Drugs Everywhere, but Man’s Convinced Police Can’t Arrest Him

On August 20, 2022 in New Mexico, officers spotted a vehicle that matched the description of a one that had been seen during an armed burglary the previous day. The officers called for back up, then pulled the vehicle over. During the detainment of the individuals inside, the officers found more than they were expecting, turning this traffic stop into a drug bust. This is footage of the events that followed.

    This was a loser of a case. The guy did everything you should do when arrested - obeyed commands, didn't admit to shit, fought it in court instead of the streets. Prosecutor was probably hoping to get him to plead on some lesser charge, but since the search was probably illegal on any one of a few legal theories that even a public defender could handle they eventually cut their losses and walked away in order to focus on more important cases.

In order for that to happen it requires prosecutors to actually do their job. Police do their job of arresting, but if the criminal isn’t prosecuted it’s all for not. The “hug a thug” mentality is destroying cities by letting career criminals continue to violate the civil rights of law abiding citizens. Police can find and arrest as many people as they can, but when the criminals are let out the next day or same day (see IL new no bail policy), it’s not going to do any good. It’ll always be ok by these crooked politicians to push these insane policies until it affects them or their family. Then they’ll be up in arms about it. 🙄

    I was pulled over once. My vehicle matched the description of being inside In a bank robbery. I complied to what law enforcement told me to do. After they discovered it wasn’t me. They apologized and I went on my way. I wasn’t pissed off at all. I’d rather Law Enforcement pull me over and discover it was not me. Than Law Enforcement not pulling a car over that matched the description of being involved in a bank robbery and the thieves get away.

    Jail isn’t the answer for everything. We don’t know why the DA dropped these charges. Could it be that the improperly arrested Black man was right? There is a proper way to pull over, detain, and search someone. The 4A applies to all of us. The US imprisons more people than any other country. And, of course, if you are not White, you can easily be arrested, tased, brutalized with no one objecting. We should all be relieved that police must do their jobs lawfully and apply standards equally.

    Cops should NEVER be allowed to stop and harass without probable cause. Even with these drug criminals, if no probable cause exists, the stop was illegal and should rightfully get thrown out.     It’s horrible here. Las Cruces, the city where this takes place is a very dangerous city. NM has been like this for years: crime and crap laws. 40 years ago people were getting their 14th DWI and still driving. Same crap still happens today.     it makes sense.. this stop would likely have been thrown out in court bc of how badly it was handled and how many rights were infringed.     Even if you take everything else out of the encounter, that frisk ended him. Cops can frisk for weapons while someone is detained if they have reasonable expectation/fear that someone may be armed. If while frisking they feel something that they can identify based on feel as being contraband, they are allowed to reach into the clothing of the person in order to retrieve the contraband. A pill bottle in your pocket? Could be a bunch of fentanyl pills or aspirin, so a reasonable lawyer could get that thrown out as the result of a frisk. A bunch of baggies full of some substance clearly in your boxers based on feel? That is 100% a permissible search. Even if it wasn't already a search incident to an arrest, that dude is going to jail for possession with intent to distribute.

    I'm amazed at how many charges get dropped. It's just wrong wrong wrong. When they get off they will do it again and again. Why have police enforce it and arrest for it for no reason at all.

    The charges were dropped because the evidence would be inadmissible after an illegal violation of the fourth. If we allowed charges to stick that would encourage police to do this more often. You can't just start searching random people because you have a hunch. You have to have a fact that points to a probable cause for arrest.

    again... like every other clueless idiot.... it was the actions of the police that resulted in this case being dropped. not the da. the cops mishandled the stop and it likely would have been thrown out at trial, thus with no evidence, tehre is no case and it was dropped.
