I'm trying to start a luxury picnic business and I would like to do business in two different counties in California. Would I need to obtain a business license from both counties to operate? And if so would the same go for filing a DBA?

You're welcome! Hm it depends upon the exact rules in those counties/cities and what you are doing. For example, if you were selling luxury picnic baskets at an event in a different county, you may only need a temporary business license (in some places). If you are providing picnic event in-person hosting on a regular basis, you may need to set up licensing in both counties, especially to get permits for the event locations and for insurance to cover your events. For the DBA, for a small business usually we just file it in the county where you are located (business address), but you might want to get a DBA in the other county so no one else gets a DBA for the same name there.

That's a great question! It really depends upon the city/country where you are getting the business license. Some of them don't pay attention to the address as long as you pay the money. Others have put all the virtual business address locations into their database and will reject your application if you use one (typically those are the online application ones). A few will let you put both the virtual address and your physical address, and will keep the physical one non-public. Many times the only way to know for sure is to try (but a few discuss it in the application/instructions).

Get the EIN first, and then you'll use that number on the business license application and such. But you can use your SSN instead if you want, assuming you are the only owner.

Yes you can switch -- it is a bit tedious because you have to go back to every place you filed or set up something, and switch it -- dba, business license, sales tax permits, bank accounts, etc.

Welcome! Hm there are categories for dolls and for toys, so probably under those (doll clothing is probably under that as an accessory). The main aspect is to make sure to state how you sell them -- for example, if you sell them exclusively online that can make it easier to get a permit (because customers are not in person).

Depends upon your location (the city and also if it is a building or a food truck) and what you are selling (just food, also alcohol, etc). You'll need a business license for the business overall, a permit for what you are selling (food, alcohol), and a permit for the location. Sometimes much of this is combined. I recommend going to the website for your local city/town -- they usually have info about opening a business. Call them and they will usually tell you what you need.

Before I ask my question: Great video! very well presented. now for my question: Would you recommend services that can set up a business license for you at some price? I immediately was flooded with ads for 50$ and get a LLC! for 50$, I would consider that a bargain. What is your opinion?

Thanks! If you are a small business getting a business license in your area, I don't recommend using a service -- you end up spending as much time dealing with them as if you'd just do it yourself. I'd just google your city/town/county and "business license" or "starting a business in" and find the government website page about starting a business in your location. If you can't apply for a business license online via their website, just call the number for whomever is listed there as in charge of business licenses and permits, and they will help you (if we were not in covid, I'd recommend going in person). If you can't find the website or number, call 2-1-1 (information) and see if they can help you. If you are a large business that needs licenses in hundreds of areas, I'd go with an enterprise service like www.cscglobal.com/service/cls/business-licenses/

The site says every person who use a pleasanton address for advertisement needs a bussiness license.... but since it's an online store, would i need one as well?

Hi, thanks for your question! My understanding is that the City of Pleasanton requires all businesses located there to have a business license. If the business has a sign, it is "prima facie" evidence of a business -- in other words, if you have a sign you are for sure a business, but you can be a business without a sign. Their code says: "“Business” means and includes professions, trades and occupations, and all and every kind of calling whether or not carried on for profit." They also have a zoning permit application for home businesses, so check that out: www.cityofpleasantonca.gov/documents/Zoning%20HOME%20OCC.pdf

I'd look at the business license paperwork in each city and see what their rules say. Usually they want you to use your actual physical location address.

I work out of my home office, but I use a virtual address for the business. Usually places only care about where you are actually doing business (not a mailing address). Occasionally the other city will send a notice but you can tell them it is only a mailing address -- you don't do business there, which should work.

Welcome! I haven't created any industry-specific videos yet. Generally you would follow any business legal tips for a one-person business. The biggest difference is you need to watch out for protecting the copyrights over your work, where you would usually want to just license work instead of doing it work-for-hire/assignment of the copyrights. You may decide to assign copyrights over work for some clients/customers if appropriate, but you don't want to do that accidentally.

this is prolly one of the best videos to explain the process.. but i do have a question, i've started the llc process and then will get the ein number. when applying for my business license in my city does it have to be the same as the llc name??? guess i'm still a bit confused if i can have one llc but have a couple different business' under it, so the names would be different that the llc.

Hm typically the business license is more about your business location, and they will let you state as it belonging to the LLC with a DBA (or maybe multiple DBAs). You may want to talk to someone with the city unit that does the biz licenses to make sure you fill out the forms right.

Generally cities want a business license / business tax certificate per the actual location of where the business work is being done. When someone works from home and has a virtual business address, the business license is using for their home business address. But check their rules -- some places don't have business licenses, and some has special home occupation permits that you need first.

For the business license? Once you get the business license you have to post it at your workplace. And then you pay a fee each year to renew it.

Hi Frankie - technically your mobile cleaning service is a home business since it has no other office -- it is like your home is the headquarters of the business. For a business license, you'd have to look at the rules for each city to see if they require it when services are provided at the client site. Also, occasionally some commercial businesses you clean may require you to show them the business license (and proof of insurance).

If you are operating in the unincorporated area of Alameda county then you need a business license www.acgov.org/business/buslic.htm (if you are in a city, look at the website of that city)

Usually if you get a city general business license, you don't need a county general business license (the county one applies if you are located in an unincorporated area). If you are located in multiple cities, you might need multiple licenses -- depends upon what you are doing in each city. Yes sometimes all owners need to be on the business license.

I want to run a recording studio from home. Have you ever seen a business license get disapproved because of the nature of the business. I checked the local guidelines (Sacramento) and the business wouldn’t violate any of the regulations. Everything would be sound proofed.

Typically that only happens if it is not following one of the rules, like the rule says no customers and they have customers.

That's a good question -- it really depends on what cities are involved. Some cities will pull the state database and be upset if you didn't get the biz license from them. I have not seen Sacramento doing that, but it could change. Usually the biz license is from the place where you are actually physically located. Note - the biz license database is public (but it doesn't seem to come up in a google search, so someone has to really be trying to find you).

Hm after you submit you'll get an email with a link to docusign to sign the license - it usually is soon after but can be up to 15 days. Might go to spam? If you don't sign in 15 days then it deletes the application and you start over.

Hi Cindy - they are probably referring to the Federal EIN (employment identification number). You need that even if you don't have employees yet - it's a tax ID for a business. If your only contact is shipping to a customer there, I don't think there's enough for a business license in those various states/cities. If you go in person to a trade show, for example, in some places you need a (special) business license. Typically business licenses are needed for in-person operations (storefront, warehouse, employees, etc.).

Hi Irene. You probably need a business license - check with the town/city where you are located. Hi Antonio - well if you are living in Oceanside and providing services there, it would not be out of state - you may be working from home (if you don't have an outside facility) but providing services in the field. Depends upon who you provide services for - like if you do pressure washing for another business, they might think of you as a contractor.

Hi - so if the business has just one owner (you) then it is a sole proprietorship and it automatically exists as as a business as soon as you start offering products/services to people. (If multiple owners, then same thing but as a partnership.) Look at getting an EIN (unless you are okay with using your SSN for the biz), then DBA (if needed), and then business licenses.

Your videos are great but discouraging as well. In California there are alot of pitfalls to opening a business in California besides the permits and being sued. You almost need to be resting on $30,000.oo just to get started and protect your self with a bond or insurance policy. Getting sued or as you said fined will put a quick financial end to someone who has good intentions but the lack of will to say, (F) this they are going to have to put me in the ground to stop me. In California the competition is fierce and the customers can be harsh and demanding. Most people start off with pure unbridled optimism without out any real life experience of how things can go wrong very fast and how do I recover super quick before I sink expertise. Keep up the informative videos and thank you for keeping it real.

I very much agree that everyone should get business liability insurance -- it is fairly affordable for many types of business, but of course does not protect against every type of lawsuit. Even if a person does everything right, some high-drama person can still sue them. A good reason to have an LLC or Corporation, instead of operating as a sole proprietorship or partnership.

For many new coaches, it makes sense to start out as a sole proprietorship to save costs / complexity, until the business gets running and you are making more money. It makes sense since coaches usually pick their clients and do the work themselves, and the business is fairly low-cost to start up (so no big loans/debt). It depends upon the city's exact rules (ordinances). For example, the city of San Jose defines "engaged in business" as "the commencing, conducting, operating, managing or carrying on of a business and the exercise of corporate or franchise powers, whether done as owner, or by means of an officer, agent, manager, employee, servant or otherwise, whether operating from a fixed location in the city or coming into the city from an outside location to engage in such activities" (section 4.76.070). So once someone starts to service clients in person in SJ, would likely need to register there.

Hm if you need to get a business license in California (that's usually from the local city/town) then you'd likely also need to register in CA as a "foreign LLC" (with the state). There's no state-level business license in CA.

That’s a great list! So far you have: - checked for business license - EIN - trademark - business checking account I am answering this question for a sole proprietorship (someone who didn’t form an LLC or corporation, and there’s only one owner): - if you are working from home, check the zoning of your location with city/town/county to make sure you're complying with rules, and see if you need a “home occupation permit” - if you are using a business name different from your personal name, get a DBA (doing-business-as) registration (also called “assumed name” or “trade name”), in California this is from the county - you may need to pay sales taxes on sales, check with the CA Franchise Tax Board (then you get a “sellers permit” from the state) - get a merchant account so you can accept payments online (I recommend having two just in case one blocks you for no reason) - put a privacy policy on your website - have a bookkeeping system of some kind (can even just be a spreadsheet) - make sure there’s not some special rule for what you are selling (like if you are selling food products or cosmetics that are regulated by the FDA) There’s other stuff you will want to look into eventually (terms & conditions agreement for sales, form an LLC, copyrights/patents, business insurance, etc.) but this list is a minimal to get started.

If a Professional Corporation (providing telehealth) is formed with a virtual address (NorthWest) in Sacramento does the business license need to be obtained in same city as the virtual address?

Usually you'd get a business license from where the business is actually located.

Hm it looks like Elk Grove would consider a mobile business (where you visits clients at their location but you do paperwork and computer work at home) to be a home-based business, but they don't allow tattoo services to be done from home, so that may not work for your purposes. You might just call them (916) 478-2211 and say that you are having a mobile business.

Hello, I want to pursue a little business setting up luxury Picnics in the city and county of San Francisco. Do I need a state business license or a local business license for each city where I would like to set up a picnic at for example most are at beaches or parks? It’s more of a mobile location.

There’s no state business license in CA so it will be city/county. I’d start with SF especially if you are physically located there (home office). You might need other city licenses too but it depends on the rules of each town - some require a temporary or mobile license for something like this.

Where do I go to get a FFL for my own home in Los Angeles County? On the application it states to check zoning ect..

Ah, then yes you'd go to the county on that, a "gun dealer" etc needs a license from them: ttc.lacounty.gov/business-license-general-information/

Well you have to check the rules for the town where the mailbox is and the town where you are actually working, but most cities want the license for the actual location

Hi Eli - you'd need to check with your local county and/or town. In some places, they don't have business licenses or permits, but in others you'd need a business license and a permit (either home occupation or mobile business). Also depends upon the type of business -- for example, if you sell food you will need permits for a food truck business.

Yes, since Harbor City is part of the city of LA, you'd get an LA business license. Typically selling products online will be a retail category. Sometimes it is just "internet retail" and sometimes you pick a specific retail category based on the specific goods sold.

Usually the city where your physical location is wants the business license there. But if you have a virtual address where there is someone physically there (they provide receptionist services, sometimes you use their conference room), it can make more sense to have that be your "physical location" instead of your home office. I'd look at the requirements of each city (especially if you are a renter, you might need your landlord's permission) and make the decision based upon the requirements.

what if you get a business license selling on eBay, Etsy, Poshmark, etc. in your local area and get a full-time job immediately after the face and have to relocate...can you do a business license transfer to that city or town? or do you just loose that money and have to start from square one? Good question -- in a state where business license are from the city/county, it does not transfer. Yep you have to start over with business licenses/permits when you move (aka have a new location).

Yep that's about right. The sellers permit really is just a number/account you get so you can file your sales taxes to the state (it's not exactly about "permitting" you to have a business). So many items have odd names.

You'd likely need a business license for your physical "office" location, which may be your home (if you work from home). I imagine that you are mostly in the field, but there's somewhere you do paperwork and such. For the field locations, really depends upon the circumstances and the rules of that particular location. Like if you are selling the tours in that location (to walk-ups) versus you sell them online and just do the tours in that location. Also you may need a business license to make your liability insurance happy, or to give to the location to get a permit.

What do you need in california if you’re operating in different counties, like a housekeeper or paint parties business?

If you have a 1099 contract position, the important thing is to make sure you are setting aside money to pay taxes (income tax and self-employment tax), and making estimated payments on those taxes each quarter. Hm see if there is anything else you can give Google that could prove your business is legit. Like a photo of the shop with the sign, insurance statement, utility statement, tax bill, etc -- something that has the address and business name on it, that shows the location is legit

Yes you need a business license if required in your city or county - selling on Facebook (or Amazon, Etsy, etc) doesn’t matter. You get it from the city or if you are in an unincorporated area, from alameda county: www.acgov.org/business/buslic.htm

If you are located in the city of Los Angeles (search your address here: finance.lacity.org/) , you need a business license from the city. If you are in an unincorporated area of LA County, you need to contact the county to see if you need a license from them: ttc.lacounty.gov/business-license-online-appointment-announcement/

Hi Lizbeth - your entity number is given by the CA Sec of State. Go here businesssearch.sos.ca.gov/ and enter the name of your LLC or corporation. The entity number will have a format like "C3512260" (that's the number for my company) and usually you just use the 7 numbers.

What happens if it is a mobile business? For example, a mobile bartending business where I provide a service to private parties in and outside of my city?

Most of the time the business license is based on your "office" (in this case, likely your house). Occasionally cities have a special license type for mobile food businesses, which might include mobile bartending. You also may need a liquor license.

Business licenses are local in California (city or county), so you don't need a business license from the state. Usually the city/county wants you to get the business license based on your physical location (many don't accept PO Boxes for location). If you are selling stuff in person in other locations, you may need a business license there too - really depends upon the exact circumstances of how your sales work. Like if someone is selling at a trade show, sometimes they need a special trade show business license from that city.

I do different types of crafts, mostly personalizing items, such as t-shirts, mugs, totes, key rings, greeting cards, etc. I will be renting booths at local fairs and swap meetings, sometimes out of Riverside county where I am located. If you are selling products at fairs/meetings, yes you'd need a seller's permit (and you'd pay sales taxes on sales). You don't have to get a FEIN (you can use your personal SSN) but getting a FEIN is a way to avoid giving out your personal SSN often.

That's a good question. Cannabis businesses are a good example of where you need an industry-specific license or permit from your local area (city/town or county). In some places, they are very restrictive about giving them out.
