Hannah Payne’s Defense Delivers Intense Closing Argument in Citizen's Arrested Turned Deadly Trial

On Tuesday, closing arguments were presented in the citizen’s arrest turned deadly trial. Hannah Payne’s defense attorney, Matthew Tucker, expresses to the jury that there is not enough evidence to prove that Payne is guilty of the murder of Kenneth Herring. Payne has been charged with malice murder, two counts of felony murder, aggravated assault, false imprisonment, and three counts of possession of a firearm during the commission of a crime. Payne still awaits a verdict.

    I could not even finish listening to him because he mutters and mumbles and makes no sense, He obviously does not know how to put together a sentence, so I don't really know what he's saying. I had no problem understanding what the Prosecutor was saying.

    The reason the State did not need a Doctor tl come in and testify to Mr.Herring's diabetes, and what the effect it has on the body, is because regardless if he had been intoxicated or having a medical emergency - it gave her absoltely no right to chase him, hunt him down, illegally detain him, and then shoot him. She had no right to be this poor man's judge, jury, and executioners. Honestly, the state did YOU a favor not having a doctor testify - they didnt need one to prove their case. She was wrong, regardless... As Americans we are afforded rights. A lawyer to defend her in a court of law, with a jury of her peers deliberating, is somewhat ironic given your client gave Mr.Herring no opportunity to have the same due process that day.

    They did not bring a doctor in because he is not the one on trial, it’s irrelevant whether diabetes or heroin caused the accident ( and of course there was no heroin ) but it’s irrelevant what caused him to miss the red light he isn’t the murderer , he is the victim .

    To be fair he did have a stroke before trial… I don’t think that automatically makes him a bad attorney, but if I were Hannah I would have considered that and maybe sought different counsel until he had more time to recuperate because he really was all over the place after his stroke

    First of all, if y’all had done this..years ago..when it first happened, or at least close to it, there wouldn’t be need..for this much recollection. Also, their stories weren’t that much different from long ago, especially..Ashley Jackson’s story. She was unwavering..in her accounts..as to what happened. Even though..u were trying to trip her up, but..failed. Now..your client..on the other hand, was all over the place..with her account, of what actually happened.
