This is why people should not let a single entity gain an overwhelming share of a specific genre of hobbies if possible. If they ever feel threatened they will use the power of the courts to crush anyone that they can. Miniatures is a field where there could easily be something like OGL. At that point you could have similar stats and similar aesthetics of the model to be safe.

We have to say no. We have to stop supporting GW, Disney, WotC, etc. Don't give them any money.

I quit warhammering some time ago. Fellow players insisted on enforcing the company's edicts on what figs I could use. It was impossible to just establish and maintain an army like that without unacceptable expense.

I still think GW is a trash company (I’m not an apologist by any means) but this is completely within their rights. GW needs to accept 3D printing is here and they don’t own the IP to literally all fantasy.

Look...I'm not the biggest lover of GW but EManG openly admitted to ripping files from Total War Warhammer and turning them into STL files. He was told to stop selling them and didn't so it's on his own stupidity.

GW will never get a penny out of me. Their business practice is terrible. If it wasn't for independents (Astartes Videos) I never would have gotten into 40k. I was just about to drop 1k on an army when they cracked down on creators a couple Years ago. I was in the process of studying the factions and choosing what I wanted- due to their crack down I bought a nice camera which I use all the time as opposed to a 40k army that'd just sit on a shelf 99.9% of the time. If I want an army, I'll get a 3d printer- I'm glad they convinced me not to pay for their overpriced plastic, the Camera has been a great investment.

Yeah my brother has a 3D printer and he has been making a grey Knight army for me I have just about a thousand points right now and I have a printed kill team of sisters of battle and my only official miniature is a deathwing Terminator dreadnought from a few months ago that was the miniature of the month so I personally have never given them any money the closest thing they have to getting money from me is the Google Play store giving them some money for my download of tacticus And I have also not paid for a single 3D file either as all of my units were free files because I wasn't trying to pay 60 USD for a five-man squad with a cost of plastic that's not even worth 20 USD and I already have the files downloaded for my next army and thankfully one of the files my brother already had for the biker squad because it's like 50 bucks for three guys and for the regular legionnaires that's like 55 USD for a squad of 10 and a squad of 5 raptors is 37 USD and because I need five five man squads of legionnaires that alone is going to cost me about 165 before tax and five of them are not even going to use and then I have to purchase the iron warrior upgrade sprues for the shoulders and the helmets which is like another 25 and 35 respectively for each single sprue and with the helmets I get 11 total heads 9 that are armored one without a helmet and one with a fancy sing on the top to symbolize him as a leader unit and the shoulders are a pack of 10 and because I need 4 squads of raptors that's another 130 something 260 USD just for heads and shoulders and I need at least a Terminator squad which is going to run me another hundred USD and not even including if I want to run a chaos rhino which is going to be another 40 for a single tank and I want the possibility of having three so that is at least 120 USD so all in all for the army I want to build I'm going to be spending just shy of 1200 for a 1000 point list but when I can spend about $70 in resin and then pay like another 20 bucks in paint because primer clear coat and Dollar store craft paints and a bottle of glue to put sand on the bases and like another six something on superglue from the dollar store that comes in two pack for a buck 25 I think spending just about a hundred bucks which is just shy of 1/12th the cost of the official models I think 3D printing is worth it in the end spend like 3 or 400 on the printer another 50 to 100 on the resin curing station which is literally just a box with UV light in it and spending like 15-20 bucks occasionally on isopropyl alcohol and gloves and as long as you have a computer or you have a friend that has the computer with the program to splice it onto the print bed cuz I mean you don't even really need a fancy computer unless you're trying to do 3D modeling yourself but you can get away with some decent models on a tablet or a phone with a modeling program you just need to be able to transfer the files through USB or wireless to the printer it's even more worth it because if you have friends who want custom fits made or certain units printed you can just charge them for the cost of the resin and electricity and your time taking the models off and cleaning them and curing them because just about a year ago my brother's best friend was going to charge me about $80 just so he would print and do all the cleaning up and curing work for 2 ten lady squads of a cyber Valkyrie sister of battle squad which would have run me about 48 USD for a single 10 man squad so I mean there's money to be made in it but long-term it's probably cheaper to just get the stuff yourself and I mean after I get myself a new job I'm planning on getting myself a laptop and then a printer and curing machine so I can just do it myself and with the army I want after I finish my iron warriors which is tyranids that's going to cost me as I want a 2000 point army if I go with the official models instead of finding free models online or asking my brother's best friend if he can send me the files as he already has all the files for that army and just getting the combat patrol box which is roughly about 115 USD 4 32 miniatures and that's only about 500 points and certain models I can't have multiple copies of and some of the models I have to get are like 50 USD for a single one

This is crazy. I have several of his files, pretty sure he used to do Marines as I wouldn't have downloaded his current stuff which is why he probably got served. What's really crazy is I reported a guy on Cults several years ago for making whaaa-tifa marines and got a follow up email about a week later saying how serious they take their IP. Just checked and the dingle is still on Cults with all of his marines still up, they are even less legally distinct than EmanG's are. This just shows who GW supports and how much they hate anybody else.

I hit the like button everything I download since there's nowhere on a models page that tells you if you've already downloaded it and when I went through your stuff the other day I didn't see anything "liked," so I figured you were forced to take down your models.

I’m 54 and supported GW for a very long time. I started playing back in the days of the original Rogue Trader. My group played through college, cutting our teeth on 40K, Epic, Necromunda, Warhammer Fantasy, and everything in between. By 2012, I had enough. They had priced themselves out of my world and I was tired of the constant updates. Too many codices and rule changes. GW’s arrogance was really pissing me off, so I walked away. Then I saw the scale changes and other cash grabs. It was good to see that sh*t in the rearview mirror. There are so many other game companies who get my money now. Battletech is doing great now, and we’re playing Dystopian Wars every week. Right now is a good time to get the hell away from GW.

If this guy indeed used free models, and didn't rip them, then he shouldn't have sold them. Adding supports wouldn't constitute as fair use. He could upload the model for free, sell the supports, and then tell users the model's correct orientation. But, selling them is asking for trouble. Examples: If you buy a book, add an index to the pdf, you can't just resell the entire pdf with the index added. If a game company provides 3d models to fans for fan animations, you can't sell those exact models elsewhere and say "they were free". I myself 3d model in my spare time. The golden rule you have to follow if you're selling something, especially if the IP is owned by a big corp, is that you gotta sculpt the models yourself. If you don't, you are risking far more than just your model being taken down for failing the squint test. Edit: mispelled squint

To be clear, this guy didnt make models. He mined the 3D models from GW videogames, made some modifications, and released them back to the public. This guy is not innocent, and he says as much. Also! GW gave him an out, and he kept going thinking it was frivolous, so now he's finding out what happens when you do that. GW made their point at this phase of the case. They really should let him be, but he's in no way innocent.

As loath as I am to admit this, he was taking assets from their games (Skaven and daemons from the Total War series) and placing them behind a Patreon wall. Copyright laws are also very different in UK and that should mentioned any time this happens That alerted GW and made them send C&D letters. They only escalate to court if you flout their letters or do something worse No matter how you look at it, this is shady stuff and he is paying the price. It would be like if someone took from your Nano Templar saga and placed parts of it behind a paywall for their account.

People forget that GW tried to copyright the terms "Space Marine" and "shoulder pad" among others. They abuse the copyright law because of their money and monopoly. As a digital artist (owner of the Martillo Y Cola studio) I got me tons of copyright strikes from GW, even on stuff / designs they have nothing to do, just because they were compatible with the Space Marine range.

For the sake of our own well being and the ability to go into business for ourselves in any industry companies like Games Workshop need to be stopped. The fastest and most ethical way for us to do that is to simply not spend any money on any of their products or services.

Sorry guys, I completely understand that the GWis a jerk, but the Emang copied the characters. Copying is completely unacceptable. Invent a new one. In essence, the creator failed in the plagiarism lawsuit. There are many creators from whom you can buy .stl files and everyone tries to make something similar, but does not plagiarize. If people want to move forwards against groups like GW then the thing they need to do before anything is published on the internet is to get a patent recognised for it, That can cost up to 2 thousand dollars for a full service fee with a lawyer, but it would secure against things like this happening where you are sued by a company that hates original design work. The only way to beat them is to out think them and then - if they do proceed to legal battle, have the paperwork ready beforehand of the copyright you have over said patent so that the lawsuit of frivolous and you can then counter sue as it should've been something they do in the run up to the suit against you...feel bad for the guy but this is obvious on what was going to happen eventually with 3D printing, ofc these corporations are going to try and stop you doing things your way. Wait til 3D printing things for electronics becomes easily available, you'll see the shtf then.

One quick google search of Emang's warhammer models shows he was violating their copyright. Most of those models are lifted straight from Total War: Warhammer's assets, posed and given out for free; and it's likely GW gave Creative Assembly their own CAD assets to speed up the creation of the in-game models. His Greater Daemons and Be'lakor are 1:1 replicas of GW's, even down to the poses on some of them. You might not like it, but that's just how it is.

IP cases start by attacking the smaller fish, if the petitioner wins the claim it sets precedent for larger cases.

It's much bigger than going after a WarHammer 40K fan. They are trying to prevent people from having any upward mobility.

OK, so to be fair, EmanG DID have a lot of STLs based off Age of Sigmar, 40k and WHFB stuff. Quality sculpts by the way. I downloaded some Not Bloodletters before he took them down. From what I remember him saying at the tike he took them down because of these C&D complaints. That being said, he took them down and wasn't selling them or anything. You'd think that would be enough. What GW'S doing is punishing him and making an example of him. Something that could potentially impact hundreds of other independent sculptors not associated with GW'S IP at all.

Space Marines in power armor are basically the mobile infantry in the book Starship Troopers. Also, the book The Forever War has space soldiers in power armor. In addition, the 70's games Ogre and G.E.V. were set in a future with hover tanks, super tanks, huge cybernetic tanks and soldiers in yet again, power armor. (In the introduction to these games the author gives credit for inspiration to Starship Troopers and The Forever War.)

GW/Warhammer is a conglomeration of 50+ different action/adventure genre of movies, and stories such as Terminator, Aliens, etc. all mashed into one. They have no right to demand copyright claims on concepts. Even the Emperor himself is borrowed from other settings. Eman is their test bed. After they are finished with him they will go after more visible creators like majorkill, but someone they can beat on the corporate level with high powered lawyers crushing people like eman gives them the corporate president to where they can go after someone else or even a franchise. Yes, they would trademark elves if they could.

Honestly? This is EmanG's fault. He ripped models directly from Total War, went on to sell pre-supported models via Patreon, and ignored multiple C&D letters from GW. Conflating this with Dave from MWG is complete bullshit, as Dave created a totally new system that, while it obviously takes inspiration from 40k, is a new game and IP. I hate having to defend GW, but people need to do more research and not take a single Twitter post at face value.

I returned the audiobook The Lords of the Lance by Graham McNeill it's an ultra-woke take on the Bretonnians. It's full of female knights, gay romance and even shoe-horns in a disabled character for box-ticking. It was terrible. The 40k Novel Rites of Passage by Mike Brooks has LGBT characters including a gay Adeptus Administratum clerk who talks about his 'husband' and a non-binary planetary govenor with xe/xer pronouns. Nice to see the xenocidal theocracy of the Imperium fully embrace LGBT identity politics. So progressive...🙄The book itself isn't actually bad but the insertion modern day politics is really jarring.

Customers should be avoiding Games Workshop for at least self-preservation reasons. None of us really wants any of these companies to get away with this kind of bad behavior. Maybe some of us want to get into this kind of business. Do we really want the kind of environment where bigger companies can out spend new and upcoming companies? (If any of us create our own company we'll be a new and upcoming company that could get squashed just because we're smaller.)

I recall a long time ago during a con someone had an Eldar army over in the US and had a troop hover transport or hover tank made bu a third party. Anyway this guy was setting his army up at a con when a rep from GW refereeing stops and says that model cannot be used. The guy insisted it was just like the vehicle and made for WH40K but the rep insisted no. Asked why the rep says the model is not made by an accredited/recognised manufacturer affiliated with GW/Citadel Miniatures. ...Partly reason i stopped before 2e, that and i jumped over to Cyberpunk 2020 and Rifts RPG.

A stl group I followhad to take down a 'totally not warhammer' kickstarter because of GW's DMCA. They said they are relaunching it with more altered models though.

I feel for anyone under the heel of this company, but they have a very large budget to litigate, its practically an arm of the GW business. We cant support all of these lawsuits, what we can do is express our willingness to walk if they continue these practices, online petition with a commitment to stop playing GW if this practice is to continue. here is the thing, you wanna print sci fi 3d minis, make sure they look as vanilla as possible, so you wanna make a space marine, make it a galactic brute marine and the space marine a normal human that is called space marine. the term space marine is generic enough to argue in court, but the term space marine and have it look like gw ip, not so much and it is the same with every other miniture. you can make a high elf 3d printed mini and as long as it does not use moon elf, sun elf gold and silver elf, you can use wood elf, wild elf high elf and low elf, and you just cant have a high elf mini under a name owned by wotc. You also cant have your wood and wild elf using the description of any IP owned by another and you only have this to worry about if you make your own setting. for instance I c an make a lunar elf and even a solar elf, I just cant have them described as the moon and sun elves of the FR. I know the elf part has nothing to do with GW but it really wasnt the point.

GW suck as a company and I hate their woke agenda. But if youre making stls which are almost identical to a companies intelectual property, it's only fair to expect legal consequences lol

As someone who is active in the 3d printing community I have to let you know you have a couple things wrong. 1. The files were just straight rips of Warhammer Total War files 2. The supported files were pay or patreon only and he was making many thousands a month this way I have interacted with Eman on a couple occasions and always found him to be a standup, decent guy. In my opinion he got greedy and turned Sauron's evil eye upon himself by his own actions.

Another thing is that they will 99% of the time send a Cease and Desist, sometimes multiple, before escalating things to court. I designed truescale astartes models and had a small patreon associated with it. When GW sent a CnD, I closed it down. I just don't see why EmanG thought it would be a good idea to let things go as far as a lawsuit, ESPECIALLY when he's redistributing actual pre-existing model files from a licensed video game. As much as I don't care for GW as a company, they have a legal obligation to defend their copyright, and while they are often overzealous and go after things that are distinct or generic enough to be protected, this is not one of those cases.

This is why I search for similar models on cults and not straight up one to one rip offs. I hate games workshop but it still feels a bit scummy to get a model that is one to one. I love models that are similar enough but someone's own take. That being said, FUCK games workshop for going this far. Spending too much time fucking over their own fans and not enough time making a good game system

Gw is going after this guy because he has no money and can’t defend themselves . Others have pointed out this fact. As long as the print is not an exact duplicate they have no ground and in fact he should counter sue. GW sued another competitor and I think the competitor won and in the facts presented it showed how GW was in the wrong it’s filings . The competitor won the case but unfortunately went bankrupt.

So GW attacks and bankrupts a guy for printing and selling his own Warhammer 40,000 models, which isn't even illegal? Then I say we keep doing this and put them out of business.

He lifted assets from Total War: Warhammer and posed them like the official models. They were 1:1 replicas.

Nothing says "Stay away from Games Workshop" more than throwing around frivolous lawsuits to destroy competition. It's a shame that the court system can be misused in such unethical manners like this.
