Gary reached out to me a few weeks ago and shared his Ferrari 360 Modena CNC Motors purchase story with me. We both could not believe the similarities between both our purchases. We both bought a 2000 Ferrari 360, red/tan, 41K miles, F1 for almost the exact same price. We both do not have our titles.

    I’m 38, Aussie living state-side, and also inquired about that exact red 360 with the front lip & kit with CNC - sorry you guys are in this situation, but so glad I dodged that bullet.... who’d have though the criminal strip club owner I ended up buying my 360 Spider from would turn out 100% more legit than CNC...!

    It doesn't necessarily work that way. The only safe way to do it is go to the dealer. If you're doing anything by mail - nobody is sending you a title without money. Why would they do that??

    Guys! It’s not a good situation in any way but Every car at the dealership has/had a label on them saying “sold as seen “ and you still bought the cars without full service history and the cars had 41k on them!Guys!

    Bald tires on a Ferrari should be a huge red flag. I would assume anyone taking care of a high end car would never let the tires go bald. I would expect a good dealership selling a Ferrari would never show a Ferrari with bald tires.

    @Matt Salvo - Those that are like Gary that have possession of vehicles and a legal bill of sale. Are they able to keep refreshing the temporary tags to be able to drive it? I know that's the least of a massive pile of problems but I'm curious how that one is being handled.

    Hope this all works out for your guys. I have seen several people say the buyer who buys in good faith through normal process is the one that gets to keep the car. The seller is the one that gets screwed. Lesson to be learned, don't mess with consignment.

    Gary makes a great point about buying cars from way more sketchier places with no problem. I certainly have, also with no (major) problems. Don't blame yourself could have happened to anyone.

    It's stories like this and Shane's (re: CNC foolery) that instill fear when dealing with used car dealerships (even more so with high end vehicles). We were debating selling a sports car recently and had it down to Vroom and Carmax. Vroom had the higher offer (and seemed more "aggressive" in buying the car whereas Carmax had a take it or leave it approach - Vroom approach reminding me of CNC contacting/pursing sellers) but their "process" is to pick up the car and then 2-3 days later send payment. Ummm...you have my car (and not local with no physical brick/mortar locations so how do I get it back and at what cost if the deal doesn't go as planned) AND you have my title...naga naga not going for that. At least with Carmax (local brick/mortar) I walked out with a check in hand (that would hopefully clear and did). BTW, sad to see all these "I've dreamed of this car forever" stories of folks saving up everything to buy their dream car and then realizing they need $$$ in repairs they didn't think about. These exotics (sorry, I don't agree with calling a 360 a "super car" these days as there are super and hyper cars now that are crazy in design, specs and $) are SO known for being in the shop more than being in your driveway/garage. They are not daily drivers for the average owner (meaning you are not mechanically inclined or able/desire to do most of your maintenance like Dan/Normal Guy Super Car [again, not a super car IMO, just an exotic Italian prone to many...many issues that are REDICULOUSLY expensive to have repaired by a manufacturer certified shop). If you follow Dan's channel, his ownership channel is all about him doing repairs (for the most part)...says something, doesn't it? I feel sorry for folks getting scammed as that's just wrong/criminal. However, I don't feel sorry for folks who don't know what they are actually getting into regarding exotic car ownership and the endless bills that follow...forever. Part of the exotic care ownership experience. Depending on how much you financed, your monthly car payment may be equal to what you will end up paying monthly (or take your annual maintenance bills divided by 12) for repairs/maintenance. There's a reason these cars have lower mileage as compared to a non-exotic of the same model year (in general). They are in the shop so frequently or for so long they don't get driven. When driven they brake down and are repeating the repair cycle/time process. Beautiful cars, totally unreliable (which is funny, because the later model years of the 360 are some of the most reliable Ferrari's made - for their day).

    For all of the trouble of these car's I would rather have a GT500, SRT Hellcat Demon (plum purple carbonfibre roof), Or a Camero exorcist edition. Your spending 100k(canadian) for a NEW CAR that is domestic that you can daily drive in the summer.

    Carvana gives you a check at the time they pick up the vehicle. Would vroom let me take car on the promise I pay later? NO? I only hand over the car, the keys, and title in exchange for payment in full! You want the car and do not have payment in full? Pound sand and kick rocks, pal! AND go away!

    Have you considered a bonded title? There’s a few people in other states that may be able to get you one so you can register the car in your name.

    This is why I take the depreciation hit on exotics. Ferrari comes with seven years full maintenance. The more you drive it, the more free service you get. I know it’s not really free, it’s included in the price of the car, but there’s no limit to service and maintenance.

    I’m driving an AMG GT 63 S currently. But go figure, I’ve only had it since February and today my infotainment system went crazy. Wouldn’t let me change any ride or comfort settings 🤦🏽‍♂️

    Clay is able to sus out who is going to be his biggest problem and make sure they are taken care of. If he smells weakness, he will take advantage. I am pretty all the guys who would have buried him 6 feet under were made whole, quickly.

I have no dog in this fight but if I did clay would be looking for crutches and a dentist by now. Or at the very least would be begging to go to jail to protect himself. Violence is not the answer so many times it's used but this is when he needs to worry about every car that pulls beside him on the highway or at a red light Why don't you have him and his Family living in fear until they sell the kids toys to pay these people off??????

    What I have to say is that do not let this negative experience destroy your confidence in GOOD people. All will turn out positive as this is how energy works out. You will have your good luck possibly in a different way than you realize. Another thing is this. Get out of the Ferrari game and back in to aircooled Porsche or 928s They are both amazing cars.

    Sorry that happened to you.. if you have the car but you don’t have a title, I think you could get a title bond to secure your vehicle without a proper title. If you don’t have the car, then you might be screwed, probably find an attorney ASAP

    Same way they all do. They blame their victims for wanting a better than average deal and being greedy and weak. In their mind just sheep to be sheared. He can distance himself from his victims because he thinks they deserve what they get. Proof is that he was still looking for another bucket of money even when he got shut down. Just like Madoff.

    He's an idea for you guys. Put a lien against cnc motors property for what you paid for the car. Look into that with a lawyer. Its security until you get the titles they owe you or you can cash out and pay the seller yourself.

    From Australia so not sure of the laws but done that here in Australia and it worked for me (not a car deal just debt of $159k). My only question is how would you put a value on the title? In terms of the ‘out of pocket’ if you paid for it, is the title holder deemed the owner?

    Good faith purchaser requires that original transaction to CNC was genuine. If in fact CNC never followed through with it’s sides of the deal the original owners, these owners can make the case (derivation principle) that one cannot sell what one does not own, and the final transferred rights are derived from the rights of the transferor, here CNC. It gets into dates and what’s on paper at this point. Cars on consignment normally do not transfer ownership rights to the consigning dealer, so that transaction would not pass the genuineness test. Buy consignment in trade would place CNC in an ownership role, a murkier realm. It will get sorted out. He’s right to be careful with that car( if the original owner can repo it it would be tougher to get it back since he has the title and the car and the bill of sale would be an empty piece of paper.) Moral of story is never allow anyone to have the money the car and the title of your car in one place other than you.

    Moral of the story, never consign your car. Sell it yourself. The other things I learned; never buy a Ferrari with the F1 transmission, and never buy an exotic without an independent PPI by a specialist. Also have deep enough pockets to be able to deal with a worst case mechanical failure. Or buy a warranty. Sorry you guys got screwed by this Clay person. Unfortunately CNC’s money is likely all gone, so probably no sense going down that path. The only reasonable resolution to the 2 owners of one car scenario is for a judge to order the cars be sold at auction and the proceeds then get split between the two parties. A lot of money will get eaten up by legal fees though. Probably not much left if it’s a $50k car.

If people really understood the whole buying a Ferrari experience they wouldn’t blame people for going through a place like CNC, yeah they F’d everyone over but they didn’t make you purchase 2 Ferrari models you don’t want before they’d give you the privilege of spending your money on the car you actually want. Purchasing a high end sports car or exotic is completely different from buying any other type of vehicle.

    I would ship it to Europe straight away and register it in the U.K. or somewhere as you won’t need a title as when you import it they issue a new U.K. title and sell it before there’s a lean on it from the court and you can’t get it out of the states . You will have to pay the U.K. taxes but at least u can sell the car on and get money back . And cnc motors owes a pal of mine over 2 million dollars for cars he sold and didn’t pay him for and even took a loan against one of the and defaulted on the loan so the car was repossessed!!!! Clay doesn’t have a dollar to his name he owes 10 s of millions if not more

    As far as lug nuts and tires falling off isn’t something you would know .. but every person must have told you before you purchase an old Ferrari that it’s a money pit and will be in the shop longer then in your garage.. people with real money that purchased led Ferrari’s are buying them for a different reason they purchase them to sit in there collection not to drive and for the most part they go from friend to friend through auctions… every person I’ve ever known with a 2000 and older Ferrari they all are money pits the 458 changed there reliably ratings just like the huracan for lambo everything before them are money pitts even the gallardo have that shit transmission… I know your a smart man to get to this level in life so I’m sure you joined every forum group on your make and model Ferrari? They usually punch reality into people with dreams of buying an old Ferrari lol and old anything for that matter woman included haha 😂.. I have a feeling you were told not to buy but the dreams you had of the car outweighed there knowledge and experience…

    The CNC story is a simple one: criminal car seller finds many dumb car buyers. Obviously I wish nobody would have been screwed by CNC, but how dumb are people when they hand over money for a pricey car without getting a title at time of purchase? Duh! Whether you buy a $500 junker off Craigslist or a $500,000 exotic from a "dealer," you DO NOT hand over money without title transfer in the same transaction. As the saying goes, "a fool and his money are soon parted."
