just gave us a big thumbs-up so all was good.
Regular viewers of this channel will know that I've been battling the local council for a very long time to allow the people of the town to fly their drones and toys in the parks. Those who watched my last VLog will have seen the councilors of our town council in action. Yet today, this was published in the local newspaper:
"Fabrie said "Children can fly drones in Tokoroa and they were "continually baffled" by Simpson's insistence that council has a rule that says they can't."
So I figured that these people would not tell bold-faced lies to the media and headed down to the park for a fly!

I guess that if the council prosecute me then the whole district will see how they have been lied to by way of the article (above). If they don't prosecute me then I guess the parks are now available to our residents and their children. Either way it's a win-win for everyone!

    The boy with a camera Yes, I'm in vic and from what I understand it's perfectly legal as long as you're not with in 30m of people, roads or private property. And I'm pretty sure you can fly above tree level if you stay under 400ft Our club oval is only about 500m from the local hospital helipad and we have permission from the council to fly there but if we hadn't of asked I doubt anyone would have noticed anyway. Because it's not classed as a full time helipad it's legal to fly there as long as the heli is not taking off or landing anyway. The use of fpv gear is still a bit of a grey area but if you've got a spotter and your not annoying anyone then I doubt anyone will care. You can find all the laws on the casa website.

    Why, South Waikato District Council, did it take for you to be exposed as lying, arrogant, deceitful fools for you to finally realise what all other councils in New Zealand already knew. These parks aren't your personal property to be used as political leverage over others. They are the peoples amenities, you are only the caretakers. It's pretty damned disgusting when it takes being exposed by the media for you to behave in a rational fashion. You have quite a lot of damage control to your reputation to take care of now.

    Good stuff Bruce. I'm jealous. I recently obtained our councils laws on model aircraft and they are prohibited in my area just east of Brisbane. I have a feeling other councils allow models though so I will do some more research. Love your work.

    If you search for on google for "drones south waikato council" you get a document titled "Flying Unmanned Aircraft (Drones) on Council Land Policy" which lists a few council parks where drones can be flown. Strathmore Park isn't on that list so that document really needs to be updated by the council to reflect their current policy.

    I totally agree... and I have emailed them asking them to bring their bylaws and policies into line with their unequivocal statement via the media that there is "no rule" preventing people from flying drones in Tokoroa.

    Well about time. Great flying xjet that's a clear and stable fpv. I didn't see a soul in that park. Even thou I'm in the middle of know where and have no homes people around this property I stay below the legal flight limit. That way my flights are not in question. Be sides no one around here cares if I fly and most people of the town up the road knows I fly drones as well. That cop gave a thumb's up wave by the looks of it. Maybe he is a drone hobbiest as well. Great info Xjet and excellent flying to. Thank you my friend.

    I Must come down tokoroa and have a fly in that park .. Looks an awesome place too .. Great flight btw .. Seems you have very nice FPV setup too . I was wondering just what that setup is ? if i may ask ... Wish you well in 2018 .

    Hi y'all...great video... here in UK we flew my Tundra in large local park.. got reported by public... parks dept turned up(looked like police)..they were well informed and checked we had insurance, we were 100mt from any people ..less than 400 ft high (estimated) nowhere near any airport ..result: we are allowed the fly on any public/council land in accordance with bmfa etc. rules. The gracious, well informed park warden asked to let his dept. know when we're flying so he can address any concerns or comments from members of the public...WELL DONE TORBAY COUNCIL PARKS DEPT. makes sticking to the laws so much more pleasant!!!! ... ps can you fly fixed wing in your park??

    You can fly in Bournemouth parks, they "welcome model aircraft" according to their website, they're still "unsure of drones' though

    Is it ture that vtx signals can interfere with aircraft or control tower signals? Is that why we need to be so far from airports and why we're limited to 25mw? I think you mentioned it in another vid but I don't remember clearly.

    In the US 400 feet is maximum height. I fly models and drones at Park near where I live big soccer field where you could possibly land a piper cub or ultralight. I fly only electric as I believe nitro would be too noisy as we have a lot of fishermen fishing the river that winds through the park and hikers on the trails. Sometimes folks stop and watch. That's a bonus.

    Is that only for multi rotors, or can you fly planes (drone is an aircraft without a pilot on board isn't it?) in the same parks below the tree level? I'm not sure how they are defining Drone in the US which has kept me from flying as I fly in open fields (I am not a club member). Thanks for the video.

    Thanks for video. What if I fly near the hill/mountain, what "tree" use as maximal altitude mark? (day, I see the drone every time, not fly over people, restricted objects, over private territory or near airport or helipads. Forgot something?).

    Awesome, video. At first when I heard u mention u can't fly above tree top, I thought what an a$$nite rule until u mentioned near airport and annoying helipads [unless there for hospital and or police (in USA they treat them the same as airport from drone law perspective- so that some pompa$$ executive can fly once a week).

    You will have to contact the Christchurch Council to see if they allow flying in the parks and make sure that if the park is within 4Km of an airport or helipad (hospital?) that you fly no higher than the height of the surrounding trees.

    If you're not a passionate sailor as I once was you may not have noticed how drones were used to capture the victory of Team New Zealand over The Oracle sponsored US catamaran in the America's cup a few days ago in Bermuda. It made great TV for we enthusiasts and small MR aircraft were far less intrusive than full-size helicopters would have been. Very little air disturbance, for one thing. I have flown my indoor MR outside in very light winds but the problem I had was orientation when it got further away. It's a lot easier with fixed wing.

    Yes I did see that TNZ were attributing much of their advantage to the use of a drone and I did comment on this elsewhere. You're right about the intrusiveness and safety of these small unmanned craft when compared to manned helicopters or whatever. Sadly, the media and regulators still seem to think that drones are far more dangerous than manned aircraft -- well I doubt they really think this but it's clear that commercial pressures are forcing them to espouse that line.

    Sounds like your persistence paid off Bruce - good job! Gee, if only we had a good, common sense rule (here in the States) that said we could fly below the level of the surrounding trees - then maybe I wouldn't have had to give up this hobby! I recently gave away all my "copter stuff" to someone who lives out in the country, in a much less populated area - where he can actually fly consistently within the FAA rules (even the more absurd ones). Back to ground RC vehicles for me, which no one cares if I drive in my own driveway every day!

    warp00009 What rules are you referring to? The FAA has no bite,you gave away all your stuff for nothing. You should have hung onto everything for a few more months. I am glad I refused to register myself for their illegal drone draft shit. I am such a rebel,lol. I do admit,it does allow states to go crazy on their own laws if they want to. The media is still the reason so much bad comes from owning a quad. That and that one bad apple,and there will always be one of those I fear.

    Just cause you don't like the rules (and I don't either), doesn't mean you can legally ignore them - or if you do, be prepared to possibly pay thousands of dollars in fines - money that I sure don't have to waste for that purpose. Yeah, the media, the politicians, and the public don't understand this sport at all - but blowing off the rules simply makes you one of the "bad apples" in their eyes, and won't help improve anyone's perception of the sport.

    Can we fly a drone above sky tower Auckland for travel video footage? Also do we need a Drone license to fly a drone for photography hobby or travel video making?I am new to New Zealand and have some confusions regarding the drone rules and regulations.     Can you fly above the trees in orher area away from airports ?? Flying that low isn't as much fun as ripping up to 400'. They're very restrictive there ?

    why is your omni aimed horizontally?

    Because the omni has a null-point (area of very weak reception) directly over the center of the four lobes. By aiming the omni in the same direction as the helical you get much better all-round coverage because when the craft is flying directly in front the helical will provide a strong signal to fill in the null from the omni and when the craft is to the side or above the direction of the helical then the omni will provide the coverage. Simple eh? :-)

    Because these people did not want to have to admit that they are the only town in the world that expects a 6-year-old kid to have a CAA-recognised certification and a permit from council before they can play with their tiny plastic flying toy in the town's deserted parks. To admit this would have proven to the world that they were idiots -- so the only alternative they really had was to say "what rules? there are no rules" and now that it's a matter of public record they will be powerless to prosecute anyone without being shown to be idiots *AND* liars. I certainly hope that the era of petulance and intransigence that has prevailed in respect to such things at the local council over the past few years has now passed and we can instead congratulate them on their change of heart.

    Of course they lied to the press... they also lied when they said that I could have trained people at the airfield by NOTAMing it. Hell, I just got through explaining to the council that DJI's GEO system makes it impossible to fly from a listed airfield -- regardless of whether it's NOTAMed or not. They knew that -- but they still chose to lie about it to the media. They also lied about the fact that my offer to lease the airfield would have affected other users because I told them (and I have a recording of this) that all existing community users would still be able to use it and that in fact, they would be encouraged to use it even more. Lies, lies lies. This will be highlighted in my documentary video. This council has already shown itself to be devious, disingenuous and utterly dishonest. I wish they'd just start acting like grown-up, rational, reasonable people and stop digging -- but they keep making things worse for themselves by compounding lie upon lie.

    Actually, the way that public sentiment over a number of issues (including this one) is boiling up around here right now, it could bet the council who are begging to be locked up so as to avoid the lynch mob :-)

    I did. There was a bylaw and a policy which prevented kids from flying their drones in the park so this is obviously a 100% about-face by the council.

    Here in Toronto you are not allowed to g fly any air craft of any sort including kites in a municipal park. Canadian drone laws also prohibit flying aywhere there might be animals, people, livestock or fish. Proximity (75m) to buildings is a concern as well.

    Seems dumb for the local regs that make you keep below the level of the trees? why not just spec a maximum altitude? as flying low with a racing drone in particular presents more of a risk to the public, little kid near me was blinded in one eye by someone flying a racing drone low to the ground.

    man wish this was true in denmark :/ man the drone rules we have... funny thing. they are not even new. been so for 20 years. ever sins rc planes was able to fly remotely we have had stright rules. like 100 meters above ground is rc space. 400 meters away from any city. 200 meters away from the nearest house. 1 km away from windmills, power line even phone towers?! 5 km away from a airfield and 7 km away from the nearest military airbase.... :( so no park flying here. :(

    Bruce I think you are making too many big things about flying these drones,just get on and fly them ! sometimes we can make the authorities too aware and then they try and warrant their jobs by making too many rules for us lesser mortals,just fly these critters but not that one its too noisy and sounds like a load of wasps,anyway fly at the airfield its far more interesting,love the videos and your dedication sir.

    The problem is that, due to the rules and regs, it's nigh on impossible to just "get on and fly them". The only place we have had where we could legally fly was the airfield and flying a miniquad over flat tarmac gets pretty boring. I love flying proximity and to do that you need trees and other objects to fly around. Then there's the rights of the people in this town. Since the newspaper article was published I've had a couple of dozen people contact me to ask more about how they can get a drone and half a dozen or so who have drones but were afraid to fly them. I'm all about supporting the hobby and sometimes that means you have to deal with the alligators in suits who try to tell us how to run our lives.

    does an officer have to be present to count the sheets of toilet paper used when you wipe your ass? I'm so tired of over regulation of every part of our lives. We deserve better from the ones that we electric to speak for us. I do believe they have forgotten their place. They work for us. We don't live to serve them... just my thoughts on the subject.

See how your fellows have accepted the training and the submission to the authority and how happy they are flying their drones and doing what they are told. You have no right to not be obedient to the council. The council is authority and you must obey.

    Hogwash. It is the right and responsibility of every man, woman and child to stand up to those who choose to abuse their power in a way that disadvantages the innocent.
