    I love how Dave often times uses the word "we" when talking about a plan of action. It really makes it seem like he's a part of what the caller is going through and especially with this caller in particular. He treated him with a lot of compassion. Even if you don't agree with his ideologies, you have to respect how he handles these sensitive situations.

    He can also file a motion for installed payments if he pays on it consistently also. This happened to me and this is what I did.

    Good for him. Turning his life around slowly and hopefully he will stay on this path. All this debt stuff and a garnishment is emotionally daunting. When my home went into foreclosure I just wanted to crawl into a hole. Keep the faith brother!

    We had an experience with a garnishment, they don’t take settlements. Once it’s granted, the only way to stop it is pay the whole thing off. Thank goodness it was only around 5k I helped a family member pay off in a lump sum to stop the garnishment but unfortunately he’s locked in until he can pay in full. I hope he’s doing better now tho

    Good for this guy. Seriously tough to start paying off debts. Seriously tough to get sober AND manage life after prison. Seriously tough to be garnished. Dave did a great job of making sure this guy know he's a tough, courageous guy. Hope the best for him. Character is not never making mistakes, it's what you do and how you handle yourself after they occur.

    He gave the roommate permission because of what was written on the outside. Sucks that they're allowed to write "Wage Garnishment" on the outside of the envelope.....no privacy at all.

    James Luna Jr. It should be normal to look through mail to find your own when you have others living with you with the same address. And when people are sharing household expenses and see "Wage Garnishment" letter from a roommate naturally that would raise some concern.

    A collection/judgment from a training course back in 2002? My first question to Dave would’ve been about any possible statute of limitations. There may not be one, but I’m surprised he didn’t mention it.

    My cousin had a court ordered payment. From what she was told there are limitations unless the court agrees to renew it. Once he made one payment he basically showed them that he was willing to. Im guessing the school decided to go back to court and ask the judge to renew it and they agreed

    Ramsey said to make them a lump sum offer less than the amount they are seeking. Why would they do that when they are garnishing his wages and can get the full amount that they seek? The double amount of what he owed is due to accrued interest on the original amount he owed. The only way to stop the wage garnishment is to quit the job.

    Dave - you missed a key option for this caller - since OTR truck drivers are an occupation that is in high demand, the caller can simply quit his job and get another one with a different company. A creditor cannot garnish a paycheck they cannot find.

    The only ways you can get out of a wage garnishment are to either file bankruptcy, pay off the entire judgment, or file a motion for slow pay with the courts, where you make a predetermined minimum payment to the courts each pay period, until the judgment is satisfied. Or, you can quit your job, which is astonishingly stupid.

    I called the company that was garnishing me and threatened to quit my job and go back to bartending cause they can't garnish tips if they didn't allow me to make smaller payments than what they were taking out of my check and that worked. They went from taking half of my paycheck to getting $150 a month.

    There a post judgement interest there act like a bank and get a min garnishment and do over a period of time cause the 11k which is rack up interests to double. I went to a trucking school like that. Never drive much but pay off debt.

    Maximum amount garnished in Illinois is only 15 percent max. you can contest the garnishment in court,financial hardship.

    They may just lower the amount. My cousin owes over 200k in a federal student loan. Her payments were 1k a month. She filed hardship and they lowered it to $500 a month after seeing her income and bills

    They get more out of the garnishment than they’d get out of payments and I doubt they’ll settle for $5,000....Maybe more like $8,000 or $10,000.

    A sheriff was outside my house today and gave me the paper saying I was getting garnished but didn't give a court date about it. I called the company I owe money to and they told me I have a court date

    Hi Dave roughly 1 yr ago I acquired a medical debt of 9000.00 I started to make payments. Before I could even make 3 payments it was sent to collection. I negotiated payments again and started paying the collection company. Within another 2 months they sent back my money order and closed the account, and sent it to the attorney representing the hospital. I talked to the attorney and he would not accept a monthly payment of about 25 dollars a month which is all I'm able to give, I have a high car payment that I'm commuted to paying I drive 80 miles round trip to work, so I need a reliable vehicle. They also told me that I had to pay this off within 5 yrs. Which I don't believe, although I do not want to, I have hired a lawyer and will do bankruptcy. if my wages are garnished I will lose everything my place to live ,my job EVERYTHING. I'm not able to save anything I live paycheck to paycheck. I make 11.50 an hr. Any advice would be appreciated thanks.

    Honestly I would of appealed that cause cause it sounds like they got a judgment against him without him knowing he getting sued. It's happened to me I got a judgement against me for an old debt that was out of statue of limitations but an illegal judgment because i wasn't served and I counter sued them for defaming me ect in the end I won my case and got my money back plus extra 1000 because they violated statue of limitations laws.

    Not showing up is the easiest way to lose in court. You only won your case because of the statute of limitations. Not because they served you incorrectly or whatever or because of defamation. If someone is suing you, you need to show up. And if it's a large amount of money, you need to consult a lawyer.

    @@bkucenski I won my case because of that and not being properly served. I subpoena the process server and he failed to provide proof that I was properly served. Here in az they need you to sign the lawsuit or they need to tape it to your door and take a photo of the tape document on the door and the house. In other words the process server was getting paid under hand by the debt collector and hope I'm ignorant of the law.

    And I only got the extra 1000 because it is a violation to collect after statue of limitations. Any violation it's a 1000 per violation made 20k one year because I was getting harassed by a debt collector for someone else that used my phone number.

    You cannot pause a garnishment procedure until you give them go away money. Once the garnishment starts it’s there until your done paying it, quit your job and they would have to file again or you declare bankruptcy. Once they garnish your wages they will not settle for a lesser amount. They have all the leverage in the world. Why settle for 5k when they can get it all?

    I have read that if you are having child support payments being taken out of your paycheck or some other IRS debt that any other garnishment cannot take place. Is this correct

    A friend of mine , said his local school district in Pa, has started garnishing his pay check , because it says "delinquent earned income taxes" ?? The wage garnishment has started , There was no court judgment ? No tax lien ? its confusing . Does anyone have any insight on this ? What does a local school district have to do with the IRS and income taxes ?

    Not sure that Dave advice here makes much sense. He's correct that they aren't going to allow him to just start making payments again; the garnishment order is basically enforced payments. They don't need him to make payments when they can just take them. But offering them a lump sum to go away doesn't make much sense. It's just going to be, "Well sure, we'll take that less-than-a-quarter-of-what-you-owe. And then we'll just collect the other $17k through the garnished wages." It makes no sense to say, "They've probably given up on seeing the money." when they've just gone to court and got a judge to issue a garnishment order. Now, if he'd managed to put together the $5k settlement offer _before_ the court date, okay. Definitely worth a try. I would have thought the more pragmatic way would be for him to just accept whatever amount was being garnished as if it were a minimum payment of a debt and treat it like any other item in the debt snowball. So get a budget together where he's making minimum payments on all his other debts and start working the baby steps.

    There going to garnish a little over 4000 from my check ever week, don't know how much, but it is what it is. That man is handling it better than me. It sucks, really does. Money I don't have to spare.

    Background checks have been going on for few years for CDL holders. I am not sure that one can have felonies for drugs and have a CDL license issued or maintained. Of course the obvious thing that glares back at me is how $5000 owed for training turned into $22,000.

    Probably, I think it depends what state you live in. In any case, they can hire collection agencies to write scary letters, to make you think they will. If you owe $$ to a hospital, call them and see of you can do a payment plan.

    He's got a record and is inexperienced. He could probably make better. But it's not a guarantee. He can't get hazmat.

    Surprised he could even get a CDL, in most states any kind of drug conviction will bar you from most driving jobs.

    Garnished wages aka forced payment plan. No way around it you will be working for them till its paid off. Work a little more to offset the garnish.

    This caller should be very proud of what he’s accomplished. Pulling himself out of addiction, getting CDL, living with a roommate within his means, and earning a respectable income of 45k a year is a major achievement.

    I'm being garnished from a credit card that was 1200 in 1998 it is now 39k ...at 14 years and 3 months they reinstated the debt by taking a penny from a bank account that was not mine...this debt is not on my credit report and no attorney wants to help only file bankruptcy..i offered 10k and they rejected the offer..in the meantime this is still accruing interest which is 28%

    2:04 he said this is from 2002 so 17 years ago. many states judgments are good for 10-20 years and renewable. It very well could be $22,000 if it was from 2002 originally $11,000 with statutory interest. Please Dave look at all possibilities. Additionally being in prison may toll the statute of limitations as well.

    How difficult is for people to understand that you should pay the money that you owe. You have used it you have to pay simple. Yes you can negotiate with the collector and hamper your credit rating or pay in full and be mentally satisfied. If you would have taken money from Dave Ramsey he would have made your life miserable and taken the money. It's easy to sit there and speak till you don't feel the pinch.

    @@noncustody I gross $1,000/week doing Ubereats when I drive 70hrs. I really don't see how he'd only make $800, unless he s only driving 20hrs a week or less.

    Ok drugs and alcohol and bad choices in your past now get a lawyer and file bankruptcy and clean this up and with a little research and good choices you’ll bounce back in just a few short years.I know...I’ve been there and done it.

    I think the garnishment would go directly to the employer and you would never know about it until your employer tells you.....somehow they found out where he worked
