Eye of the Storm: From Inside the Courtroom III | Talking Feds Podcast

Another very special episode this week about the room where it’s happening with three commentators who were there - Jon Alter, Danny Cevallos, & Kristy Greenberg. We focus in depth on the dramatic highlight of the week for the jury and the country - Stormy Daniels’s testimony, esp the cross-examination. We next consider how much Madeline Westerhout helped Trump. After an in-depth preview of Michael Cohen’s testimony, we assess what persuasive arguments about reasonable doubt remain for the defense.

I'm with Harry on Michael Cohen. Cohen has it in him to resist taking the bait, but yeah really a bad move to post the Trump behind bars T shirt, but understandable. He has PTSD and self regulation is difficult when under the amount of pressure he's under.

I find it amazing that people talk about lawyers as if they are automatically better, or even smarter people. Lawyers know the law. Some are better and some are worse about that knowledge set. It is a little like the apocryphal story of British intelligence in the Second World War: When recruiting from universities, a Don was asked by a colleague why he was recruited. He answered. "I really don't know. Apart from a very particular period of early Christian history in the United Kingdom, I don't really know much of anything". Lawyers, like any demographic have that wide swath of humanity... No disrespect to your wonderful panel.

Everybody tut-tutting about Michael Cohen having an axe to grind and explicitly hating Trump seems to have completely forgotten that he’s got excellent reasons. I don’t think *anyone* who’d been thrown under buses and into jails the way he has, who has been the subject of power abuse and venom from Trump and magaworld wouldn’t also have a whole lot of resentment for the person responsible. He’s *far* more relatable than people like Hicks and Westerhout, who still like and admire Trump.

Kristy makes a good point about Stormy and the money being the motivating factor. A couple of things Stormy testified to made me question her credibility: (1) The threat in the parking lot [There was no corroboration of that event which conveniently backed up her ‘fear for my family’ motivation], (2) That the sex was no coerced when it so obviously was by her own account. A woman as quick with a quip could have cut a man like Trump down to size. Everything she testified to about her encounter spoke to taking the easiest way to exit the situation. She didn’t say that she WANTED to sex, she wanted to get out of the room [and maintain the possibility of future contact and appearance on The Apprentice]. Were I in the jury room, these are both points I would make. Bottom Line: The purpose of Stormy’s testimony is that she and Trump had sex that night; no one should have doubts about that fact. Shouldn’t have taken all day to prove it, though. My thoughts. Edit: It just seemed to me that her account was practiced, and benefited from legal advice, as in, “I felt there was an imbalance of power in the room.” Where does a description like that come from? Why did she use it? Her testimony answered some questions, but opened up far more to my skeptical mind.

I had to look to see if you were a man or a woman. I assume man based on the Jeremiah? I hope the women on the jury are able to explain some of this to the men in the jury. I understand that it wouldn’t make sense to a man, but I would think most women (especially older women)- understand this completely. It was mentioned in the testimony that she was prepped- and the judge tells the jury that is normal. So it shouldn’t be used against her. She testified to that. And remember- Stormy of today is not the same as a 26 year old Stormy. I hope the prosecution points that out.

Two points: you apparently are unaware of Stormy Daniels's extreme intelligence and quick wittedness. She was on her way to veterinary school and had the highest grade point avg in her entire state, but her mother's neglect forced her out on her own at age 17. How many young girls survive that to rise from sex worker to shot caller? Also do NOT forget that each and every witness is not only prepped as extensively as possible before they take the stand, Daniels has had to repeat this account over and over and over again for nearly 20 YEARS! honey, I'd say you'd have your story down pat too.

None of that wall of text is really relevant. Did sex occur? Yes. Did they pay to cover it up? Yes. Did they commit crimes in the process? Yes. Did Trump falsify business records in furtherance of those crimes? I'd say yes, but that is the question before the jury.

@@wanderlustworldschooling543 I imagine women would hear her testimony differently. Allowance should also be made for the pressure-packed atmosphere in which she was giving her testimony. I don’t discount the value of the details she recounted, even the yuckiness of some of it [“you remind me of my daughter”], but I still feel her witness would have been stronger if she had confined herself to a more relevant accounting of the facts and not strayed into interpretive remarks like ‘an imbalance of power’ where, ‘he was bigger than me and there was a guard at the door’ would have sufficed. Similarly, I felt she was a bit defensive and trying to give herself cover with her claim that the sex was not in any way forced, that it was driven by her insecurities, etc. Now, you’re very correct when you claim that women understand more of what was going on in that encounter, and what Stormy might have been feeling; but my point is that it is not up to Stormy to excuse Donald Trump’s actions by blaming herself. Donald, in my view (as a man) was using his power as a possible aid to her career and basically forcing her to choose between a possibly violent encounter if she resisted, or a brief sexual encounter if she submitted. In I other words, she was not a cheerful sleazebag as David Pecker, she was trying to preserve a bit of her dignity in an awful circumstance. She definitely held her own, and she ‘got the job done,’ but I still don’t completely trust her. Maybe most women would, but I don’t. I do, however, believe they had sex that night; so Trump is lying, that’s the main point. But if E. Jean Carroll can sue for defamation, I don’t see why Stormy can’t.

@@BJones-yw4dd I don’t deny that Stormy is smart or that she has incredible survival skills. I also don’t deny that ‘she told her story.’ I’m saying that by ‘telling her story’ she missed the mark a bit and muddied the waters. She was on the witness stand to bear witness to the actions of Donald J. Trump on the evening in question, not to justify or defend her own actions or offer opinions on what she thought of Trump’s actions (or lack of same). Not surprisingly, these lawyers are looking at these events through the lens of the law. I'm sorry, but there is another dimension of this situation that is quite different. Trump's strategy is directed toward the court of public opinion, not the court of law. And he may well be winning in that court. All he has to do is to convince one juror that the case is not fair to get jury nullification, an acquittal. I'm sorry, but that's my prediction. BTW I once won a $5 bet with a lawyer with a similar case. Mayor Marion Barry had been caught on video tape smoking crack. The lawyer couldn't see how a conviction could be avoided. The jury refused to convict.

Grammar matters and adds to one's credibility...otherwise you'll be tagged as part of the MAGA whiners and ignored. In proper English, the formulation is "democratic congressman" . It's only "Democrat" when used as a noun, otherwise it's an adjective with "-ic", as in: "My best friend is a Democrat. He's proud to be fighting for democratic values and norms." And why do you think the sponsor's democratic political leanings are a surprise for a pro-democracy podcast? Do you complain to FOX that all it's favorite guests are MAGA Republicans? IMHO, we have far more serious things to worry about.

not a big fan of Danny on msnbc. He always seems very contrary and oppositional to other speakers , not only that he just never gives other people the space to talk , he talks way way too much which makes it seems he values his opinion over others opinions . Lets see how he does here today, maybe it will be different . He just seems very argumentative, maybe even dismissive , maybe good in a court , but not in political commentary. Love Kristy , she is really great .

WILL SOMEONE AT KZread PLEASE REMOVE--OR ENABLE ME TO REMOVE!--THIS AND EVERY OTHER "PODCAST" JUNKING UP MY FEED!? (And then go back to feeding them one-by-one so I can make an individual decision about whether a certain individual topic interests me?) In the interim. I will only be clicking on vids that I know enough about to DESIRE to select, and have the option to remove from my incredibly lousy feed if I want to...

Trump could serve his prison sentence on a military base. It is the best solution.

Did Danny just insinuate Stormy is a Liar, and a Low Life , does he realize what this sounds like , does he even hear himself?? What is up w him , calling people Low Life's , He needs to be out of this work . Who the hell is he to call people Low Life's . I feel bad for Kristy that she works with Danny . he is awful... I had to skip by his comments . just ugh , actually he should move to fox . Why did you let him talk soooo much , this is the problem, he hogs the space.

Why are you promoting a recreational drug (alcohol) that according to NIH kills millions of people? Hopefully, you're not a hypocrite and you support ending the drug war. Let's treat all recreational drugs the same way that we treat alcohol (the deadliest drug on Earth). Legalize to reduce crime, regulate to save lives, tax to pay for it. Incarceration is not the answer.
