HOA's should be illegal. Giving your rights away and allowing someone else to decide what you can and cannot do on YOUR property is to me not even a concept I can ever accept.

A good HOA can be an advantage in some communities; unfortunately, too often they are taken over by petty despots, who use the HOA to tyrannise the rest of the members. A good HOA can protect the neighborhood from: * lazy neighbours, who refuse to keep their gardens reasonably neat; * rowdy neighbours, who have rowdy parties at all hours of the night; * inconsiderate neighbours , who park across other people's driveways, or who do not trim their bushes, depriving other neighbours of the ability to simply walk down their local footpaths; * etc. Some of these matters can be addressed through legal avenues, if the offender does not respond to reasonable requests. However, this can be an expensive and time consuming process, and can lead to long-term bad relationships between neighbours. If you are a member of an HOA, you can instead use the HOA to deal with such problems, without incurring additional legal costs, and without your neighbours knowing that you initiated the complaint. If you are lucky to be a member of a really good HOA, they will often with things,such as; * organising working bees to help beautify common areas and parks; * organising working bees to help disabled and elderly residents maintain their gardens in a reasonable condition; * having a social committee that will organise/supervise community events like; Christmas parties; Halloween parties; visits to elderly residents; etc. In short, a good HOA can be a blessing to its residents, but a bad one can be hell on earth. If you do live in a HOA community, please be an active member. Attend it's meetings, run for leadership positions if you can. HOA's usually become despotic and dysfunctional when the majority of members do not participate in them, and leave the running of the HOA to a few people who enforce their restrictive opinions on the rest.

We got lucky. It's an older subdivision (1974) and it's only an HOA to keep junk cars and such away. They maintain a park and a pool. That's it. I've had no problem with them on anything at all in over 28 years of living here. But the one we lived in before this was awful. I actually caught the HOA "investigator" (ie: a nosey Nancy) getting out of her car and actually MEASURING my lawn!!! Their precious HOA, however, didn't keep the gang activity out and we moved. Our subdivision is awesome and well-patrolled. But, if they decided to keep us from building a ramp for my wheelchair (and I have one), I would have to own them. But, I bet they won't even have aproblem with it.

@@geoffreywood5808there are no “lawyers for the ADA”. The ADA (and the Fair Housing Act) is just a law that is under the authority of the Department of Justice. If someone violates the ADA, a person can file a civil lawsuit against the person/entity who violated their rights given by the ADA. Part of what makes these lawsuits rare is the expense of filing suit bc hiring lawyers is expensive and unless one is independently wealthy most disabled people can’t afford it. Some lawyers will take cases on contingency (meaning the lawyer doesn’t get paid unless they win the case) but that usually means the lawyer won’t take the case unless they know it is a “slam dunk”. If a person DOES pay up front to retain their own lawyer, they can always request lawyers fees as part of the monetary award at the end as a form of punishment for violating their rights.

I hope the HOA president got booted out of his office of president.

HOA's have been VERY discriminating and appear to be continuing to decline during year to year "personal opinions". Options for disabled persons get more difficult, complicated and prices continue to rise. Self righteous persons (if I could consider them as "people", cost the disabled persons extreem amounts of money while those making complaints nothing. Perhaps they should be forced to pay for anything they consider to be remedies.

The demand to remove the wheelchair ramp is an ADA violation. The first thing to do is get a lawyer that specializes in HOA & ADA cases & sue the board. The HOA board will quickly realize that they are violating federal law by demanding the removal of the ramp & will back down.

I would have fought like Angela. The ramp gave her freedom to move around and have some ability to get around by herself. The lien was bad enough, but then to complain about her wheelchair causing marks, that was unbelievable. Whoever was instigating this whole fiasco should be ashamed of themselves. It's called harassment at a level that is digusting. I'm glad she fought this HOA fool. This was clearly discrimination on a high level.

The board needs to be removed. That’s crazy that they think they can do that . HOA’s take everyone’s abilities away, and in their own homes .

HOA's were designed to be temporary things to manage common property like the roads, opens spaces, and things like community pools and playgrounds in the neighborhood until the town or municipality took them over. Not to invade your privacy like many of them do now, and charge exorbitant fees.

They have become all about having power to dictate what people can and can't do with their homes to protect "property values".

HOA's do this a lot, and it is completely against the law. They're so worried about their own outlandish rules and regulations, they completely forget about real laws.

This I don't believe. So many lawyers out there would love this case and probably not charge for it.Especially these days. Or no money upfront

I'm with you. The writing is poorly done so it makes it very difficult to believe even if it is true. It could be based on a true story but I'm inclined to believe it is highly embellished. A lot of the ways they phrased things in the presentation left me with a lot of questions of how accurate it could be.

Even there is some lawyer go to parking of commercial building count the ratio of disable parking space to total parking space. If it's under the ratio set by ADA, they will sue the owner to get the money (lawyer fee).

All she had to do was talk to a lawyer that specializes in disability rights. Then file a complaint with the ADA and it would quickly stop. The fines for discrimination under the ADA would be crippling to the HOA AND each individual that voted against them.

This is protected by the Americans With Disabilities Act. The HOA’s lawyers should have told the President to back off. They would definitely loose in court.

If a contract has a violation of law written in it, the contract is nul and void. Sue the hoa a lot.

The only thing I'm pissed about... the lawyer should have started looking at this when he was first talked to... not wait until they brought up the disabilities act...

Show up at the next HOA meeting with an ADA lawyer at your side. A lawsuit for discrimination may shut them up and leave you alone.

Thank God someone finally spoke out.

I would have also contacted the police and swear out a warrant for the arrest of the HOA president for violation of Federal Law.

Let this be a warning to all HOAs.

Not all HOI's are the same. We only hear about the bad ones! I lived in one for over 10 yrs. and was able to resolve all issues. Some do many things for those who live there. Me? No, thank you. Those I know that are living in this particular one wouldn't want life any other way!

Why take the risk? Chances are greater that they'll be bad than be good. Besides people who own homes are adults and should be left alone unless they need help, then neighbors help, not evict someone who needs help. We don't need bullies. The politicians are bad enough.....

HOA all over should be looked in. Their fees are strenuous and nothing to show for yearly increases. It is sad. I could imagine Angela's nightmare. Sad, but glad it was to her advantage.

They should have immediately contacted the State's Attorney General Civil Rights Division. All states have a division to handle something like this.

I used to work for a city department that had many citizens call in on HOA’s that violated all human rights by their illegal policies. These HOA managers feel they have the right to threaten their members who live in gated communities. I like what one homeowner who had a lean put on their property did to the HOA management by disconnecting their electrical meters from their houses because their son owned the electric company. Letters were sent out to every homeowner in the gated community that anyone helping the HOA management members will face the same treatment. The community members voted the HOA was illegal and desolved them.HOA tried to sue all involved but judge was with the community on this.

Tell the HOA to come build a new ramp that meets his standards or he’ll be facing lawyers himself for discriminating against a handicapped person.

Disability Rights Advocate here. The HOA needs to read the Americans With Disabilities Act. Wheelchair ramps are a reasonable housing accommodation if one cannot walk far and gets around with a wheelchair. I suspect if this goes to court any HOA would lose.

That would be a great 5 million dollar lawsuit.

Charge the entire board, and fine them with maximum punitive costs. Also fine the HOA as an entity. Then permanently disband the HOA.

*I know of a friend of a person who was discriminated against at a bank by the teller, wouldn't cash a check or something, and the bank manager only made it worse by backing the teller. Well, six months later, after gathering some money from some friends and family, that guy bought that bank. Then he went back and waited to go up to that same teller and he asked her, 'Remember me?' She didn't remember him, but he told her to call her manager and the manager showed, and he remembered him. He told them both that he now owns the bank and they're both fired.* *I love when people go to this extent to get revenge on those who truly deserve what they've got coming to them.*

Angela should have known her rights as a disabled person and when they said “there will be consequences” she should have said “bring it on, I’ll see you in court and clean your clocks”.

I had spinal cord surgery. Left me in a wheelchair for eight months. Our crazy HOA President demanded my wheelchair ramp be removed. We got a Judge to issue a no contact order. Weeks later the HOA President knocked on our door. She said they are removing my wheelchair ramp. My neighbor was over and he told the HOA President and removal crew they were trespassing and were going to be arrested. I went out and parked on my wheelchair ramp. The crew under the order of the HOA President started to remove my wheelchair ramp with me on it. The police arrived. The HOA President demanded that I be arrested immediately. The police officers looked at my neighbor. The HOA President tried to pull me out of my wheelchair. My neighbor is the police captain and had the HOA President and crew arrested. Unfortunately the HOA President hit and kicked the police officers. She went to jail. At arraignment the crazy HOA President demanded the judge release he and arrested me and the police force. Later the police found out the HOA President and treasurer had been hiding $600 k from the HOA. Both are serving prison time.

I think anyone who discriminates like this hoa boss did should be sentenced to work, closely supervised, in a physical rehab or related service, for at least half of their jail sentence. So they can see first hand what their discrimination does to people.

Not just her freedom to voluntarily come and go was violated, but what if her house was on fire?! This couldn't actually be a real story, i find it impossible to believe that anyone in a wheelchair would take down their ramp, before getting a lawyer.

This sounds like a major lawsuit in favor of a massive payout for the disabled which is protected under constitutional laws regardless of any hoa

This well done video shows just how you can take a 3 minute and stretch it into 17 minutes, all while still not giving all the details (How much was HOA fined? What happened to Lawyers who were doing legal demand letters? Etc). Kudos to the producers.

I like that every ramp they show in the video is not ADA compliant.
