And breach of contract. A good judge is needed to void the contract, award the RV to Mrs. Pueblo as paid in full, award her court costs and damages from General RV and then to start an in-depth, full-scale investigation into the company and all of its current and previous contracts. They should make them suspend operations until the investigation is concluded too. Really drive a wedge up their asses and then give them jail time to boot.

It's not really a standard "vehicle" though, right? More of a house that drives around a bit like an average vehicle. A 20 year loan on a house isn't bad. Say the house is lean free, getting prepared to become rental property. She's retiring, has income generating property and her home that she can drive anywhere in north America and freely park her home on more available usable public land than any other continent. I'm more than sure that the asshat who modified that contract is definitely worse. I wouldn't be side to find out that he has lost everything he's ever had in life and is now living on the streets with a shoe with a giant hole at the ball of it. Remember, after the salesperson is done with the contract, it goes to a finance person/team. With the salesperson, the contract may have been left as she agreed to it, but the finance person/team changed it. You can't condemn the entire company, or even the one sales office, without knowing all the facts, and the news rarely presents all the facts. Their job, after all, is to sell a story that elicits an emotional response, not tell the truth. And before you come down on me as supporting the company, I have no affiliation with them. I just hate to see people making blanket statements about a group of individuals for what may be the actions of one.

@@floridareedsreviews Maybe the co-workers or some of the co-workers aren't aware of what's going on and the innocent should not be found guilty of others actions, I get that, the innocent should not be imprisoned. Those who knew and did nothing about it and the mastermind of this deceit should be imprisoned. The owner/owners of the business should do the right thing and rectify any wrongdoing that occurred with the financial amount of every contract with this issue no matter how long it has been since the purchase was made. Not to make necessary adjustments on the owners part means that they have no problems with taking 💰 from customers that they are not entitled to which makes them no better than a thief who break into a home and steal or take the money or credit cards that's in a wallet. It tells others that they don't care about customers who helped their business sales and put food on their tables and it speaks volumes about their character. This place should be shutdown and as much as I wouldn't want to see anyone without a job and have to find a new position, to knowingly and to continue to work at any business place where owners don't acknowledge and correct wrongdoing makes the employee no better than the ones they work for. I would have to question such a persons character as well. Working with and hanging with thieves or those who steal or take from others will eventually rub off on you, next thing you know, you go from being an upstanding person to becoming a criminal and a liar. The good news is that if the place is shutdown, as it should be, employees can file for unemployment.

Last year a site at our campground sold for 160,000 in 3 days. Memberships have gone from around 1500 to 6000+ on the secondary market.

It’s criminal racketeering. There’s no way she is alone. This is classic sleazy salesmen tactics. Always sit and go over each inch of final documents before signing even if it takes 2 hours. Tell the salesmen to go find something else to do for a while. Any effort to rush you or statements like they’re getting off soon or have other customers waiting are VERY big red flags. Tell them if that’s the case run me off a copy to take home and read and then you also have that if they alter after the fact. I usually do this based on “I” have to be somewhere. If they alter and don’t leave obvious disparities as in this case, you have the original to bring with you for comparison. Just have them sign the copy with the remark, “final agreement” and signature. It’s a copy. They should have Zero problem writing on it.

Sounds like General RV is just planning on legal billing her to death. She pays for an attorney then they just keep requesting new court dates and delays on the new court dates to run up her fees. Contact the State’s University’s LAW DEPARTMENT and see if they are willing to take on her case as a Contract Law & Fraud Review Case just paying court fees. Some Big Universities do help people in a situation such as this. Worst case keep paying JUST the monthly payments and if they try coming after HER in 2025 THEY will need to PROVE that their contract wasn’t altered.

She’s also been paying for 6 out of 20 years...5 yrs of payments before she understood that she was a criminal victim by an entity with simply, more money to get away with it, stealing from her, twice over; taking the payments & later, attempting to either collect a balloon payment or repossessing the RV, to sell it, again. There’s a cherry on top of that which is, it would soon affect her credit score which...is a manipulative, debunked controlling entity, as well but also a ruler over many, in many ways. My point... their plan worked and which way. She’s not trying to chase something non-threatening, at the end of the day. She’s trying to save major upsets that could devastate her, financially. I was a lawyer for 42 years working in consumer and business insolvency. These types of problems are common in the RV vehicle sales industry. They hook the customer with a deal on the financing. Over the years, the legal amplifications re disclosure requirements on these contracts have made them so complex that exactly the opposite result occurs. The customer often doesn't read or reads but does not understand the terms and financial consequences. Although not as common, what probably happened here is that some salesman and "finance guy" got together to secure their month end commissions with a big sale like this one. They gave the customer one set of contracts with terms, but prepared a second or altered form of the contract to sell. These dealers never carry the contracts. They sell them to some underlying finance entity, bank, or whatever. Often, the initial payments are the same on the two contracts so the buyer and contract purchaser look at the same performance (payments) for months or years before the forgeries kick in and it hits the fan, like here. Now, you think these dealer guys would know that their conduct is illegal and fraudulent, that they will be hauled up for it in the end. These guys are commonly gypsies who move from job to job within months or a few years. They are likely to be long gone and several other jobs later before the fraud is discovered. The dealership itself may be gone, or owned by someone new. "I don't know what happened.", followed by bad record keeping and a lot of BS to the parties, the lenders and the state regulators will often make the problem slide back to the finance company and the buyer. It just a dirty business by its nature. Anyway, this one is clearly dealership fraud on the underwriter. I used to run into this scam regularly with car and RV dealerships.

The evidence just based on the numbers they show proves their intent to defraud. The finance charge showing $46,470.37 is exactly what it would be on a 20 year full amortization. A 119 payments with 1 balloon payment amortized over 20 years would only have a finance charge $33,348.10. That would be a total cost of purchase on credit of $143,304.10, not the $156,426.37 they show. All the numbers at the top showing the rate at 3.90%, finance charge of $46,470.37, total payments $151,670.40 and total cost of purchase $4,755.97 down, $156,426.37, this is based on a full 20 year amortization term with no balloon payment. The number of payments at 119 payments of $631,96 for 1 balloon payment of $63,139.96 does not even compute with any of the finance charges and costs showing above. These numbers alone shows they did in fact calculate everything based on 240 payments, not 119 payments plus 1 balloon payment. They committed major loan fraud and defrauded the consumer and they did it knowingly with intent to defraud. The numbers alone proves this beyond a reasonable doubt and the people at the dealership responsible for this needs to be prosecuted for loan fraud and wire fraud.

I went with NIRV and I called the saleswoman at General and told her that I went with NIRV simply because of their refundable deposit. She then said she could do it with a refundable deposit. No, there won't be any jail time. This was a fraud by contract forgery committed by the dealer against its financing underwriter which purchased the sale contract the same day the deal was closed. If the buyer can afford to hire a lawyer and make it stick, she will get the terms of her copy of the contract, because that's why the law requires they get it. The lender has recourse against the dealership for fraud. Often the value of future business is so great that they end up settling on some reimbursement and a bandaid agreement to "not make that mistake" again. Otherwise, the dealership pays back the loss, or it goes broke and doesn't. Commonly in this deal, the customer pays the installments up to the fraudulent "balloon" date, then stops over the dispute, the loan goes into default under the terms of the customer's real contract, the RV it repoed and sold, and the customer is then on the hook for any unpaid balance. (There is always an unpaid balance.) The trick here is once the customer has defaulted by failing to make the real installment payments while recovering from shock over the situation, the lender can and will call the balance of the loan due, thereby quite legally removing the issue of when deferred payment is due from the legal dispute.
