@@Dez9Nutzwell after the injury occurred if they stopped paying premiums it would not matter because insurance was in place at the time of the actual injury or accident. Some companies switch insurance companies but as long as there was coverage at the time of the loss insurance will cover it.

Thank you so much for the info, I damaged my vertebrae do to repetitive work at the company I worked for from I was fired, cortisone injections, CMBB injection, RFA injections, surgery in a couple of weeks will be the last strike, I really hope my pain and suffering is worth something, Greetings from Chicago.

Depends on the ability and where. But usually bulging with injections we’ve settled for up to $150,000

Awesome perspective and insight it’s been 7 months and my lawyer hasn’t informed me with any information 🤷‍♂️ I spoke with the his aid and it sounded like she was trying to come up with something which was absolutely nothing 🙄 I’m being patient though… but I have a bad feeling that something not right… thanks for sharing your information.

Its been year since i got my settlement that was may 1, 2023 finally they said they are in the final stages since they are seeing who has leins. So should i be getting my settlement next month and will my settlement increased since its been a year and 2 months

What happens when the city doesn't comply with a motion to compel order? Compelling documents and a deposition that is being delayed by NYC.

If they don’t comply with a motion to compel the order should say what happens next - they are precluded or their answer is stricken. The order should have some teeth.

I was hit in NYC by an taxi like Uber or Lyft. I was on bike, he did a u turn on to me. I got 3 surgeries I got to have now.

Kinda in this position. My lawyer told the adjuster that he was filing a lawsuit and they hired a defense attorney immediately and now here it is 2 months later and it still hasn't been served. He even asked the defense lawyer to accept it on the behalf of his client because he was having issues with the process server. I think we've lost the upper hand and not being taken serious anymore because they're not even responding anymore.

2 months is not a huge delay. As long as he’s ready and willing to go to trial and prosecute the case you should be ok

Hi, not sure what you mean by "lawyers use the at fault person who cause the accident and the victim insurance" ? How have you seen lawyers use the two insurances ? In my experience, the bodily injury or at fault person will pay for all the pain & suffering. In NY the victim's auto insurance (the car you were in) pays for all the medical bills under PIP or No Fault coverage. But each state is different.

Please, please, please see if I can call you... Idk if I'm able to write my situation here, in public bc it's an almost 6yrs case & I'm just feeling so disappointed. What I'll write is that I'm going thru a malpractice situation. Tysvm

I was rear ended by a 18wheeler (dollar general) with a full load here in OKC, guy jump out and said he was on his phone. State trooper was their Within 20secs & the guy hit 2 other cars. Totaled 2 and damaged another , he totaled my car in a HWY contruction Zone. I have dashcam footage and in cabin footage of direct impact. I showed the state trooper my footage on the scene . I had back pain, leg pain and whiplash. I just recently got an MRI done on my arm and i have a Minior tear on my roator cuff. I have been seeing phyical threapy and Chiroprator for almost 3months now and will be cleared for a recovery here in 3weeks. Do you know the average settlement of a rotator cuff? The lien would be on the legal fee. Your client share does not get affected if you change lawyers. For example if you fire him and hire a new lawyer who wins $1 mil for you. Then you get approx $700,000. Same as you would if you didn’t fire him. The only change is if you never fired him he would take $300k fee but if you hire a new lawyer the new lawyer and your old lawyer share the $300k legal fee. What is comparative fault?

That refers to the percentage of liability or fault for both the plaintiff and defendant. Comparative fault means the plaintiff can recover no matter the percentage even if the plaintiff is 70% at fault he or she can still recover for the 30% fault of the defendant. Contributory negligence means plaintiff can only recover if the defendant is 51% or more at fault.

Lol im coming up on the 5 year mark and i still haven't had my deposition yet! I got ran over by a towtruck broke 9 bones ripped my liver in half internal bleeding and a huge list of other stuff. Its a huge joke!! I think the instances company hopes i DIE before there is a mediation for me😂

With city of New York it takes a bit longer bc city court parts are slower and the city doesn’t respond to discovery so you need to file motions. But the amount can be high bc there is no limit with insurance so that’s a huge benefit.

I do have a question, say am insurance policy is a certain limit and your damages go beyond that like in an premises commercial case, can we go after the land owners personal property and put liens on his business accounts to collect the damages that exceed the insurance 🧢? Do you have any idea if a posterior tibial tendon subluxation (ankle) pays a lot. My doctor said it's a rare surgery. Thank you, and I love your demeanor!! You seem really nice.

Thank you. Yes that is a serious injury which often requires surgery to the tendon so I would say that can be worth a substantial amount into the mid to high six figures. We have handled tendon surgery cases and settled anywhere from $250,000 all the way up to $850,000 and if it’s combined with other injuries or serious it can get into the millions.
