This was a loser of a case. The guy did everything you should do when arrested - obeyed commands, didn't admit to shit, fought it in court instead of the streets. Prosecutor was probably hoping to get him to plead on some lesser charge, but since the search was probably illegal on any one of a few legal theories that even a public defender could handle they eventually cut their losses and walked away in order to focus on more important cases.

The D.A that dropped these charges should be fired for incompetence

Police do their job of arresting, but if the criminal isn’t prosecuted it’s all for not. The “hug a thug” mentality is destroying cities by letting career criminals continue to violate the civil rights of law abiding citizens. Police can find and arrest as many people as they can, but when the criminals are let out the next day or same day (see IL new no bail policy), it’s not going to do any good. Than Law Enforcement not pulling a car over that matched the description of being involved in a bank robbery and the thieves get away.

Jail isn’t the answer for everything. We don’t know why the DA dropped these charges. Could it be that the improperly arrested Black man was right? There is a proper way to pull over, detain, and search someone. The 4A applies to all of us. The US imprisons more people than any other country. And, of course, if you are not White, you can easily be arrested, tased, brutalized with no one objecting. Cops should NEVER be allowed to stop and harass without probable cause. Even with these drug criminals, if no probable cause exists, the stop was illegal and should rightfully get thrown out. Let's a few drug crims off but the flip side is that citizens are free from police persecution. Think Nazi demands for cits to show id.

Tbf, the cops know they need to follow procedures in the right order so that cases can be seen all the way thru. They messed this one up sadly.

The only one to give the cops problems is the entitled one. This nonsense with them needs to stop.

These cops screwed up. Thats why the DA had to drop the charges. You cant arrest and search someone because 'maybe' they did something the other night. His arrest was illegal so his search was illegal which means any evidence found can not be used in court. Look up 'reasonable articulable suspicion'

Resisting arrest is a secondary charge. He'd have to be arrested before he can resist arrest.

it makes sense.. this stop would likely have been thrown out in court bc of how badly it was handled and how many rights were infringed. Thus without the evidence of this stop, tehre really isnt a case.... thus dropping the case. You should be blaming cops not the DA... its the cops who fuck up encounters and get evidence withheld.

How many people died from his fentanyl after the DA dropped all charges?

On Sep,26 2023 JP Morgan settled a lawsuit of $75million with the US Virgin Islands for Human trafficking violations, Nobody went to jail, they were only fined Pennies basically and you probably never heard of this until now. Look up the story on CNN and see for yourself, stuff like this runs rampant within this country, probable cause or not these occurrences of not being held accountable is starting to become the norm.

Once again prosecutors continue to fail both our citizens and insult our justice system in the name of things like "fairness" and equity."

Why does nobody know what resisting means in these videos?? Refusing to get in a police car? Resisting. Refusing to put your hands behind your back? Resisting. You don't have to punch a cop to get charged with resisting 🤦‍♀️

Even if you take everything else out of the encounter, that frisk ended him. Cops can frisk for weapons while someone is detained if they have reasonable expectation/fear that someone may be armed. If while frisking they feel something that they can identify based on feel as being contraband, they are allowed to reach into the clothing of the person in order to retrieve the contraband. A pill bottle in your pocket? Could be a bunch of fentanyl pills or aspirin, so a reasonable lawyer could get that thrown out as the result of a frisk. A bunch of baggies full of some substance clearly in your boxers based on feel? That is 100% a permissible search. Even if it wasn't already a search incident to an arrest, that dude is going to jail for possession with intent to distribute.

The charges were dropped because the evidence would be inadmissible after an illegal violation of the fourth. If we allowed charges to stick that would encourage police to do this more often. You can't just start searching random people because you have a hunch. You have to have a fact that points to a probable cause for arrest.
